All comments are to be directed to the City Council and shall not consist of any personal attacks. Members of the public are expected to maintain a professional, courteous decorum during their comments. There is a time limitation of three minutes per person. Award a contract for the "Project Phoenix Site Improvements Compaction and Materials Testing" to Geocon West, Inc. in the amount of $42,936 and authorize a Ten Percent (10%) Contingency in the amount of $4,293.60, for a total contract amount of $47,229.60; 2. Authorize the City Manager to execute all documents necessary to enter into the contract, including any necessary amendments thereto. 3. Since the award, the City has received the construction schedule to complete the improvements. This was used to informally seek compaction and materials testing services for the project. Soil compaction and materials testing is a crucial step in the construction process. Soil that has not been properly compacted can be detrimental to the structural integrity of buildings, retaining structures, roads and pavements. By conducting compaction and materials testing, it can be determined subgrade, base and pavement materials have been constructed in accordance with the approved construction plans. Most regulatory agencies, such as Caltrans and the International Code Council, require compaction and materials testing. Numerous compaction and materials testing firms were requested to submit an informal bid to perform such services. By December 31, 2020. The informal bid request yielded the following six bids: Bidder Bid Geocon $42,936 Sladden $49,200 RMA Group $74,839 Page 3 of 14 Merrell Johnson $77,310 CTE South $84,020 GeoMat Testing $100,600 Upon review of the submitted bids, it has been determined that Geocon is the lowest responsive/responsible bidder. Geocon has an extensive background in providing comprehensive geotechnical engineering, engineering geology and geotechnical instrumentation, including materials testing and special inspections. In an effort to show interest in working with the City of Twentynine Palms, Geocon has discounted their hourly rate for an inspector as well as a 20% discount on all invoiced lab tests. Considering Geocon is the lowest/responsible bidder and they are highly qualified, Staff is recommending the City award Geocon a contract to conduct compaction and materials testing. Construction for Project Phoenix Site Improvements is underway. Once the Contract for compaction and materials testing services is awarded, it is anticipated testing will begin immediately. ENVIRONMENTAL: There are no environmental impacts associated with this action. ALTERNATIVES: The City Council could reject the bids and request additional bids. FISCAL IMPACT: This work will be paid by Project Phoenix funds. (Geocon) is pleased to present this proposal to provide the requested special inspection and testing services during construction of the site improvements for Project Phoenix in the City of Twentynine Palms, California. In accordance with your request, we have provided a fee estimate to perform inspection and testing services for the subject project. In preparing this proposal we attended the Non-Mandatory Pre-Bid meeting on site and reviewed the plans, (October 16, 2020) designed by NV5. A contractor’s construction schedule was provided at a later date during the preparation of this proposal. We will supply the City of Twentynine Palms a Multi Certified Inspector for the duration of the Project who will be able to test and sample multiple construction areas and materials on the same scheduled date thus saving money on the project budget. PROJECT UNDERSTANDING AND SCOPE The project consists of grading and over excavation of the Cultural/Community Center pad area, construction of concrete curb and gutter, cross gutters, curb ramps, driveways, sidewalk, parking Lots, AC pavement, soil and aggregate base sampling and testing, As per our discussion we will provide as needed testing and inspection services with a 4 hour testing minimum per occurrence. Efficient scheduling of multiple areas to be tested per trip will save the project significant money on the budget. If this scope changes, an updated cost proposal will be provided that will also include any additional testing required. We understand the project is slated to start in January 2021. Our staff is prepared to assist you and the City of Twentynine Palms in accordance with your schedule. Page 5 of 14  SCOPE OF SERVICES Geocon’s scope of services to be provided include but are not limited to the following: Geotechnical Engineering, Testing and Inspection, sampling and Lab testing. Geocon has the professional qualifications and equipment to perform, evaluate, and report the results of all tests and inspections required for the construction testing and materials testing. Consultation. Provide consultation as necessary to the design and construction team. Review, stamp and sign project plans as necessary. Attend team meetings (at no charge), respond to RFI’s and provide additional or alternative design recommendations as necessary. Compaction Testing & Inspection. Provide multi certified inspector as required for the project during the excavation, grading and construction period. Our inspector would be equipped with a vehicle and sufficient field-testing equipment to provide in-place density test results in the field, as well as to collect samples for both earth and construction materials testing. A Deputy or Special Inspector can be provided as required for oversight and inspection during placement of steel reinforcement, concrete, masonry, welding, epoxy and framing. To show our interest in being part of the team with The City of Twentynine Palms on the Phoenix Project, we have discounted our Inspector Hourly rate. Geotechnical Observation. Site visits by our engineer and/or geologist would be performed as needed in areas where site conditions require a licensed professional to perform inspections or give recommendations. Laboratory Testing. Geocon will Perform all necessary laboratory soil testing required for project support and report preparation. The quantity and type of tests performed will depend upon the conditions encountered. The actual cost for laboratory tests will be invoiced in accordance with our Schedule of Fees included with this proposal. To show our interest in being part of the team with The City of Twentynine Palms on the Phoenix Project, we will discount our lab testing 20% off of all invoicing. All tests will be performed in our in-house laboratory. Report Preparation and Submittal. Upon completion of the site grading, foundation installation, and/or compaction testing, reports will be prepared as required by the Building Official. Total Estimate $ 42,936 The actual fee for services is directly related to the construction schedule, weather, and efficiency of the contractor performing the work. Our services will be provided on a time and materials basis in accordance with the cost estimate and our Schedule of Fees. Our invoices will be itemized to reflect only the actual time and costs incurred in addition to the Laboratory testing discount of 20%. The attach cost provides a task item breakdown of our estimate. The fee estimate is for budgeting purposes. This proposal assumes that the services offered herein are subject to prevailing wage laws. If Client should conclude this project is not subject to prevailing wages, please so advise Geocon in writing immediately. If failure to so advise Geocon results in additional costs to Geocon, Client will reimburse Geocon for all costs and expenses. To show our interest in working with the City of Twentynine Palms, we will discount our Inspector Prevailing Wage rate from $130 to $108 per hour. In addition, we will discount all lab fees by 20 percent. 1. Listed are typical charges for the services most frequently performed by Geocon. Prices for unlisted services as well as special quotations for programs involving volume work will be provided upon request. Laboratory test prices shown are for laboratory work only, and include reporting of routine results not calling for comments, recommendations or conclusions. 2. Sampling and testing is conducted in substantial conformance with the latest applicable or designated specifications of the American Society for Testing and Materials, Caltrans, American Association of State Highway and Transportation Officials, or other pertinent agencies. 3. Saturday, night work, and overtime hours are charged at time and one-half; Sundays and holidays at double time. Per diem is $155.00 per day when location of work dictates. 4. Equipment and materials will be billed at cost plus 15%. Outside services including subcontractors and rental of special equipment are billed at cost plus 15%. Hourly services are billed portal to portal from closest office in accordance with the stated hourly rates herein, with a minimum two-hour charge 5. Invoices will be submitted at four-week intervals. Terms of payment are met upon presentation of invoice. Invoices become delinquent thirty (30) days from invoice date and subject to one and one-half percent (1-1/2%) service charge per month, or the maximum rate allowed by law, whichever is lower. If Client objects to all or any portion of any invoice, Client will so notify Geocon in writing within fourteen (14) calendar days of the invoice date, identify the cause of disagreement, and pay that portion of the invoice not in dispute. The parties will immediately make every effort to settle the disputed portion of the invoice. Payment on delinquent invoices will first be applied to accrued interest and then to the principal amount. All time spent and expenses incurred (including any attorney's fees and costs) in connection with collection of any delinquent amount will be paid by Client to Geocon per Geocon's current fee schedule. 6. Client and Geocon shall allocate certain of the risks so that, to the fullest extent permitted by law, Geocon’s (the term “Geocon” includes Geocon’s partners, officers, directors, employees, agents, affiliates, subcontractors and subconsultants) total aggregate liability to Client is limited to the greater of $50,000 or the total compensation received from Client by Geocon for services rendered on this project, for any and all of Client’s injuries, damages, claims, losses, expenses, or claim expenses arising out of this Agreement from any cause or causes, including attorneys’ fees and costs which may be awarded to the prevailing party, and Client agrees to indemnify and hold harmless Geocon from and against all liabilities in excess of the monetary limit established above. 7. Client and Geocon shall allocate certain of the other risks so that, to the fullest extent permitted by law, Client shall limit Geocon’s total aggregate liability to all third parties, including contractors, subcontractors of all tiers, materialmen, and others involved in Client’s project, as well as persons and other entities not involved in the project, to the greater of $100,000 or the total compensation received from Client by Geocon for services rendered on this project, for any and all injuries, damages, cause or causes, including attorneys’ fees and costs which may be awarded to the prevailing party, and Client agrees to indemnify and hold harmless Geocon from and against all liabilities in excess of the monetary limit established above, including all liability incurred by Geocon for acts, errors, or omissions, pursuant to entering into agreements with third parties on behalf of Client in order to obtain access or entry onto property not owned by Client. Client agrees to notify all contractors and subcontractors of any limitation of Geocon’s liability to them, and require them to abide by such limitation for damages suffered by any contractor or subcontractor arising from Geocon’s actions or inactions. Laboratory test prices shown are for laboratory work only, and include reporting of routine results not calling for comments, recommendations or conclusions. 2. Sampling and testing is conducted in substantial conformance with the latest applicable or designated specifications of the American Society for Testing and Materials, Caltrans, American Association of State Highway and Transportation Officials, or other pertinent agencies. 3. Saturday, night work, and overtime hours are charged at time and one-half; Sundays and holidays at double time. Per diem is $155.00 per day when location of work dictates. 4. Equipment and materials will be billed at cost plus 15%. Outside services including subcontractors and rental of special equipment are billed at cost plus 15%. Hourly services are billed portal to portal from closest office in accordance with the stated hourly rates herein, with a minimum two-hour charge 5. Invoices will be submitted at four-week intervals. Terms of payment are met upon presentation of invoice. Invoices become delinquent thirty (30) days from invoice date and subject to one and one-half percent (1-1/2%) service charge per month, or the maximum rate allowed by law, whichever is lower. If Client objects to all or any portion of any invoice, Client will so notify Geocon in writing within fourteen (14) calendar days of the invoice date, identify the cause of disagreement, and pay that portion of the invoice not in dispute. The parties will immediately make every effort to settle the disputed portion of the invoice. Payment on delinquent invoices will first be applied to accrued interest and then to the principal amount. All time spent and expenses incurred (including any attorney's fees and costs) in connection with collection of any delinquent amount will be paid by Client to Geocon per Geocon's current fee schedule. 6. Client and Geocon shall allocate certain of the risks so that, to the fullest extent permitted by law, Geocon’s (the term “Geocon” includes Geocon’s partners, officers, directors, employees, agents, affiliates, subcontractors and subconsultants) total aggregate liability to Client is limited to the greater of $50,000 or the total compensation received from Client by Geocon for services rendered on this project, for any and all of Client’s injuries, damages, claims, losses, expenses, or claim expenses arising out of this Agreement from any cause or causes, including attorneys’ fees and costs which may be awarded to the prevailing party, and Client agrees to indemnify and hold harmless Geocon from and against all liabilities in excess of the monetary limit established above. 7. Client and Geocon shall allocate certain of the other risks so that, to the fullest extent permitted by law, Client shall limit Geocon’s total aggregate liability to all third parties, including contractors, subcontractors of all tiers, materialmen, and others involved in Client’s project, as well as persons and other entities not involved in the project, to the greater of $100,000 or the total compensation received from Client by Geocon for services rendered on this project, for any and all injuries, damages, cause or causes, including attorneys’ fees and costs which may be awarded to the prevailing party, and Client agrees to indemnify and hold harmless Geocon from and against all liabilities in excess of the monetary limit established above, including all liability incurred by Geocon for acts, errors, or omissions, pursuant to entering into agreements with third parties on behalf of Client in order to obtain access or entry onto property not owned by Client. Client agrees to notify all contractors and subcontractors of any limitation of Geocon’s liability to them, and require them to abide by such limitation for damages suffered by any contractor or subcontractor arising from Geocon’s actions or inactions. Neither the contractor nor any subcontractor assumes any liability for damages to others which may arise on account of Geocon’s actions or inactions. -3- Page 14 of 14
