MINUTES Planning and Zoning Commission Meeting 6:00PM - Tuesday December 1, 2020 City Hall-Council Chambers 101 E. Main St. Uvalde, TX 78801 The Planning and Zoning Commission meeting of the City of Uvalde was called to order on Tuesday December 1, 2020, at 6:00PM, in the City Hall Council Chambers, with the following members present: COMMISSIONERS Matthew Visel-Chair PRESENT: Gilbert Limones Rosemberg Risa Joe Suarez COMMISSIONERS Lydia Moss ABSENT: Jimmie Raines Walter Tidwell Regina Santos-Aviles-Alt. Jose Saucedo-Alt. STAFF PRESENT: Susan Anderson-Director of Planning and Development Jovita Maldonado-Code Enforcement Officer Sorayda A. Sanchez-City Secretary 1. CALL MEETING TO ORDER 2. APPROVAL OF MINUTES Consider and act on the approval of the minutes of the November 3, 2020 Regular Planning and Zoning Commission meeting. Motion to approve the minutes of the November 3, 2020 Regular Planning and Zoning Commission meeting made by Commissioner Gilbert Limones. Motion seconded by Commissioner Joe Suarez. Motion carried 4-0. 3. PUBLIC HEARING AND ZONING MATTERS Citizens who would like to come before the board are to limit their presentations to no more than three (3) minutes. 4. CASE FILE 12-20PZ Open a public hearing to consider and act on the request of MRKI Hotel, LLC, Janish Patel, applicants, to subdivide the lot into 3 lots. The property is located at 920 E. Main St., Stroman Tract Subdivision, Block 2, Lot 2, 3, 4, 5, 6, PT7., City of Uvalde, Uvalde County Texas. a) Open public hearing Page 1 of 3 b) Citizens comments c) Close public hearing d) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development explained to commissioners that this is a difficult case because the property does not have street frontage. The street frontage is owned by the City of Uvalde. This would typically face Nopal St., but city owns section across Nopal St. Therefore the only access would be through the back or off of the alley. The problem is that the alley doesn't run all the way through from Fourth St. to Fifth St., and because of the way our subdivision ordinance is written, it is not staffs recommendation to approve this subdivision unless there is a way that the alley can be dedicated as a public alley. Our subdivision ordinance says "the subdivision of the land will be such as to provide by means of a public street each lot the satisfactory access to an existing public street". There is no way to get it to the public street because we own that property. However it could have alley access, but it would not be a public alley. As it is submitted currently it is not a public alley, it is an easement. Public hearing opened at 6:03PM Ken Dirksen, Engineer with Dirksen Engineering spoke on behalf of Mr. Patel the property owner. Mr. Dirksen stated he was surprised to hear staffs recommendation. Mr. Dirksen stated that he has been in contact with staff on how property was going to be developed. The alley is closed, it is not developed, and it does not go all the way through. Mr. Dirksen asked if the city was going to pave the alley. Commissioner Gilbert Limones also asked that if it becomes an alley, does the alley become property of the city or the property owner. Mrs. Anderson answered that the way the ordinance reads is that it has to be a public street. Staff is compromising to say the alley counts as a street, that would mean it would have to be dedicated as a public alley. Mr. Dirksen stated that the property in question is a hotel and where its being discussed about putting an alley is actually going through the parking lot. He does not want a public alley going through the parking lot of the hotel for security reasons. The two lots are intended to be developed as rental units. The property owner would like to develop suites that are separate from the hotel. The access to the two lots will through Fifth St. by an easement. Mrs. Anderson asked if the easement would be paved. Mr. Dirksen stated that the easement will be paved, but it will not be a public alley for through traffic. The intention of the alley is to access the suites. The intention of the suites is to provide a corporate rental. Mrs. Anderson stated that once the property is subdivided the property becomes separate parcels and once they are separate parcels they do not meet our code. Public hearing closed at 6:14PM Matthew Visel, Commission Chair stated he has concerns on subdividing. Mr. Visel feels that property owner can achieve his goal without subdividing. Motion to deny Case File 12-20PZ made by Commissioner Joe Suarez. Motion seconded by Commissioner Gilbert Limones. Motion carried 4-0. 5. ADJOURNMENT Motion to adjourn made by Commissioner Rosemberg Risa. Motion seconded by Commissioner Joe Suarez. Motion carried 4-0. Meeting adjourned at 6:15PM.
