Town of Tyrone Planning Commission Minutes August 28, 2014 Present: Gordon Shenkle, Chairman David Nebergall, Vice Chairman Wil James, Commissioner Judy Jefferson, Commissioner Kyle Hood, Town Manager Patrick Stough, Town Attorney Dina Rimi, Zoning and Development Coordinator Call to Order: Chairman Shenkle called the meeting to order at 7:00 p.m. Approval of Agenda Vice Chairman Nebergall made a motion to approve the agenda with the removal of item 6. Commissioner James seconded the motion; approved 3-0 Approval of Minutes- July 24, 2014 Commissioner James made a motion to approve the minutes with corrections. Commissioner Jefferson seconded the motion; approved 3-0. Public Hearings 1. Consideration of Text Amendment ( TA 2014-06) to the Tyrone Zoning Ordinance Article VII § 7-1 B Conditional Uses to establish condition for the following uses; Outdoor Sports Facility and Swimming Pool Mini Golf Tennis Courts Automotive Parking Establishments Golf Cart Sales Ms. Rimi explained that this is a continuation of the staff reviewing the zoning ordinance for items that may be in conflict or may need to be amended. Chairman Shenkle opened up the Public Hearing to anyone in favor None Chairman Shenkle closed the Public Hearing to anyone in favor Chairman Shenkle opened the Public Hearing to anyone in opposition None Chairman Shenkle closed the Public Hearing to anyone in opposition Chairman Shenkle opened the floor to commission comments. Mr. Hood explained that the Town of Tyrone tennis courts are open till 11:00 p.m. and he felt that it would be best to change item (d) to No outdoor activities after 11:00 p.m. Commissioner James made a motion to recommend approval to the Mayor and Council with the changes to item (d). Commissioner Jefferson seconded the motion approved 3-0. 2. Consideration of Text Amendment (TA 2014-007) to the Tyrone Zoning Ordinance Article V Downtown Commercial § 5-14 (A) Permitted Uses and (B) Conditional Uses. a. Establish General Building Contractors, Hardware Sales, Special Trade Contractors and Indoor Sports Facilities as a permitted use. b. Establish Dog Grooming, Electric Transformer Stations, Gas regulator Stations and Telephone Exchanges, Health club, Day Spa and Outdoor Sports Facility as conditional uses. Commissioner Jefferson made a motion to recommend approval to the Mayor and Council for item (b) to establish Dog Grooming, Electric Transformer Stations, Gas regulator Stations and Telephone Exchanges, Health club, Day Spa and Outdoor Sports Facility as conditional uses. Commissioner James seconded the motion; approved 3-0. 3. Consideration of Text Amendment (TA 2014-08) to the Tyrone Zoning Ordinance Article V § 5-15 Highway Commercial (A) Permitted Uses to establish Landscaping services as a permitted use. Ms. Rimi explained that this is a continuation of the staff reviewing the zoning ordinance for items that may be in conflict or may need to be amended. Chairman Shenkle opened up the Public Hearing to anyone in favor None Chairman Shenkle closed the Public Hearing to anyone in favor Chairman Shenkle opened the Public Hearing to anyone in opposition None Chairman Shenkle closed the Public Hearing to anyone in opposition Chairman Shenkle opened the floor to commission comments. Commissioner James made a motion to recommend approval to the Mayor and Council. Commissioner Jefferson seconded the motion; approved 3-0. New Business 4. Consideration of Landscape Plan for Multi-Purpose Building located on the campus of Dogwood Church - Beth Vaughn- Environmental and Planning Technician Ms. Rimi explained that the staff has reviewed the landscaping plans for the Multi- Purpose Building and the plans meets all to the Town’s requirements as stated in The Town of Tyrone’s Code of Ordinances and approval is recommended. Applicant, Mr. Mike Lorber explained that the landscape plan is in compliance with the town’s regulations. Currently during construction there has been some currently landscaping that was disturbed and the company will be fixing these areas. Commission Jefferson stated that the church has done a beautiful job with the present landscaping. Commissioner Jefferson made a motion to approve the landscape plans as submitted. Vice Chairman Nebergall seconded the motion; approved 3-0. Staff Comments Ms. Rimi recommended that the September 11, 2014 meeting be cancelled due to lack of agenda items. Commissioner Comments Commissioner James asked when the repaving of the intersection of Highway 74 and Tyrone Road will be done. Mr. Hood explained that C. W. Matthews will be working on this after Labor Day.
