CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE:
Lucie Brown, Commission Clerk, led us in the flag salute.
CITIZEN COMMENTS:
None.
COMMISSIONER COMMENTS:
Commissioner Cox requested additional information on an item that was on the Site Plan Review
Agenda. He also asked for an update on the trailer that is parked in a vacant parking lot just
north of the Living Christ Church on M Street
Director Myers, stated that the property owner has posted a No Trespassing sign which gives the
occupant of the trailer 48 hours to comply. If they are still on property after the 48 hours, Code

Enforcement will be making physical contact with the owner of the trailer and begin the process
to have them removed from the property.
Commissioner Cox also noted that Candidate Forum for City Council members up for election
was very well moderated and very well done.
Chairman Miguel noted that the Del Lago Park is looking very well taken care of even with all
the ducks and geese.
Commissioner Olivares stated that he noted a lot of gatherings at the parks such as youth sports.
He asked if the City was doing anything to enforce social distancing and these types of
gatherings.
Director Myers stated that the City is not issuing any special event permits, street closure permits
or amplified sound permits. She noted that the City is doing the best it can do get the word out
about the importance of social distancing.
CONSENT CALENDAR:
(1) Minutes of the September 28, 2020 Regular Planning Commission Meeting
(2) Minutes of the September 14, 2020 Regular Planning Commission Meeting
It was motioned by Commissioner Miller and seconded by Commissioner Rocha to
approve the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2020-16:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Marquis Auto
Sales to establish Auto Sales within an existing commercial building located at 451 E.
Cross Avenue.
Chairman Miguel opened the public hearing.
Marciel Angulo, Applicant, spoke in favor of the project.
There being no one to speak against the project, the public hearing was closed.

Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Miller to adopt Resolution 5376, approving Conditional Use
Permit No. 2020-16 based on the findings and subject to the conditions as listed in the
staff report.

(2) Conditional Use Permit No. 2020-17:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Veronica Ortiz
to operate a stationary mobile vending vehicle on the property located at 1414 W. Tulare
Avenue.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was
closed.
Following Commission discussion it was motioned by Commissioner Olivares and
seconded by Commissioner Cox to adopt Resolution 5375, approving Conditional Use
Permit No. 2020-17 based on the findings and subject to the conditions as listed in the
staff report.

(3) Conditional Use Permit No. 2020-18:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Karen Ribeiro
to establish a residential use within a commercial zone.
Chairman Miguel opened the public hearing.
There being no one to speak in favor of or against the project, the public hearing was
closed.

Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Cox to adopt Resolution 5377, approving Conditional Use
Permit No. 2020-18 with the removal of condition #4 requiring covered parking based on
the findings and subject to the conditions as listed in the staff report.

DIRECTORS REPORT:
Director Myers asked the Commissioners to consider changing the start time of the Planning
Commission meetings in 2020 to an earlier time.
Chairman Miguel asked that this be agendized for discussion at the next Planning Commission
meeting.
Chairman Miguel encouraged staff to allow restaurants to keep their outdoor dining options. He
noted that some restaurants have spent a considerable amount of money to provide this service.
Commissioner Miller asked if there is time limits under the municipal code for outdoor dining.
Steven Sopp, Senior Planner, noted that there are requirements for outdoor dining however, due
to Covid 19 and the restrictions for indoor dining the City is not enforcing them at this time.

jurisdiction of the Planning Commission. The Planning Commission cannot legally
discuss or take official action on citizen comments that are introduced tonight. Each
speaker will be allowed three minutes, with a maximum time of 10 minutes per item,
unless otherwise extended by the Planning Commission.

VI. GENERAL BUSINESS- PUBLIC HEARING:
(1) General Plan Amendment No. 2020-03/ Zone Amendment No. 742/ Conditional
Use Permit No. 2020-13/ Kensington Estates Tentative 3 & 4 Subdivision Map
and Mitigated Negative Declaration:
Consider a request by San Joaquin Valley Homes for a General Plan amendment
to change the existing land use designation from Medium Density Residential and
Community Commercial to Low Density Residential, for a Zone Amendment to
change the existing zone from RM-2 (Multi-family Residential) and C-3 (Retail
Commercial) to R-1-4 (Small Lot Single Family Residential- 3,200 sq. ft. minimum
lot area), a Conditional Use Permit for small lot residential development, and a
request for a Tentative Subdivision Map to establish 111-lot single family small lot
residential subdivision. A Mitigated Negative Declaration has been prepared in
accordance with the California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5378, adopting the Mitigated Negative
Declaration and recommending to City Council adoption of General Plan
Amendment No. 2020-03 and Zone Amendment No. 742, based on the findings as
listed in the staff report.
Recommended Motion: Adopt Resolution 5379 approving Tentative Subdivision
Map Kensington Estates 3 & 4 and Conditional Use Permit No. 2020-13, based on
the findings and subject to the conditions as listed in the staff report.
(2) Conditional Use Permit No. 2020-19:
Consider a request by Vivian Singh to operate a stationary mobile vending vehicle
on the property located at 3002 North “M” Street. This project is exempt pursuant to
section 15304 (e) of the California Environmental Quality Act of 1970, as amended.

Recommended Motion: Adopt Resolution 5380, approving Conditional Use Permit
No. 2020-19, based on the findings and subject to the conditions as listed in the
staff report.

(1) Planning Commission discussion and consideration to change the time of Planning
Commission meetings from 7:00 p.m. to 6:00 p.m. beginning January 2021.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-080,
decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located at 411 E. Kern
Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal
shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the
appeal, include ng an error, abuse of discretion or a decision that is not supported by the evidence in the record.
