601 REGULAR CITY COUNCIL MEETING MUNICIPAL MINUTES CITY OF TUPELO STATE OF MISSISSIPPI AUGUST 18, 2020 Be it remembered that a regular meeting of the Tupelo City Council was held in the Council Chambers in the City Hall building on Tuesday, August 18, 2020 at 6:00 p.m. with the following in attendance: Council members Markel Whittington, Lynn Bryan, Travis Beard, Nettie Davis, Buddy Palmer, Mike Bryan and Willie Jennings, City Attorney Ben Logan; and Missy Shelton, Clerk of the Council. Councilman Willie Jennings introduced Fireman Josh Parks, who gave the invocation. Councilman Markel Whittington led the pledge of allegiance. President Mike Bryan called the meeting to order at 6:00 PM. CONFIRMATION OR AMENDMENT TO THE AGENDA AND AGENDA ORDER Councilman Palmer moved, seconded by Councilman Whittington, to confirm the agenda and agenda order with the following addition: ADD: RESOLUTION APPOINTING CHIEF FINANCIAL OFFICER KIM HANNA AS APPLICANT AGENT FOR THE CITY OF TUPELO WATER AND LIGHT DEPARTMENT FOR FEDERAL DISASTER FINANCIAL ASSISTANCE DECLARED The vote was unanimous in favor. PUBLIC AGENDA Councilwoman Nettie Davis thanked all those who helped with the 'Don't Bug Me' campaign that held an event at Gumtree Park last Saturday. Councilman Travis Beard recognized Mitch Fowler, with Waste Management, for assistance they give to those who aren't able to get their garbage to the curb. Councilman Willie Jennings recognized Josh Parks, employee of the Tupelo Fire Department, and Deputy Rashad Ruff, employee of the Lee County Sheriff's Office, to address the Council. Mr. Parks, on behalf of the two, thanked the Council for offering the Plant A Seed Program in the past and to please continue to keep the program going. Both these men are products of the program. APPENDIX A IN THE MATTER OF PUBLIC HEARING FOR DEMOLITION A public hearing was held concerning demolition of the following: 451 North Spring Street 6797 Endville Road 523 Barnes Street Mr. Melvin Wallace appeared concerning the property located at 523 Barnes Street and asked for more time to bring the property up to code. Attorney Michael McHenry appeared on behalf of Frank Garrison, the owner of 6797 Endville Road and also asked for more time to take care of the issues. APPENDIX B ROUTINE AGENDA IN THE MATTER OF APPROVAL OF MINUTES FROM REGULAR COUNCIL MEETING AUGUST 4, 2020 Councilman Palmer moved, seconded by Councilman Whittington, to approve the Minutes from the Regular Council Meeting held on August 4, 2020. The vote was unanimous in favor. IN THE MATTER OF REVIEW, PAY BILLS AND APPROVE UTILITY ADJUSTMENTS Bills were reviewed at 4:00 p.m. by Council members: Travis Beard, Markel Whittington, Nettie Davis, Lynn Bryan and Buddy Palmer and Accounts Payable Clerk Traci Dillard. Councilman Jennings, seconded by Councilman Palmer, to approve the payment of the checks, bills, claims and utility adjustments. The vote was unanimous in favor. APPENDIX C  603 IN THE MATTER OF INTENT TO RAISE SANITATION RATE Councilman L Bryan moved, seconded by Councilman Whittington, to approve the request to advertise the intent to raise the sanitation rate. After a short explanation from CFO Kim Hanna, the vote was unanimous in favor. EXHIBIT D IN THE MATTER OF SURPLUS DUTY WEAPON OF JAMES BOND UPON HIS RETIREMENT Councilwoman Davis moved, seconded by Councilman Beard, to surplus the Glock model 45 9mm, SN BKLR992 and allow Corporal James Bond to purchase same in the amount of $1.00 upon his retirement from the City of Tupelo Police Department. The vote was unanimous in favor. A copy of the request is attached as APPENDIX E. IN THE MATTER OF UNMARKED VEHICLES THAT THE TUPELO POLICE DEPARTMENT MAINTAINS AS OF AUGUST 11 2020 Councilman Whittington moved, seconded by Councilman L. Bryan, to approve this list as submitted. IN THE MATTER OF APPROVAL OF THE CONVENTION AND VISITORS BUREAU MINUTES FROM AUGUST 3, 2020 Councilman Jennings moved, seconded by Councilman Palmer, to accept the Convention and Visitors Bureau Committee Minutes dated August 3, 2020. The vote was unanimous in favor. APPENDIX G IN THE MATTER OF PLANNING COMMITTEE MINUTES AUGUST 3, 2020 Councilwoman Davis moved, seconded by Councilman Beard, to approve the Minutes of the Planning Committee dated August 3, 2020. The vote was unanimous is favor. APPENDIX H IN THE MATTER OF TAX ABATEMENT OF WEST PARK PAVILION Councilman Whittington moved, seconded by Councilman L. Bryan, to approve the application of West Park Pavilion LLC located at 3418 West Main and in a business improvement district for a commercial ad valorem tax abatement in the amount of $1,065,364.75 for a period of five (5) years. The vote was unanimous in favor. APPENDIX I IN THE MATTER OF LOT MOWING Councilman Whittington moved, seconded by Councilman L Bryan, to approve the final lot-mowing list submitted by the Department of Development Services, and find such properties being in such a state of  604 uncleanliness as to be a menace to the public health, safety, and welfare of the community, thereby authorizing the department to proceed with the mowing of these properties. The vote was unanimous in favor. APPENDIX J IN THE MATTER OF DEMOLITION A Public Hearing was held pursuant to Mississippi Code 1972, as amended, 21-19-11. Councilman L Bryan moved, seconded by Councilman Whittington, to approve the demolition of properties located at: 451 N Spring Street 6797 Endville Road 523 Barnes Street These properties were determined to be in such a state of uncleanliness and disrepair as to be a menace to health, safety and welfare of the community. A vote was called for to approve the demolition of the properties listed and was in favor 7 - 0. By this action, the City of Tupelo was authorized to demolish said property, invoice the owners, and place liens on the property. APPENDIX K IN THE MATTER OF BID AWARD 2020-025WL FOR SALE OF BORING MACHINE AND TRAILER At a previous meeting of the Tupelo City Council on February 5, 2019, the following items were declared as surplus: 2002 Vermeer Boring Machine (S/N 1128) 2002 Redi-Haul Trailer (S/N 9436) Bids were received for 2020-025WL for the highest bid to dispose of these items. The highest qualified bid submitted by J.J. Merchant Accelerated Marketing and Appraisals was received in the amount of $7,777.77. Councilman Jennings moved, seconded by Councilman Beard, to approve the sale of the surplus property for the amount of $7,777.77. The vote was unanimous in favor. APPENDIX L IN THE MATTER OF REJECTION OF BID 2020-012WL 2020 4 X 4 CAB AND CHASSIS Bids were received by the City of Tupelo for the purchase of a 2020 Cab and Chassis 4 x 4 and awarded to Cannon Motors at the June 16, 2020 council meeting. Cannon Motors has now advised, in writing, that they are unable to meet this bid because the manufacturer is no longer making 2020 models. Councilman Whittington moved, seconded by Councilman L Bryan to allow Cannon to withdraw its earlier bid, reject all bids for Bid # 2020-012WL and redvertise. The vote was unanimous in favor of rejecting the bid. Board members present were Neal McCoy, Chauncey Godwin, Leslie Nabors, Louis Britton and Gwendolyn Hudson via Zoom. Tupelo CVB staff members present were Jennie Bradford Curlee, Jan Pannell, and Stephanie Moody-Coomer. Neal McCoy called the meeting to order at 2:00 p.m. Louis Britton moved, Leslie Nabors seconded approval of the agenda. All voting aye, the motion carried. Chauncey Godwin moved, Louis Britton seconded approval of the July, 2020 minutes. All voting aye, the motion carried. Kim Hanna presented the financial report. Other members attending by Zoom were Mr. Ted Moll and Mrs. Patti Thompson. Mr. Bill Smith, Mr. Gus Hildenbrand, and Jimmy Swann were present. Mr. Swann provided the invocation and Ms. Mart led the Pledge of Allegiance. Staff present were Pat Falkner and Marilyn Vail of the Development Services Department. APPROVAL OF MINUTES The minutes of the June 1 meeting was approved on a motion by Mr. Hildenbrand, seconded by Mr. Swann. . NEW BUSINESS Mr. Hildenbrand made a motion to adjourn. Mr. Smith seconded. The motion passed unanimously. NEW BUSINESS FLEXVAR 20-06: Application from First United Pentecostal Church to allow placement of waste container in the front yard of the property at 900 South Thomas Street. Pastor Jay Carney spoke on behalf of the applicant. He said that the church had noted deterioration of their driveway and parking lot in the area where the waste container is currently located. They had spoken to Waste Management about this who recommended that the container be relocated closer to the street. Mr. Carney said that the cost of rebuilding the driveway and parking lot would be impossible for the church to afford. Mr. Hildenbrand asked if the church members had discussed the relocation of the container. Mr. Carney said that they had. Mr. Hildenbrand asked if the church had contacted any of the residents on Willow Chase Drive. Mr. Carney said that they did not. Mr. Swann asked about the scale of activities at the church and the types of waste that are generated. Mr. Carney said that the church had about 400 members meeting for two services on Sunday and one on Wednesday, but nothing unusual about the type of waste created. Est Glen APPENDIX H  633 Ms. Mart asked if the church had asked any contractors for quotes on the repair work. Mr. Carney said they did not. The chair opened the meeting for public comment. Ms. Karen Mayfield of 2403 Willow Chase Drive spoke. Her residence is across the street from the proposed location of the waste container. She said that she did not know about the church’s plans until she received the notice from the city. She said that she is opposed to the location because of the potential effects on traffic visibility, the possibility of unwanted dumping, the noise of the truck emptying the container, the smell, the view and the effect on property value. Mr. Curry of 1116 Forest Glen Cove and his wife Crystal Curry also appeared to state their opposition. Councilman Willie Jennings spoke to say that he had received calls from residents about the proposed variance and said that he thought locating the dumpster at the street would be a disservice to the neighborhood. Ms. Mart asked if staff had a recommendation. Mr. Falkner answered that the staff recommended disapproval. Ms. Mart noted that the concrete pad where the container was to be placed had been installed without permit from the city. She also noted that she had provided a set of drawings to show the church how they should improve the area around the current container location so that the pavement would hold up. She also pointed out that the proposed relocation would shift any damage from the waste collection process to the city street. Ms. Thompson said she agreed with Ms. Mart and with the residents. Mr. Hildenbrand made a motion to deny the variance, seconded by Ms. Thompson. The motion was amended to include a requirement that the concrete pad placed at the street be removed. The amended motion passed unanimously. Mr. Falkner reported to the committee that he was beginning some preliminary work toward the eventual preparation of a new comprehensive plan. The current plan has a time horizon of 2025, but the economic impacts of the COVID pandemic are likely to make ordinary projections of trends less reliable. He advised the committee that he would be asking for their input and also bringing in some other people for additional perspective, with the intent being to find the right questions to be asking as a starting point for the process. Mr. Falkner noted that two applications were expected for the September meeting. Ms. Mart set the work session for August 31 and the meeting for September 14.
