Unapproved Minutes Council Special Session March 18, 2019 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, March 18, 2019 at 12:00 noon at the City Hall large conference room. 1. Roll Call Present: Collier-Wise, Hellwege, Holland, Humphrey, Price, Sorensen, Ward, Willson, Mayor Powell 2. Visitors to be Heard - None 3. Informational Session – Small cell technology – John Prescott John Prescott, City Manager, reported that the City has reviewed the model small cell ordinance as developed by the SDML and earlier this year adopted aesthetic standards for small cell infrastructure. John introduced Jeff Armour and Sarah Meuli who are representing Verizon to review small cell. Sarah Meuli and Jeff Armour, representing Verizon, made a presentation on next generation technology known as small cell. Sarah presented a video explaining wireless communications networks and small cell. Sara reviewed the need for small cell as wireless usage grows noting that the lead time for design and construction is 18 to 24 months. Sarah provided pictures of small cell installations in Minneapolis, Omaha and Des Moines. Jeff reviewed the FCC regulations that govern how carrier/cities deploy small cell, noting the need to be reasonable and cost-neutral while aesthetic requirements must be reasonable and nondiscriminatory. Jeff noted that the state of South Dakota has not adopted any state regulations thus the carriers will need to work with each city. Sarah reported that the next step would be Vermillion’s desired permitting process being a master lease agreement or city ordinance. Sarah noted that a draft master lease agreement has been provided to the City as well as a timeline to proceed. Jeff stated that they would prefer a master lease agreement with the City as was done in Sioux Falls but Jeff noted that they would work with the City on either the master lease or ordinance. Sarah and Jeff answered questions of the City Council on small cell and the master lease. John Prescott, City Manager, reviewed the differences between the model ordinance as proposed by the SDML, the City of Sioux Falls master lease agreement with Verizon and the draft master lease agreement provided to the City. John stated that staff is looking for direction from the City 1 Council on if they want to proceed with small cell being an ordinance or master lease agreement. John noted that an ordinance might also require a smaller lease agreement with each provider. Alderman Ward requested to leave the meeting at 12:50 p.m. Jim McCulloch, City Attorney, stated that he has reviewed the model ordinance as provided by the SDML and the draft master lease agreement provided by Verizon. Jim stated that he has not reviewed the Sioux Falls master lease agreement. Jim noted that the options would be an ordinance to address all providers or a master lease agreement with each provider. Jim noted that the FCC addressed the amount of fees that can be charged which would need to be the same under either option. Jeff and Sarah stated that they would be willing to work with the City on the ordinance or master lease agreement. Discussion followed on the options with the consensus of the City Council to request the review and report by the Utility Committee. 4. Educational Session – Highway 50 storm drainage study – Jose Dominguez Mayor Powell stated that due to time this item will need to be continued to a future meeting. 5. Briefing on the March 18, 2019 City Council Regular Meeting Council reviewed items on the agenda with City staff. No action was taken. 6. Minutes of March 4, 2019 Special Meeting; March 4, 2019 Regular 75-19 Alderman Price moved approval of the March 4, 2019 Special Meeting and March 4, 2019 Regular Meeting minutes. Alderman Holland seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 4. Adoption of Agenda 76-19 Alderman Willson moved approval of the agenda. Visitors to be Heard National Music Museum Scott Lawrence, Chairman of the Board of National Music Museum, introduced Matt Collinsworth as the new Museum Director and Larry Schou, Dean of the College of Fine Arts. Mr. Lawrence reported on the nationally recognized collection at the museum. Mr. Lawrence stated that, on behalf of the entire National Music Museum Board, he wanted to thank the City Council for the contribution of $100,000 per year for the next seven years. 6. Public Hearings 3 A. Special daily malt beverage and wine license for the Vermillion Area Farmers Market at 202 Washington Street for a fundraising event on March 28, 2019 Mike Carlson, Finance Officer, reported that an application has been received for a special daily malt beverage and wine license from the Vermillion Area Farmers Market for a fundraising event on March 28th at 202 Washington Street. Mike stated that the press release on the event, Police Chief's report and notice of hearing were included in the packet. Mike stated that Grace Freeman completed the application and staff is not aware of any problems with previous special daily licenses for the Vermillion Area Farmers Market. Grace Freemen, representing Vermillion Area Farmers Market, explained the fundraising event. 77-19 Alderman Price moved approval of the special daily malt beverage and wine license for the Vermillion Area Farmers Market for a fundraising event on or about March 28, 2019 at 202 Washington Street. Alderman Ward seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 7. Old Business A. Second reading of Ordinance 1399 to amend Title III, Administration, Chapter 32, City Organizations to amend definitions and complaint processes for the Human Relations Commission, and add Commission Subcommittee preliminary review. Addison McCauley, Vermillion Human Relations Commission Chairperson, reported that, since appointed, the Commission has been focusing on finalizing and disseminating the complaint Alternative Dispute Resolution (ADR) timelines, templates, and policies. Addison stated that the Board came to realize that some amendments to the adopted ordinance would be required to accommodate for regulations in state statutes as well as the practical implementation of the complaint ADR procedures. Addison reported that the ordinance amendments address policies regarding the procedure timeline and mode of notification for both parties, the addition of a Commission Subcommittee charged with the preliminary review of received complaints, a statute workaround with regard to the definition of officially “filing” a complaint, and other basic formatting alignment corrections. Addison reported that a draft ordinance was included with the committee report at the February 19th City Council meeting. Addison reported that first reading was approved at last meeting noting that no changes or comments have been received since then. Discussion followed. 4 78-19 Second reading of title to Ordinance 1399, entitled An Ordinance Amending Title III, Administration; Chapter 32, City Organizations; Sections 32.41, 32.47, and Sections 32.50 through 32.61 Amending Definitions, Correcting Formatting, Clarifying a Quorum, and Dismissal, Preliminary Review, And Investigation Of Complaints for the Vermillion Human Relations Commission of the City of Vermillion, South Dakota. Mayor Powell read the title to the above named Ordinance, and Alderman Sorensen moved adoption of the following: BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1399, entitled An Ordinance Amending Title III, Administration; Chapter 32, City Organizations; Sections 32.41, 32.47, and Sections 32.50 through 32.61 Amending Definitions, Correcting Formatting, Clarifying a Quorum, and Dismissal, Preliminary Review, And Investigation Of Complaints for the Vermillion Human Relations Commission of the City of Vermillion, South Dakota was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 4th day of March, 2019 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 18th day of March, 2019 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE NO. 1399 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES TITLE III: ADMINISTRATION, CHAPTER 32: CITY ORGANIZATIONS. BE IT ORDAINED by the Governing Body of the City of Vermillion that South Dakota Title III: Administration Chapter 32; City Organizations be amended as follows: § 32.41 DEFINITIONS. COMPLAINANT. A person for whom, or on whose behalf, a verified complaint alleging unlawful discrimination has been submitted to the Commission. DISABILITY. A physical or mental impairment of a person resulting from disease, injury, congenital condition of birth or functional disorder which substantially limits one or more of the person's major life functions; a record of having an impairment; or being regarded as having an impairment which: 5 (A) For purposes of § 32.49 (A) through (C), inclusive, is unrelated to an individual's ability to perform the major duties of a particular job or position, or is unrelated to an individual's qualifications for employment or promotion; (B) For purposes of § 32.49 (D) and (H) is unrelated to an individual's ability to acquire, rent, or maintain property; and (C) For purposes of § 32.49 (E) and (F) is unrelated to an individual's ability to utilize and benefit from opportunities, programs, and facilities of accommodations and services. This term does not include current illegal use of or addiction to marijuana as defined in SDCL subdivision 22-42-1(7) or a controlled substance as defined in SDCL subdivision 22-42-1(1). DISCRIMINATORY OR UNFAIR PRACTICE. Any unlawful act or attempted unlawful act which, because of sex, race, color, creed, religion, ancestry, disability, national origin or familial status, results in the unequal treatment or separation or segregation of any person, or denies, prevents, limits or otherwise adversely affects, or if accomplished would deny, prevent, limit or otherwise adversely affect the benefit or enjoyment by any person of employment, a labor union membership, housing accommodations, property rights, education, public accommodations, and public services. DISCRIMINATORY OR UNFAIR PRACTICE as defined above is unlawful and is a violation of this subchapter. In addition, it is the policy of the City that discriminatory practices based on marital status, military or veteran status, gender identity, or sexual orientation, while not prohibited by state law, constitute unfair practices which adversely affect people. The Commission, through public information promotion and as permitted by § 32.50, will seek to improve human relations and eliminate such unfair practices. Accordingly, discriminatory practices based on marital status, military or veteran status, gender identity, or sexual orientation will not be investigated or be the subject of complaint resolution procedure until permitted by state law. However, such acts may be brought to the attention of the Commission by a complainant in the form of a verified complaint, which is consistent with the provisions of § 32.51 for record keeping and referral purposes. FILE. A verified complaint is officially FILED with the Commission when the Commission has completed a preliminary review of said verified complaint and determined that an investigation of discriminatory or unfair practice shall commence in accordance with SDCL 20-12-4. PARTY. The complainant or the respondent. 6 REAL ESTATE BROKER OR REAL ESTATE SALESPERSON. A real estate broker and a real estate salesperson as defined by SDCL 36-21A-6 or as licensed pursuant to SDCL 36-21A-47. RESPONDENT. A person against whom a verified complaint alleging unlawful discrimination has been filed. § 32.47 QUORUM/RULES AND REGULATIONS. (A) A majority of the voting members of the Commission then holding a current appointment shall constitute a quorum for the transaction of all official business. (B) Any decisions made by the Commission regarding actions to be taken on any official business shall be determined by a majority of a quorum. § 32.50 SUBSTANTIVE AND PROCEDURAL AUTHORITY AND DUTIES. The authority and duties of the Commission shall be to: (O) Hear and inquire into verified complaints alleging discrimination regarding the City of Vermillion in accordance with the procedures set forth in this subchapter. Pursuant to state law, there is presently no legal authority to investigate verified complaints alleging discrimination because of marital status, military or veteran status, gender identity, or sexual orientation. Accordingly, until state law authorizes municipalities, pursuant to SDCL 20-12-4, to investigate discriminatory practices based on marital status, military or veteran status, gender identity, or sexual orientation, these discriminating practices cannot be investigated by the Commission. However, such acts may be brought to the attention of the Commission by a complainant in the form of a verified complaint, which is not inconsistent with the provisions outlined in § 32.51, for record and referral purposes. The Commission shall have no regulatory enforcement powers which are inconsistent with the provisions of this subchapter. § 32.51 SUBMITTING A VERIFIED COMPLAINT. (A) Any person claiming to be aggrieved by a discriminatory practice may submit to the Commission a verified complaint which shall state the name and address of each person complained against (respondent[s]) and shall set forth the pertinent facts as known to the complainant. (B) Any verified complaint shall be submitted to the Commission by means of completing and submitting a verified complaint form made available to the public by the City. 7  (C) Any verified complaint submitted with the Commission under this subchapter shall be submitted within one hundred and eighty (180) calendar days after the last occurrence of an alleged discriminatory or unfair practice. § 32.52 DISMISSAL OF COMPLAINT PRIOR TO FILING. The Commission may order the dismissal of any verified complaint prior to investigation if the Commission determines in good faith that: (A) The unlawful act or practice complained of occurred outside city limits; (B) The verified complaint has been abandoned or withdrawn by the complainant; (C) The City is not authorized by state law to investigate the verified complaint; (D) The complainant fails to state a claim within the verified complaint form upon which relief can be granted; (E) The unlawful act or practice complained of has been satisfactorily eliminated and that further proceedings are unnecessary; or (F) The allegations complained of are being processed or have been addressed to the satisfaction of the Commission by another agency or by a court of competent jurisdiction. § 32.53 COMMISSION SUBCOMMITTEE PRELIMINARY REVIEW. (A) Promptly upon the receipt of any verified complaint, either the Commission Chairperson or Vice Chairperson shall meet with two additional Commission Members within ten (10) calendar days to review and recommend whether or not said verified complaint shall be dismissed as prescribed in § 32.52. These three Commission Members shall be referred to as the Commission Subcommittee for said verified complaint. (B) Promptly after the review of any verified complaint by a Commission Subcommittee, the Commission Subcommittee shall submit a report to the Commission summarizing their recommendation and reasoning therefore. (C) The Commission shall meet to review any Commission Subcommittee report within five (5) calendar days of the completion of said report. § 32.54 SERVICE OF RESPONDENT AND VERIFIED ANSWER. (A) Upon review of any Commission Subcommittee report, the Commission shall promptly either: 8  (1) Dismiss the verified complaint as prescribed in § 32.52 and serve a notice of complaint dismissal, by personal service or registered or certified mail, unto the complainant; or (2) File the verified complaint and serve a notice of complaint investigation, by personal service or registered or certified mail, unto the complainant and a notice of complaint and investigation and verified response form, by personal service or registered or certified mail, unto the respondent. (B) Within fifteen (15) calendar days after the service of a notice of complaint and investigation, or within any period of extension granted by the Commission Chairperson, the respondent may submit to the Commission a completed verified response form. § 32.55 COMPLAINT INVESTIGATION; DETERMINATION OF PROBABLE CAUSE AND REFERRAL. (A) Except to the Commission and either party involved in a verified complaint, any and all documents submitted to or created by the Commission, or copies thereof, regarding an allegation of discrimination asserted in said verified complaint shall remain confidential documents until such time as the matter is transferred to either a court of competent jurisdiction or to the State Commission of Human Rights. (B) Within five (5) calendar days following the fifteen-day wait period, or following any period of extension granted by the Commission Chairperson to allow for a respondent to submit a completed verified response form, the Commission shall meet and proceed in good faith to investigate a verified complaint and verified answer to determine whether there is probable cause to support any allegations of discriminatory or unfair practice. (C) If the respondent does not wish to submit a verified response form, probable cause shall be determined with regard to the information available to the Commission. (D) The Commission may request the complainant and/or the respondent to appear before the Commission for a pre-determination conference if deemed necessary by the Commission. (E) Upon the completion of any investigation of discriminatory or unfair practice by the Commission, the Commission shall promptly serve a notice of determination of probable cause, by personal service or registered or certified mail, unto both parties. Additionally, referrals to appropriate state regulatory bodies and 9  other relevant resources that may help to remedy the matter may be sent along with the notice of determination of probable cause. (F) The Commission shall keep for record any and all documents, or copies thereof, regarding an allegation of discrimination asserted in a verified complaint form submitted to the Commission. Both parties shall be permitted to inspect any documents not prepared by the Commission in the possession of the Commission that are relevant to the determination of probable cause upon request. § 32.56 CONSULTING WITH THE CITY ATTORNEY. (C) The Commission shall only request to employ the consultation services of the City Attorney when the Commission members believe that it is necessary for the just and competent effectuation of their duty to determine probable cause regarding a specified matter, or specified matters, within a verified complaint that has been submitted to the Commission. § 32.57 TRANSFER AFTER PROBABLE CAUSE DETERMINATION. If the matter before the Commission is not resolved informally, either party must elect to assert their claims in circuit court in order to have them determined. If such election does not occur within twenty (20) calendar days following notice of probable cause determination, the matter shall be dismissed by the Commission. § 32.58 TRANSFER OF COMPLAINTS TO STATE COMMISSION. Upon the filing of any verified complaint, the parties to the verified complaint shall be notified that any party thereto may, within fifteen (15) calendar days of the date of receipt of the notice of the proceeding, demand as a matter of right that the matter be transferred to the State Commission of Human Rights, which shall process the verified complaint under the provisions of SDCL Ch. 20-13. Immediately upon receipt of notice of a party’s demand to transfer the verified complaint under this provision, the Commission shall forward the verified complaint to the State Division of Human Rights and shall thereafter have no further jurisdiction with regard to the verified complaint. Statutory reference: Similar provision, see SDCL § 20-12-9 § 32.59 RIGHTS OF PARTIES NOT ABRIDGED. § 32.60 APPLICATION TO OTHER DISABILITIES. 10 § 32.61 SEVERABILITY CLAUSE. Mayor Powell declared that the Ordinance has been adopted and directed publication thereof as required by law. 8. New Business A. Certified Local Government agreement with State Historic Preservation Office for program application John Prescott, City Manager, reported that in 2018 the City Council adopted an ordinance establishing a Historic Preservation Commission and made appointments to the seven-person Commission in September 2018 and the first meeting was held in October 2018. John stated that the State Historic Preservation Office, in partnership with the National Park Service, has a program called Certified Local Government (CLG). John reported that the national perspective on the program is that the primary responsibility of the CLG is to review local nominations to the National Register of Historic Places and offer input. John reviewed the five requirements to become certified. John reported that if CLG status is obtained the City is required to submit an annual report to the State Historic Preservation Commission every February and the State also requires at least one historic preservation workshop per year, as well as an annual public education program. John reported that the Vermillion Historic Preservation Commission recommended that the City Council pursue CLG designation. John noted that a briefing on the CLG program was provided at the March 4, 2019 noon meeting and to submit an application for CLG designation, the City Council would need to approve the attached agreement. John stated that the agreement, along with 11 documentation establishing the Historic Preservation Commission and resumes of the Commission, would be submitted to the State Historic Preservation Office (SHPO) for consideration. John noted that the SHPO makes a recommendation on awarding CLG designation but the final decision is made by the National Park Service. Gloria Barns, representing the Vermillion Historic Preservation Commission, stated that the Board recommended the Local Government Certification program. 79-19 Alderman Sorensen moved approval of the Local Government Certification Agreement between the State Historic Preservation Office and the City for the Vermillion Historic Preservation Commission. Alderman Humphrey seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. B. Report of Policies and Procedures Committee and Labor and Finance Committee on BBB ordinance changes. Alderman Collier-Wise, Chairman of the Labor and Finance Committee, reported that at the February 4th noon meeting Alderman Willson presented a proposal to modify the language of Section 34.24 dealing with the use of the BBB sales tax funds. Alderman Collier-Wise reported that the Policies and Procedures Committee met on February 28th to review the proposal with recommendations to modify the first and second sentence and remove the proposed second paragraph. Alderman Collier- Wise reported that the Labor and Finance Committee met on March 6th and made adjustments to the second sentence which is included in the final report being presented tonight. Alderman Collier-Wise thanked Alderman Willson for bringing this proposal to the committees for consideration. Alderman Willson thanked the committees for their review of his proposal for the use of the BBB sales tax funds. 80-19 Alderman Willson moved to recommend the acceptance of the report of the Policies and Procedures Committee and Labor and Finance Committee on BBB ordinance changes. Alderman Humphrey seconded the motion. Alderman Sorensen stated that he felt the current ordinance language meets the statute requirements and suggested that the first sentence wording be changed from will to may. Alderman Collier-Wise also reported that during the discussions it was recommended that the Vermillion Chamber of Commerce and Development Company present their budget request to the City Council as well as information that should be included in the budget request as a more formal recognition of the partnership between the two entities. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 12 C. Tree Board appointment Mayor Powell reported that Clarence Pederson was appointed to fill the remaining year of the term vacated by Howard Willson following his election to the City Council in 2018. Mayor Powell noted that Mr. Pederson is unable to complete the remainder of the term that expires in September 2019. Mayor Powell recommended the appointment of Joan Doss to fill the remainder of the term and thanked Clarence Pederson for his service on the Tree Board. 81-19 Alderman Price moved approval of the appointment of Joan Doss to the Tree Board filling the remainder of the term expiring in September 2019. Alderman Collier-Wise seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. D. Planning Commission appointment Mayor Powell reported that Robert Oehler has resigned from the Planning Commission with his term expiring in 2022. Mayor Powell recommended the appointment of Keith Gestring to fill the remainder of the term. 82-19 Alderman Willson moved approval of the appointment of Keith Gestring to the Planning Commission filling the remainder of the term expiring in 2022. Alderman Humphrey seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 9. Bid Openings - None 10. City Manager's Report A. John reported that Paint South Dakota will take place again this June. John stated that this program is seeking a volunteer group to paint a single, family owner-occupied home in need of painting. John noted that the owner should be physically or financially unable to paint the home. John asked eligible homeowners and volunteer groups to contact the City so that Vermillion can apply to be one of the 25 grants in South Dakota this year. John stated that applications are due by April 12th. B. John reported that the Planning Commission next meets on Monday, March 18th at 5:30 p.m. John noted that one of the items on the agenda is the continuation of Conditional Use Permit for storage units at 911 N Norbeck on Lot 10, Block 1 Brooks Industrial Park. 13 C. John reported that the next Tree Board meeting is on March 27th at 9:30 a.m. at City Hall. D. John asked City Council members if they would like a hard copy of the budget book that has 2019 budget and 2018 actuals, please let him know as the book is in the final stages noting that all will receive an electronic copy.
