CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers February 8, 2021 491 North M Street COMMISSIONERS PRESENT: Miller, Cox, Olivares, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Mario Anaya, Principal Planner Steven Sopp, Senior Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Commissioner Olivares led us in the flag salute. CITIZEN COMMENTS: None COMMISSIONER COMMENTS: Commissioner Miller asked about the construction at the Apple Annies entrance on Blackstone and Prosperity. Senior Planner Sopp stated that it is a CalTrans project. Commissioner Miller asked if there was a timeline for when the project was going to be completed. Planning Commission Minutes 1 February 8, 2021 Principal Planner Anaya stated that the City is managing this project and he will check with Project Manager and provide Commissioner Miller with project schedule. Commissioner Cox asked if a mobile vendor wanted to be mobile only do they still need a Conditional Use Permit. Senior Planner Sopp, stated that the Ordinance requires mobile vendors to move every 30 minutes and if that is what they do then the only requirement would be a City of Tulare business license. However, if they are set up daily at a specific location longer than 30 minutes a Conditional Use Permit is required. CONSENT CALENDAR: (1) Minutes of the January 11, 2021 Regular Planning Commission Meeting (2) CEQA Exemption - Water Wells 21 & 25 Rehab Project- Resolution 5385 (3) CEQA Exemption- Sequoia-Spruce Tract Improvements- Resolution 5386 (4) CEQA Exemption- Elliott Tract Improvements- Resolution 5387 Commissioner Miller asked that items 3 and 4 be pulled for discussion. It was motioned by Commissioner Miller and seconded by Commissioner Olivares to approve items 1 and 2 of the Consent Calendar as presented. Motion carried by unanimous vote. Commissioner Miller asked staff where the funding for items 3 and 4 was coming from. Principal Planner Anaya stated that funding for several of these projects coming from a combination of sources. Funds from utility billing is going to cover utility upgrades, funding from Measure R is going to curb ramps and ADA improvements and also funding from Gas Tax. Commissioner Miller asked if there was a timeline for these projects. Principal Planner Anaya stated that he will obtain project schedule for those projects and provide it to Commissioner Miller as well. It was motioned by Commissioner Miller and seconded by Commissioner Cox to approve items 3 and 4 of the Consent Calendar. Motion carried by unanimous vote. Planning Commission Minutes 2 February 8, 2021 PUBLIC HEARING: (1) Conditional Use Permit No. 2021-01: Steven Sopp, Senior Planner, reviewed with the Commission a request by Verinder Singh for a Type 41 (On-Sale Beer and Wine) license to sell beer and wine on the premises in conjunction with an eating place (Curry Pizza). Chairman Miguel opened the public hearing. There being no one to speak in favor of or against the project, the public hearing was closed. Following Commission discussion it was motioned by Commissioner Cox and seconded by Commissioner Olivares to adopt Resolution 5384, approving Conditional Use Permit No. 2021-01 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Cox, Olivares, Miller, Miguel ABSENT: Rocha NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None TEENS ON BOARD: None DIRECTORS REPORT: Principal Planner Anaya, announced to the Commission that at the next Planning Commission meeting he will be providing the Commission with the Housing Element and General Plan Annual Progress Report. He stated that he is especially excited for the General Plan Report as it is the first one Tulare has filed. He also noted that sometime in March and April staff will begin working on a comprehensive update to the Zoning Code. Planning Commission Minutes 3 February 8, 2021 Chairman Miguel also noted that a local business, VIP Pizza, was vandalized and is very pleased to see the community rally around this business to show its support for a business that does so much for the community.
