CALL MEETING TO ORDER The regular council meeting of the City of Uvalde was called to order on Tuesday, March 10, 2026, at 6:00 P.M, in the City hall Council Chambers with all members present. 2. Jay Pleggenkuhle alongside Jackie Burrow with Stonerose Design Studio from Las Vegas, Nevada addressed council to present the idea of creating a healing garden similar to the one in Las Vegas. The garden was completed within 4 days in Las Vegas at no cost to the City. They are currently working and have completed the contract with Community Health Development, Inc. (CHDI) to begin one on CHDI property located on Ham Ln. They are also in the works with El Progreso Library to create a second location in hopes of bringing the community together. They added that at this time, it is their hope to create a third garden within the City at no cost. All they ask the City if for their assistance to get the word out and get help with community involvement. Page Page51ofof24 5 6. REPORT 6.A. Report by Auditors Crowe LLP regarding the City of Uvalde audit for year ending 2025. Cory Lee, CPA with Crowe LLP addressed the Mayor and City Council regarding the City’s audit results for the fiscal year ending September 30, 2025. She explained the auditors’ responsibilities, the planned scope of the audit, and the overall audit process. The City received an unmodified opinion, which is the highest level of audit opinion and indicates that the financial statements were presented fairly with no material modifications required. During the audit, adjustments were made to accounts payable, restricted cash balances, and aging accounts receivable. Ms. Lee also noted an uncorrected misstatement related to pension liability from the Texas Emergency Services Retirement System. In the prior year, the amount was below the reporting threshold and did not need to be disclosed; however, this year it exceeded the threshold and therefore had to be reported. There were no required communications or significant issues that needed to be addressed with City leadership. Overall, the City ended the fiscal year with a net position of $44,069,891 and an ending General Fund balance of $2,344,381. Councilmember Ernest W. "Chip" King, III asked about the City's Rating on a scale from 1-10, in which Ms. Lee stated she would rate the City’s financial condition a 9 out of 10. 6.B. Report by Ernie Gonzalez with EMC Strategy Group, LLC regarding grant writing services provided to the City. EMC Strategy Group, LLP President and CEO Ernie Gonzalez began by introducing Chief Operating Officer Mitchell Gonzalez, who joined him at the meeting. Mr. Gonzalez stated that he had the opportunity to meet with City Manager Joe Cardenas, Councilmember Ernest Santos, Councilmember Donald “Mac” McLaughlin, III, and Uvalde resident Roy to discuss some of the needs within the community. Parks and Recreation Manager Gloria Resma provided him with a tour of the city pool, and Chief Homer Delgado provided a tour of the police department. Mr. Gonzalez stated that during the tour he was able to observe the need for a new public safety building. Mr. Gonzalez explained that he was addressing the Mayor and City Council to provide a timeline of EMC Strategy Group’s work with the City. He stated that their contract was signed on December 29, 2025. An onboarding briefing was conducted on January 20, 2026, with the City Manager and several city staff members. Approximately two weeks ago, a meeting was held with Parks and Recreation Manager Gloria Resma regarding shovel-ready projects and the steps needed to prepare for the next round of grant applications. Mr. Gonzalez also stated that a funding request for $16.4 million was submitted last week for a proposed landfill project. He explained that monthly reports will be provided to the City Manager and City Council to keep them updated on current activities and the status of any grant applications. In addition, 45 letters of support have been drafted, which are required for submission with the landfill project application. Mr. Gonzalez encouraged everyone to reach out to local businesses and community members who may be willing to sign a letter of support. Mayor Hector Luevano asked whether there were any additional grants currently in progress. Mr. Gonzalez responded that, due to the onboarding process, this was the first grant application currently underway. Page Page62ofof24 5 7. Motion carried 6-0. 8. NEW BUSINESS 8.A. Consider acceptance of Annual Financial Report from Crowe LLP for the year ended September 30, 2025 City Manager Joe Cardenas addressed the Mayor and Councilmembers and advised that this was the first year the City worked with Crowe LLP as its auditing firm. He explained that the City typically changes auditors every six to eight years. City Manager Cardenas stated that the City’s financials look good and thanked staff for their hard work throughout the process. He concluded by recommending that the financial report for the fiscal year ending September 30, 2025, be accepted. Motion to approve item 8A was made by Councilmember Donald "Mac" McLaughlin. Motion seconded by Councilmember Constantine "Con" Mims. Motion carried 6-0. 8.B. Consider approval of Grant Resolution for State Homeland Security Program Law Enforcement Terrorism Prevention Activities (LETPA) for FY26 Assistant Chief Michael Davis began by explaining to Mayor and Council that a signed resolution is needed to move forward with the application for a federal grant. The grant is for an armored personal vehicle that will be shared asset housed at Uvalde Police Department. Because it is shared all Middle Rio Grande agencies will have access to that as well. The application that was previously presented for ballistic shields has been exhausted and no monies are available leaving the department without those resources. Assistant Michael Davis explained the grants are popular base and once is approved the monies are split between multiple agencies. Motion to approve item 8B was made by Councilmember Ernest Santos. Consider approval of Memorandum of Understanding Between Sacred Heart Catholic School and City of Uvalde, Texas City Manager Joe Cardenas addressed Mayor and Council explaining that in case of an emergency the Civic Center would be used a reunification center. City Manager Cardenas recommends that the MOU be executed and the city move forward with it. Motion to approve item 8C was made by Councilmember Ernest "Chip" King, III. Motion seconded by Councilmember Constantine "Con" Mims, III. Motion carried 6-0. 8.D. Consider approval of Memorandum of Understanding with Southwest Texas College regarding the College's use of the City's Firing Range City Manager Joe Cardenas addressed Mayor and Council advising them for many years it was an understood, "handshake" agreement with many agencies however, it will be on paper now. The Memorandum of Understanding (MOU) is now required because the academy is licensed through the Texas Commission of Law Enforcement and that is a requirement. All parties agreed on the wording of the MOU and request to move forward with the acceptance of the MOU. Motion to approve item 8D was made by Councilmember Ernest Santos. We plan to host an event in Campwood, Uvalde, and Sabinal for area residents to take part and ensure their pet’s vaccinations are current. Many cat & dog diseases are very prevalent in our area, so hosting yearly rabies drives are important not only for the community animals but also for the health/safety of the community as a whole. Any person who shall violate any of the provisions of this ordinance, or shall fail to comply therewith, or with any of the requirements thereof, within the City limits shall be deemed guilty of an offense and shall be liable for a fine not to exceed the sum set out in Section 1.12.010 of this Code. Each day the violation exists shall constitute a separate offense. Proof of a culpable mental state shall not be required to establish a violation of this ordinance. All rights and remedies of the City of Uvalde are expressly saved as to any and all violations of the provisions of any ordinances regarding historic tax exemptions which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. Section 5. Effective Date. This Ordinance shall take effect immediately from and after its passage and publication in accordance with the provisions of the Tex. Loc. Gov’t. Code and the City Charter. Section 6. Severability. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable and, if any phrase, sentence, paragraph or section of this Ordinance should be declared invalid by the final judgment or decree of any court of competent jurisdiction, such invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation into this Ordinance of any such invalid phrase, clause, sentence, paragraph or section. If any provision of this Ordinance shall be adjudged by a court of competent jurisdiction to be invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision, and to this end the provisions of this Ordinance are declared to be severable. Section 7. Open Meetings. It is hereby officially found and determined that the meeting at which this Ordinance is passed was open to the public as required and that public notice of the time, place and purpose of said meeting was given as required by the Open Meetings Act.
