Minutes of an Informal Public Hearing DATE: Tuesday, June 2, 2020 TIME: 5:30 pm PLACE: 400 S. Vine Street, Urbana, IL *Virtually via Zoom INFORMAL PUBLIC HEARING OF APPEAL TO THE HUMAN RELATIONS COMMISSION An informal public hearing pursuant to Urbana City Code Sections 12-82(d) and (e) regarding an appeal of an initial determination of lack of jurisdiction in case number 001-05-20. 1. Call to Order and Roll Call Hearing Body: Peter Resnick (chair) Marion Knight Rizwan Uddin Presenters: James Simon (Officer) Christopher Hansen (Complainant) 2. Chair’s Introduction Chair Peter Resnick introduced the appeal. Mr. Resnick provided guidelines for the hearing and gave an overview of the process that would take place. 3. Officer’s Statement of Reasons for Determination James Simon gave a statement and provided reasons for his determination of no jurisdiction. Mr. Simon cited instances from City code and City ordinances to support his determination of no jurisdiction. He also provided additional resources and avenues available to the complainant that he believes would have jurisdiction. 4. Complainant’s Statement of Objections to Determination Christopher Hansen gave a statement and provided reasons for why he is pursuing an appeal of the officer’s no jurisdiction ruling. Mr. Hansen cited instances from City code and City ordinances to support his argument that the Human Relations Commission does have jurisdiction on the matter in question. 5. Officer’s Reply James Simon responded to the Complainant’s remarks. 6. Hearing Body Questions to the Presenters Mr. Uddin asked Mr. Simon about other avenues of complaint. Mr. Simon responded by talking about the Illinois Human Rights Commission and EEOC. Mr. Resnick asked Mr. Simon about definitions in the ordinance, to which Mr. Simon replied with his interpretations. Mr. Resnick asked Mr. Simon about how the ordinance might apply to City workers, and Mr. Simon replied that it could not. Mr. Resnick asked Mr. Hansen about how fines might apply in this case, to which Mr. Hansen replied that they need not in this case. Mr. Resnick asked Mr. Hansen about definitions in the ordinance. Mr. Hansen replied with his interpretations. 7. *Public Input Tracy Chong shared her disappointment with the situation taking place and her disagreement with the determination. Vijal Patell shared his concern with conflicts in the City code and ordinance. He also shared his disappointment with City staff actions. Ron Kester shared his outrage and disappointment with City staff actions during this meeting. 8. Hearing Body Deliberations Members of the hearing body discussed the matters presented. 9. Vote and Announcement of Hearing Body’s Decision Members of the Hearing Body voted either jurisdiction or no jurisdiction in regards to whether the Urbana Human Relations Commission should rule on the original complaint filed by the complainant. Marion Knight: No Jurisdiction Rizwan Uddin: Jurisdiction Peter Resnick: No Jurisdiction The determination of the panel is no jurisdiction. 10. You can click “Join from your browser.” It appears Zoom prefers for users to download and install their meeting client software on your computer. Choose the option you are comfortable with and note, these may be browser specific. There is a Zoom app for smartphones.
