CITY OF TULARE PLANNING COMMISSION REGULAR MEETING MINUTES Tulare Public Library—Council Chambers February 22, 2021 491 North M Street COMMISSIONERS PRESENT: Miller, Cox, Olivares, Rocha, Miguel TEENS ON BOARD PRESENT: None STAFF PRESENT: Mario Anaya, Principal Planner Steven Sopp, Senior Planner Lucie Brown, Commission Clerk CALL TO ORDER: Chairman Miguel called the regular meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Mario Anaya, Principal Planner, led us in the flag salute. CITIZEN COMMENTS: None COMMISSIONER COMMENTS: Chairman Miguel noted that one of the City’s former Planners (Bonnie Simoes) lost her son to cancer over the weekend. Chairman Miguel asked that Lucie Brown, Commission Clerk, extend the Commissions deepest condolences to her and her family. Planning Commission Minutes 1 February 22, 2021 CONSENT CALENDAR: (1) Minutes of the February 8, 2021 Regular Planning Commission Meeting It was motioned by Commissioner Miller and seconded by Commissioner Cox to approve the Consent Calendar as presented. Motion carried by unanimous vote. PUBLIC HEARING: (1) Housing Element Annual Progress Report for 2020: Mario Anaya, Principal Planner, presented the Commission with a brief background and summary of the Housing Element Annual Progress Report. Chairman Miguel opened the public hearing. There being no one to speak the public hearing was closed. Following Commission discussion it was motioned by Commissioner Rocha and seconded by Commissioner Olivares to receive and forward to the City Council the 2020 Housing Element Annual Progress Report. COMMISSIONERS AYES: Rocha, Olivares, Cox, Miller, Miguel ABSENT: None NOES: None ABSTAIN: None (2) General Plan Annual Progress Report for 2020: Mario Anaya, Principal Planner, presented the Commission with a brief background and summary of the General Plan Annual Progress Report. Chairman Miguel opened the public hearing. There being no one to speak the public hearing was closed. Planning Commission Minutes 2 February 22, 2021 Following Commission discussion it was motioned by Commissioner Miller and seconded by Commissioner Rocha to receive and forward to the City Council the 2020 General Plan Annual Progress Report. COMMISSIONERS AYES: Miller, Rocha, Olivares, Cox, Miguel ABSENT: None NOES: None ABSTAIN: None (3) Conditional Use Permit No. 2021-02: Steven Sopp, Senior Planner, reviewed with the Commission a request by Miguel Perez to operate a stationary mobile vending vehicle located at 549 W. Inyo Avenue. Chairman Miguel opened the public hearing. Miguel Perez, Applicant, spoke in favor of the project. There being no one else to speak in favor of or against the project the public hearing was closed. Commissioner Olivares noted that on the agenda it has the Conditional Use Permit number incorrect. It should be 2021-02 instead of 2020-02. Following Commission discussion it was motioned by Commissioner Olivares and seconded by Commissioner Cox to adopt Resolution 5388, approving Conditional Use Permit No. 2021-02 based on the findings and subject to the conditions as listed in the staff report. COMMISSIONERS AYES: Olivares, Cox, Miller, Rocha, Miguel ABSENT: None NOES: None ABSTAIN: None GENERAL BUSINESS—NON PUBLIC HEARING ITEMS None Planning Commission Minutes 3 February 22, 2021 TEENS ON BOARD: None DIRECTORS REPORT: Principal Planner Anaya, provided Commissioner Miller and the rest of the Commission with a construction report for projects that Commissioner Miller had inquired about at the previous Planning Commission meeting. He stated that the construction on Prosperity Ave. and Blackstone Street in front of the Apple Annie’s should be completed by April of this year. He further noted that the Sequoia/ Spruce Tract as well as the Elliott Tract projects are on a one year schedule and are scheduled to begin construction in the Summer of 2021 and end by the Summer of 2022. The Planning Commission cannot legally discuss or take official action on citizen comments that are introduced tonight. GENERAL BUSINESS- PUBLIC HEARING: (1) Conditional Use Permit No. 2021-04: Consider a request by Juan Carlos (Jaliscos Tacos) to continue to operate a stationary mobile vending vehicle on the property located at 1510 North “J” Street. This property is zoned C-4 (Service Commercial). Project is exempt pursuant to Section 15304 (e) of the California Environmental Quality Act of 1970, as amended. Project Planner: Steven Sopp, Senior Planner Recommended Motion: Adopt Resolution 5389, approving Conditional Use Permit No. 2021-04, based on the findings and subject to the conditions as listed in the staff report. The appeal shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the appeal, include ng an error, abuse of discretion or a decision that is not supported by the evidence in the record.
