Main St. Uvalde, TX 78801 The Regular Planning and Zoning Commission meeting of the City of Uvalde was called to order on Tuesday March 4, 2025, at 6:00PM, in the City Hall, Council Chambers, with the following members present: COMMISSIONERS Gabriela Anfinsen PRESENT: Gilbert Limones Rosemberg Risa, III Joe Suarez Monica De Leona-Alt. Motion seconded by Commissioner Joe Suarez. Motion carried 5-0. III CASE FILE 06-25PZ III. Consider request from Olivia Trevino, for a conditional use permit for a short term rental. The property address is 825 Laurel St. NCB 237, Mahaffey Subdivision, BLK 1 Lot 7, City of Uvalde, Uvalde County Texas. a) Staff Comments b) Public hearing c) Reconvene meeting for discussion and decision on application Page 1 3 of 3 7 Susan Anderson, Director of Planning and Development addressed Commissioners present. Mrs. Anderson explained that this case was previously approved for the former property owner. The property has since been sold, and the new owner wishes to retain the designation. A total of 24 letters were mailed, 17 were received, and 1 remained unclaimed. Public hearing opened at 6:02PM Annabell Rivera, representing the property owner, addressed the commissioners present, requesting approval for the continued use of the property as a short-term rental. Public hearing closed at 6:07PM Motion to approve Case File 06-25PZ made by Commissioner Joe Suarez. Motion seconded by Commissioner Rosemberg Risa, III. Motion carried 5-0. IV CASE FILE 07-25PZ IV. Consider request from MasTec on behalf of AT&T Agent Emily Snow, for a zone change from Residential 1 to Factory/Industrial-Division 1, to allow the construction of a wireless telecommunication structure. The property address is 201 N. High St, NCB 41, Old Town Subdivision, BLK 4, LOT 47, 55A, 63A, 71A, 79A, City of Uvalde, Uvalde County Texas. a) Staff Comments b) Public hearing c) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development addressed Commissioners present. Mrs. Anderson explained that this request was previously presented to both the Planning and Zoning Commission and City Council a year ago but was not approved by either board. Commissioner Gabriela Anfinsen inquired about the reasoning for last year’s denial. Commissioner Gilbert Limones stated that the primary concern was the proximity of a nearby daycare and the potential risk of the tower falling and causing damage. Jose Saucedo, Code Enforcement Officer shared that there were a total of 22 letters mailed, with 11 returned, 2 unclaimed, and 9 not received. Public hearing opened at 6:11PM Mario A. Barragan, Director of External Affairs with AT&T Texas, addressed commissioners present. He began by outlining the benefits of the proposed tower and distributed handouts to the commissioners. Mr. Barragan emphasized that the tower would enhance cellphone coverage in the City of Uvalde, incorporate the latest technology, and support the FirstNet network. Mr. Barragan acknowledged the concerns regarding the tower’s potential to fall and explained that the towers are engineered to withstand winds exceeding 100 miles per hour and are built to endure seismic activity. He further stated that, in the unlikely event of a collapse, the towers are designed to crumble inward rather than fall outward. Public hearing closed at 6:23PM Motion to approve Case File 07-25PZ made by Commissioner Gabriela Anfinsen. Motion seconded by Commissioner (Alt.) Monica De Leon. Commissioner Rosemberg Risa, III and Commissioner Joe Suarez opposed. Motion carried 3-2. V CASE FILE 08-25PZ V. Consider request from NHMP3 LLC on behalf of Robert Holiday, to replat Page 2 4 of 3 7 property into 3 lots. The property address is 2342 E. Main St. & 2344 E. Main St. Abstract 0216 Survey 75, (SEARS) 4.526 & .71, Lot A 0.7102, Lot B 1.202 Acres, Lot C 3.325 Acres, City of Uvalde, Uvalde County Texas. a) Staff Comments b) Public hearing c) Reconvene meeting for discussion and decision on application Susan Anderson, Director of Planning and Development addressed Commissioners present. Mrs. Anderson explained that this request is to replat the property located at 2342 and 2344 E. Main St., property is located east of Hobby Lobby and behind Billy Bob’s. The request seeks to divide the lot into two parcels, with one facing Main St. and the other positioned behind it. The proposed replat meets all requirements, with access provided via the driveway in front of the Sears building. Public hearing opened at 6:28PM Ken Dirksen, the engineer assisting with the project, addressed the commissioners present. He stated that Billy Bob’s will remain unchanged, while the Sears building is planned for removal. The project includes the construction of a hotel in the rear portion of the property, with a potential restaurant or retail development in the front. Public hearing closed at 6:29PM Motion to approve Case File 08-25PZ made by Commissioner Joe Suarez. Motion seconded by Commissioner Rosemberg Risa, III. Motion carried 5-0. A recreational vehicle may be stored on a residential lot if: 1. It is parked on an all-weather surface and is provided with a similarly improved driveway connecting to a street or alley, and 2. It is parked behind the front building line and side building line for corner lots, and 3. It is parked 5’ from the side and rear property lines, and 4. It is not permanently connected to electricity, water, or sewer, and 5. It is not used as a dwelling, and 6. It has a valid license plate and current registration, and 7. No more than one (1) recreational vehicle may be stored per parcel. 2. Temporary Occupancy of Recreational Vehicles – by permit with fee 17.20.020 Certain uses to be located by conditional use permit. B. Uses for which conditional use permits shall be secured, conditions that must be observed and districts in which they may be allowed are: Temporary Occupancy of Recreational Vehicles 1. Recreational vehicles may be used as temporary housing for family members and/or guests on property having as its principal use an existing residence for a period not to exceed seven (7) calendar days from the date of permit issuance, with a one-time renewal of seven (7) days. Temporary housing may not exceed 21 days per calendar year. No rent may be charged or collected for any such temporary occupancy. The permit will be issued administratively and a fee of $15.00 will be charged per permit. 2. Recreational vehicles may be used as temporary housing for a period not to exceed six months on a lot that has an uninhabitable home due to fire, deterioration or act of God that is undergoing repairs. The permit will be issued administratively and will not have a fee. The owner of the property must file a written request with the building official for the installation of temporary housing. The recreational vehicle must be removed when the repairs or reconstruction are complete, or the building permit expires.. If the owner or tenant needs to remain in the temporary housing past the initial time period, the owner must request an extension of time from city council. Page 6 of 7 3. Recreational vehicles may be used as a temporary housing for a period not to exceed six months, for the sole purpose of remodeling or constructing a house provided such applicant provides the building official with proof of commitment for remodeling or construction and is issued a building permit. The recreational vehicle must be removed when construction or remodeling is completed, or the building permit expires. Construction must begin on the property within one week or be in progress when placing the recreational vehicle on the property. If the owner or tenant needs to remain in the temporary housing past the initial time period, the owner must request an extension of time from city council. The permit will be issued after approval by the Planning and Zoning Commission and will be charged the regular fee for zone changes. Page 7 of 7
