Planning Commission Regular Meeting

Town of Tyrone Planning Commission Minutes May 9, 2013 Present: Gordon Shenkle, Chairman David Nebergall, Vice Chairman Judy Jefferson, Commissioner Michael Sanak, Commissioner Patrick Stough, Town Attorney Dina Rimi, Zoning and Development Coordinator Absent: Chris Wigginton, Commissioner Kyle Hood, Town Manager Call to Order Chairman Shenkle called the meeting to order at 7:05 pm. Approval of Agenda Commissioner Sanak made a motion to approve the agenda. Vice Chairman Nebergall seconded the motion approved 3-0. Approval of Minutes – April 25, 2013 Commissioner Jefferson thanked Ms. Rimi for doing a wonderful job on the minutes, since at the end of the April 25, 2013 meeting it was a bit confusing. Commissioner Jefferson made a motion to approve the minutes. Commissioner Sanak seconded the motion; approved 3-0. Old Business 1. Discussion on zoning and conditions for Personal Care Home. Ms. Dina Rimi introduced this item by informing the Planning Commission that this item was discussed at the April 25, 2013 Planning Commission meeting. Attorney Stough presented the information that the Planning Commission requested at the April 25, 2013 meeting. Commissioner Jefferson made a motion to have this item on the May 23, 2014 Planning Commission agenda as a Public Hearing, Text Amendment item. Vice Chairman Nebergall seconded the item; approved 3-0 2. Discussion regarding Article I Section 1-2 Definitions; item Livestock Ms. Dina Rimi introduced this item by informing the Planning Commission this item was voted on by Mayor and Council in a text amendment at the March 21, 2013 Council Meeting. The Mayor and Council at the March 21, 2013 meeting requested that the Planning Commission re-evaluates the definition in place. The Planning Commission discussed the current definition and regulations in place for livestock and suggested that chickens be added to the definition for kennels and removed from the definition of livestock. The Planning Commission then requested that roosters be added to the definition of livestock. Commissioner Jefferson made a motion to have this item as amended on the  May 23, 2014 Planning Commission agenda as a Public Hearing, Text Amendment item. Commissioner Sanak seconded the item; approved 3-0 Staff Comments Ms. Rimi informed the Planning Commission that recently an applicant for an Occupational Tax Certificate questioned if an Art Studio could be located in an M-1 zoning. After a brief discussion the Planning Commission requested that Ms. Rimi have a text amendment to allow Art Studios in the M-1 zoning at the May 23, 2013 Planning Commission meeting.
