CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Rocha led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Rocha thanked staff for addressing the overgrown bushes causing visibility issues
at the intersection of Blackstone Street and Bardsley Avenue. She noted that the visibility has
greatly improved.
Commissioner Miller commended City Council and the Citizens of Tulare on addressing the
issues of the homeless at the last City Council meeting. She noted that the Mayor did a great job
in allowing all the citizens to speak and voice their concerns and she is very proud of everyone.

CONSENT CALENDAR:
(1) Minutes of the August 10, 2020 Regular Planning Commission Meeting
It was motioned by Commissioner Rocha and seconded by Commissioner Olivares to
approve the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2020-06:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Varo-Real
Investments, Inc. to establish a special event venue and to obtain an Alcoholic Beverage
Control Type license (Type 47: On Sale General—Eating Place) at 115 E. Tulare
Avenue.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was
closed.
Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Miller to adopt Resolution 5373, approving Conditional Use
Permit No. 2020-06 based on the findings and subject to the conditions as listed in the
staff report.

DIRECTORS REPORT:
Director Myers announced that Principal Planner Anaya applied and was awarded a grant from
the state which will be used to update the Zoning Ordinance.
Chairman Miguel stated that he is very pleased with the development downtown. He noted that
he has seen more development in the last few years than he has in the past 10 years.
AJOURNMENT:
There being no other items to come before the Commission, the meeting was adjourned at 7:13
p.m.

jurisdiction of the Planning Commission. The Planning Commission cannot legally
discuss or take official action on citizen comments that are introduced tonight. Each
speaker will be allowed three minutes, with a maximum time of 10 minutes per item,
unless otherwise extended by the Planning Commission.

VI. GENERAL BUSINESS- PUBLIC HEARING:
(1) Conditional Use Permit No. 2020-03/ Mitigated Negative Declaration :
Consider a request by TAE Inc., on behalf of Darshan Singh to construct a service
station and convenience store with a lease space for a future tenant. The proposed
project site is located on the southeast corner of Prosperity Avenue and West
Street and is zoned C-3 (Retail Commercial). A Mitigated Negative Declaration has
been prepared in accordance with the California Environmental Quality Act of 1970,
as amended.

Recommended Motion: Adopt Resolution 5368, adopting the Mitigated Negative
Declaration and approving Conditional Use Permit No. 2020-03, based on the
findings and subject to the conditions as listed in the staff report.
(2) Conditional Use Permit No. 2020-15:
Consider a request by Jose Antonio Martinez (Los Culichis) to operate a stationary
mobile vending vehicle on the property located at 265 S. West Street. This project
is exempt pursuant to section 15304 (e) of the California Environmental Quality Act
of 1970, as amended.

Recommended Motion: Adopt Resolution 5374, approving Conditional Use Permit
No. 2020-15, based on the findings and subject to the conditions as listed in the
staff report.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-080,
decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located at 411 E. Kern
Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal
shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the
appeal, include ng an error, abuse of discretion or a decision that is not supported by the evidence in the record.
