THE CITY OF TUTTLE BOARD OF ADJUSTMENT MEMBERS MET IN REGULAR SESSION ON
November 10, 2020 AT 5:00 P.M. IN THE TUTTLE CITY HALL LOCATED AT 221 W. MAIN STREET.
MEMBERS PRESENT: ELBERTA JONES, VICKIE SOUTHARD, RYAN OVERHOLT, JAY BRUNSON,
AND RICHARD SCHWALBACH
MEMBERS ABSENT: NONE
STAFF PRESENT: TIM YOUNG, KAYLEY GORDON, WENDY MARBLE, AND BREVIN GHORAM
OTHERS PRESENT: JON DOYLE AND LESLIE WALKER
CALL TO ORDER Schwalbach called the meeting to order at 5:02 pm
ROLL CALL Marble called the roll and declared a quorum present
ORDER OF BUSINESS
1. DISCUSSION and related CONSIDERATION approval of minutes from August 4, 2020
Motion was made by Jones and seconded by Southard to approve minutes from August
4, 2020 meeting. Brunson recused himself from the vote.
Motion carried as follows:
Aye: Overholt, Jones, Southard and Schwalbach
Nay: Brunson
2. PUBLIC HEARING, DISCUSSION and RELATED CONSIDERATION of BOA Petition 2020-04
Request of Frisco Land & Properties, LLC for a front yard setback variance at 5003 E. SH 37
Jon Doyle representing Frisco Land & Properties talked about property fronts 3 public
streets (Hwy 37, Hwy 4, & Timbercreek) Southard asked what the side of property will the
dumpster be located. Doyle explained dumpster and delivery lane.
Overholt asked question regarding dumpster enclosure being considered part of the
setback. Doyle stated 10-15ft of room on back of store, not enough to move the
dumpster to the back.
Young stated could issue permit minus sanitation enclosure and let Planning
Commission and City Council make changes for dumpster. Jones asked if it is right
entrance and right exit. Doyle stated yes, Department of Transportation required the
highway entrances as on plan. Brunson asked about Island by entrance, do they extend
out to Timbercreek? Doyle replied that they do not. Overholt asked if they can still
approve the finding of facts. Young stated yes.
Schwalbach asked if they allow the setback will it cause any issues. Young, stated no.
Schwalbach went over the four questions on the findings of facts asking if the variance
meets all the requirements.
Motion was made by Overholt, seconded by Brunson to approve the findings of facts for
BOA Petition 2020-04 Request of Frisco Land & Properties, LLC for a front yard setback
variance at 5003 E. SH 37
Motion carried as follows:
Aye: Overholt, Brunson, Jones, Southard and Schwalbach
Nay: None
Southard asked Young if the City could put up signage stating that Timbercreek Drive is
not a through street. He stated yes that can happen
3. DISCUSSION and related CONSIDERATION approval of meeting calendar for 2021
Young stated the state law requires to set a meeting schedule even though this board
meets on an as needed basis. Schwalbach asked if 5:00 was good for all and the
members stated yes. He stated the meetings will be called as needed.
Motion was made by Brunson, seconded by Jones to approve the meeting calendar for
2021. Motion carried as follows:
Aye: Overholt, Brunson, Jones, Southard and Schwalbach
Nay: None

Motion was made by Brunson, seconded by Jones to adjourn the meeting at 5:27 p.m.
