The Regular Planning and Zoning Commission meeting of the City of Uvalde was called to
order on Tuesday January 4, 2022, at 6:00PM, in the City Hall Council Chambers, with the
following members present:

I. CALL MEETING TO ORDER

II. Consider and act on the approval of the minutes of the December 7, 2021
Regular Planning and Zoning Commission meeting.
Motion to approve the minutes of the December 7, 2021 Regular Planning and Zoning
Commission meeting made by Commissioner Jimmie Raines. Motion seconded by
Commissioner Joe Suarez. Motion carried 7-0.
III. PUBLIC HEARING AND ZONING MATTERS
Citizens who would like to come before the board are to limit their presentations to no
more than three (3) minutes.
IV. CASE FILE 1-22PZ
IV. Open a public hearing to consider and act on the request of WILCAP
Investments, LLC, dba, David C. Willis and L. Carper Capt, applicants, for

a zone change from Residential 4 to Business 2. WILCAP Investments,
LLC, would like to build self-storage units on the property. The property
is located on the corner of Garner Field Rd and Joe Carper Drive property
ID 18705 – Garner Field Rd, Abstract 216, Survey 75 1.62 acres, City of
Uvalde, Uvalde County Texas.

d) Reconvene meeting for discussion and decision on application.
Susan Anderson, Director of Planning and Development explained to commissioners
that the property is located on Garner Field Road. The whole area was annexed in
1979 and when it was brought in it was zoned Residential 4, multi family. Some of the
pieces have been rezoned throughout the years. The area in question is currently
zoned Residential 4 and the property owner is requesting a change to Business 2. The
property owner would like to build self-storage units on the property.

David Willis, property owner explained that what he would like to build on the
property are storage buildings, similar to those located behind Burger King.

Motion to approve Case File 1-22PZ made by Commissioner Jimmie Raines. Motion
seconded by Commissioner Gilbert Limones. Motion carried 7-0.
V. CASE FILE 2-22PZ
V. Open up a public hearing to consider and act on the request of Ricardo Perez,
applicant, for a zone change from Residential 1 to Business 1 to build a
workshop with a bathroom on the property. The property is located at 226
W Garden St., NCB 54, Old Town Subdivision, Block 2, Lot 19-B-2, 27, 35-
B, City of Uvalde, Uvalde County Texas.

d) Reconvene meeting for discussion and decision on application.
Susan Anderson, Director of Planning and Development explained to commissioners
that the property is located on West Garden Street. The property backs up into a
business district and is surrounded by a mix of different densities of housing. Around
this property there are residential 4, residential 3, and industrial properties. The
hesitation Mrs. Anderson has with the zone change is that staff prefers changes to
business be at a corner, and this property is located mid block.

Property owner Rick Perez addressed commissioners. Mr. Perez explained that he is
building a workshop behind his home. Mr. Perez stated that what prompted the zone
change was the fact that he wanted to build a restroom inside the building. Mrs.
Anderson clarified that the change was not brought forth because of the restroom. The
change was brought forth because Mr. Perez has been operating a business as a home
occupation and has been allowed to do so because he met requirements for a home
occupation. However, now that Mr. Perez will have multiple employees, the zone must
be changed. Home occupation only allows one other employee besides a family
member, because he has more than one employee the zone must be changed.

Commissioner Rosemberg Risa asked if the traffic flow would be in the alley, Mr.
Perez stated that the traffic would be in the alley. Commissioner Gilbert Limones
asked if Mr. Perez had any trailers that would be stored on the property, Mr. Perez
stated he does have a few trailers, a 16 ft. trailer, a 27 ft. trailer and a gooseneck
trailer. The trailers will be stored on his property.

Motion to approve Case File 2-22PZ made by Commissioner Rosemberg Risa. Motion
seconded by Commissioner Joe Suarez. Motion carried 7-0.
VI. CASE FILE 3-22PZ
VI. Open a public hearing to consider and act on the request of B&L Storage,
LLC, Diane Gerdes, applicant, for a zone change from Residential 1 to
Business 2 to build RV Storage rooms. The property is located at 1024
North Camp Street, NCB Abstract 241, Survey 72, 3.222 acres, City of
Uvalde, Uvalde County Texas.

b) Citizens comments.
c) Close public hearing.
d) Reconvene meeting for discussion and decision on application.
Susan Anderson, Director of Planning and Development explained to commissioners
that the property is located on N. Camp St. part of the property is located within the
city limits and the other part is not. The property is adjacent to an industrial zone and
across the street is zoned business. Staff does not see a problem with the storage units.

Mr. Buchannon explained to commissioners that he would like to build storage units on
the property.

Motion to approve Case File 3-22PZ made by commissioner Gilbert Limones. Motion
seconded by commissioner Joe Suarez. Motion carried 7-0.
VII. CASE FILE 4-22PZ
VII. Open a public hearing to consider and act on the request of City Staff to
adopt the 2021 International Zoning Code.

3. Reconvene the meeting for discussion and decision on the ordinance.
Susan Anderson, Director of Planning and Development reviewed and discussed the
2021 International Zoning Code with Commissioners. This is the third time
commissioners have had the opportunity to review the 2021 International Zoning
Code.

seconded by Commissioner Rosemberg Risa. Motion carried 4-3.
