CITY OF URBANA COMMITTEE OF THE WHOLE – August 24, 2015 – 7:00 P.M. CITY COUNCIL CHAMBERS – 400 S. VINE STREET, URBANA, IL The City Council Committee Of The Whole of the City of Urbana, Illinois, met in regular session Monday, August 24, 2015 in the Council Chambers of the Urbana City Building. ELECTED OFFICIALS PHYSICALLY PRESENT: Aaron Ammons; Bill Brown; Eric Jakobsson; Michael P. Madigan; Diane W. Marlin; Dennis Roberts; Charlie Smyth; Laurel Lunt Prussing; Phyllis Clark ELECTED OFFICIALS PRESENT VIA TELECONFERENCE: There were none. ELECTED OFFICIALS ABSENT: There were none. CALL TO ORDER AND ROLL CALL There being a quorum, Chair Michael P. Madigan called the meeting of the Committee of the Whole to order at 7:00 p.m., after which the City Clerk called the roll. 2. ADDITIONS TO THE AGENDA AND STAFF REPORT 1. Proclamation – National Library Card Sign Up Month – MAYOR Mayor Prussing proclaimed September, 2015 as National Library Sign up Month in the City of Urbana Illinois. 2. Library Annual Report – LIBRARY Director of the Urbana Free Library Celeste Choate gave an oral and visual presentation of services offered by the Urbana Free Library, along with an overview of the Library’s annual report of finances, use and other statistical and interesting information pertaining to the Library. Discussion with the Committee ensued following Ms. Choate’s presentation. 3. Community Development Director Elizabeth Tyler gave a staff report reminder of the Food Truck Rally being held August 25, 2015 at the Urbana Civic Center, and a reminder of the Urbana Sweetcorn Festival being held this coming weekend. August 10, 2015: Alderman Ammons made a motion to approve the August 10, 2015 minutes. Alderman Roberts seconded. Being no changes, the motion to approve the August 10, 2015 minutes was carried by voice vote. 4. PUBLIC INPUT 1. Steve Bridges with the Mahomet Aquifer Protection Alliance addressed the Committee in opposition to Resolution No. 2015-08- 047R. 2. Bill Spencer with WATCH (We're Against Toxic CHemicals) addressed the Committee in opposition to Resolution No. 2015-08-047R. 3. Urbana resident Terry Hoffman addressed the Committee in opposition to Resolution No. 2015-08-047R. Discussion with the Committee ensued following Mr. Hoffman’s presentation. 4. Sherrie Brown with WATCH (We're Against Toxic CHemicals) addressed the Committee in opposition to Resolution No. 2015-08- 047R. 5. Jennifer Putman with Health Care Consumers addressed the Committee in support of and thanking the City of Urbana for co- sponsoring the upcoming September 19, 2015 community meeting on the Mahomet Aquifer to be held at the Champaign Public Library. 6. Patricia Avery addressed the Committee on behalf of the CU Superstars, thanking the Urbana Arts Council and Public Arts Coordinator Pauline Tannos for the grant the CU Superstars received. Ms. Avery also thanked the Committee for protecting our water source (Resolution No. 2015-08-047R). Following Ms. Avery’s presentation, there was a performance by this year’s CU Superstars. 7. Chair Madigan acknowledged a card from Bishop King James and Reverend Dr. Evelyn Underwood, and further acknowledged that neither wanted to verbally express their concerns regarding Dr. Ellis Subdivision sewer issues, but asked that these issues be mentioned. 8. Urbana resident John C. Marlin addressed the Committee in support of Resolution No. 2015-08-047R. 9. Urbana Citizen David Noreen addressed the Committee in opposition to Resolution No. 2015-08-047R. 10. George Wissmiller addressed the Committee in opposition to Resolution No.2015-08-047R. Discussion with Mr. Store and the Committee ensued following Mr. Stohr’s presentation. 12. Urbana Resident Scott Dossett submitted a public input card regarding discussing downtown, however did not address the Committee. 7. Ordinance No. 2015-08-091: An Ordinance Amending Urbana City Code Chapter 26 (Transportation Network Company Services – 2015) Following Public Input Chair Madigan proposed in the interest of time moving item 7/Ordinance No. 2015-08-091 to the next Committee of the Whole meeting. After a brief discussion with Finance Director Elizabeth Hannan, Collector's Office Supervisor Elizabeth Beaty and the Committee, all were in agreement that Ordinance No. 2015-08-091 be moved to the September 28, 2015 Committee of the Whole meeting. Alderman Roberts then made a motion to move Ordinance No. 2015-08-091 to the September 28, 2015 Committee of the Whole meeting. Alderman Brown seconded. After brief further discussion, the motion to move Ordinance No. 2015-08-091 to the September 28, 2015 Committee of the Whole meeting was carried by voice vote. 5. Resolution No. 2015-08-047R: A Resolution Approving a Consent Decree to Settle All Claims in a Citizens’ Complaint Filed with the Illinois Pollution Control Board by The City of Urbana and Other Units of Local Government Against Clinton Landfill, Inc. After Chair Madigan introduced Resolution No. 2015-08-047R, Mayor Prussing introduced Champaign City Attorney Joe Hooker to address the Committee. Mr. Hooker presented an overview of the consent decree’s content and purpose. Following Mr. Hooker’s presentation, discussion with the Committee and Mayor Prussing ensued. Mr. Hooker participated in the discussion and addressed the Committee’s questions and concerns. Additional public input was heard following discussion (please see the Public Input section of these minutes). Discussion resumed following the additional Public Input. Alderman Jakobsson made a motion to send Resolution No. 2015-08-047R to Council with recommendation for approval. Alderwoman Marlin seconded. Discussion then continued. Alderman Roberts proposed a friendly amendment to Alderman Jakobsson’s motion to send Resolution No. 2015-08-047R to Council without recommendation for approval. Alderman Jakobsson and Alderwoman Marlin agreed to the friendly amendment to send Resolution No. 2015-08-047R to Council with no recommendation. Being no further discussion, the amended motion to send Ordinance No. 2015-08-047R to Council with no recommendation was carried by voice vote. Ordinance No. 2015-08-090: An Ordinance Authorizing the Sale of Certain Real Estate (A Portion of 108 East Water Street) After Chair Madigan introduced Ordinance No. 2015-08-090, it was agreed upon by the Committee with no objections by staff that no presentation for Ordinance No. 2015-08-090 was necessary. Assistant City Engineer Brad Bennett and Community Development Director Elizabeth Tyler were present to answer questions. Being no questions and no discussion, Alderman Smyth made a motion to send Ordinance No. 2015-08-090 to Council with recommendation for approval. Alderwoman Marlin seconded. Being no discussion, the motion to send Ordinance No. 2015-08-090 to Council with recommendation for approval was carried by voice vote. 8. Ordinance No. 2015-08-092: An Ordinance Amending Urbana City Code Chapter 3, Section 3-43 (Increasing the number of Class G-2 liquor licenses for SOILL Restaurant Systems, LLC, d/b/a Dotty’s, 1901 S. Philo Road, Ste. B) Alderman Smyth volunteered to take, and then took over the Chair for Ordinance No. 2015-08-092, Ordinance No 2015-08-093 and Ordinance No. 2015-08-094. After Alderman Smyth introduced Ordinance No. 2015-08-092 Mayor Prussing presented Ordinance No. 2015-08-092. Alderman Madigan recused himself from participating in Ordinance No. 2015-08-092, Ordinance No 2015-08-093 and Ordinance No. 2015-08-094 due to possible conflict, as he holds a liquor license in the City of Urbana. A brief discussion then ensued with Mayor Prussing and the Committee. Following discussion, Alderman Jakobsson made a motion to send Ordinance No. 2015-08-092 to Council with recommendation for approval. Alderman Roberts seconded. Being no further discussion, the motion to send Ordinance No. 2015-08-092 to Council with recommendation for approval was carried by voice vote. 9. Ordinance No. 2015-08-093: An Ordinance Amending Urbana City Code Chapter 3, Section 3-43 (Increasing the number of Class G-1 liquor licenses for A Plus Entertainment, d/b/a A Plus VIP Lounge, 214 W. Main Street) After Alderman Smyth introduced ordinance No. 2015-08-093 Mayor Prussing presented Ordinance No. 2015-08-093, and recommended approval of the same. Mayor clarified that this liquor license is for an existing business. After brief discussion, Alderman Roberts made a motion to send Ordinance No. 2015-08-093 to Council with recommendation for approval. Alderman Ammons seconded. Being no further discussion, the motion to City of Urbana Committee Of The Whole Minutes: August 24, 2015 Page 5 of 6 send Ordinance No. 2015-08-093 to Council with recommendation for approval was carried by voice vote. 10. Ordinance No. 2015-08-094: An Ordinance Amending Urbana City Code Chapter 3, Section 3-43 (Increasing the number of Class A liquor licenses for Upscale Entertainment Group, LLC, d/b/a Flight Ultra Lounge, 142 Lincoln Square, Ste. 138) After Alderman Smyth introduced Ordinance No. 2015-08-094, Mayor Prussing presented Ordinance No. 2015-08-094. After brief discussion, Alderman Roberts made a motion to send Ordinance No. 2015-08-094 to Council with recommendation for approval. Alderman Ammons seconded. Being no further discussion, the motion to send Ordinance No. 2015-08- 094 to Council with recommendation for approval was carried by voice vote. *** Alderman Madigan resumed the Chair at 10:14 p.m.*** 11. Real Estate Transfers to Champaign County Habitat for Humanity After a brief discussion, Chair Madigan announced that the Committee would forego the briefing regarding Ordinance Nos. 2015-08-095, 2015- 08-096 and 2015-08-097, and go into a questions and answers discussion. Discussion then ensued. Community Development Director Elizabeth Tyler and Community Development Associate Matthew Rejc addressed the Committee’s questions. a. Ordinance No. 2015-08-095: An Ordinance Authorizing the Sale of Certain Real Estate (1306 1/2 West Dublin Street) Following discussion, Alderman Smyth made a motion to send Ordinance No. 2015-08-095 to Council with recommendation for approval. Alderman Ammons seconded. Being no further discussion, the motion to send Ordinance No. 2015-08-095 to Council with recommendation for approval was carried by voice vote. b. Ordinance No. 2015-08-096: An Ordinance Authorizing the Sale of Certain Real Estate (5 Hill Street Court) Alderman Smyth made a motion to send Ordinance No. 2015-08-096 to Council with recommendation for approval. Alderman Ammons seconded. Being no further discussion, the motion to send Ordinance No. 2015- 08-096 to Council with recommendation for approval was carried by voice vote. c. Ordinance No. 2015-08-097: An Ordinance Authorizing the Sale of Certain Real Estate (1310 W. Hill Street) Alderman Smyth made a motion to send Ordinance No. 2015-08-097 to Council with recommendation for approval. Alderman Ammons seconded. Being no further discussion, the motion to send Ordinance No. 2015- City of Urbana Committee Of The Whole Minutes: August 24, 2015 Page 6 of 6 08-097 to Council with recommendation for approval was carried by voice vote. 12.
