CALL TO ORDER:
Chairman Miguel called the regular meeting to order at 7:01 p.m.
PLEDGE OF ALLEGIANCE:
Commissioner Rocha, led us in the flag salute.
CITIZEN COMMENTS:
None
COMMISSIONER COMMENTS:
Commissioner Cox asked if there had been any feedback regarding changing the time of the
Planning Commission meetings to 6 p.m.

Director Myers stated that she reached out the BIA, Director and has not received any feedback
as to whether the time change would affect developer/applicant attendance. If the Commission
wished to discuss it further it would have to be agendized.
Chairman Miguel thanked staff for the continued Site Plan Review agendas. He stated that it
provides a lot of information on upcoming projects that he can share with the citizens.
CONSENT CALENDAR:
(1) Minutes of the February 22, 2021 Regular Planning Commission Meeting
It was motioned by Commissioner Rocha and seconded by Commissioner Cox to approve
the Consent Calendar as presented.
Motion carried by unanimous vote.
PUBLIC HEARING:
(1) Conditional Use Permit No. 2021-04:
Steven Sopp, Senior Planner, reviewed with the Commission a request by Juan Carlos
(Jaliscos Tacos) to operate a stationary mobile vending vehicle located at 1510 North J
Street.
Chairman Miguel opened the public hearing.
There being no one else to speak in favor of or against the project the public hearing was
closed.
Commissioner Rocha asked if there was a way of extending this approval for a longer
period than two years.
Director Myers stated that the Tulare Municipal Code states a Conditional Use Permit is
valid for three years with two one year extensions. It is at the discretion of the Planning
Commission if they want to go ahead and extend it for a three year period.
The Applicant, Juan Carlos Bernal, requested the Conditional Use Permit remain valid
for three years, through the translation efforts of Mario Anaya, Principal Planner.
Mr. Bernal then provided the Commission with a power point presentation depicting his
future site and plans for a strip mall, including his storefront restaurant with drive thru
and also future tenants located just south of his existing location on J Street.

Following Commission discussion it was motioned by Commissioner Rocha and
seconded by Commissioner Miller to adopt Resolution 5389, approving Conditional Use
Permit No. 2021-04 based on the findings and subject to the conditions as listed in the
staff report with the correction to Condition No. 7 to read as follows:
7) This permit shall remain valid for three years from approval or March 22, 2024; at
which time Applicant may apply for a new Conditional Use Permit.

DIRECTORS REPORT:
Director Myers, shared with the Commission a power point presentation that was shared with the
City Council at their last meeting regarding the COVID “Red Tier” Service Changes.
Director Myers also thanked the Commission for their patience in her absence.
Commissioner Miller thanked staff for being so pleasant and cheerful during this pandemic and
asked Director Myers to please relay this to the City Manager. Commissioner Miller asked if
there was any update on Dutch Bros.
Senior Planner Sopp stated that they updated their site plan and the City should be seeing
building plans soon.
Chairman Miguel stated that he was glad to see High School football back.

jurisdiction of the Planning Commission. The Planning Commission cannot legally
discuss or take official action on citizen comments that are introduced tonight. Each
speaker will be allowed three minutes, with a maximum time of 10 minutes per item,
unless otherwise extended by the Planning Commission.

VI. GENERAL BUSINESS- PUBLIC HEARING:
(1) Addendum to Mitigated Negative Declaration/ Tentative Subdivision Map-
Monterey Estates No. 2:
Consider a request by Lino Pimentel to establish a 47-lot single-family residential
subdivision on approximately11.94 acres. The parcel is zoned R-1-6 (Single-family
Residential- 6,000 sq. ft. minimum lot area) and is located south of Bardsley
Avenue and west of West Street along the Sonora Avenue alignment. An
addendum to the previously adopted Negative Declaration in August 15, 2005 was
prepared in accordance with California Environmental Quality Act (CEQA) sections
15162 and 15164.

Recommended Motion: Adopt Resolution 5391, adopting the Negative Declaration
Addendum for Monterey Estates No. 2 and approving Tentative Subdivision Map
Monterey Estates No. 2 based on the findings and subject to the conditions as
listed in the staff report.
VII. GENERAL BUSINESS-NON PUBLIC HEARING ITEMS
(1) CIP- Five Year Capital Improvement Program 2021-2026:
Review the list of new public works project added to the Fiscal Years (FY) 2021-
2026 Five Year Projects Budget and report to the City Council as to their conformity
with the General Plan pursuant to Government Code 65401.
Project Planner: Traci Myers, Community Development Director
Recommended Motion: Adopt Resolution 5392, reporting to the City Council
conformance with the General Plan.

APPEAL PROCEDURE
According to City of Tulare Zoning Ordinance Section 10.20.020 and Subdivision Ordinance Section 8.24-080,
decisions of the Planning Commission may be appealed by filing a letter with the City Clerk, located at 411 E. Kern
Avenue, Tulare, CA 93274, no later than ten (10) days after the day on which the decision was made. The appeal
shall state the name of the person making the appeal, the decision that is being appealed, and the reason for the
appeal, include ng an error, abuse of discretion or a decision that is not supported by the evidence in the record.
