Quarantine Building (c) Amboy Bike Path (d) Hatch/Sullivan Bike Path (e) El Sol Curb and
Gutter, (f) Playground Equipment, and (g) Electronic Sign for a total of $860,786.67;
2. Allocate funds to the following projects: (a) Replacing Roofs and (b) Repair Animal Control
Building for a total of $100,000;
3. The defunded and Closed Out project funds will be re-allocated to the following: (a) Covid-19
Stabilization Fund for $380,000 and (b) Project Phoenix for $380,000 and
4. Approve all the budget transfers/adjustments to accomplish the recommendations.

CALL TO ORDER - Mayor Pro Tem Mintz called the meeting to order at 2:31 p.m.
Roll Call - The following Councilmembers were present: Bilderain, Wright, Mintz. O'Gilvie and Klink
were present remotely (through teleconference).
DISCUSSION AND POTENTIAL ACTION ITEMS
1. In Consideration of Public Health, Discussion on Cancelling Public Gatherings within the City, per
the “Guidance” of Governor Newsom.
City Manager Luckino presented the item. He went through the guidelines document as presented
by Governor Newsom. Staff is asking to consider cancelling public gatherings in the City for the
month of March. He went over the list of events occurring in the community during the month of
March individually and asked for votes on whether to continue with each event or cancel it.
PUBLIC COMMENTS
Gary Daigneault, Twentynine Palms, mentioned that Theatre 29 is performing a play in March.
Ron Smith, Yucca Valley, on behalf of the Hilltoppers Motocross Races, commented that their event
the last weekend in March would cost a lot of money if they were to cancel the event. This event
brings a lot of revenue to the City. He is asking that the City Council allow the event to continue.
Roger Thomas, Twentynine Palms, spoke on behalf of the Farmer’s Market. He mentioned that the
Joshua Tree Farmer’s Market is staying open and is asking the City Council to allow the Twentynine
Palms’ Farmer’s Market to stay open as well.
After a brief discussion, a Roll Call Vote was given on the following events:

Mayor Pro Tem Mintz commented that he has not attended any meetings.
Councilmember Wright mentioned that he attended the new Bakery's Ribbon Cutting Ceremony.
Councilmember O'Gilvie commented that she also attended the Bakery's Ribbon Cutting Ceremony and she is doing her
part in maintaining social distancing.
Mayor Klink mentioned that he participated in the Measure I meeting via teleconference and attended the Bakery's Ribbon
Cutting Ceremony.

Mayor Pro Tem Mintz abstained from Consent Calendar Item #5 Warrant Register checks #9913,9888,
9981, 9986, and 10015 due to a possible conflict of interest.

RECOMMENDATION: The City Council adopt Resolution No. 20-03 approving the design for the public
buildings in Project Phoenix.
Mayor Pro Tem Mintz recused himself from this item due to a possible conflict of interest. He left the Council
Chambers at 6:16 p.m.
Community Development Director Clark (Director Clark) presented the Staff Report. City Manager Luckino
then added some key points to the report.

O'Gilvie to adopt Resolution No. 20-03 approving the design for the public buildings in Project Phoenix.

RECOMMENDATION: The City Council adopt Resolution No. 20-04 ratifying the Proclamation, declaring the
existence of a local emergency, enhancing the City’s emergency preparedness and response and review the
continuing need for the local emergency every 14 days or as required.
City Manager Luckino presented the Staff Report.
After a brief discussion, a motion was made by Mayor Pro Tem Mintz, seconded by Councilmember
Wright to adopt Resolution No. 20-04 ratifying the Proclamation, declaring the existence of a local
emergency, enhancing the City's emergency preparedness and response and review the continuing
need for the local emergency every 14 days or as required.

RECOMMENDATION:
The City Council:
1. Accept the completed work on the Highway 62/Adobe Road Traffic Signal Modification Project - Accept
Contract as Complete with PTM General Engineering Services for the amount of $523,365.
2. Direct the City Clerk to file a Notice of Completion.
3. Direct the Finance Director to release the retention after 30 days if no claims are filed against the
contractor.

BACKGROUND:
On October 23, 2018, the City Council awarded a contract to PTM General Engineering Services, for the
modification of the traffic signal at the intersection of State Route 62 and Adobe Road. This project
included providing necessary labor, equipment, and materials to modify the traffic signal and to widen
both Adobe Road and State Route 62 at the northwest corner.
Staff inspected the project and is satisfied that PTM General Engineering Services, has satisfactorily
completed the work under this contract.

ALTERNATIVES:
The City Council could choose not to approve the project as complete.

interest or estate stated below in the property hereinafter described:
2. The full name of the owner is: City of Twentynine Palms, a municipal corporation of the State of California,
and which is located within the County of San Bernardino, in said State, and the address is 6136 Adobe
Road, Twentynine Palms, California 92277.
3. That on the 23rd day of October, 2018 and pursuant to approval of the City Council of the said City, the City
entered into a contract with PTM General Engineering Services. whose address is 5942 Acorn St.,
Riverside, CA 92504, to perform the SR62/Adobe Road Traffic Signal Modification Project in the City of
Twentynine Palms, and in accordance with the City of Twentynine Palms' Plans and Specifications.
4. That all of the said work or improvement was located at various locations in said City. Address: None,
APN: Unknown.
5. That all of the said work or improvement contemplated in and under said contract was completed on
September 17, 2020, and accepted by Council action on April 14, 2020.
6. That the Surety on the Performance Bond of said Contractor and the surety on the Labor and Material Bond
of said Contractor, under said contract, was and is $496,069 and $496,069.
The undersigned states: That the City of Twentynine Palms, the political subdivision of the State of California
conducted the proceedings for the improvement located at 6136 Adobe Road, in said City, described or referred to
in the foregoing "Notice of Completion”.

RECOMMENDATION:
The City Council consider the following actions:
1. Defund and Close out the following projects: (a)Trails Flood Control Plan (b) Animal Control Quarantine
Building (c) Amboy Bike Path (d) Hatch/Sullivan Bike Path (e) El Sol Curb and Gutter, (f) Playground Equipment,
and (g) Electronic Sign for a total of $860,786.67;
2. Allocate funds to the following projects: (a) Replacing Roofs and (b) Repair Animal Control Building for a total
of $100,000;
3. The defunded and Closed Out project funds will be re-allocated to the following: (a) Covid-19 Stabilization Fund
for $380,000 and (b) Project Phoenix for $380,000 and
4. Approve all the budget transfers/adjustments to accomplish the recommendations.

BACKGROUND:
A novel coronavirus (COVID-19) was first detected in Wuhan City, Hubei Province in China in December 2019.
Since then, on January 30, 2020, the World Health Organization declared COVID-19 a public health emergency
of international concern. Further, on of March 11, 2020, the World Health Organization has elevated the public
health emergency to the status of a pandemic. On January 31, 2020, The United States Health and Human
Services Secretary, Alex M. Azar II, declared this global outbreak a public health emergency for the United
States. The Centers for Disease Control and Prevention announced on February 25, 2020 that community spread
of COVID-19 is likely to occur in the United States. The County of San Bernardino declared a local emergency
and a local health emergency on February 26, 2020. The State of California proclaimed a State of Emergency on
March 4, 2020. On March 12, 2020, Governor Newsom issued Executive Order N-25-20, declaring that state and
local public health officials may, as they deem necessary in the interest of public health, issue guidance limiting or

recommending limitations upon attendance at public assemblies, conferences, or other mass events, which could
cause the cancellation of such gatherings through no fault or responsibility of the parties involved, thereby
constituting a force majeure.
Government Code section 8558 defines a local emergency as “the duly proclaimed existence of conditions of
disaster or of extreme peril to the safety of persons and property within the territorial limits of a county or city
caused by conditions such as air pollution, fire, flood, storm, epidemic, riot, drought, or other conditions, other
than conditions resulting from a labor controversy, which are or are likely to be beyond the control of the services,
personnel, equipment, and facilities of that political subdivision and require the combined forces of other political
subdivisions to combat.”
The above is a Health and Safety problem that we will overcome, however the lasting effect will be financial. Staff
is not sure how deep the financial impact will be or when the recover will begin. A large portion of the City's
funding comes from economic activity, i.e. Sales and Transient Occupancy Tax (TOT). Property Tax is the
largest portion of funding for the City, however staff does not see an immediate impact. Another impact that Staff
has not fully wrapped our arms around is the delay of payments, i.e. Sales, TOT, and Property Tax. When will we
realize those funds and if a businesses does not continue, will we ever see those funds.
The estimates for loss of revenue for our Current Fiscal Year 2019/20 is $439K and the loss for our next Fiscal
Year 2020/21 is $586K, couple this with the Sheriff's Department annual increase of $240K. Staff has already
made some actions to mitigate the loss of revenue (a) Freezing Step and COLA employee adjustments ($77,000
annual savings) (b) Furloughed Part Time Staff ($78,354 annual savings) (c) Voluntary Furlough mostly only
through June 30th ($33,331) and (d) Miscellaneous Cost Savings ($218,813 sixteen month savings).
Attached is the analysis of the actions tonight. As you can see, there will need to be other actions taken: (a)
Federal Stimulus for Cities TBD (b) Sheriff's Contract relief and/or reductions (c) reduction of programs and
services, (d) Other cost reductions, and (e) undesignated reserves.
