APPROVAL OF AGENDA A motion was made to approve the agenda with the removal of item number 7. Motion made by Council Member Campbell, Seconded by Council Member Hill. Voting Yea: Council Member Howard, Council Member Furr. VI. CONSENT AGENDA: All matters listed under this item are considered to be routine by the Town Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. 1. Approval of the April 20, 2023 minutes. 2. Approval of Christ Church's open to the public Dessert and Yard Games in the Park every Wednesday in June and July at Shamrock Park from 6:00 pm - 8:00 pm. Consideration to recommend approval of a text amendment to section 113-10 of Article 1 of the Zoning Ordinance regarding appeals of zoning administrator decisions. Phillip Trocquet, Community Development Mr. Trocquet shared that the following three text amendments were being pursued in response to Georgia House Bill 1405 which became effective on July 1, 2022. HB 1405 was intended to clarify the process for appeals of zoning decisions and disputes with local governments. He added that it was an administrative change in response to State HB 1405. The attached ordinance changes reflected the appropriate response for the Town’s compliance with the new State Law and were drafted by our legal department. He stated that staff recommended approval and that the Planning Commission also recommended approval on April 27th. He stated that the ordinance needed to be enacted by July 1, 2023. Motion made by Council Member Furr, Seconded by Council Member Campbell. Voting Yea: Council Member Howard, Council Member Hill. IX. OLD BUSINESS X. NEW BUSINESS 6. Consideration to Award the demolition of the Garage at 881 Senoia Road to Crawford Grading and Pipe, Inc. for $8,110.00. Scott Langford, Town Engineer / Public Works Director Mr. Langford informed Council that during a recent storm, a large tree fell on the 3-bay garage which took it to the ground. The demolition would also include the removal of electrical service. He added that an insurance claim had been filed through the Georgia Interlocal Risk Management Agency (GIRM). GIRM was sending the check that week. The low quote was for $8,110.00 from Crawford Grading and Pipeline, Inc. Council Member Howard asked when it would take place, the Museum anniversary was going to be on May 13th. Mr. Langford stated that he would ask but doubted that it would be removed before the celebration. He also added that the garage would be rebuilt for additional storage for Recreation, Library, and Museum. Council Member Campbell asked if GIRM was also paying for the rebuild. Mr. Langford stated that yes, it would also include the reconstruction and that quotes were required. There would also be a claim filed for the damaged contents of the garage. Council Member Furr asked if the old Veterans Park bricks were still inside the garage. Mr. Langford stated that he would check. He confirmed that the unused Veteran bricks that were outside had been relocated. A motion was made to award the demolition and removal of the garage at 881 Senoia Road to Crawford Grading and Pipe, Inc. for $8,110.00. STAFF COMMENTS Page 3 of 5  Mr. Perkins stated that it was National Clerk’s Week and recognized Ms. Baker for her work. She stated that it was a pleasure being part of the team. Mr. Perkins announced that the recently approved radios for public works had been delivered. He also shared that the baseball scoreboards that had been ordered several months ago were due around May 2-9, he would place a call to confirm tomorrow. Mr. Perkins stated that the pickleball grading proof roll for one court would be tomorrow. Hopefully, the proof roll would show promise after the approval of the removal of the unforeseen buried concrete. Mr. Perkins also announced that approximately 100 Birch Elementary students would arrive around 9:00 am at Town Hall along with teachers and chaperones. They have been learning about civics. He added that teachers had given him a few topics to speak on, and it should be a fun time. He ended by announcing the DDA’s first, First Friday event tomorrow night at Shamrock Park. The entertainment would be The Mowtowners, a well-known act. There would also be retail vendors and food trucks. He invited everyone to attend. Mr. Trocquet announced that the Gator that had been ordered arrived, and already had dirt on it. XIII. COUNCIL COMMENTS Council Member Howard announced that the Museum’s second anniversary would take place on May 13th beginning at 9:00 am with a Car Show. She invited everyone to attend. Mayor Dial congratulated the citizens of Tyrone for showing up to vote in the District 68 Special Election. Our numbers exceeded all of Fayette County and Fulton County (relatively). He added that the polls would be open through May 16th. XIV. EXECUTIVE SESSION A motion was made to move into Executive Session for one real estate item.
