Vine St., Urbana, IL 61801 The City Council Committee of The Whole of the City of Urbana, Illinois, met in regular session Monday, August 12, 2019, at 7:00pm in the Council Chambers of the Urbana City Building. Call to Order and Roll Call With a quorum present, Chair Jared Miller called the meeting of the Committee of the Whole to order at 7:00pm, following a public hearing. 2. Approval of Minutes of Previous Meeting CM Maryalice Wu made a motion to approve the minutes from the July 8, 2019 meeting. Motion seconded by CM Dean Hazen and carried by voice vote. 3. Additions to the Agenda There were none. 4. Public Input Bishop King James and Rev. Dr. Evelyn Underwood did not wish to speak but wanted their concerns about the Dr. Ellis subdivision sewer problems entered into the record. 5. Presentations There were none. 6. Staff Report Mayor Marlin announced that the Public Works Department was awarded the 2018 Local Government Partner of the Year by the U.S Environmental Protection Agency. The award was given for outstanding waste reduction. Mayor Marlin said the City is considering taxing the sale of recreational cannabis and that there will be a public input session at the City Council meeting on August 19. The public is invited to come to the session and provide input on the sale of recreational cannabis in Urbana. She said it will be an agenda item at the Committee of the Whole meeting on August 26 and at the Council meeting on September 3. 7. Ordinance No. 2019-08-043: An Ordinance Amending Urbana City Code Chapter 9.5, Article II (Raffles/2019) Mayor Marlin presented this ordinance. She said the ordinance is to amend City code to conform to the Raffle and Poker Runs Act passed by the Illinois General Assembly in July. She said there Committee of the Whole Minutes Monday, August 12, 2019 Page 2 of 3 have been requests for the City to accommodate progressive raffles like the Queen of Hearts raffles, and that the Developmental Services Center would like to hold a Queen of Hearts raffle in Urbana, as well as one in Champaign. She said there is no direct revenue from raffles to the City or to the business hosting the raffle. Proceeds go to the organization sponsoring the raffle. The only revenue to the City is the license fee. The changes by the state: • Remove the requirement for a municipality to set upper limit on prize value, cost of tickets, and number of days for sale of tickets. • Set the licensing jurisdiction as the place the winning ticket is drawn and allow ticket sales outside that jurisdiction. • Expand the type of not-for-profits that can conduct raffles. CM Hursey made a motion to send Ordinance No. 2019-08-043 to council with recommendation for approval. Motion seconded by CM Hazen. Discussion ensued. Janice McAteer, Vice President of Development & Communications at DSC explained how the Queen of Hearts raffle is run, and said DSC will hold one in Champaign and would also like to have one in Urbana. CM Wu asked to have a maximum value of prizes of $750,000 to $1,000,000. It was suggested that staff recommend a range for the limit, and Mayor Marlin asked for ideas from committee members as to a range for the maximum prize. Suggestions ranged from $750,000 to 5,000,000, and it was mentioned there could be a lower limit set initially, and the ordinance could be amended to raise the limit if necessary. Assistant City Attorney Curt Borman told committee members that with the new state law, raffle tickets can be sold state-wide. That means that the license may be issued in one town, but tickets for that raffle can be sold all over the state. Rather than purchase a raffle license in a city that has a lower limit for prizes, someone could obtain a raffle license in a city with higher or no limit, and sell the raffle tickets anywhere in the state, including cities with lower limits. After discussion the motion to send Ordinance No. 2019-08-043 to council with recommendation for approval was carried by voice vote. 8. Ordinance No. 2019-08-044: An Ordinance Amending Schedule J of Section 23-183 of the Urbana Local Traffic Code Prohibiting Parking at all Times on Certain Streets (Springfield Avenue at Busey Avenue) Interim City Engineer Craig Shonkwiler presented this ordinance. He said there are visibility concerns at the northeast corner of Springfield Avenue when vehicles exit Busey Avenue onto Springfield Avenue. Parked vehicles along the north side of Springfield Avenue restrict visibility for motorists travelling south on Busey Avenue, and there have been two crashes in the past five years at that location. CM Wu made a motion to send Ordinance No. 2019-08-044 to council with recommendation for approval. Motion seconded by CM Hazen and carried by voice vote. 9. Ordinance No. 2019-08-045: An Ordinance Amending Schedule M of Section 23-190 of the Urbana Local Traffic Code to Establish a Tow Away Zone in a Specified Place on a Certain Street (Baronry Drive) Interim City Engineer Craig Shonkwiler presented this ordinance. He said the ordinance is the first in the city to be based on two inches of snow. It establishes a tow away zone on the south end of Baronry Drive on any day on which two or more inches of snow have accumulated and for 48 hours after that time. The intersection at the south end of Baronry makes it difficult for snow plows to turn around when cars are parked close to it. The ordinance prohibits parking for 42 feet from the southern end of Baronry when two inches of snow have accumulated, and a vehicle Committee of the Whole Minutes Monday, August 12, 2019 Page 3 of 3 parked there at that time can be towed away and impounded at the expense of the owner. CM Hursey moved to send Ordinance No. 2019-08-045 to council with recommendation for approval. Motion seconded by CM Wu and carried by voice vote. 10. Ordinance No. 2019-08-046: An Ordinance Amending Urbana City Code Chapter Three, Section 3-43 (Increasing number of Class C liquor licenses for Camy Inc. dba El Progreso, 510 N. Cunningham Ave. #7, Urbana, IL) Mayor Marlin presented this ordinance. She said it would increase the number of Class C liquor licenses to 23. She said El Progreso is a grocery store and this is for packaged sales. Chair Miller said there was a correction made to the ordinance. He relinquished the chair to CM Wu so he could make a motion. CM Miller motioned to send Ordinance No. 2019-08-046 to council with recommendation for approval. He said the correction is to Section 1 of the ordinance. He said the words “is hereby amended and as amended shall read as follows” are replaced with “is hereby amended with the underlined text indicating new language and strikethrough text indicating deletion as follows“. CM Hursey seconded the motion, which carried by voice vote. 11. Adjournment With no further business before the committee, Chair Wu adjourned the meeting at 7:43pm.
