Town of Tyrone Council Meeting Minutes February 5, 2015 Present: Mayor Eric Dial Council Member Ken Matthews Council Member Ryan Housley Council Member Linda Howard Town Manager Kyle Hood Town Clerk Dee Baker Town Attorney Dennis Davenport Mayor Pro Tem Gloria Furr was absent. Mayor Dial called the meeting to order at 7:00 p.m. The Invocation was given by Mayor Dial, followed by the Pledge of Allegiance. Public Comments Approval of Agenda Council Member Matthews made a motion to approve the agenda. Council Member Howard seconded the motion. Motion was approved 3-0. CONSENT AGENDA: All matters listed under this item are considered to be routine by the Town Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. Approval of Minutes, January 15, 2015 Consideration and action on approval of a contract with Tyrone Youth Baseball Association. Council Member Housley seconded the motion. Motion was approved 3-0. Page 1 of 4 PRESENTATIONS/RECOGNITION: PUBLIC HEARING: Consideration and action on Resolution adopting Fayette County Fire Services Impact Fee Report. Kyle Hood, Town Manager Mr. Hood stated that each year the Town works with Fayette County, Brooks and Woolsey to submit information to the Department of Community Affairs. He added that for the first time there have been changes to projects and pricing in the Capital Improvement Element. The Town has phased out a few older projects and included several new projects, such as road resurfacings and cart path extensions. This process has two phases. He stated that once Council has approved the tables and resolution, the information will be sent to Fayette County’s Planning and Zoning Director, Pete Frisina. There will be a follow-up to the report in May or June including the Fayette County Fire Impact Fee. He ended by stating that a public hearing will now take place for the Short Term Work Program and Capital Improvement Elements for FY 2015-2019. Mayor Dial opened the public hearing for anyone that wished to speak in favor of this item. No one spoke. Mayor Dial asked for anyone in opposition to speak. No one spoke. Council Member Matthews made a motion to approve the Transmittal Resolution adopting Tyrone’s Capital Improvement Element and Short Term Work Program. Council Member Housley seconded the motion. Motion was approved 3-0. OLD BUSINESS: NEW BUSINESS: Public Comments Staff Comments Chief Brandon Perkins stated that his department was offered the opportunity to apply for a federal grant to fund a generator for the Police Department. He asked Council’s permission to authorize the Mayor to sign the paperwork to send to the Georgia Emergency Management Association for the final consideration of project. Council Member Housley made a motion to have Mayor Dial sign the final grant paperwork to be sent to the Georgia Emergency Management Association for the funding of a new Police Department generator. Council Member Howard seconded the motion. Motion was approved 3-0. Page 2 of 4 Mayor Dial stated that he was told earlier that day that Ms. Anderson wished to speak. He stated that both public comment sections were announced. He stated that he would detour from the agenda and allow Ms. Anderson to speak for the allotted three minutes. Ms. Winnie Anderson, who lives at 100 Farr Lake Drive, stated she was there to speak about a problem that she has had for years. Ms. Anderson stated the she noticed the “state of the art monstrosity” construction on Friday. She added that it is located on the west-side of Farr road, directly across the street from her property. Ms. Anderson stated that the reason she was there is due to the letter she had received from Mr. Hood. Channel 2 received an email stating that the Town has worked with her and added that that is not the truth. Ms. Anderson stated that she is extremely displeased about everything Tyrone has done. She added that they (the Town) have never done anything to benefit her. She has been abused all along. She stated that she purchased the home in 2000 and was the first person in the home. John Wieland homes was not there (across the street). The upper does not have the right to drain water on the lower if you know that you will cause that person some harm. She stated that she has asked the Town of Tyrone to enforce the law that would require John Wieland to send his water back on his subdivision, because that is what “he” said and it has never been done. She added that when she asked Barry Amos to assist her because she was getting trickles of water in her yard, nothing was done to assist her. Ms. Anderson stated that large pipes were installed and she called Channel 2 News this time because she wanted the whole state of Georgia to see the mess that the Town of Tyrone created. Ms. Anderson added that she has no ditch. She stated that she gets water from John Wieland, from the right side, from the left side and across the street. Ms. Anderson stated that she came to Town Hall on Monday morning at 5 minutes till 8:00 to discuss the monstrosity that was created on Friday. She added that since back in 2000 (has to check records) when the City Council voted unanimously not to do anything there has been a problem. She stated that there is a hole in her yard and water goes over the silt fence. She stated that she will be writing a certified letter addressing everything. Mayor Dial stated that he has looked into this personally, and much of what Ms. Anderson has stated is not factual; and is purely speculative. It is contrary to what many highly trained engineers have assured the Town. He stated that in five years the Town has not heard a word from her, other than hearing from Channel 2. Mayor Dial asked Ms. Anderson that if she has any information to the contrary of the Town’s findings, please do not hesitate to schedule a time to meet with staff. Mayor Dial asked Ms. Anderson that she show the common courtesy of communicating with the Town directly rather than through Atlanta media. Council Comments Council Member Matthews asked that the Town look into the situation and go from there. Page 3 of 4 Executive Session Pursuant to O.C.G.A § 50-14-4 (b) of the Open and Public Meetings Act, Council will meet in Executive Session for one (1) item of pending litigation and one (1) item of threatened litigation. Council Member Howard made a motion to move into Executive Session for one item of pending litigation and one item of threatened litigation. Council Member Matthews seconded the motion. Motion was approved 3-0. Council Member Matthews made a motion to reconvene. Council Member Howard seconded the motion. Motion was approved 3-0.
