COMMITTEE OF THE WHOLE MINUTES DATE: Monday, May 3, 2021 TIME: 6:00pm PLACE: *Held virtually due to Governor’s and Mayoral Emergency Declarations 400 South Vine Street, Urbana, IL 61801 The City Council Committee of The Whole of the City of Urbana, Illinois, met in regular session Monday, May 3, 2021, at 6:00pm via Zoom. ELECTED OFFICIALS PHYSICALLY PRESENT: Diane Wolfe Marlin, Mayor; Phyllis D. Clark, City Clerk ELECTED OFFICIALS PRESENT VIA TELECONFERENCE: City Council Members (CM), Maryalice Wu, Christopher Evans, Shirese Hursey, Jaya Kolisetty, Chaundra Bishop, Grace Wilken, James Quisenberry ELECTED OFFICIALS ABSENT: None STAFF PRESENT: Matt Bain, Kevin Garcia, Wendy Hundley, Jason Liggett, Stepheny McMahon, Carol Mitten, Scott Tess, Katherine Trotter, Dave Wesner OTHERS PRESENT VIA ZOOM: Tracy Chong, Christopher Hansen, Carl Hill, Sarah Nixon, Wayne Williams Chair: Maryalice Wu, Ward 1 1. Call to Order and Roll Call With a quorum virtually present, Chair Wu called the meeting of the Committee of the Whole to order at 6:50pm, following a Cunningham Township meeting. 2. Approval of Minutes of Previous Meeting CM Hursey made a motion to approve minutes from April 19, 2021. Seconded by CM Bishop and carried by roll call vote as follows: Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 3. Additions to the Agenda There were none 4. *Public Input and Presentations a. Council Member Training Session – Enterprise Zones & Subdivisions Economic Development Supervisor Stepheny McMahon began the presentation by explaining the role of an Enterprise Zone and current projects completed under this type of incentive for economic development. She then addressed question from committee. Economic Development Principal Planner Kevin Garcia began the presentation by explaining his role in the planning division, what a subdivision is and what items are brought to committee for approval. He then addressed question from committee. b. Public Input Public Input via Zoom included the following comments: in opposition of liquor license for Cracker Barrel; disappointment about inappropriate use of Taser and Taser review at a CPRB meetings. There was no public via email Page 1 of 3 Mayor Marlin read a proclamation acknowledging Municipal Clerk’s week May 2-8, 2021 and the staff City Clerk Phyllis Clark; Deputy City Clerk Wendy Hundley, and Assistant City Clerk Kay Meharry. 5. Staff Report Mayor Marlin announced upcoming street work projects in Urbana and announced Urbana Public television won two regional media awards. 6. Resolution No. 2021-05-020R: A Resolution Accepting a Grant from the Community Foundation of East Central Illinois for Tree Planting Public Works Sustainability & Resilience Officer Scott Tess presented this resolution with recommendation for approval. This resolution will allow the city to accept an anonymous donation through the Community Foundation of East Central Illinois in the amount of $98,650.00 for the purpose of planting more trees in Urbana. After the presentation, staff addressed questions from committee. CM Hursey made a motion to send Resolution No. 2021-05-020R to council with recommendation for approval, under the consent agenda. Seconded by CM Kolisetty and carried by roll call vote as follows: Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 7. Resolution No. 2021-05-021R: A Resolution Approving an Intergovernmental Agreement for Animal Impoundment Services City Administrator Carol Mitten and Police Lieutenant Matt Bain presented this item with recommendation for approval. This resolution is to approve an updated version of the existing intergovernmental agreement for animal impoundment services to the City of Urbana from the county. Discussion ensued. After the presentation and discussion, CM Hursey made a motion to send Resolution No. 2021-05-021R to council without recommendation. Seconded by CM Wilken and carried by roll call vote as follows: Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 8. Ordinance No. 2021-05-015: An Ordinance Approving a Final Subdivision Plat (South Ridge VIII Subdivision / Plan Case No. 2418-S-21) Planner Kat Trotter presented Ordinance No. 2021-05-015 with recommendation for approval. This ordinance will allow the requester to subdivide a 6.32 acre tract of land into 27 lots to be developed for single family homes. Discussion ensued. After discussion, staff and applicant Carl Hill addressed questions from committee members. CM Bishop made a motion to send Ordinance No. 2021-05-15 to council with recommendation for approval. Seconded by CM Hursey and carried by roll call vote as follows: Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 9. Ordinance No. 2021-05-016: An Ordinance Amending Urbana City Code Chapter Three, Section 3- 43 (Increasing number of Class R&T-1 liquor licenses for Sitara Indian Cuisine Inc. dba Tres Nopales, 114 S Race St, Urbana, IL) Mayor Marlin presented Ordinance No. 2021-05-016 and Ordinance No. 2021-05-017 in omnibus fashion. She explained that both license are new for these restaurants. She then addressed questions from committee. Discussion ensued. After the discussion, CM Kolisetty made a motion to send Ordinance No. 2021-05-016 to council with recommendation for approval. Seconded by CM Hursey and carried by roll call vote as follows: Page 2 of 3 Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 10. Ordinance No. 2021-05-017: An Ordinance Amending Urbana City Code Chapter Three, Section 3- 43 (Increasing the number of Class R&T-2 liquor licenses for CBOCS West Inc dba Cracker Barrel Old Country Store #129, 2101 N. Kenyon Rd, Urbana, IL) After the discussion, CM Quisenberry made a motion to send Ordinance No. 2021-05-017 to council with recommendation for approval. Seconded by CM Bishop and carried by roll call vote as follows: Ayes: Bishop, Evans, Hursey, Kolisetty, Quisenberry, Wilken, Wu Nays: None 11. Discussion: Frasca Redevelopment Agreement City Administrator Carol Mitten and Economic Development Supervisor Stepheny McMahon presented this item. They gave background information about the Frasca Redevelopment Agreement from 2012/2015, this included project phases, real estate tax abatement, and project completions. Frasca is in the process of adding a building for flight simulation and would like funding assistance from the City’s Tax Increment Financing (TIF) district four to complete the project. Discussion ensued. After the presentation, staff and the applicant addressed questions from committee. 12. Council Input and Communications → Welcome greetings to new council members and gratitude for outgoing council members → Condolences to Rev. Dr. Underwood on the lost of her son due to Covid → Suggestions for more parliamentary training for new council and public → Motorcade event announced → Clarification for website guidelines “Think Urbana” → Roll call rotation for council meetings 13. Our goal is to foster respect for the meeting process, and respect for all people participating as members of the public body, city staff, and the general public. The City is required to conduct all business during public meetings. The presiding officer is responsible for conducting those meetings in an orderly and efficient manner. Public Input will be taken in the following ways: Zoom Webinar Participant Click on the link listed in the agenda to join the Webinar. You must provide your name and email address in order to join the Webinar. If you wish to speak during Public Input, “raise your hand” and wait to be called on by the meeting host. You must state your first and last name for the meeting record. Participants will be muted except when they are called on to speak; video will remain off for all members of the public when speaking. Telephone Participant Call the phone number listed on the Agenda. Enter the Webinar ID followed by the # key. All callers are muted by default. If you wish to speak, “raise your hand” by pressing *9 once. When you are called on by the host or presiding officer, you will be un-muted. Emailed public comments labeled as such will be incorporated into the public meeting record, with personal identifying information redacted. Copies of emails will be posted after the meeting minutes have been approved. Written Input Any member of the public may submit their comments addressed to the members of the public body in writing. If a person wishes their written comments to be included in the record of Public Input for the meeting, the writing should so state. Written comments must be received prior to the closing of the meeting record (at the time of adjournment unless otherwise noted). Verbal Input Protocol for Public Input is one of respect for the process of addressing the business of the City. Obscene or profane language, or other conduct that threatens to impede the orderly progress of the business conducted at the meeting is unacceptable. Public comment shall be limited to no more than four (4) minutes per person. The Public Input portion of the meeting shall total no more than one (1) hour, unless otherwise shortened or extended by majority vote of the public body members present. The presiding officer or the city clerk or their designee, shall monitor each speaker's use of time and shall notify the speaker when the allotted time has expired. A person may participate and provide Public Input once during a meeting and may not cede time to another person, or split their time if Public Input is held at two (2) or more different times during a meeting. The presiding officer may give priority to those persons who indicate they wish to speak on an agenda item upon which a vote will be taken. The presiding officer or public body members shall not enter into a dialogue with citizens. Questions from the public body members shall be for clarification purposes only. Public Input shall not be used as a time for problem solving or reacting to comments made but, rather, for hearing citizens for informational purposes only. In order to maintain the efficient and orderly conduct and progress of the public meeting, the presiding officer of the meeting shall have the authority to raise a point of order and provide a verbal warning to a speaker who engages in the conduct or behavior proscribed under “Verbal Input”. Any member of the public body participating in the meeting may also raise a point of order with the presiding officer and request that they provide a verbal warning to a speaker. If the speaker refuses to cease such conduct or behavior after being warned by the presiding officer, the presiding officer shall have the authority to mute the speaker’s microphone and/or video presence at the meeting. The presiding officer will inform the speaker that they may send the remainder of their remarks via e-mail to the public body for inclusion in the meeting record.
