AN ORDINANCE AMENDING CHAPTER 239 18 “LITTERING” 19 20 ACTING CITY CLERK: Next item is Ordinance 21 for Hearing and Adoption Consideration. 22 First Ordinance, an Ordinance Amending 23 Chapter 239, Littering. 24 MAYOR STACK: Yes, if we could just maybe 25 explain the Ordinance -- what it is?  6 1 MS. de los RIOS: Yes. 2 This is the -- this Ordinance changes the 3 penalties for the littering of noxious fluids. 4 What it does is it increases the fine from 5 $50.00 up to a three -- three level; $500.00 for 6 the first offense, 750 for the second, and a 7 thousand dollars for the third offense. 8 MAYOR STACK: We’ve been having a problem 9 in the City of Union City with some of the 10 garbage haulers that pick up the City’s garbage 11 and also -- that also pick up garbage at private 12 -- at commercial establishments in the City; 13 leaking fluid all of the streets. 14 It’s not only unhealthy but it’s also 15 dangerous. People slip on it. It’s very 16 unsanitary. 17 So, we felt increasing this from just a 18 $50.00 fine -- we’ve had some of the same 19 companies where we issued dozens of summons to 20 and they just pay the $50.00 fine. They feel 21 it’s a cheap way of doing business. 22 We follow some of these garbage trucks; 23 make sure that they have their plugs in the back 24 where the stuff is not able to drip out. So we 25 felt by increasing the penalty we were going to  7 1 show them that we mean business. We don’t want 2 this stuff being left all over the City. 3 So it’s from $50.00 to 500, first offense; 4 750, second offense; a thousand dollars, the 5 third offense. This will be on each violation. 6 Anyone wishing to comment on this Ordinance 7 at this time, please step forward. 8 And this was at the recommendation of Chief 9 Molinari and Lieutenant Loaces who felt that this 10 would be something that would be a step in the 11 right direction. 12 Mr. Price? 13 MS. DILLON: Just step forward, Mr. Price. 14 MR. PRICE: Here? 15 MAYOR STACK: Yeah, right, this one right 16 here. 17 MR. PRICE: Larry Price, 1006 Palisade 18 Avenue. 19 One of the other obnoxious things that 20 happens in this City, too often, is we have 21 people changing their oil at the curb. And of 22 course they end up -- or changing their 23 antifreeze. 24 Will this apply to someone who, you know, 25 drops the oil on the street?  8 1 MAYOR STACK: I believe that it will, 2 Larry. But to make certain -- 3 Chief? 4 CHIEF MOLINARI: Hi, Mayor. 5 MAYOR STACK: Hi, Chief. 6 Chief, Mr. Price -- just to recap what he 7 said, he was wondering -- 8 And it’s a good question. It’s also one of 9 my pet peeves. 10 Where people changing their oil on the 11 street and people, you know, antifreeze -- 12 And you see it too often that people are 13 doing this. In fact, this summer I called out a 14 few times on it. 15 Would the Ordinance that we just applied on 16 littering, would that also apply to them also? 17 Or just to garbage haulers? 18 CHIEF MOLINARI: It would be my 19 interpretation. I believe it just talks about 20 noxious fluids. So I would consider it -- and I 21 guess we can ask legal counsel just to verify. 22 But I would say that it just -- it’s not an issue 23 with the garbage trucks solely; it’s an issue 24 with any noxious fluid being left on the roadway, 25 which creates hazardous condition. You know,  9 1 unsightly, unsanitary conditions. I would say it 2 would also apply to the same and not just 3 isolated to the garbage truck issue. 4 MAYOR STACK: If you can, tomorrow, just 5 check on this; make sure it does apply. 6 CHIEF MOLINARI: Yes. 7 MAYOR STACK: If it doesn’t, let’s get an 8 Ordinance in there and increase the penalty on 9 that -- 10 CHIEF MOLINARI: I’ll do that. 11 MAYOR STACK: -- because it has to be very 12 low also right now. Absolutely. 13 Thank you very much. 14 CHIEF MOLINARI: Absolutely. No problem. 15 MAYOR STACK: It’s a good question. 16 Because it’s all part of the quality of life, 17 something we’re trying to improve, not to have 18 people leaking these fluids all over the City and 19 garbage trucks traveling throughout the City. 20 It’s bad enough we have to keep on a lot of 21 these independent garbage trucks when they throw 22 garbage all over the street. AN ORDINANCE AMENDING CHAPTER 16 VEHICLES 23 TRAFFIC SCHEDULE XIII “BUS/COMMUTER VEHICLES 24 STOPS” 25  12 1 ACTING CITY CLERK: Next Ordinance Amending 2 Chapter 16 Vehicles Traffic Schedule XIII 3 Bus/Commuter Vehicles Stops. 4 MAYOR STACK: Okay. 5 What we’re doing on this -- and I believe 6 is we’re changing one bus stop that’s in front 7 of, I believe, Colin Powell School, at 15th and 8 New York Avenue. And that would be on the 9 northeast corner of 15th and New York Avenue. 10 The Police Department along with numerous 11 parents in the school have spoken to us that the 12 bus stop being so close to the school, pulling 13 over into the location passing the crosswalk has 14 made it dangerous for the children and 15 pedestrians in the area. 16 We’re moving this to 14th and New York 17 Avenue and it would be on the northeast corner of 18 14th and New York Avenue. 19 There really won’t be too much of a loss of 20 parking. Whatever we lose on 14 th Street, we’ll 21 gain on 15th Street. 22 And I believe there’s one other bus stop. 23 MS. de los RIOS: 30th. 24 MAYOR STACK: 30th. 25 MS. de los RIOS: Yeah.  13 1 MAYOR STACK: And the other bus stop was on 2 the 30th. And this actually came from a community 3 meeting. 4 We had a meeting during the summertime up 5 on 29th to 30th on Bergenline Avenue. And we held 6 -- probably this summer the Chief and I probably 7 held 80 community meetings -- outdoor community 8 meetings. And we really got a lot of people to 9 come to them. 10 At this individual meeting -- 11 In fact, Greg, it’s where your office used 12 to be, right on the corner. 13 -- we probably got about 90 people at the 14 community meeting. And the consensus among the 15 residents there is right now you have a bus stop 16 in front of 501 30th Street, which is right on the 17 side of the Fiji store, heading east if you’re 18 going into New York City. 19 As buses stop there, the buses come one 20 from behind each other, it blocks off that one 21 lane. People then go around them to make the 22 right onto Bergenline Avenue, causing a hazard to 23 pedestrians trying to cross the street. Not only 24 adults but children trying to cross the street, 25 mothers with strollers trying to cross the  14 1 street. 2 So we’re moving the bus stop to the side of 3 the pizzeria, which is on the other corner and 4 we’re going off the corner. 5 And, Chief, maybe if you could just step 6 forward and just explain this one? 7 We’re going off the corner. It would be on 8 the -- 9 CHIEF MOLINARI: We’re going from the 10 southwest side -- 11 MAYOR STACK: -- southwest side. 12 CHIEF MOLINARI: -- of 30th to now the 13 southeast side of 30th. 14 MAYOR STACK: Okay. 15 And that was a complaint that we received 16 from residents and the Traffic Division studied 17 it, so the buses would be able to pull off to the 18 side. 19 Maybe you want to explain that, Chief, what 20 they’ll -- 21 CHIEF MOLINARI: Yeah. 22 MAYOR STACK: -- be doing? 23 CHIEF MOLINARI: The biggest problem is 24 there is a lot of buses, both commuter buses and 25 New Jersey Transit.  15 1 So when that bus stop is blocked with 2 either the commuter bus or the NJ Transit, the 3 buses or anybody else can’t make a right hand 4 turn. 5 So by moving the bus stop one block further 6 east, we’re now allowing that flow of traffic to 7 continue. So, a vehicle can come to the corner, 8 make a right turn unimpeded and not have to worry 9 about passengers both exiting and entering on the 10 bus stop right there. 11 So it was mostly a safety concern, Mayor. 12 We did two or three traffic studies there in the 13 morning. And the amount of people that utilize 14 that bus stop -- it’s one of the most, by far, 15 used bus stops in all of Union City. 16 So, by far, a safety concern and by moving 17 it we should alleviate a lot of traffic concerns 18 and pedestrian safety concerns there. 19 MAYOR STACK: And once we move it, we’ll 20 maybe put an officer there at peak times just to 21 get the buses used to going to the next -- 22 CHIEF MOLINARI: We have an officer there 23 now -- 24 MAYOR STACK: Good. 25 CHIEF MOLINARI: -- and he’ll be assigned a  16 1 little further up just to assist with that. 2 MAYOR STACK: Good. And it’s all in the parking so 2 you can’t leave. 3 And then the doorman doesn’t care and no 4 one cares. They just want to evict you. And 5 that’s against the Fair Housing Act. 6 We really have to get the Attorney General 7 involved in the violation of the Fair Housing 8 Act. Tenants are supposed to be treated the same 9 way as owners and no less. 10 MAYOR STACK: I agree. 11 MS. MIKHAIL: If the tenant -- and there is 12 a lot of sided laws. I sat with Bloomberg 13 (phonetic) a lot -- a whole book with laws. If 14 the tenant is treated any different than the 15 owner, then the Fair Housing Act we have to -- 16 it’s a violation of the Fair Housing Act. And 17 then it gets to be very costly to the owner and 18 to the condo association and they have to correct 19 it. And the minimum violation is hundreds of 20 thousands of dollars. 21 MAYOR STACK: Right. 22 MS. MIKHAIL: So the onsite management, 23 yes, but he’ll get any girl to sit there and 24 she’s not gonna do anything.
