CITY OF UNIVERSITY PLACE MINUTES Regular Meeting of the City Council Monday, May 3, 2021 (Remote Participation) 1. CALL REGULAR MEETING TO ORDER Mayor Belleci called the Regular Meeting to order at 6:30 p.m. 2. PLEDGE OF ALLEGIANCE LD Councilmember McCluskey led Council in the Pledge of Allegiance. 4. APPROVAL OF AGENDA MOTION: By Mayor Pro Tem Worthington, seconded by Councilmember Keel, to approve the agenda. The motion carried. 5. PRESENTATION OC EN Pierce County Library System’s 75th Diamond Anniversary Proclamation – Mayor Belleci presented a proclamation to Steve Carmody, Branch Manager of the University Place Library, proclaiming May 1 through December 31, 2021 as Piece County Library System’s 75th Diamond Anniversary. 6. 7. PUBLIC COMMENTS – None. CONSENT AGENDA UM MOTION: By Mayor Pro Tem Worthington, seconded by Councilmember Keel, to approve the Consent Agenda as follows: T A. Approve the minutes of the April 19, 2021 Council meeting as submitted. B. Receive and File: Payroll for period ending 04/15/21; and Claims dated 03/31/21 and 04/15/21. C. Adopt a Resolution appointing Kevin Briske to the Greater Tacoma Regional Convention Center Public Facilities District Board of Directors through December 31, 2022. (RESOLUTION NO. 948) D. Adopt a Resolution requesting an agreement with area stakeholders establishing the Four Corners Planning Area in preparation for future development. CITY MANAGER AND COUNCIL COMMENTS/REPORTS City Attorney Kaser briefed Council on action being taken by Pierce County Council on legislation that would impose an additional $4.00 per hour hazard pay for grocery employees working with the County during the State’s declared COVID-19 emergency. He explained that although the County is imposing this legislation countywide, with an option for cities to opt-out, a County ordinance is applicable only within the portions of the County not occupied by incorporated cities. He sought input from Council on how they would like to proceed and received unanimous opposition to the County’s overreach. Councilmembers do not agree that the City should have to opt-out of legislation that is not binding as the City of University Place is incorporated. City Attorney Kaser will draft a letter expressing Council’s opposition. City Manager Sugg indicated vaccination rates picked up last week, showing progress is being made UN between public and private sectors to increase the number of people being vaccinated. Councilmember Figueroa asked Mayor Belleci to be the spokesperson to call the Representative regarding the City’s opposition to Pierce County Council imposing legislation outside of its authority. OF Councilmember Keel stated that he will also be calling the Representative. Councilmember McCluskey reported that she attended the Natural Yard Care workshop supported by the FI City’s Storm Water Management program in partnership with Pierce County Health Department. Mayor Belleci shared feedback of public comments and participation during the April 28 public virtual CI A meeting held to get input on improvements and uses for Homestead Park. She believes there would have been a larger turnout if the meeting were not held virtually. 9. UPMC TITLE 23 TELECOMMUNICATION AMENDMENTS LD Planning and Development Services Director Swindale presented the proposed amendments to Title 23 Telecommunications. First drafted in 2002 to permit the deployment of macro towers, Title 23 now requires the addition of two new chapters for consistency with the subsequent Federal Communications Commission (FCC) orders. OC Two minor amendments will be made to Chapter 23.45 in Definitions and Third-Party Review. A new Chapter 23.50 Small Wireless Facilities will be added in response to the FCC’s Report and Order to acceleration of broadband deployment, expanding the reach and reducing the costs of broadband deployment by improving policies regarding public rights of way and wireless facilities siting. He showed EN different types of small cell facility options (hollow pole with full wire concealment, freestanding small cell with full concealment, wood power pole with the equipment mounted on the top of the pole, wood power pole with the installation in communication space, and strand mount attachment to wires), and discussed UM the components and different standards for each type. Chapter 23.55 Eligible Facility Requests is added to recognize the 2012 Spectrum Act. The 2012 Spectrum Act allows for minor modification of existing macro facilities, and this new chapter identifies processes for applications with no substantial change. Applicants can apply for eligible facility requests when there is not more than a 10% increase in height of an existing wireless tower or a height exceeding 20 feet whichever is greater. T Director Swindale answered questions regarding permitting; maximum facilities and allowed franchise; provisions for removal of facilities; requirements for eligibility, location, and SEPA. Council requested that a provision be added to provide notification to adjacent property owners when an application is made. 10.
