MONDAY, October 9, 2023 – TWIN VALLEY CITY COUNCIL REGULAR MONTHLY MEETING Twin Valley Community Center – 7:00 PM MEMBERS: Paul Bekkerus, Michael Bolton, Tracy Christianson, Mike Lampton STAFF: Douville, Nysetvold. OTHERS: Prestin Douville, Connie Hamernik, Cindy Julin PURSUANT DUE TO CALL and notice thereof the Twin Valley City Council held its regular monthly meeting on Monday, October 9, 2023. Mayor Bolton called the meeting to order at 7:00PM. ADDITIONS TO AGENDA—Bekkerus requested the Council add discussion in regards to City street signage to the agenda. ML/TC-m/s/p to approve. The majority of the land is currently owned by the City of Twin Valley, with a small portion of the right of way belonging to Norman County. The County has agreed to grant the City a utility permit to pass through this area. Certificate was approved and signed by Mayor Bolton. DILAPIDATED PROPERTIES—Clerk was approached by the owners of both 201 Pleasant Ave SW and 204 Norman Ave NW in regards to options for these vacant properties. Both properties are in disrepair and in violation of Twin Valley City Ordinance Chapter 92: Health and Safety; Nuisances. Council was not opposed to the property being donated to the City to take care of, however, were uninterested in purchasing said properties due to the amount of funding it will take to abate the nuisances as is. Brief discussion on creating a demolition fund for these type projects going forward. PUBLIC WORKS—2006 Sterling L-8511 Snow Plow truck was purchased, invoice totaling $47,751.25 was paid from the General Capital fund. Will need to move funding around in November from the Public Works CD’s once they mature. Bekkerus addressed concerns with missing and dull street signs in town, specifically the street sign at the corner of Highway 32 and Cleveland Ave SW and the yield sign next to the Zion Lutheran Church. Clerk will review all street signs in town and ensure any missing/faded signs get ordered and replaced. EDA/PARKS—No committee meeting held. Clerk requested permission to purchase dog waste stations for Heiberg Park after receiving complaints. ML/TC-m/s/p to approve purchasing four. LIQUOR—Gross sales for September $51,815.02, ATM revenue $668.50. Current cash basis shows profit of $10,883.09 for the year as of 09/30/2023. Nysetvold updated council on events, has been staying open on Sunday for Vikings Games. Will have a final steak night on 10/13. Halloween and hunting events are planned. Prior to meeting Nysetvold and the Liquor Committee (Christianson and Askelson) were given a proposed cannabis use policy for the liquor store property to review and ultimately approve. Councilmember Christianson motioned to adopt policy as presented, seconded by Councilmember Lampton the following resolution was passed. RESOLUTION 2023—20 WHEREAS, the City Council of the City of Twin Valley is committed to assuring that the environment in its municipal liquor store is safe and comfortable for the general public; and WHEREAS, the use of marijuana on public property creates a nuisance, marijuana smoke may dissipate into common areas interfering with others health, property and expectation of clean are and a drug free environment. THEREFORE, BE IT RESOLVED BY THE TWIN VALLEY CITY COUNCIL that recreational cannabis use will not be allowed on city owned property, including but not limited to the Twin Valley Liquor Store building, smoking shelter, and/or public parking area and grounds. 4 WHEREUPON said resolution was duly adopted this 9th day of October, 2023. Nays—none. ___________________________________________________ _____________________________________________________ RACHEL JOHNSON, CLERK-TREASURER MICHAEL BOLTON, MAYOR Nysetvold has taken and passed her food safety licensing test. Noted the fryer is back up and operational and has ordered new clothing merchandise that should arrive in time for hunting season. POLICE—Council given current recreational vehicle ordinance for the City of Twin Valley, Chapter 73 to review. Douville and Johnson suggested adding additional regulation for golf carts that would require a licensed driver to be in the vehicle if driven on city streets. Councilmember Lampton motioned to approve this addition to the ordinance and begin the process of adopting an amendment to Chapter 73 of the City Code. Motion was seconded by Councilmember Bekkerus and the following resolution was passed. RESOLUTION 2023—21 A RESOLUTION AMENDING ORDINANCE 73 RECREATIONAL AND OTHER VEHICLES, SECTION 08 MOTORIZED GOLD CARTS TO ADD ADDITIONAL REGULATIONS AND LANGUAGE The City Council of the City of Twin Valley ordains that Chapter 73 Section 8 of the Twin Valley City Code shall be amended to include the following: §73.08 (A)(14) Persons operating a golf cart on city streets must either be at least sixteen (16) years of age and holding a valid driver’s license recognized by the State of Minnesota and/or accompanied by a responsible licensed adult. This Ordinance shall be in full force and take effect from and after its passage and publication of the Ordinance or a summary of the Ordinance as provided by law. WHEREUPON said resolution was duly adopted this 9th day of October, 2023. Ayes—Mark Askelson, Paul Bekkerus, Michael Bolton, Tracy Christianson, Mike Lampton. Nays—none. ___________________________________________________ _____________________________________________________ RACHEL JOHNSON, CLERK-TREASURER MICHAEL BOLTON, MAYOR Douville updated Council on the new squad vehicle progress. Currently waiting on stickering and equipment installation, which may take as long as 3-4 months. Still looking to fill the full-time officer position, no interest has been received. FIRE/RESCUE—Lampton reported 1 fire and 8 rescue calls. Noted that EMR classes are starting this coming weekend. FINANCIALS—September financial statements distributed to Council for review, no questions addressed. Clerk requested Council set a Cost-of-Living percentage for 2024 to help with the budgeting process. There was a consensus to start with a 2.5% increase and determine at a later time if that will be feasible. ORDINANCE—Council heard no comments or concerns on proposed rate increase for 2024. Will have a final reading in November with the rate change becoming effective as of January 1. Council reviewed possible public cannabis use ordinance for the City, ultimately deciding to wait to see where the State legislature move going forward before taking any actions. GAMING PERMIT—PB/ML-m/s/p to approve LG220 Gaming Permit for the Wild Rice Conservations Club supper to be held January 27, 2024 in the Twin Valley Community Center. 5 Meeting adjourned 8:02PM, TC/PB-m/s/p.
