763 753 REGULAR CITY COUNCIL MEETING MUNICIPAL MINUTES CITY OF TUPELO STATE OF MISSISSIPPI FEBRUARY 21, 2023 Be it remembered that a regular meeting of the Tupelo City Council was held in the Council Chambers in the City Hall building on Tuesday, February 21, 2023, at 6:00 p.m. with the following in attendance: Council Members Travis Beard, Lynn Bryan, Nettie Davis, Buddy Palmer, Janet Gaston and Rosie Jones; Ben Logan, City Attorney and Missy Shelton, Clerk of the Council. Council Member Chad Mims was absent. Council Member Buddy Palmer gave the invocation, and Council Member Janet Gaston led the pledge of allegiance. Council President Lynn Bryan called the meeting to order at 6:00 p.m. CONFIRMATION OR AMENDMENT TO THE AGENDA AND AGENDA ORDER Council Member Beard moved, seconded by Council Member Palmer, to approve the agenda and agenda order, as presented. Of those present, the vote was unanimous in favor. IN THE MATTER OF COMMENDATION FOR OFFICER AHMAD TUBBS Deputy Police Chief Anthony Hill recognized Officer Ahmad Tubbs for going above and beyond the call of duty on the afternoon of January 15, 2023. APPENDIX A PUBLIC RECOGNITION Council Member Nettie Davis asked that everyone remember the family of Syliner Coleman "Lena" Chewe, who recently passed. She also thanked the Rust College Alumnae for the successful UNCF Banquet last weekend. She thanked the City of Tupelo for their support and Rosie Jones for giving the welcome at the event. Council Member Rose Jones also thanked all involved in the UNCF banquet. MAYOR'S REMARKS Mayor Todd Jordan was not present for this meeting, but COO Don Lewis recognized the passing of Captain Bret Moyer of the City of Tupelo Police Department. IN THE MATTER OF TUPELO WONDURA CLASS II RUBBISH SITE EXPANSION PUBLIC HEARING A public hearing was held for the Tupelo Wondura Class II Rubbish Site Expansion. Several members of the Council and audience asked questions to city engineer Dennis Bonds and Cook Coggin representative Jimmy Spencer. APPENDIX B 764 754 IN THE MATTER OF APPROVAL OF MINUTES OF FEBRUARY 7, 2023 CITY COUNCIL MEETING Council Member Palmer moved, seconded by Council Member Gaston, to approve the minutes of the February 7, 2023, regular City Council meeting. Of those present, the vote was unanimous in favor. IN THE MATTER OF BILL PAY Bills were reviewed at 4:30 p.m. by Council Members Gaston, Beard, Palmer and Davis. Council Member Beard moved, seconded by Council Member Jones, to approve the payment of the checks, bills, claims and utility adjustments. Of those present, the vote was unanimous in favor. APPENDIX C IN THE MATTER OF ADVERTISING AND PROMOTIONAL ITEMS Council Member Beard moved, seconded by Council Member Jones, to approve the request for advertising and promotional items, as submitted. Of those present, the vote was unanimous in favor. APPENDIX D IN THE MATTER OF APPROVAL TO SUBMIT THE WALMART COMMUNITY SAFETY TECHNOLOGY PROGRAM GRANTS Grant Writer Abby Christian asked approval from the Council to submit the Walmart Community Safety Technology Program grants. The three (3) grants are separate submissions to place license plate readers on public right of way at each of the Walmart stores located in the City of Tupelo. Each submission requests funding in the amount of $2,500.00 for a one-year subscription of a Flock Safety Falcon license plate reader. No match is required from the City. Council Member Davis moved, seconded by Council Member Beard to approve the submission of the Walmart Grants. Of those present, the vote was unanimous in favor. APPENDIX E IN THE MATTER OF MUNICIPAL COURT CLERK TRAINING Council Member Palmer moved, seconded by Council Member Gaston, to accept the Municipal Court Clerk Training Certificates for Municipal Court Clerk, Rhonda L. Cole, and spread it on the municipal minutes. Of those present, the vote was unanimous in favor. Mrs. Cole attended the 2022 Mississippi Municipal Court Clerk’s Continuing Education Course, June 27-28, 2022, September 21-23, 2022 and October 26-27, 2022. Under Mississippi code Sec. 21-23-12, a training certificate of the Municipal Court Clerk is required to be made part of the permanent records of the City Council. A copy of the training certificate for Clerk Cole is attached to these minutes and made part hereof as APPENDIX F. IN THE MATTER OF TUPELO WONDURA CLASS II RUBBISH SITE EXPANSION A Public Hearing was held on February 21, 2023, for the purpose of any interested person to attend and provide comments regarding the amendment to the Three Rivers Solid Waste Management Authority Solid Waste Plan. This landfill is located off of South Canal Street in Tupelo and disposal activities are limited to the City of Tupelo, primarily materials removed from Tupelo right-of-ways. The addition to the current landfill will include 3 contiguous disposal cells totaling 27.1 acres with sufficient property available for future development. Council Member Palmer moved, seconded by Council Member Beard, 765 755 to approve the expansion of the current landfill with the attached Resolution. Of those present, the vote was unanimous in favor. APPENDIX G IN THE MATTER OF APPROVAL FOR CHANGE ORDER #1 FOR BID 2022-030PW – CLARK PLACE DRAINAGE PROJECT Council Member Palmer moved, seconded by Council Member Gaston, to approve change order #1 for Bid # 2022-030PW - Clark Place Drainage Project. This change order will increase the original contract order by $52,260.65 and is for additional structural concrete required due to conditions discovered in the field. Of those present, the vote was unanimous in favor. APPENDIX H IN THE MATTER OF BID APPROVAL FOR THERMOPLASTIC 2023-007PW Bids were received for bid # 2023-007PW - Thermoplastic Traffic Marking and Paint Traffic Marking Materials for a 12 month period. One bid was received from Riverside Traffic System Inc. Council Member Gaston moved, seconded by Council Member Palmer, to find that advertising was conducted affording other bidders the opportunity to bid, the single bid was commercially reasonable, and to award the bid to Riverside Traffic System, Inc. Of those present, the vote was unanimous in favor. APPENDIX I IN THE MATTER OF AN ORDER TO RESCIND CITY COUNCIL ACTION OF NOVEMBER 1, 2022 AWARDING A BID OF ACCU-TABS POOL CHEMICALS TO ADCOCK POOL AND SPA Council Member Palmer moved, seconded by Council Member Davis, to approve an order rescinding Council action on November 1, 2022. The original action awarded Bid # 2022-042AQ - Accu-Tabs to Adcock Pool & Spa. However, the Park & Recreation has since received a letter from Adcock stating that they are unable to furnish the Accu-Tabs due to their contractual obligations with the manufacturer. Of those present, the vote was unanimous in favor to rescind the November 1, 2022 bid award for the Accu-Tabs. APPENDIX J IN THE MATTER OF SOLE SOURCE FOR ACCUTAB FROM MEMPHIS POOL Council Member Gaston moved, seconded by Council Member Jones, to approve a sole source provider of Accu-Tabs to Memphis Pool Supply, who is the authorized dealer for this area. Of those present, the vote was unanimous in favor. APPENDIX K IN THE MATTER OF REAPPOINTMENT OF MR. BOB BAUGHN TO THE NORTHEAST MISSISSIPPI REGIONAL WATER SUPPLY DISTRICT BOARD OF COMMISSIONERS Council Member Beard moved, seconded by Council member Palmer, to approve the Mayor's reappointment of Bob Baughn to the Northeast Mississippi Regional Water Supply District Board of Commissioners for five (5) years, expiring on April 30, 2023. Of those present, the vote was unanimous in favor. APPENDIX L IN THE MATTER OF AWARD OF BID # 2022-052EP FOR THE ELVIS PRESLEY BIRTHPLACE BUS TURNAROUND 766 756 The City accepted bids for Bid # 2022-052EP - Elvis Presley Birthplace Bus Turnaround. Council Member Davis moved, seconded by Council Member Palmer, to award the bid to the lowest and best bid of Paul Smithey Construction Co., Inc. in the amount of $294,515.10. Of those present, the vote was unanimous in favor. APPENDIX M IN THE MATTER OF APPROVAL OF CONTRACT WITH PAUL SMITHEY CONSTRUCTION CO.INC FOR ELVIS PRESLEY BIRTHPLACE BUS TURNAROUND AND PARKING IMPROVEMENTS AND AUTHORIZING MAYOR AND CITY CLERK TO SIGN ALL NECESSARY DOCUMENTS Council Member Palmer moved, seconded by Council Member Gaston, to approve the contract with Paul Smithey Construction Co., Inc. for Bid # 2022-052EP - Elvis Presley Birthplace Bus Turnaround and Park Improvements, and give the Mayor and City Clerk authorization to execute all documents. Of those present, the vote was unanimous in favor. APPENDIX N IN THE MATTER OF A RESOLUTION AUTHORIZING THE SETTLEMENT OF OPIOID RELATED CLAIMS AGAINST ALLERGEN, CVS, TEVA, WALGREENS AND WALMART AND TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE ALL RELATED SETTLEMENT AGREEMENTS At the December 21, 2021 City Council meeting, the Council approved a resolution authorizing the City of Tupelo to participate in the national litigation settlement. Assistant City Attorney Stephen Reed requested that the Council now approve the 2nd round of the settlement agreements. Council Member Beard moved, seconded by Council Member Palmer, to approve the Resolution Authorizing the Settlement of Opioid Related Claims Against Allergen, CVS, TEVA, Walgreens and Walmart and to Authorize the Mayor and City Clerk to Execute all Related Settlement Agreements. Of those present, the vote was unanimous in favor. APPENDIX O IN THE MATTER OF THE ACCEPTANCE OF A FRONTAGE ROAD LYING ADJACENT TO WEST JACKSON STREET FROM THE NEIGHBORHOOD DEVELOPMENT CORPORATION Council Member Gaston moved, seconded by Council Member Davis, to accept the deed to real property from the Neighborhood Development Corporation which includes the dedication of a street for public use and maintenance, namely, a frontage road lying adjacent to West Jackson Street. Of those present, the vote was unanimous in favor. APPENDIX P EXECUTIVE SESSION Council Member Davis moved, seconded by Council Member Beard, to determine the need for an executive session. Attorney Ben Logan said the session will be for the prospective land purchase, sale or leasing under Miss. Code Anno. 25-41-7 (g) (1972 as amended). Of those present, the vote was unanimous in favor at 6:51 p.m. Council Member Palmer moved, seconded by Council Member Jones, to close the regular session and enter executive session for discussion of prospective land purchase, sale or leasing under Miss. BOX 690 PONTOTOC, MS 38863 NOTICE IS HEREBY GIVEN that the Three Rivers Solid Waste Management Authority will hold a public hearing to amend the Solid Waste Management Plan in reference to the proposed expansion of the Tupelo Wondura Class II Rubbish Site located on Canal Street, Tupelo, Mississippi in Section 8, Township 10 South, Range 6 East. The proposed facility expansion will provide an additional 27.1 acres of disposal area within the 279 acre parcel increasing the permitted disposal area to 37.1 acres. Acceptable wastes for disposal will include natural vegetation (such as tree limbs, stumps, and leaves), brick, mortar, concrete, stone, and asphalt. The service area is limited to the City of Tupelo. Any interested person is invited to attend the public hearing to provide comments regarding the amendment to the Three Rivers Solid Waste Management Authority Solid Waste Management Plan. Box 1526, Tupelo, MS 38802. 771 2.4.3 Tupelo Wondura Class II Rubbish Landfill The conversion of the Tupelo Wondura sewage lagoon to a Class II Rubbish Landfill in 2014 provided continued rubbish disposal capabilities to the Tupelo Water & Light Department. The landfill is located off of South Canal Street in Tupelo and disposal activities are limited to the City of Tupelo, primarily materials removed from Tupelo right- of-way. The existing 10-acre disposal area is located on a 47.5 acre parcel owned by the City of Tupelo. This western adjacent property will be developed to provide rubbish disposal capabilities for years to come. The immediate plan is to develop a new cell that will tie in to the west side of the existing disposal area. Future expansion will be further to the west and then to the south providing a total of three (3) contiguous disposal cells totaling 27.1 acres increasing the permitted disposal area to 37.1 acres. These three (3) cells will provide approximately 612,440.5 cubic yards (cy) of air space resulting in an estimated life span of approximately 20.1 years based on the average disposal rate from 2014 to 2021.
