NOVA: Yes. 10 This Ordinance is to amend the current 11 nuisances of the City to include a noise 12 nuisance. So that the police officers would be 13 able to -- 14 MAYOR STACK: If you could just keep your 15 voice up. 16 Not stand up so much -- 17 MS. NOVA: Oh. 18 MAYOR STACK: -- but keep your voice up. 19 MS. NOVA: Sorry. 20 MAYOR STACK: You could stand up though. 21 That’s fine. No. No, I would never say stand 22 up. I would never do that. 23 MS. NOVA: Okay. 24 This Ordinance is -- it’s to add a nuisance 25 ordinance for noise.  7 1 The police officers in the City have been 2 restricted in their abilities to curb excessive 3 noise and unreasonable noise in the City. This is just extending it to ten 7 years. 8 Anyone wishing to comment on this at this 9 time please step forward. 10 MS. DILLON: You know what, come -- 11 MAYOR STACK: You could just stand over 12 here, Mr. Price. 13 ACTING CITY CLERK: Right here? 14 MAYOR STACK: Sure. 15 ACTING CITY CLERK: Yeah. 16 MS. DILLON: Come close. 17 MR. PRICE: Sure. 18 Larry Price, 1006 Palisade Avenue. 19 Couple of comments in general about this -- 20 MS. DILLON: Keep your voice up, Mr. Price, 21 because of the air conditioner. 22 MR. PRICE: Okay. Sorry. 23 I kind of -- well, I have a whole series of 24 comments here. 25 The one thing -- clearly we got to have  11 1 some control over opening the streets. I mean I 2 remember in the past watching Public Service dig 3 up for a gas line and when they close it up they 4 dumped a couple of bags of asphalt in and hit it 5 with a spade and that was the end of it. And of 6 course six months later, after the winter, we had 7 a gully in our street which lasted for ten years. 8 And that’s true all over the City. 9 And that -- that really -- I’m starting to 10 see that on Palisade Avenue now, which was paved 11 six years ago. 12 So, I mean clearly there has to be some 13 control over it. 14 On the other hand, certainly when we got a 15 new street and someone opens it, they better make 16 good on it because, you know, the City taxpayers 17 just paid for a new -- new street and we would 18 like to not have that destroyed immediately. 19 On the other hand, there’s also a useful 20 life for a street. Palisade Avenue is now 21 starting to show its age. It’s six years. And 22 this change, as I understand it, basically it 23 says if you open the street for ten years you got 24 to replace the street. 25 Well, if you do that on Palisade Avenue  12 1 right now, we’ve gotten our money’s worth out of 2 the paving job from six years ago. So if we 3 require someone to do it now, they’re going to 4 probably feel all I’m doing is paying for your 5 street program. You know, it’s not because I’m 6 destroying something; it’s worn out. But 7 whatever. 8 What I would really invite your attention 9 to -- talk to a couple of buddies of mine who are 10 engineers and they said if you have a good repair 11 program, not the, you know, two bags of asphalt 12 and pound it with a shovel but a good repair, you 13 know, will last longer than the original pavement 14 and will -- you know and will not deteriorate. 15 But it’s -- it’s a gull. Layers and pave 16 -- you know, you roll it and whatever. That’s 17 what I think we need. Because right now, with 18 this change you -- that would change. But right 19 now if you opened Palisade Avenue and create a 20 gull -- there’s no -- there’s no cost to you. 21 If you open Palisade Avenue –- more the 22 amendment here and -- and we have an enforced 23 repair program, you know, the thing -- they’re 24 talking, you know, there’s a lot of -- you know 25 I’m not an engineer, there are a lot of elaborate  13 1 steps. You know the -- the cut has to be five 2 foot wide and you put a -- you put a level in and 3 whatever. 4 But if we do that then we -- we protect our 5 -- our streets from whatever the abuse they 6 suffered in the past without, you know, -- 7 (indiscernible). Because what I fear on -- and I 8 -- I see a few changes, I know of one property -- 9 there are probably a lot of properties like this. 10 A guy buys a house. It’s officially a three 11 family but it was always a four family. Terrible 12 condition; solid structure, not so good. 13 So he buys the house to -- to rehab it and 14 have it legalized as a four family. He does 15 that. And then he finds out the Construction 16 Code requires that because it’s a four family it 17 has to be sprinklered. Okay, fine. He wants to 18 do it off his household line; pressure isn’t 19 enough. He has to put a line in down the street. 20 So that requires that he put $25,000.00 in for 21 the line down the street and another $50,000.00 22 to redo the street. And suddenly that new –- 23 whatever. 24 At this point if he knew -- as he said to 25 me, if I knew then what I know now, I would never  14 1 have touched this project. 2 We don’t want to discourage -- you know, 3 look at all the deteriorated properties in the 4 City. We don’t want to discourage or go out of 5 our way to discourage renovation. And that’s -- 6 this step makes -- 7 I think a rigidly enforced repair program 8 works a lot better than -- 9 MAYOR STACK: We do that. On the streets 10 that are currently out there that are older than 11 -- older than five and ten years we make them. 12 We do the infrared paving and stuff like that but 13 it’s not the same. I’ve got a lot of experience 14 with the streets, it’s not the same. 15 Where on Palisade was six years; 8 to 10 on 16 Pal? 17 MR. PRICE: I -- I’m just going -- 18 MAYOR STACK: When you said Palisade Avenue 19 was done six years ago, where? 20 MR. PRICE: By the pool. 21 MAYOR STACK: Yeah. 22 MR. PRICE: September of 2009. 23 MAYOR STACK: Okay, yeah. But that was 24 redone recently by -- 25 MR. PRICE: Well, those two blocks.  15 1 MAYOR STACK: Right. Right. 2 MR. PRICE: But the rest of it -- 3 MAYOR STACK: Right. 4 MR. PRICE: -- was -- 5 MAYOR STACK: But no more than those two 6 blocks was done six years ago. 7 MR. PRICE: Oh. Oh. 8 MAYOR STACK: It was -- 9 MR. PRICE: Yes. Yes. 10 MAYOR STACK: Yeah. 11 MR. PRICE: But the part -- oh, the part we 12 did, whatever, three months ago, looks beautiful. 13 MAYOR STACK: Yeah. 14 MR. PRICE: But beyond that -- 15 MAYOR STACK: But Palisade Avenue, beyond 8 16 to 10, wasn’t done six years ago. I wish it was. 17 It wasn’t. 18 Palisade Avenue hasn’t been done since I’ve 19 been the Mayor. It will be 15 years this month. 20 I never did Palisade. 21 MR. PRICE: Between -- 22 MAYOR STACK: Palisade Avenue was done -- 23 MR. PRICE: Between 10th and -- 24 MAYOR STACK: -- about -- 25 MR. PRICE: -- 11th Street.  16 1 MAYOR STACK: Tenth and 11th? 2 MR. PRICE: Yeah, that’s where I live. 3 MAYOR STACK: No. I didn’t -- not during 4 my time as Mayor, no. 5 I wish I could take credit for that. I 6 didn’t do it. No. 7 Palisade Avenue had a coating put on it 8 about 16, 17 years ago. They did a coating. 9 That’s all they did. Yeah. 10 They scraped it. They did a scraping down 11 about an inch and a half and they -- they did it. 12 They did a little bit of base repair. 13 What I’m doing now with the streets, like 14 15th that we just did the sidewalks, 47th, 48th, 15 Summit Avenue, I’m paving them next year. 16 Because Public Service and the water company came 17 out and did proactively -- 18 MR. PRICE: Right. 19 MAYOR STACK: -- did trenches and they did 20 some new water lines, some new gas lines. 21 MR. PRICE: Right. 22 MAYOR STACK: I’m going to wait a year just 23 for that to settle, do a good base repair, and 24 then I’ll pave those next year. 25 MR. PRICE: The one thing -- by the way the  17 1 change from five to ten, -- 2 MS. DILLON: Don’t stray away. 3 MR. PRICE: Oh, sorry. 4 Five years utilities can work around. Ten 5 years is -- I see a lot of, I guess you call it, 6 prophylactic work in a sense. That, you know, 7 they know it’s going to happen next year, so 8 they’re -- 9 MAYOR STACK: They got the message. 10 MR. PRICE: -- they got the -- so they’re 11 doing things this year. But -- 12 And then -- and then I’ll bet, you know, 13 the other half of the coin will be they’ll -- 14 they were intending to wait the last two years to 15 do nothing so that they could be beyond the five 16 year -- 17 Five years you can work around. Ten years 18 you can’t work around it if you’re a utility. 19 You might as well -- weather it so, -- and, you 20 know, the utility companies pay for it initially 21 but, you know, it’s going to be the property 22 owners in the City who will end up paying for 23 this in the end, so. 24 MAYOR STACK: We’ll take a look at it. 25 We’ll --  18 1 MR. NOVA: That’s correct. 10 MAYOR STACK: This is around all the 11 schools and school zones; we’re reducing the 12 speed limit to 15 miles an hour. 13 MS. NOVA: Fifteen miles per hour, every 14 school in the District. 15 MAYOR STACK: And it’s going to be 16 enforced. We’ll have officers out there 17 enforcing it. There will be additional signage 18 placed. It’s 19 a great, great, great Ordinance to introduce. 20 There’s so many groups of kids coming out 21 of the school at one time and people just seem to 22 fly by. take any comments -- 3 MAYOR STACK: Sure. 4 ACTING CITY CLERK: -- on any of the items 5 on the Consent Agenda? 6 MAYOR STACK: Just before I do, just on 7 number 5, which is a Resolution Authorizing 8 Submission of an Application to the New Jersey 9 Local Finance Board. That’s on our current bond; 10 the municipal bond -- the City bond, for lack of 11 a better term. We’re just changing that to 12 include the 47th Street Emergency Shelter that 13 we’ve spoken about many times before, which is 14 the firehouse. 15 In the event of a bad fire in the City, 16 rather that the City spending money on hotels, 17 we’ll keep the families in the City. All we’re 18 doing is moving money out of the road program 19 over to the shelter project. 20 The second one I wanted to mention was the 21 Jersey City Incinerator Authority for Use of 22 Compactor Trucks. That’s again working together 23 with Jersey City, sharing some equipment back and 24 forth. 25 I thank Mayor Fulop and his administration  40 1 for working closely with us. 2 Item number 8, the Purchase of Two Garbage 3 Trucks; it’s long overdue. When we talk about 4 the life of equipment in -- in trucks, these 5 trucks are out there seven days a week. 6 They’re the ones that pick up the various 7 items -- recycling -- some recycling material 8 that’s left over, any garbage that’s not picked 9 up by the hauler. They also do all the schools. 10 They also do all the receptacles. And they’re 11 out there seven days a week. 12 And the Public Works Department -- I give 13 all the Commissioners credit but specifically 14 Commissioner Rivas for the great job that they do 15 in keeping our City in the condition it’s in. We 16 receive many compliments about how clean the 17 streets are. The men and women in that 18 department do a great job. 19 Commissioner, you should be very proud. 20 COMMISSIONER RIVAS: Thank you. 21 MAYOR STACK: The Submission of a Grant 22 Application on the New Jersey DOT for Summit 23 Avenue Section 5. That’s to help us to get 24 Summit Avenue completed. 25 This year we’re doing from 15 to 22. That  41 1 will help us do 22 going north on Summit Avenue. 2 I’m hoping next year to complete Summit Avenue. 3 As I mentioned earlier when Mr. Price was 4 speaking, we did the sidewalks on Summit Avenue 5 from 15 to 22. We won’t do the paving until next 6 year. We’re hoping to do 22 going north -- the 7 sidewalks and then pave the entire project next 8 year. 9 Number 13, Ratifying an Agreement with the 10 City of Union City and Chief -- Chief of Police, 11 Richard Molinari. I’m very happy that the 12 Chief -- 13 The Chief is here with us tonight but I’m 14 very happy the Chief is not going to be retiring; 15 he’s going to be staying with us. I lobbied the 16 Chief quite a bit to stay with us. I know he had 17 other plans but I wanted him to stay with us. 18 Continuity in the Police Department is critical. 19 The Chief has done -- 20 (Applause.) 21 MAYOR STACK: The Chief has strong roots to 22 the community. He’s done an excellent job. 23 Not because he’s here and not because he’s 24 my Police Chief but he’s done an excellent job in 25 running the Department, managing it  42 1 professionally. 2 We’ve added many new officers in the 3 Department. The numbers speak for themselves 4 that are out there right now. He’s on the job 24 5 hours a day, seven days a week. He’s out there 6 with me at Community Meetings; we were out there 7 last night in a Community Meeting. Almost 90 of 8 them a year we do together. 9 And congratulations, Chief, and I’m glad 10 you’re staying. 11 CHIEF MOLINARI: Thank you, Mayor. 12 MAYOR STACK: I hope your wife’s not mad at 13 me -- on the record. 14 COMMISSIONER MARTINETTI: On the record. 15 MAYOR STACK: As for the Resolution -- 16 Resolution Number 20, on 41st Street from New York 17 Avenue to Palisade, naming after Coach Morell. I 18 thank the Commissioners -- and specifically both 19 Commissioner Valdivia and Commissioner Fernandez 20 -- for working on this to get this done. 21 He’s been a coach in the community for a 22 long time. I know Commissioner Valdivia knows a 23 lot about him. He’s a hardworking gentleman; not 24 well. And I think it’s -- I think it’s so 25 important -- so important that we recognize  43 1 somebody who’s done so much for the community. 2 COMMISSIONER VALDIVIA: I would like to 3 make a comment on two things. 4 MAYOR STACK: Sure. Please. 5 COMMISSIONER VALDIVIA: First of all on 6 number 6, on the Family Shelter Firehouse. I 7 want to thank the Mayor for his positive outlook, 8 always looking out for the residents of Union 9 City. I know myself and the Commissioners were 10 excited when he -- when he talked about this 11 project going -- going forward and I’m so happy. 12 Some of our citizens sometimes are -- have 13 a tragedy where they -- there’s a fire in their 14 apartment or house. They have a place now to go 15 and stay. 16 And also on Mr. Morell Way, it’s very well- 17 deserved. I know Commissioner Fernandez went to 18 school with some of his kids like I did. He was 19 a dedicated coach of Saint Augustine Parish. He 20 gave a lot to the City of Union City. It’s a 21 beautiful family. We’re 9 removing the loading zone at 611 Palisade and 10 we’re putting a bus stop. 11 Last meeting we took the loading zone -- 12 put the loading zone in and took the bus stop and 13 moved it. 14 What happened? 15 MAYOR STACK: Just going back, Larry, in 16 reviewing it, the bus stop, it wasn’t the best 17 location on the corner -- on the south-- on the 18 southwest corner of 7th and Palisade. So we’re 19 going to go back and try to refigure this and see 20 what we can do in that area. 21 There’s a bus stop at 10th and Palisade as 22 you know going south. We have the bus stop at 7 th 23 and Palisade Avenue right now. We’re going to 24 possibly look to either move that down further or 25 try to merge it maybe with another bus stop in  45 1 between. 2 But we’re going to go back and revisit this 3 again. 4 MR.
