BACKGROUND:
SB 1383 and its implementing regulations (collectively “SB 1383) impose numerous requirements on cities related
to Organic Waste. In 2023, the City’s franchise agreement with Burrtec was updated to require the collection and
recycling of organic waste and otherwise comply with the various requirements of SB 1383. The updated
franchise agreement contemplated that Burrtec, and the City would enter a subsequent agreement (a
“Procurement Agreement”) to enable the City to comply with its obligations under SB 1383 related to the
procurement of Recovered Organic Waste Products. Generally speaking, Recovered Organic Waste Products
refers to products made from organic waste diverted from landfill disposal as a result of organic waste recycling
programs, such as compost. SB 1383 imposes obligations on every City to procure a certain amount of
Recovered Organic Waste Products using a formula generally based on population. Currently the City is
obligated to procure approximately 923 tons per year of compost to comply with this requirement, with this
obligation currently set to go up to approximately 2500 tons per year. Once procured, compost must be utilized
for purposes set forth in SB 1383, such as agricultural applications, and the City is obligated to keep records of
both procurement (demonstrating the required type and amount of products have been procured) and the final
application of such products (demonstrating they were used for required purposes.)
The recommended action is to approve a Procurement Agreement as contemplated by the amendment to the
Burrtec franchise. Per the terms of the Procurement Agreement, Burrtec will take responsibility for both
procuring the required materials, ensuring they are delivered for proper use, and keeping the records of such
activities as required by SB 1383. While the City may be charged up to $17/ton for compost that Burrtec procures
on its behalf, Burrtec has agreed not to charge the City for such materials in the current fiscal year. Our office is

working with Burrtec to address the issue of costs and anticipates arriving at an agreement for that purpose which
will be implemented on or about July 1, 2025.
ENVIRONMENTAL:
N/A
ALTERNATIVES:
The City Council can choose not to enter the Procurement Agreement, however, should that occur, the City would
need to arrive at an alternative solution to address its SB 1383 imposed procurement obligations. Failure to do
so would subject the City to fines imposed by the State of up to $10,000 per day.
FISCAL IMPACT:
Burrtec has agreed not to impose charges on the City for procurement services in the current fiscal year. Our
office is negotiating with Burrtec to address this issue, and in the absence of coming to a different solution the City
will be charged up to $17/ton for compost procured by Burrtec with the actual cost dependent upon market
conditions.

AGREEMENT FOR PROCUREMENT OF
RECOVERED ORGANIC WASTE PRODUCTS
This Agreement for Procurement of Recovered Organic Waste Product is entered into
as of January 28, 2025, by and between Burrtec Waste and Recycling Services, LLC, a
California limited liability company (“Burrtec”) and the City of Twentynine Palms, a
municipal corporation (the “City”) ”) (collectively the “Parties,” or individually a “Party”).
RECITALS
WHEREAS, Burrtec is a “Direct Service Provider” to the City as defined in 14
CCR Section 18982(a)(17).
WHEREAS, City desires to comply with State requirements as contained in 14
CCR Division 7, Chapter 12, 12, Article 12 (“SB 1383 Procurement Regulations”) to
procure a specified amount of Recovered Organic Waste Products (as defined herein)
to support organic waste disposal reduction targets and markets for products made from
recycled and recovered organic waste materials.
WHEREAS, the parties desire that Burrtec procure, on behalf of the City
sufficient Recovered Organic Waste Product for City to meet the SB 1383 Procurement
Regulations.
NOW, THEREFORE, in consideration of the promises above stated and the
terms, conditions, covenants, and agreements contained herein, the Parties do hereby
agree as follows:
1. Procurement. Burrtec will annually procure, on behalf of the City, a quantity of
products made from California, landfill-diverted recovered organic waste processed
at a permitted or otherwise authorized operation or facility, or as otherwise defined in
14 CCR Section 18982(a)(60) (“Recovered Organic Waste Products”) that the City is
required to procure annually under 14 CCR Section 18993.1 (the “Annual
Procurement Target.”) The per-ton cost of the organic products will be borne by the
City. Burrtec may charge the City up to $17/ton for compost material. Annual
increases will depend on market conditions.
2. Use. The Recovered Organic Waste Products procured on behalf of the City shall be
for use by the City or giveaway to third parties. The Recovered Organic Waste
Products may not be sold; provided, however, that if any third-party user elects to
have the products delivered rather pick up the products onsite at a Burrtec facility,
Burrtec may charge for such transportation and delivery as may be agreed by
Burrtec and the third party.
3. Reporting. Burrtec shall provide written reports to the City on a quarterly basis of its
procurement of Recovered Organic Waste Products and behalf of the City. The
reports shall include:

a. General description of how and where the product was used and if applicable,
applied;
b. Source of product, including name, physical location, and contact information for
each entity, operation, or facility from whom the Recovered Organic Waste Products
were procured;
c. Type of product; and
d. Quantity of each product.
3. Relationship of Parties. The Parties intend that Burrtec shall perform the services
required by this Agreement as an independent contractor engaged by the City and not
as an officer or employee of the City nor as a partner of or joint venture with the City.
No employee or agent or Burrtec shall be or shall be deemed to be an employee or
agent of the City.
4. Compliance with Law. In providing the services required under this Agreement,
Burrtec shall at all times, at its sole cost, comply with all applicable laws and regulations
of the United States, the State of California, and local agencies. The City shall comply
with all applicable regulations promulgated by federal, state, regional or local
administrative and regulatory agencies, now in force and as they may be enacted,
issued, or amended during the Term.
5. Governing Law. This Agreement shall be governed by, and construed and enforced
in accordance with, the laws of the State of California.
6. Assignment. Burrtec shall not assign its rights, nor delegate, subcontract or
otherwise transfer its obligations under this Agreement (collectively referred to as an
“Assignment”) to any other Person without the prior written consent of City. Any such
Assignment made without the consent of City shall be void and the attempted
Assignment shall constitute a material breach of this Agreement.
7. Notice. All notices, demands, requests, proposals, approvals, consents, and other
communications which this Agreement requires, authorizes, or contemplates shall be in
writing and shall either be personally delivered to the other party at the address below
or be deposited in the United States mail, first class postage prepaid, addressed as
follows:

The address to which communications may be delivered may be changed from time to
time by a written notice given in accordance with this Section. Notice shall be deemed
given on the day it is personally delivered or, if mailed, three days from the date it is
deposited in the mail.
8. Attorney’s Fees. In any action or proceeding to enforce or interpret any of the terms
or conditions of this Agreement the prevailing party shall be entitled to an award to
attorney’s fees in the amount reasonably incurred in the prosecution or defense of such
action. The term “prevailing party” shall mean the party entitled to recover costs of suit,
upon the conclusion of the matter, in accordance with the laws of the State of California.
9. Entire Agreement. This Agreement represents the full and entire Agreement between
the Parties with respect to the matters covered herein and supersedes and replaces all
prior agreements, understandings, commitments, communications, and representations
made between the Parties, whether written or oral, with respect to the subject matter
hereof,

BACKGROUND:
In 2021, the City acquired the properties located on APN 0624-082-23 which includes a stand-alone (6937 Elm
Ave) structure and a three-plex (6939, 6941, and 6943) with the intent of providing low-income housing. The City
received funding from Project Home Key to renovate one unit, making it ADA compliant. Upon inspection by
Staff, the unit located 6943 Elm Avenue was selected for rehabilitation. Improvements will include asbestos
removal, renovated kitchen, and a renovated bathroom. In addition, an accessible ramp to the front door will be
designed as well as a path of travel to the laundry facility which is adjacent. Lastly, an accessible parking space
and path of travel to Elm Avenue for transit access will be designed.
With a unit selected, Staff sent out a Request for Proposals seeking to retain a Certified Access Specialist (CASp)
architect. A site visit was conducted, and Staff received two proposals from architects with equal qualifications.
Since both firms were qualified, Staff selected Design Concepts based on the overall cost and ability to complete
the project within 120 days upon Notice of Award.

The City Council could choose not to approve Design Concepts and go with another firm or choose an another
alternative.

BACKGROUND:
The current primary Animal Control truck is a 2012 Ford F-350 Chassis with an Animal Control Body purchased in
2002. The current truck has well over 100,000 miles on it. Given the critical operation of this vehicle, Staff is
recommending we replace this truck and move the current truck to a backup role. The current backup truck is a
2002 Ford F-150.
Staff has spent significant time researching the Animal Control Bodies, leveraging years of experience to meet
current weaknesses. Diamond Truck Body offers one of the finest boxes on the market, backed by 45 years of
experience in the upfit industry. This new box offers advanced safety features for City Staff providing hydraulic lift
gates for the movement of large animals. Additional features include air conditioning for the animal areas, anti-
corrosion coatings, safety lighting, interior secondary safety doors, and much more. Diamond was the most cost-
effective body manufacturer we found.
Rush Truck Center is a Sourcewell Partner, allowing us to leverage the cooperative purchase agreement we are a
member of. Sourcewell guarantees us the best price by leveraging national negotiating power with local vendors.
Staff is recommending the F-350 for a variety of reasons primarily maintenance standardization of our existing
fleet, also the diesel engine and four-wheel drive are important for operation during emergencies.
The City Council has previously approved $105,000.00 for the purchase of this new vehicle. Unfortunately, the
funds ultimately were not sufficient to acquire this vehicle due to inflationary concerns. We are asking the City
Council to provide an additional $25,894.22, allowing us to complete this purchase.

BACKGROUND:
Our City Council’s leadership and City Staff’s dedication has enabled our residents to receive and enjoy
a variety and level of services typically found in much larger and well-funded communities. From a
capable and responsive Public Works Department to a passionately committed and creative Parks and
Recreation Department, the City Council identifies community needs and Staff strives to meet those
needs. Additional events and services are currently limited by available City revenues.

Identifying, prioritizing, and addressing community needs with limited resources is one of the biggest, if
not the biggest, challenge community leaders face. Tonight’s agenda item is an opportunity to discuss
the Council’s interest in acquiring and operating a center designed to address the needs of youth, lower
socio-economic status[1] residents, and workers displaced by rapidly evolving technology.
Initial Discussion:
While not an exhaustive list, initial discussions may include:
1. Conducting a community survey to better identify and clarify community needs;
2. Review and discuss any formal survey during a public meeting to ensure thorough public engagement;
3. Analyzing and prioritizing service needs and marketplace gaps;
4. Conduct a cost-benefit analysis on higher priority needs to determine economic and social feasibility;
5. Identifying the ability to leverage and collaborate with existing service providers (e.g., other public
agencies, NGO’s, private sector, etc.,) to address identified needs;
6. Service provision will drive hours of operation and required staffing levels which, in turn, drives upfront and
ongoing programing costs;
7. Identifying the funding sources to acquire, improve, and operate said center;
8. Understand the fiscal impact of long-term funding requirements;
9. Ability to utilize an existing facility (e.g., Luckie Park Activity Center or LPAC) in concert with existing
programs; and
10. Discuss any need to phase or scale programing based on available resources.
Building Design:
Building size and layout should be driven by services to be rendered while balancing (i) cost
considerations, and (ii) the ability to repurpose the building for future use(s).
Types of services offered:
The City Council has broad discretion in providing services. Practically speaking, the type, frequency,
and extent of services will be limited by (i) available municipal funds and (ii) one-time or recurring grant
requirements.

Economic Considerations:
The Twentynine Palms economy is growing and shows tremendous potential. Despite this potential, the
current reality is that our economy is substantially based on Marine Corps-related spending and tourism.
While Marine Corps Base funding is reasonably resilient to local, regional, or even some national
economic downturns, war-time deployments or cuts to national defense spending have historically
resulted in substantially reduced economic activity within the community.
Growing tourism will provide the quickest boost to the local economy. There are multiple communities
throughout the Western United States where tourism was the initial economic catalyst which made more

diverse economic growth possible. Some of these communities include the Coachella Valley, Truckee,
CA, and Sedona, AZ. It is important to note while tourism is often the spark which allows communities
to grow in size, in amenities, and in the ability to provide opportunities for upward economic mobility;
tourism is the discretionary spending on a luxury good. National or regional economic retractions by
necessity force individuals to limit or eliminate discretionary spending.
All this is to say, maintaining healthy reserves and limiting (as much as possible) future non-scalable
spending is vital to long term municipal financial health. As will be discussed in the upcoming strategic
planning sessions, there are a number of existing buildings with significant deferred maintenance. The
Council must balance construction of new buildings (and the resulting new operating costs) with the
ongoing obligation of maintaining existing assets and programs.
In closing:
A community resource center could be a valuable addition to the Twentynine Palms community and
provide services to those in need. As Mahatma Ghandi is reported to have said, "the true measure of
any society can be found in how it treats its most vulnerable members".

Fairbank, Maslin, Maullin, Metz & Associates (FM3 Research or FM3) is pleased to present this proposal to conduct
a strategic planning survey for the City of Twentynine Palms. We believe our experience in communities similar to
yours and extensive experience conducting strategic, resident satisfaction, and planning surveys throughout the
state, makes us uniquely qualified to conduct this research for Twentynine Palms.
FM3 has been performing public policy-oriented opinion research since 1981 on issues of major economic and
social concern, such as constituent satisfaction with public services and support for policy proposals; budgetary
issues and taxation; public safety; parks and open space; growth and property development; environmental
protection; natural resource conservation and development; organizational branding and more. FM3’s principal
business and philosophy is to provide timely public opinion analysis designed to help policymakers make decisions,
and we pride ourselves on helping local cities meet their objectives to improve their residents’ quality of life and
protect the valued sense of community.
The research that FM3 conducts goes far beyond simply documenting the knowledge, views, and behaviors of
various populations. Rather, our work produces actionable data which provides a strategic roadmap for policy
makers to inform community outreach and communication efforts. FM3’s clients benefit from our significant
experience translating survey data into meaningful recommendations that help provide direction for public
agencies on a variety of goals, including policy changes to better serve the needs of residents.
In any given year, FM3 conducts as many as 500 surveys and 160 focus groups (as well as other types of opinion
research), which we use to provide strategic insights and advice to our clients. All key FM3 staff members have
advanced degrees in public policy, research methods, and/or extensive experience working in state and local
government.
FM3 understands that Twentynine Palms would like to conduct a community survey to inform the development
of an updated strategic plan. The survey will help City leaders better understand attitudes toward city services,
programs and infrastructure, residents’ priorities and concerns, opinions on current and proposed policies. FM3
also recognizes that the objective is to understand views today, but also to design a survey that is future-thinking
and will assist the City in formulating its long-range vision.

For this project, FM3 recommends conducting a 15-minute survey among up to 300 residents of Twentynine Palms
18 years of age or older using an address-based sampling methodology. This research approach would employ at
least three different contact methods (landline and cellular telephone calls, emails, and text messages) and two
different collection methods (landline and cellular telephone calls and online interviews). By offering a variety of
contact and data collection methods, FM3 ensures survey responses are collected from a demographically and
geographically representative sample of adults in your community because all residents have the opportunity to
be selected for the survey. We recommend offering the survey in Spanish to ensure more residents can participate
in sharing their views.
Given the size of the Twentynine Palms community, the costs of the survey will be prorated if the final sample
does not reach 300 completed interviews. Any additional completed interviews, using the aforementioned three
contact methods, beyond the 300 will be included in the final data analysis at no additional charge. We are also
providing the option to include a fourth contact method: mailed postcards with individual links to complete the
survey for residents who cannot be reached by phone call, text or email message. With this method, we believe
we can reach a sample size of 350 completed survey interviews.
We believe our firm is the clear choice to conduct a community survey on behalf of Twentynine Palms for several
reasons, including the following:
• FM3 is a recognized leader in conducting community priority, resident satisfaction, and strategic and long-
range planning survey research for cities and other local government agencies. Our research has helped
inform the municipal priorities of more than 300 cities and other local agencies throughout the U.S. Our
research findings and recommendations have been strategically utilized by numerous municipalities for
activities such as developing 5-year strategic plans, setting budgetary priorities, updating general plans,
developing public policies, and creating internal performance measurement systems. FM3’s past clients for
