CALL TO ORDER-Chair Krushat called the meeting to order at 5:00 p.m.
Pledge of Allegiance- Chair Krushat led the Pledge of Allegiance.
Roll Call- The following Commissioners were present: Dickson, Krushat, Paahana, Walker. Commissioner Leslie had an
excused absence.

Chair Krushat announced he will have to recuse himself during the VHR Study Session for a potential conflict of interest
being a VHR owner. He added for transparency reasons two years ago when he served on the VHR Ad-hoc Committee
he was not a VHR owner.

COMMUNITY DEVELOPMENT DIRECTOR UPDATES
Director Gardner provided updates on study sessions previously discussed.
• Limiting two story homes - Feedback from legal, once zoned for 35' downgrading is frowned upon. The State is
pushing for higher density.
• Downtown Specific Plan - Allowable Uses, Side Streets, Circulation Element and Wayfinding will be brought back
to the Commission at a later date, possibly October 17, 2023.
• Single family residential parking and garages will come back June 6, 2023.
• The inaugural meeting of the Planning Commission and Homeless Committee will be May 16, 2023.
• Campgrounds and legal access will come back June 6, 2023.
• Joshua Trees and non-conforming uses and regulations will be June 20, 2023.
Chair Krushat recused himself from the VHR Study Session for a potential conflict of interest. Vice Chair Walker took over
the meeting.
STUDY SESSION
2. Study Session - Vacation Home Rentals
That the Planning Commission provide direction to staff on a potential amendment to the Vacation Home
Rental regulations.
Director Gardner presented the staff report to the Commission. He noted, given the fact that we have two
recusals, legal recommended we touch base on items previously discussed at the prior VHR study session.
• Reduction in the number of VHR's per entity: Commission was of the consensus 5 per entity.
• Reduction in insurance requirement: Consensus of the Commission is to leave it at million-dollar single
limit liability.
• Single family homes built for VHR's: Consensus of the Commission is once the house is built and
receives a final building inspection an owner can apply for a VHR License.
• National Park buffer zone: Consensus of the Commission is no action needs to be taken for VHR's.
• Density per neighborhood: Commissioner Dickson commented that this is going to be a difficult task
however, consensus of the Commission is to try to come up with a density program.
Vice Chair Walker opened Public Comment.
Vice Chair Walker read into the record email comments from John Talley-Jones.
Heather Vescent, Twentynine Palms commented on the first 7 VHR items and suggested a casual VHR
licensing option.
Cindy Bernard, Twentynine Palms commented in favor of VHR regulations and provided suggestions for
density regulations.
Mary Jane Binge, Twentynine Palms spoke in opposition of more VHR regulations.
Susan Peplow, Joshua Tree commented on VHR regulations.
Veno Nathraj, Twentynine Palms commented on the need for housing and spoke regarding VHR regulations.

Vice Chair Walker closed the Public Comments.
Director Gardner presented the next items up for VHR discussion.
The Commission had lengthy discussions regarding VHR's.
Chris Giunta and Vanessa Cabrera, City Code Enforcement Officers made some brief comments regarding
nuisance issues.
The following decisions were made regarding suggested VHR code changes:
1. Number of VHR's allowed per parcel: Consensus of the Commission is to limit one license per parcel.
2. Parking: The item was tabled and will come back at a future meeting.
3. Conditions of Approval: Consensus of the Commission is to issue COA at license approval.
4. Response time for nuisance complaints: Consensus of the Commission is to bring this back at a future
meeting.
5. Storage of recreation vehicles: Consensus of the Commission is to allow only for storage purposes.
6. Structural alteration: Consensus of the Commission is to allow it with proper building permits.
7. Issuance of additional permits (Film permits and Temporary Use permits): Consensus of the
Commission is to allow it with proper Planning permits.
8. Good Neighbor Class: Consensus of the Commission is to require the class on an annual basis.

Mary Jane Binge, Twentynine Palms commented on suggested VHR regulations.
Jonathan Hume, Twentynine Palms suggested the City look into short term rental regulations in San
Bernardino County.
Beau Campbell, Twentynine Palms said the City should enforce the rules and regulations in place now and
hold people accountable.
Heather Vescent, Twentynine Palms commented on suggested VHR regulations.
Susan Peplow, Joshua Tree commented on suggested VHR regulations.

BACKGROUND:
On March 07, 2023, an application was submitted by Titus R Burns for the conversion of an existing commercial
structure to a church. The property is located at 6386 Adobe Road, also identified as APN: 0618-252-14. The
0.23-acre property contains an existing structure with a footprint of 2,816 square feet.
The parking requirement in the Development Code for a church is based upon one parking stall per 40
square feet of principal assembly area. The principal assembly area for this project is 1,031 square feet,
therefor 26 spaces would typically be required. However, the project is located in the DT zoning district
of the DTSP, which does not require onsite parking. The parcel contains 14 parking spaces.
The applicant proposes to conduct two services, a Sunday prayer service from 9:30 AM to 12:00 PM and a
Wednesday prayer/bible study from 6:30 PM to 8:00 PM. The congregation consists of approximately twelve adults
and six children, with occasional guests up to four.

Downtown Specific Plan Consideration
The property is located in the Downtown Specific Plan area and is zoned Downtown Traditional (DT). The
Downtown Traditional zone is intended to support a pedestrian-oriented district full of outdoor dining, visitor
amenities, and a high-quality public realm. Parking is predominantly public and shared. Churches are a permitted
use in the DT zone, subject to a Conditional Use Permit.
General Plan Consideration
In reviewing any new project, the Commission must consider the request in relation to the City's adopted General
Plan. The project is found to consistent with the following goals and policies of the General Plan.
Land Use Element Goal LU-1
Encourage orderly growth and development as envisioned by community residents.
Land Use Element Goal LU-2
Protect existing neighborhoods and the area's natrual surroundings by encouraging development that is
compatible with the City's small-town character.
Prior to approving a Conditional Use Permit, the Commission must make the following findings:
1. That the proposed design and location of the conditional use and the conditions under which it will be operated
are in accordance with the purpose of the Development Code, the zoning regulations applicable to the site, the
City of Twentynine Palms General Plan, and other applicable development policies and standards of the City.
The project is located at an existing commercial property in the Downtown Traditional (DT) zoning district.
Churches are a permitted use in the DT zone, subject to a Conditional Use Permit.
2.The the proposed design and location of the use, and the conditions under which it will be operated, will not be
detrimental to the public health, safety or welfare or materially injurious to uses, properties or improvements in the
vicinity.
The project is proposed to operate from an existing commercial structure. The property is located in area
developed with retail businesses, services uses and professional offices. The use of the property as a church will
not be detrimental to the health, safety or welfare of the public.
3.That the proposed site is adequate in size and shape to accommodate the use and integrate it with the existing
and planned uses in the vicinity.
The applicant is requesting a change in use for an existing building. There are no additions of square footage
proposed to occur at the location. The project has existing parking on site adequate to meet the needs of the
church.
ENVIRONMENTAL:
The project is exempt from CEQA pursuant to Section 15301, Existing Facilities.
ALTERNATIVES:
1. Request additional information and postpone the hearing to a date certain.
2. Deny the request for a Conditional Use Permit

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TWENTYNINE PALMS, CALIFORNIA, APPROVING CUP23-000003, A
CONDITIONAL USE PERMIT FOR THE CHANGE OF USE OF AN EXISTING
COMMERCIAL STRUCTURE TO A CHURCH LOCATED AT 6386 ADOBE
ROAD, TWENTYNINE PALMS, CA 92277.
WHEREAS, on March 07, 2023, an application was received from Titus R Burns, on
behalf of Truth Tabernacle Church, requesting approval of a Conditional Use Permit for the
change of use of an existing commercial structure to a church located at 6386 Adobe Road,
Twentynine Palms, CA 92277, also identified as APN: 0618-252-17; and
WHEREAS, the land use designation (zoning) for the subject property is presently
Downtown Traditional (DT); and
WHEREAS, a church is a permitted use within the Downtown Traditional zone with
approval of a Conditional Use Permit; and
WHEREAS, Pursuant to Section 15301(a) (Class 1) of the CEQA Guidelines, the
project, the change of use of an existing structure, does not have the potential to have an
adverse impact upon the environment and is, therefore, Categorically Exempt from further
environmental review; and
WHEREAS, the Planning Commission finds on the basis of the whole record before it
(including the review of CEQA requirements and any comments received) that there is no
substantial evidence that the project will have a significant effect on the environment and that
this determination reflects the Planning Commission’s independent judgment and analysis: and
WHEREAS, the project is consistent with the applicable General Plan designation and
all applicable General Plan policies as well as with applicable zoning designation and
regulations, with adherence to the recommended Conditions of Approval; and
WHEREAS, the site can be adequately served by all required utilities and public
services; and
WHEREAS, the public hearing notice for CUP23-000003, a Conditional Use Permit was
published in the Desert Trail, a newspaper of record, on May 03, 2023; and

WHEREAS, a notice was mailed to all property owners located within 300 feet of the
project site on or before May 03, 2023; and
WHEREAS, in accordance with California Government Code Section 65350 et. Seq. and
California Government Code Section 65853 et. seq., the Planning Commission held a public
hearing pursuant to the notice required by law; and
WHEREAS, a Public Hearing was held by the Planning Commission on May 16, 2023,
at which time the Commission adopted Planning Commission Resolution No. 23-__ approving
CUP23-000003, a Conditional Use Permit for the change in use of an existing commercial
structure to a church located at 6386 Adobe Road, Twentynine Palms, CA 92277, APN 0618-
252-17; and
WHEREAS, with respect to the Conditional Use Permit, the Planning Commission
makes the following Findings:
A. That the proposed design and location of the conditional use and the
conditions under which it will be operated are in accordance with the purpose of

CONDITIONS OF APPROVAL
CUP23-000005, A Conditional Use Permit (CUP) for the change of use of an existing
commercial structure to a church located at 6386 Adobe Road, APN: 0618-252-17.
GENERAL
G1. All conditions are continuing conditions. Failure of the applicant and/or operator to comply
with any of the said Conditions at any time may result in the revocation of the Conditional
Use Permit and/or citation for code violation.
G2. The applicant and applicant’s successor in interest shall be responsible for payment of all
applicable fees, including reimbursement for all city expenses in ensuing compliance with
the Conditions of Approval.
G3. The applicant shall provide a signed copy of the Conditions of Approval to the Planning
Division within ten (10) days of approval.
G4. The applicant shall, at its sole cost and expense, indemnify, defend (with counsel selected
by the City), release, and hold harmless the City and any agency or instrumentality
thereof, including any of its officers, employees, commissions, and agents (hereinafter the
“Indemnities”), from and against any and all claims, actions, or proceedings, of any type or
nature, arising out of or in any way relating to the processing and/or approval of this
Project. The obligations set forth in this Condition shall include, but not be limited to, suits,
damages, judgments, costs, expenses, liens, levies, attorney fees or expert witness fees
that may be asserted by any person or entity against the Indemnitees, arising out of or
relating to the processing or approval of this Project, without regard to any allegations of
fault on the part of the Indemnities. In the event the obligation to defend or indemnify the
Indemnitees as set forth herein should arise, upon demand by the Community
Development Director the applicant shall within 10 calendar days, deposit an amount with
the City which the Community Development Director reasonably deems necessary to
secure such obligation. This deposit may be used by City to pay the defense or
indemnification obligations arising hereunder; and, further, should any such amounts be
utilized by the City the deposit shall be replenished by the applicant within 10 calendar
days of any demand by the Community Development Director to do so. The amount of the

deposit required hereunder may be increased or decreased at any time by the Community
Development Director, in his discretion, based upon his determination as to the funds
reasonably necessary at any given time to ensure compliance with the obligations hereof,
and any demand to increase the deposit shall be complied with within 10 calendar days.
Any amounts deposited and ultimately not utilized shall be returned to the applicant.
G5. The Applicant shall ascertain and comply with requirements of all Federal, State, County
and Local agencies as are applicable to the proposed project.
G6. The applicant shall maintain a current City business license.
PLANNING
P1. Conditional approval is granted by the Planning Commission, acting as the Approval
Authority, for the change of use of an existing commercial structure to a church located
at 6386 Adobe Road, and also identified as APN: 0618-252-17.
Approval Date: May 16, 2023
Expiration Date: May 16, 2025
P2. This Conditional Use Permit shall be null and void if construction/occupancy has not
commenced within two (2) years of the date of approval. Extensions of time may be
granted by the Planning Division, in conformance with the City of Twentynine Palms
Development Code. The applicant is responsible for the initiation of an extension
request.
P3. The property owner/applicant shall keep the property neat, clean, and in good physical
condition including open spaces, sidewalks, lighting, driveways, parking areas, and
landscaping.
P4. All outdoor lighting shall conform to Development Code Chapter 19.78 (Lighting
Standards) and shall be designed to not glare or reflect onto neighboring properties or
public rights-of-way. Outdoor lighting shall be shielded and limited to that required for
security and safety purposes.
P5. The applicant shall install a trash enclosure sized to accommodate a trash container,
recycling container, and organics recycling toter in conformance with Chapter 19.92 of
the City’s Development Code. The trash enclosure shall be ADA compliant with
pedestrian access.
BUILDING AND SAFETY
B1. Property shall be in compliance with Title 24 ADA requirements. Applicant shall install
the following ADA improvements:
1. One van accessible parking stall with proper striping and signage.
2. Path of travel to all areas of the facility shall be of a level and secure surface.

3. Applicant shall provide documentation that exterior doors are in compliance with
ADA requirements.
4. Applicant shall provide documentation that all restrooms are ADA compliant.
B2. Applicants shall obtain permits from the Building Division for any proposed
improvements.
B3. The site shall be developed in compliance with the approved plans on file and with all
adopted City regulations.
B4. All plans shall be designed by a CA licensed engineer or architect and shall be in
compliance with the California Building Codes as adopted by the City of 29 Palms.
B5. The maximum occupant load of the structure is 116.
FIRE DEPARTMENT
F1. Prior to any construction, the applicant shall contact the San Bernardino County Fire
Department for verification of current fire protection requirements and plan check.
F2. All construction and activities shall comply with the Uniform Fire Code and all other
state, county, and city ordinances, rules and regulations regarding fire protection.
F3. Street addresses shall be posted with numbers a minimum height of four (4) inches.
Posted numbers shall contrast with their background and be visible and legible from the
street.

This letter is to provide a project description for proposed services for Truth Tabernacle. Truth
Tabernacle services are as follows:
Wednesday prayer/Bible study 6:30 p.m. to 8:00 p.m.
Sunday prayer/Service 9:30 a.m. to 12:00 p.m.
We are a small congregation of twelve adults and six children. We also have visitors
occasionally, which on average is about two to four on Wednesdays or Sundays.
