Main St. Uvalde, TX 78801 The Regular Planning and Zoning Commission meeting of the City of Uvalde was called to order on Tuesday July 2, 2024, at 6:00PM, in the City Hall, Council Chambers, with the following members present: COMMISSIONERS Matthew Visel-Chair PRESENT: Gabriela Anfinsen Lydia Moss Rosemberg Risa, III Joe Suarez Jose Tomas Garcia-Alt. CASE FILE 20-24PZ 3.A. Consider the request of Dora Margarita Lopez, for a Zone Change from Business 1 to Residential 2a. CASE FILE 22-24PZ 5.A. Consider the request of Dr. Jeff S Curtis, for a Zone Change from Residential 4 to Factory/Industrial division 1. The property is located at 210 E Oak St, NCB 33, Old Town Subdivision, Blk 17, Lot 333, 337, City of Uvalde, Uvalde County Texas. a) Staff comments b) Public hearing c) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development explained to commissioners that this property is located on East Oak St. Property owner is requesting to re-zone from Residential 4 to Factory/Industrial division 1. Jose Saucedo, Code Enforcement Officer stated there were 17 letters mailed, 14 received, 1 returned unclaimed, 1 in favor and 2 opposed. Public hearing opened at 6:09M. Dr. Jeff Curtis, property owner explained to Commissioners that he currently has a storage fuel tank behind the Texas Farm Store and plans to move the tank to this property. The Planning and Zoning Commission asked about any guidelines regarding distance between the fuel tank and a residential area. They also questioned the safety factors involved in storing a fuel tank near a residential area and testing of the land. Mrs. Anderson shared that there are no distance requirements for the storage tank and that the testing by TCEQ is done after the fuel tank is removed from a location to check for any saturation or spillage. Public hearing closed at 6:22PM. Motion to approve Case File 22-24PZ made by Commissioner Joe Suarez. Motion seconded by Commissioner Gabriela Anfinsen. Motion did not pass. Commission Chair Matthew Visel, Commissioner Rosemberg Risa, III and Alternate Commissioner Jose Tomas Garcia opposed. Commissioner Page 2 4 of 3 5  Lydia Moss abstained. Motion did not pass 2-3-1. 6. ADJOURNMENT Motion to adjourn made by Commissioner Joe Suarez. Motion seconded by Commissioner Rosemberg Risa, III. Motion carried.
