City Council Special Session
June 11, 2018
Monday 5:15 p.m.
The regular session of the City Council, City of Vermillion, South
Dakota was called to order on Monday, June 11, 2018 at 5:15 p.m. by
Mayor Powell in the City Hall second floor large conference room.
1. Roll Call
Present: Collier-Wise, Erickson, Holland (arrived 5:17 p.m.),
Humphrey, Meins (arrived 5:17 p.m.), Price, Sorensen, Mayor Powell
Absent: Ward
2. Pledge of Allegiance
3. Adoption of Agenda

Alderman Price moved approval of the agenda. Alderman Collier-Wise
seconded the motion. Motion carried 6 to 0. Mayor Powell declared the
motion adopted.
4. Visitors to be Heard – None
Alderman Holland and Meins arrived at 5:17 p.m.
5. New Business
A. Canvass of June 5, 2018 Municipal Election Results
Mike Carlson, Finance Officer, stated that the duties of the Canvassing
Board are to open the returns from each precinct, which are found in
the poll book, determine that the returns are genuine and not forged,
tabulate the returns from the precincts, declare the results and make
an abstract of the results that is to be signed. Mike reported that the
County Commission and School Board have canvassed the results for the
primary election so the poll book envelopes have been opened, but were
again sealed with paper seals. Mike stated that attached to each poll
book is the detail results for that precinct, copy of the county
results listing each precinct and the total and the unofficial results
for the city. Mike stated that the totals from the poll book can be
compared to the precinct results and the precinct results can be traced
to the unofficial results. Mike noted that the County Auditor reported
that there were no provisional ballots in any of the City wards. The

Mayor and City Council examined the poll books along with election
results for each ward. Discussion followed.

Alderman Erickson moved approval of the official election results from
the June 5th election as follows:

We, the undersigned, appointed as the Board of Canvassers because of
our position on the governing body in the jurisdiction of the City of
Vermillion for the municipal election held on the 5th day of June,
2018, hereby certify that the foregoing is a true abstract of the votes
cast in the City of Vermillion at the election as shown by the returns
certified to the person in charge of the election.
The Council members signed the election results and Alderman Price
seconded the motion. Motion carried 8 to 0. Mayor Powell declared the
motion adopted.

Alderman Sorensen moved to adjourn the Council Meeting at 5:31 p.m.
Alderman Erickson seconded the motion. Motion carried 8 to 0. Mayor
Powell declared the motion adopted.

As the Northwest Ward vote was a tie one of the candidates
requested a recount that was held on June 15, 2018. The recount
ended in a tie so drawing for lots was set for 11:45 am on June 18,
2018. At the drawing for lots Howard Willson was drawn and became
the Alderman for the Northwest Ward.

Subject: Canvass of June 5, 2018 Election Results
Presenter: Mike Carlson
Background: State law requires the canvass of the election results by the governing body
within seven days of the election.
9-13-24. Return and canvass of votes.
The election returns shall be reported as soon as possible to the finance officer, and within seven
days of the election, the governing body shall canvass the election returns, declare the result, and
enter the result on its journal.
Discussion: The Administrative Rules list the duties of the board of canvassers as
follows:
5:02:17:12. Duties of official board of canvassers for local jurisdiction.
The duties of the official board of canvassers for a local jurisdiction are as follows:
(1) Open the returns from each precinct which are found in each poll book;
(2) Satisfy itself that the returns are genuine and not forged;
(3) Tabulate the returns from the precincts and the certification of provisional ballot count;
(4) Declare the result; and
(5) Make an abstract of the results of the votes cast for each of the candidates and each of the
issues. The abstract must be signed and certified by the canvassers under the seal of the
business manager or finance officer of the local jurisdiction.
It should be noted that the poll books have been opened by the County and School when
canvassing. The total number of voters in the poll book should be compared to the total
ballots counted from the tabulation machine printout. The recap sheets for each precinct
(ward) along with the tabulation machine printout for each City Ward are attached.
I have completed an abstract of the results from the unofficial election results sheets,
which will need to be signed unless there are any changes found.
Financial Consideration: None.
Conclusion/Recommendations: A motion will need to be made to certify the election
results and all members will need to sign the abstract.
