APPROVED MINUTES OF A REGULAR MEETING URBANA CIVILIAN POLICE REVIEW BOARD DATE: Wednesday, September 22, 2021 TIME: 5:30 p.m. PLACE: Virtually via Zoom Urbana City Building 400 South Vine Street Urbana, Illinois 61801 MEMBERS PRESENT: Tony Allegretti, Ricardo Díaz, Katrina Kindle, Colum Wilson 1. CALL TO ORDER, ROLL CALL, AND DECLARATION OF QUORUM  Ricardo Diaz called this meeting of the Urbana Civilian Police Review Board to order. Roll was taken. A quorum was present. 2. APROVAL OF AGENDA  Tony Allegretti made a motion to approve the agenda. Colum Wilson seconded the motion. The motion was approved by a roll call vote. 3. PUBLIC PARTICIPATION  There was public participation in regards to several past issues in regards to CPRB Membership. 4. OFFICER’S REPORT HREO, Carla Boyd reported there were no new formal or informal complaints. She shared there 51 appeals from 202 and that 14 had been resolved. With an additional 37 to be scheduled with no October date available. Carla shared she has reached out to the UPD for ride along opportunities. She futher shared the process by CPRB can begin to be a regular part of City Council meetings. Volunteers are needed for the CU-PRIDE FEST as well as working a table at the Market on the Square for possible engagement opportunities and volunteer recruitment. 5. UNFINISHED BUSINESS a. Status of Complaints and Appeals Previously reported by Carla Boyd b. Updates on augementing the CPRB Procedures Manual Tony Allegretti shared the date on the current manual was from 2012. Tony Allegretti shared the CPRB should begin looking over the various part of the manual and shared a committee of 2 members look over the manual for proposed changes. Tony Allegretti formally suggested the formation of a committee of 2 members to complete the revisions. Katrina Kindle asked and agreed to work with Tony Allegretti, and Chair Ricardo Diaz asked for updates at the October Meeting. c. Outreach to the public and member recruitment Colum Wilson shared he as formulated questions for City Employees on getting setup logistics and help with table and tent materials for a booth, along with handout materials at the Farmers Market in an attempt to fill CPRB Vacancies. d. 5 year report Update Ricardo & Colum-request for system to collect feedback from residents. Chair Ricardo Diaz shared that he and Colum Wilson have gone over the report, but have not sent it out to the other CPRB members as of yet. They are currently still cross checking the numbers from the years 2014-19’s complaints. e. Consideration of Taser report U19-579 Tony Allegretti led this conversation. City Administrator, Carol Mitten, refrenced ordinance 19-43 in reference to a vote taken in April of 2020 by CPRB members. Carol Mitten advised that the vote taken in April of 2020 is not within the authority of the CPRB. Carol Mitten advised that the FOP will take feedback in regards to a policy, but not on the conduct of a specific officer concerning the use of the Taser. There was no police presence at this meeting, however Carol Mitten shared if the CPRB wanted to further review and continue this discussion she in turn would make sure a Police representative would be present at the October meeting. 2 6. NEW BUSINESS a. FOP contract. Following up on City Council on the inclusion of people with a felony conviction. Requests for other changes that affect CPRB. Ricardo Diaz commented on the City Council vote of this matter. Ricardo referenced Ordinance 19-22 for CPRB membership. Carol Mitten shared history of when the CPRB Ordinance was passed. Carol further shared that a compromise was struck in that no one was eligible with a felony conviction as to no one with police/law enforcement is eligible either. Ricardo shared he would like one CPRB Member present at every City Council meeting and vice versa. Colum Wilson made a motion to strike 19-22-c and part of 19-22-b which would prohibit former law enforcement officials from joining the CPRB. Ricardo Diaz seconded the motion. The motion did not pass on a 2-2 vote. 7. BOARD INPUT AND COMMUNICATIONS a. Board member comments and announcements Ricardo Diaz announced the Champaign County Welcoming Plan. b. Two CPRB Vacancies Vacancies remain c. Time Commitment for Regular Meetings & Appeals Hearings Ricardo encouraged CPRB members to volunteer on a monthly basis. d. Appeals and Suggestions for dealing with them quicker. Some new suggestions on how to complete the remaining 37 appeals. Katrina and Tony both expressed minimizing or limiting time on CPRB Members talk time during the hearings. Ricardo Diaz suggested a quarterly meeting or an every other month for Regular meetings and use the other calendar time for Appeals Hearings. Ricardo Diaz made a motion to move Regular meetings to every two months after the October meeting. Katrina Kindle seconded the motion. Motion passed via roll call vote. e. Possible appeal hearing on October 22, 2021 No Appeals hearing for the month of October. f. Next Regular Meeting Date: October 27, 2021 8. PUBLIC INPUT Public commentary given. 9. The City is required to conduct all business during public meetings. The presiding officer is responsible for conducting those meetings in an orderly and efficient manner. Written Input Persons with disabilities needing special services or accommodations for this meeting should contact the City Clerk of Urbana at (217) 384-2366. Any member of the public may submit their comments addressed to the members of the public body in writing. If a person wishes their written comments to be included in the record of Public Input for the meeting, the writing should so state. Written comments must be received prior to the closing of the meeting record (at the time of adjournment unless otherwise noted). Verbal Input Protocol for Public Input is one of respect for the process of addressing the business of the City. Obscene or profane language, or other conduct that threatens to impede the orderly progress of the business conducted at the meeting is unacceptable. Public comment shall be limited to no more than four (4) minutes per person. The Public Input portion of the meeting shall total no more than one (1) hour, unless otherwise shortened or extended by majority vote of the public body members present. The presiding officer or the city clerk or their designee, shall monitor each speaker's use of time and shall notify the speaker when the allotted time has expired. A person may participate and provide Public Input once during a meeting and may not cede time to another person, or split their time if Public Input is held at two (2) or more different times during a meeting. The presiding officer may give priority to those persons who indicate they wish to speak on an agenda item upon which a vote will be taken. The presiding officer or public body members shall not enter into a dialogue with citizens. Questions from the public body members shall be for clarification purposes only. Public Input shall not be used as a time for problem solving or reacting to comments made but, rather, for hearing citizens for informational purposes only. In order to maintain the efficient and orderly conduct and progress of the public meeting, the presiding officer of the meeting shall have the authority to raise a point of order and provide a verbal warning to a speaker who engages in the conduct or behavior proscribed under “Verbal Input”. Any member of the public body participating in the meeting may also raise a point of order with the presiding officer and request that they provide a verbal warning to a speaker. If the speaker refuses to cease such conduct or behavior after being warned by the presiding officer, the presiding officer shall have the authority to mute the speaker’s microphone and/or video presence at the meeting. The presiding officer will inform the speaker that they may send the remainder of their remarks via e-mail to the public body for inclusion in the meeting record.
