AN ORDINANCE AMENDING CHAPTER 366 OF THE 22 CODE OF THE CITY OF UNION CITY ENTITLED “STREETS 23 AND SIDEWALKS” STAINS 24 25 ACTING CITY CLERK: The first item on the  5 1 agenda are Ordinances for Hearing and Adoption 2 Consideration. 3 This Ordinance Amending Chapter 366 of the 4 Code of the City of Union City Entitled Streets 5 and Sidewalks Stains. 6 MAYOR STACK: Krystle, you want to give a 7 brief explanation? 8 MS. NOVA: Yes. 9 This Ordinance establishes a duty of the 10 property owner, tenant or occupant to maintain 11 unstained sidewalks and to clean the sidewalks if 12 they become stained. 13 So within ten days of discovering the 14 stain, the owner or tenant has to clean it. If 15 they do not clean it, they will get a violation. 16 These are for very stubborn, very 17 significant stains. NOVA: We have not been able to reach 20 the property owner -- 21 MAYOR STACK: No. 22 MS. NOVA: -- on it. 23 MAYOR STACK: How -- how have we tried to 24 reach them? 25 I know I had the tenant’s number but I  11 1 didn’t have the landlord’s number. 2 MS. NOVA: We -- we had the Police 3 Department send police detectives and go and ask 4 if the -- who the owner was and -- and who lived 5 there and if we could reach them and that was the 6 number that they gave us. 7 MAYOR STACK: Not anymore. 8 MS. NOVA: They didn’t give us the actual 9 owner’s number. 10 MAYOR STACK: Okay. 11 MS. NOVA: I did also speak to the Tax 12 Collector and they don’t have the -- the address 13 doesn’t match up with the property and the names 14 of the owners that they have. 15 So, I don’t know what else we can do. 16 My thoughts, Mayor, was to put this -- have 17 it approved, still try to -- because it takes so 18 long for these to get moving to -- to begin with 19 -- that if we approve it now we can still always 20 pull it back if we speak to the owner. 21 MAYOR STACK: Right. We’ll -- we’ll 22 approve it tonight though just pending that we 23 speak to the property owner. 24 MS. NOVA: Yes. 25 MAYOR STACK: Because somebody has a bus  12 1 shelter up here in front of their property -- 2 MS. NOVA: Correct. 3 MAYOR STACK: -- may get them upset. 4 Alex will be the one. Alex will get -- 5 Alex, it’s the house on the south -- 6 southwest corner of 22nd and Palisade. It’s a -- 7 it’s a great big white house, three stories high. 8 Just if you could get the property owner’s name 9 and address for me so I can speak to them. 10 MS. NOVA: The -- the address that I had 11 for it was 2115 -- 12 MAYOR STACK: Right. 13 MS. NOVA: -- Palisade Avenue. 14 MAYOR STACK: Used to be Dr. Frances’ 15 (phonetic) office years ago. 16 Just see if we can get the property owner’s 17 information there and we’ll talk to him. 18 MS. NOVA: I’m sorry; it’s 2115 22 nd 19 Street. 20 MAYOR STACK: 21 -- Palisade. No, Palisade 21 Avenue. 22 MS. NOVA: Palisade. 23 MAYOR STACK: 2115 Palisade. 24 MS. NOVA: I’m sorry. 25 ACTING CITY CLERK: Palisade Avenue, yes.  13 1 COMMISSIONER VALDIVIA: I saw him. He was 2 an orthopedic doctor. 3 MAYOR STACK: Many, many years ago he owned 4 the property. 5 Just -- just see what we can do on that, 6 Alex. We have some information because we mailed 7 out a letter that we’re doing 22nd Street over 8 right now. We notified him on that also. 9 So, just reach out for him, get me a number 10 and I’ll speak to him. If he agrees then we can 11 work this out -- putting a bus shelter in front 12 of the property so when it’s raining out people 13 don’t get wet, the elements of the weather. 14 Okay. 15 ACTING CITY CLERK: Item 6 is a Resolution 16 Naming 28th Street from Summit Avenue to Kennedy 17 Boulevard as Pasquale Aquino Way. 18 This is a longtime Union City resident who 19 lived on that block. 20 Commissioner Fernandez can give more 21 information on it. 22 COMMISSIONER FERNANDEZ: Yeah. The family 23 has lived there for over 50 years -- way beyond, 24 58 years, I’m sorry -- 25 MAYOR STACK: They still do live there.  14 1 COMMISSIONER FERNANDEZ: -- and they still 2 live there. And members of the community 3 requested that if we could name that after them 4 and that’s why we just introduced today. 5 MAYOR STACK: He passed away though, right? 6 ACTING CITY CLERK: Yes, he did. 7 MAYOR STACK: He passed away. 8 ACTING CITY CLERK: Also, item 7, is a 9 Resolution Naming 41st Street, from Bergenline 10 Avenue to Kennedy Boulevard, as Ignacio J. 11 Alfonso Way. 12 MAYOR STACK: Commissioner Fernandez? 13 COMMISSIONER FERNANDEZ: These -- Mr. 14 Ignacio Alfonso was the owner of El Artesano 15 Restaurant, which is -- it’s a staple of Union 16 City. 17 It’s historically known as probably one of 18 the best Cuban restaurants in the State of New 19 Jersey. And his -- his family still owns it; the 20 two -- his two sons still run the establishment 21 -- establishment nowadays. 22 And, again, we got a request from -- 23 (indiscernible) -- Fomento (phonetic), the club, 24 if we could name it, from another source. 25 MAYOR STACK: Thank you.  15 1 ACTING CITY CLERK: Item 8. 2 Resolution Approving Contract with G4S for 3 Security Cameras in Memorial Park. 4 MAYOR STACK: This -- this is something 5 that we’re trying to do, not only at parks but in 6 various streets in the City, adding additional 7 security cameras. 8 We’re now -- security cameras putting them 9 on The Yardley Steps on 7th and Palisade Avenue is 10 another location this summer will be done and 11 throughout the parks in the City and on various 12 streets. 13 COMMISSIONER FERNANDEZ: I want to say 14 something about Memorial Plaza. This was an area 15 that was in blight. 16 Many, many years ago it was abandoned; only 17 pigeons hung out there. And the Mayor found the 18 funding as a State Senator to refurbish the area 19 and also name it as Memorial Plaza in honor of 20 the veterans. 21 So we have a lot of bang for the money 22 there where we’re honoring our veterans and at 23 the same time beautifying the area in a blighted 24 area that was dark and decrepit and making it 25 beautiful. You’re putting bus 25 shelter on the southwest corner of 22 nd and  18 1 Palisade. 2 Is there any possibility of moving it 3 across the street to the southeast corner? It’s 4 much more convenient. 5 On the southwest corner are the people 6 coming back from the -- they get off the bus, 7 they go home. 8 On the southeast corner are the people who 9 are waiting for the bus to New York. Public 10 transit being what it is, sometimes that’s a long 11 wait. And having shelter across the street from 12 the elements would be very handy. 13 MAYOR STACK: We’re -- we’re definitely 14 looking to do that, Mr. Price. The only issue is 15 that’s Weehawken technically still. Still at 1006  30 1 Palisade. 2 Let me relate the latest from the Zoning 3 Office. 4 When we adopted the Land Development 5 Ordinance in 2012 I thought one of the more 6 innovative and significant items was the 7 Greyfield Development provision. Leave it to 8 developer -- basically that provided if you had a 9 vacant old commercial industrial building there 10 were incentives in there to take it and develop 11 it. 12 I thought it was a good provision. 13 Needless to say the -- the developers of Union 14 City will try and gain that provision and they 15 are. 16 They’re -- they’re -- there is a 17 development at 38th and Bergen Boulevard currently 18 where the developer claims it’s a Greyfield 19 Development by virtue of a small industrial 20 operation maybe, which was torn down in 1991 or 21 25 years ago or the fact that the vacant lot was 22 used as a parking lot for -- as a parking lot for 23 a year and a half. And, therefore, it becomes a 24 Greyfield Development. 25 MAYOR STACK: It becomes what?  31 1 MR. PRICE: It becomes a Greyfield 2 Development. 3 And he says he’s entitled to build, as a 4 result, a five -- it’s a residential zone and he 5 -- he says he’s entitled to build a five-story 6 building with 40 units. 7 He claims that the wording and the 8 ordinance is ambiguous. I don’t think it’s that 9 ambiguous but -- but if -- but that’s not a good 10 development because if he gets away with it, 11 everybody with a vacant lot in Union City is 12 going to park cars on it for a year and then say 13 I’m entitled to a four-story building.
