AN ORDINANCE ESTABLISHING A NEW CHAPTER 220 6 (BUSINESS, RENTAL PROPERTY, AND MULTI-FAMILY 7 PROPERTY INSURANCE REGISTRATION) OF THE CITY CODE 8 GOVERNING INSURANCE CERTIFICATE REGISTRATION FOR 9 CERTAIN BUSINESSES AND RENTAL AND MULTI-FAMILY 10 PROPERTIES PURSUANT TO P.L. 2022, C. 92.) 11 12 MS. ROSARIO: There are three ordinances 13 for introduction. Adoption on first reading 14 authorizes the Municipal Clerk to advertise the 15 ordinance with a notice of the introduction, 16 together with a notice of the time and place when 17 the ordinance will be considered for final 18 passage. The ordinances will be further 19 considered at a meeting of the Board of 20 Commissioners to be held on Tuesday, January 24, 21 2023, at the Bella Vista Apartments, 522 22nd 22 Street. 23 The first ordinance is an ordinance 24 establishing a new Chapter 220 (business, rental 25 property and multi-family property insurance  6 1 registration) of the city code governing insurance 2 certificate registration for certain businesses 3 and rental and multi-family properties pursuant to 4 public law 2022, C. 92. Motion to introduce? 5 MAYOR STACK: Angelo, can you just give 6 a brief explanation on this? 7 MR. AUTERI: Absolutely, Mayor. So this 8 ordinance is to codify a new statutory requirement 9 for insurance. There's two categories, one will 10 be the commercial buildings and the larger 11 residential buildings, multi-unit buildings, which 12 will have a $500,000.00 casualty insurance 13 requirement per occurrence. There's also a 14 secondary requirement for $300,000.00 worth of 15 coverage per occurrence for the smaller 16 owner-occupied residential buildings. 17 And what the City's going to do is 18 charge a $25 administrative fee to process, it 19 will be an annual requirement. We'll require the 20 certificate to be filed with the Clerk's office. 21 And the penalty for noncompliance will be a 22 $500.00 fee. 23 MAYOR STACK: We'll send out a mailing 24 on this to everyone, just to make sure they know 25 this is taking place?  7 1 MR. ORDINANCE AMENDING ARTICLE III SECTION 92 23 REQUIRING SURVEILLANCE CAMERAS FOR SENIOR CITIZEN 24 FACILITIES.) 25  8 1 MS. ROSARIO: The second ordinance is 2 ordinance amending Article III, Section 92 3 requiring surveillance cameras for senior citizen 4 facilities. 5 MAYOR STACK: This is real important. 6 So we have an ordinance on the books right now. 7 Angelo will just go into a little more detail. 8 MR. AUTERI: So back in 2012, the City 9 adopted an ordinance which required surveillance 10 cameras in certain places within senior 11 facilities, which is defined as buildings with 12 20 units or more that house citizens who are 13 62 years of age or older. And what this amendment 14 to the ordinance will do is require the security 15 camera plan to be submitted to the police 16 department for approval. And we've also extended 17 the camera requirement to stairwells and hallways. 18 MAYOR STACK: That's good. This is 19 something that's very much needed. This is 20 something we did a number of years ago, we'll 21 strictly enforce it. Just so all you know the 22 camera coverage is for seniors to protect them. 23 This is another issue that came up in the summer, 24 when we were at the Bella Vista. ROSARIO: The third ordinance is an 2 ordinance amending Chapter 311 property 3 maintenance. 4 MAYOR STACK: Angelo, if you can just 5 explain that also. 6 MR. AUTERI: Absolutely, Mayor. So this 7 ordinance again is to codify a new statutory 8 requirement. This one will authorize and enable 9 the City to place a lien on foreclosed and vacant 10 properties that don't pay this registration fee. 11 So just briefly, a foreclosed property will have a 12 $500 annual requirement. If that foreclosed 13 property is also determined to be vacant, there 14 will be another $2,000 annual registration fee. 15 And then the failure to pay that fee would enable 16 the City to actually place it as a lien on the 17 property by ordinance. 18 And, additionally, the statute also 19 requires out-of-state banks and note holders to 20 designate an in-state entity to make it easier for 21 us to communicate with them. 22 MAYOR STACK: Great. 23 MS. Number one is 8 an ordinance amending Chapter 301 of the Code of 9 the City of Union City entitled "Peddling and 10 Soliciting" setting forth permitted hours of 11 operation. 12 Mayor, would you like to take public 13 comment on the ordinance? 14 MAYOR STACK: Sure, anyone wishing to 15 comment on this ordinance at this time, please 16 step forward, state your name and address for the 17 record. Angelo, if you can just go into a little 18 detail on this, that would be great. 19 MR. AUTERI: Sure, Mayor. With this 20 ordinance, we're going to prohibit the operation 21 of food trucks outside of the hours of 11 p.m. to 22 7 a.m. 23 MAYOR STACK: So the issue that we're 24 having -- the issue that we're having is that we 25 have these vendors outside there in the streets  22 1 until 1, 2, 3 o'clock in the morning. And then 2 they're leaving the vehicle on the street at 3 night. And it just makes another place where it 4 could be vandalized, it's become very problematic. 5 While we want to see the vendors succeed and 6 prosper, we just want them also to obey the laws 7 and close at a certain time and not become an 8 attraction for other activities that could 9 possibly take place in the streets at nighttime. 10 We're just trying to keep the community safe. And 11 most importantly, keep the good quality of life 12 that we've been able to bring to it, along with 13 the Board of Commissioners that we worked hard on. 14 We're just looking for these vendors to cooperate 15 and work with us. 16 MS.
