CITY COUNCIL Regular Meeting December 5, 2016 7:30 P.M. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the American Flag was given by all present. CALL TO ORDER: Mayor Gottman called the regularly scheduled meeting of the Vandalia City Council to order at 7:30 P.M. ROLL CALL: Aldermen present were: Hubler, Lester, B. John Clark, Hobler, Crawford and Swarm. Stunkel and Rebbe were absent. MINUTES: A motion was made by Hobler and seconded by Hubler approving the minutes from the November 21, 2016 meeting as presented. Motion carried. REGULAR BILLS: A motion was made by Swarm and seconded by Hobler approving the regular bills as presented. Motion carried. TREASURER’S REPORT: A copy of the Treasurer’s Report will be filed for audit. SPECIAL BILLS: A motion was made B. John Clark and seconded by Swarm approving the Special Bills as listed: SCIRP&DC in the amount of $4,117.00 for technical outside services; Ameren Illinois in the amount of $4,056.91 for street lights; Land of Lincoln Credit Union in the amount of $12,488.50 for fire truck payment; Rusani, Inc. in the amount of $10,675.00 for TIF reimbursement; PMSI in the amount of 1  $2,572.30 for saw; U.S. Bancorp in the amount of $14,781.19 for water meters; Brenntag in the amount of $18,865.46 for chemical supplies; Kaskaskia Springs Water Company in the amount of $2,095.20 for water. Motion carried. DISCUSSION OF 2016 TAX LEVY: Dale Timmermann of Timmermann & Associates presented numbers to the City Council explaining that the council can utilize the tax levy that the actuary has come up with or you can use the tax levy that the Department of Insurance has come up with. Timmermann said at this time we do not have the figures from the Department of Insurance. The city is required to act on the tax levy by the December 19th council meeting. Timmermann brought examples of possible tax levies that the aldermen may choose to adopt and offered to draft ordinances for each proposal in time for the next council meeting. APPROVAL OF COUNCIL MEETINGS A motion was made by Swarm and FOR 2017: seconded by Hobler approving the Council Meetings for 2017 as presented. Motion carried. APPROVAL OF HOLIDAY LIST FOR A motion was made Crawford and 2017: seconded by Swarm approving the Holiday List for the employees for 2017. Motion carried. ORDINANCE #2016-12-5-A: A motion was made by Hobler and AMENDING THE VANDALIA seconded by Crawford approving MUNICIPAL CODE AT TITLE V Ordinance #2016-12-5-A, Amending The BUSINESS LICENSES AND Vandalia Municipal Code At Title V REGULATIONS AT SECTION Business Licenses And Regulations At 5.08.270 CLASS T LICENSES Section 5.08.270 Class T Licenses. 2  This ordinance will allow current liquor license holders to cater events within the city limits of Vandalia at locations other than their place of business. This will change the city’s Class T liquor licenses by omitting a subsection in the current code that stipulates how many licenses may be held for a certain location. As the code reads now, the code capped off the liquor license allowances to two per year for a certain location. The amendment will allow license holders and owners of the properties that host off-site events to jointly apply for the Class T licenses multiple times per calendar year. City Attorney Connor said the council could put forth a special events license but instead, this action on a license that was already in place and hardly used because of the limited restriction. MAYOR’S REPORT: Mayor Gottman reported that he attended the IML meeting in Chicago on Saturday, December 3rd. Senator Christine Radogno was the key speaker at the meeting. The city received a check from Emerick Farms in the amount of $31,388.40 for crops from the land owned by the city. A copy of the IDES news release was included in your packets. 3  A copy of the project status report from Hurst-Rosche was also included in your packets. A copy of the Code Official’s Report is included in your packet. CITY CLERK’S REPORT: Clerk Peggy Bowen announced that Monday, December 12th will be the first day to file for the Consolidated Election to be held on April 4, 2017. STANDING COMMITTEES: Swarm reported that Public Works Director Marlin Filer has been looking for the water leak that has been causing problems. They think they have found it. The Vandalia Police Department received their new squad car. Hobler reported that Marlin Filer, Public Works Director has received a bid on repair to the levy. That will be discussed at the next council meeting. COUNCIL CONCERNS: Lester asked, if the city is powerless to do anything to clean the exterior wall of the building that was exposed when the city demolished two building at the northwest corner of Fifth & Gallatin Street. City Attorney Connor said that any effort to address the issue would have to be directed toward health and safety. So, it would be directed at the stability of the wall rather than the appearance of the wall. The city can regulate anything that’s related to health & safety. Lester said that he would like to see if the city can come up with a way to address this kind of situation as it arises. 4  Swarm asked where do we stand in converting the area where the fuel tanks are at into a salt shed for the Public Works. Mayor Gottman said that Marlin got a couple bids on it but haven’t had a meeting to discuss it. Marlin Filer said that the current salt bin is collapsing. Mayor Gottman asked that B. John Clark call a meeting to discuss the bids. Swarm asked if the city received money to replace one of the sheds at the cemetery? Mayor Gottman said yes, the city did receive a check to do so. Swarm asked if we could put that out for bid, but Mayor Gottman and Chairman of the Cemetery Committee suggested that we wait till spring to do so. Swarm also questioned “occupancy permits” on rental property. He felt this is something the city needs to look into further. Mayor Gottman said that over the winter months they will be looking into this. COUNCIL MOVES INTO EXECUTIVE A motion was made by Swarm and SESSION AT 8:16 P.M.: seconded by Crawford to move into Executive Session at 8:16 P.M. under 5ILCS120/2 for personnel matters of the hiring, firing or discipline of an employee.
