16 MS. ROSARIO: The next item is the
17 ordinance for introduction. Adoption on first
18 reading authorizes the municipal clerk to
19 advertise the ordinance with a notice of the
20 introduction, together with a notice of the time
21 and place when the ordinance will be considered
22 for final passage. The ordinance will be further
23 considered at meeting of the Board of
24 Commissioners to be held on Tuesday, August 8,
25 2023, at the Robert Waters School, 2800 Summit

1 Avenue in Union City.
2 The first item is an ordinance amending
3 Chapter 171 entitle "fire prevention" restricting
4 open burning throughout the City of Union City.
5 May I have a motion to introduce?
6 MAYOR STACK: I'll make a motion. This
7 is important because this would be any type of,
8 Angelo, you can correct me, restriction on fire
9 pits and things like that, also on top of roofs in
10 the City, which is a big concern. It was brought
11 to my attention by the construction code official
12 that the boards may be approving some of this and
13 it's very dangerous to have a fire on the roof of
14 the building. If something happens, the amount of
15 danger to the residents that live in the building
16 and the surrounding area. I don't know if you
17 wanted to add anything?
18 MR. AUTERI: That's right on the mark,
19 Mayor. And this ordinance in particular will
20 amend our prior open flame ordinance to specify
21 that the rooftop won't be allowed for any kind of
22 charcoal or open flame burning.

14 MAYOR STACK: This is a brand new --
15 this is a brand new vehicle that Board of
16 Education had purchased, that Tony Vergona had
17 mentioned to me and the Board of Ed couldn't use
18 it as a school bus, so it's a smaller van, a
19 passenger van, brand new. I may even have a
20 picture in my phone, it's 58,000. We're going to
21 buy it exactly from the Board of Ed for what the
22 Board of Ed purchased it. It's got zero miles on
23 it and we'll probably put that in the senior
24 citizens department, which will be helpful when
25 the senior citizens have to be transported.

1 COMMISSIONER VALDIVIA: It's a very nice
2 van.
3 MAYOR STACK: And it's a low step van,
4 which is good for senior citizens to get in and
5 out, very good. It's a smaller van. When they go
6 to Shop Rite, stuff like that, we'll have a second
7 or third one. We've beefed it up, so we have
8 plenty of vehicles, not like where we had before
9 with the broken down vehicles we were dealing with
10 for a long time. The fleet now overall in the
11 City is better than what's it's ever been.
12 COMMISSIONER VALDIVIA: I've driven one.
13 MAYOR STACK: How many passengers?
14 COMMISSIONER VALDIVIA: Fifteen. The
15 senior citizens will be less than that because
16 they need more room and all that.
17 MS. ROSARIO: Seventeen, resolution to
18 approve grant application with the NJ DOT for 2024
19 37th Street (Park Avenue to Hudson, New York
20 Avenue to Bergenline Avenue and Hudson Avenue to
21 Palisade Avenue) and 38th Street (New York Avenue
22 to Bergenline Avenue) roadway improvement
23 projects.
24 Eighteen, resolution authorizing payment
25 to Z-Tech Contracting, LLC, for emergency repair

1 services to Firefighters Memorial Park.
2 MAYOR STACK: Just to go back to number
3 17. This would be doing streetscape on 37th
4 Street, between Park Avenue and Hudson Avenue by
5 the shelter and in that whole block, that would be
6 new sidewalks, new street, and tree planting.
7 Then we would be doing 38th Street from New York
8 Avenue to Bergenline. So we'll be paving this
9 year, Hudson to Palisade, Palisade to New York,
10 and we would continue that from New York Avenue to
11 Bergenline on 38th Street.
12 And then also, we would also do 37th
13 Street would also get paved this year, which we're
14 doing between Palisade and New York Avenue. And
15 we would also be doing 37th Street between New
16 York and Bergenline Avenue. So the whole area
17 would be done around that neighborhood. And
18 that's extra money that we had on a grant that we
19 did very well on the last bid. It was much lower
20 than what we anticipated, so we did an LTIF
21 application and that's what we want to do,
22 transfer that money over.

24 "All Terrain Vehicles, Dirt Bikes and
25 Snowmobiles".

2 an explanation on this one?
3 MR. AUTERI: Sure, Mayor.
4 So this ordinance will prohibit all
5 terrain vehicles, dirt bikes, and snowmobiles from
6 being driven on the City roads. But in addition
7 to that, it also prohibits gas station attendants
8 from filling gas in unregistered vehicle. It also
9 prohibits storage facilities from allowing storage
10 of unregistered vehicles.
11 MAYOR STACK: Excellent.
12 MR. AUTERI: So that's all in an effort
13 to keep these vehicles, which are really not fit
14 for city driving on the roads.
