Main St. Uvalde, TX 78801 The Regular Meeting of the Planning and Zoning Commission was called to order on Tuesday October 1, 2019, at 6:00PM, in the City Hall-Council Chambers, with the following members present: COMISSIONERS Lydia Moss, Jimmie Raines, Joe Suarez, Walter Tidwell, Mario Valdez, PRESENT: Matthew Visel, Rosemberg Risa III-Alternate COMISSIONERS Lauren Nolasco-Freitag-Chair, Gilbert Limones-Alternate, Jose Saucedo- ABSENT: Alternate STAFF Susan Anderson-Director of Planning and Development, Jovita PRESENT: Maldonado-Code Enforcement Officer, Sorayda A. Sanchez-City Secretary 1. CALL MEETING TO ORDER 2. APPROVAL OF SEPTEMBER 3, 2019 MINUTES Motion to approve September 3, 2019 minutes made by Commissioner Lydia Moss. Motion seconded by Commissioner Joe Suarez. Motion carried 7-0. 3. PUBLIC HEARING Citizens who would like to come before the board are to limit their presentations to no more than three (3) minutes. 4. CASE FILE 20-19PZ Open a public hearing to consider and act on the request of Michelle R Garza, applicant, to change the zone from Residential 1 to Business 2. She would like to place an Office Supply Retail Store at this location. The property is located at 123 South Fourth Street, NCB 242, Burns & Campbell Subdivision, Block D, Lot 3, 4, City of Uvalde, Uvalde County Texas. Susan Anderson Director of Planning and Development explained to commissioners that this property is two lots adjacent to each other. The Property is located at 123 South Fourth Street and it is behind Hondo National Bank, it backs up to SWART and the property owner is requesting a zone change to Business 2 for both lots. One lot will be used for parking the other will be used for business. Public hearing opened at 6:05PM Property owner Michelle Rodriguez Garza currently rents the building for her business on 124 E. North Street. The parking situation is not ideal and landlord is not willing to work with tenant. Mrs. Garza would like to relocated to the Fourth Street address. Mrs. Anderson added that B2 is highway business and the zoning for that block is B2. Meaning anything that is on Main Street can go on this block. Page 1 3 of 2 4 Neighboring property owner Michael Jacobs asked if the zone change would affect his taxes. Commission and staff could not answer his question as property taxes are not determined by the City of Uvalde. Mr. Jacobs was not opposed to the business, however he was opposed to his taxes increasing and is concerned with the heavy traffic of that area. Jovita Maldonado Code Enforcement Officer mentioned that 18 certified letters were mailed, 15 were signed, and 3 were not claimed. Hondo National Bank submitted a letter of approval and one neighbor submitted a letter against. Maria Estela Casarez was the opposing neighbor, she is concerned with the school bus traffic dropping off and picking up kids. Public hearing closed at 6:15PM Commissioner Walter Tidwell asked if City Staff had a recommendation. Mrs. Anderson responded by stating that the City likes to keep things as uniform as possible. Zoning for that area is mainly B2 and other than traffic staff does not have a problem one way or the other. Motion to deny made by Commissioner Joe Suarez. Motion seconded by Commissioner Lydia Moss. Motion was taken off the table and new motion made. Motion to approve was made by Commissioner Mario Valdez. Motion seconded by Commissioner Walter Tidwell. Motion carried 4-3 5.
