Main St. Uvalde, TX 78801 The Regular Planning and Zoning Commission meeting of the City of Uvalde was called to order on Tuesday September 6, 2022 at 6:00PM, in the City Hall, Council Chambers, with the following members present: COMMISSIONERS Matthew Visel-Commission Chair PRESENT: Gilbert Limones-Commissioner Rosemberg Risa, III-Commissioner Joe Suarez-Commissioner Jose Tomas Garcia-Alternate COMMISSIONERS Lydia Moss-Commissioner ABSENT: Jimmie Raines-Commissioner Walter Tidwell-Commissioner Gabriela Anfinsen-Alternate Regina Santos-Aviles-Alternate STAFF PRESENT: Susan Anderson-Director of Planning and Development Sorayda A. Sanchez-City Secretary Jovita Maldonado-Code Enfocement Officer Jose Saucedo-Code Enforcement Officer in Training Adrian Trevino-IT Administrator I. CALL MEETING TO ORDER II. APPROVAL OF MINUTES II. Consider and act on the approval of the minutes from the August 2, 2022 Regular Planning and Zoning Commission meeting. Motion to approve the minutes from the August 2, 2022 Regular Planning and Zoning Commission meeting made by Commissioner Gilbert Limones. Motion seconded by Commissioner Joe Suarez. Motion carried 5-0. III. PUBLIC HEARING AND ZONING MATTERS Citizens who would like to come before the board are to limit their presentations to no more than three (3) minutes. IV. CASE FILE 29-22PZ Page 1 3 of 3 5 IV. Consider and act on the request of Chase Guldenpfennig,applicant, is requesting a Special Use Permit to use the structure in the back of the property as an accessory dwelling. The address is 213 Minter St., NCB 6, Kerby and Smith Subdivision, Block 2, Lot 19B, 20A, 21A, City of Uvalde, Uvalde County Texas a) Staff comments b) Public hearing c) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development demonstrated the property on the Future Land Use Map to the Commissioners. Mrs. Anderson explained that the property meets all requirements for the Future Land Use Map as well as the requirements for accessory dwelling. Jovita Maldonado stated that 40 letters were mailed, 30 received, and 1 returned. Staff received 3 letters that were all in favor. Public hearing opened at 6:04PM Property owner Chase Guldenpfennig stated that this is a request for an accessory dwelling unit. the unit will be used to house his mother in law. Commissioner Rosemberg Risa asked if Mr. Guldenpfennig had any plans to rent the unit in the future. Mr. Guldenpfennig stated that he does not have any intentions of renting. Mrs. Anderson stated that Mr. Guldenpfennig can rent the property out, if he chose to do so. A requirement for accessory dwelling is that the property be owner occupied. Public hearing closed at 6:06PM Motion to approve Case File 29-22PZ made by Commissioner Rosemberg Risa. Motion seonded by Commissioner Gilbert Limones. Motion carried 5-0. V. CASE FILE 30-22PZ V. Consider and act on the request of Arturo Perry, applicant is requesting to subdivide property. The property is located at 726 Ft. Clark Rd., 230 Springer Tract Subdivision Blk B, Lot B1, B2, City of Uvalde, Uvalde County, Texas. a) Staff comments b) Public hearing c) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development demonstrated the property on the Future Land Use Map to the Commissioners. Mrs. Anderson explained that the property is located at 726 Ft. Clark, which is the old Dale Evans house. The developer would like to subdivide the property into 8 lots. The property is zoned Residential 3 and meets all lot size requirements. No letters required for subdivision. Public hearing opened at 6:10PM Ken Dirksen, Engineer is working with Arturo Perry, property owner on this subdivision. Mr. Dirksen stated there is no water or sewer on the property. Mr. Dirksen will work with city staff on obtaining water and sewer as well as all other requirements for property. Public hearing closed at 6:17PM Motion to approve Case File 30-22PZ made by Commissioner Rosemberg Risa. Motion seconded by Commissioner Gilbert Limones.
