Unapproved Minutes Council Special Session December 2, 2019 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, December 2, 2019 at 12:00 noon at the City Hall large conference room. 1. Roll Call Present: President Collier-Wise, Hellwege, Holland, Price, Sorensen, Willson Absent: Humphrey, Ward, Mayor Powell 2. Visitors to be Heard 3. Educational Session – Discussion of requiring permits for roofing and siding work – Historic Preservation Commission Susan Keith Gray, President of the Vermillion Historic Preservation Commission, reported that the Commission has five days to review a building permit issued in a historic district. The review was to determine if the permitted activities encroached upon, damaged or destroyed historic properties. Susan noted that the Commission can only provide input to the permit applicant and did not have the ability to force any changes. Susan stated that, during an information review of an area under consideration for a district, it was brought to the Commission’s attention that properties have converted to metal roofs and vinyl siding. Susan stated that, in talking to Farrel Christensen, Building Official, building permits are not required for roofs or siding and, as such, there were no roof or siding permits to forward to the Commission for review. Susan requested that the City Council could make a change to require the permits for siding and roofing in the historic districts to allow the Commission time to inform the property owners of the options available. Farrel Christensen, Building Official, reported that when the City adopted the Uniform Building Codes it has included an exception for roof and siding. Farrel stated that in contacting other cities a majority require permits for roofing and about 50% require permits for siding. Farrel noted that he would recommend that all properties obtain the permits for siding and roofs, not just those in the historic districts, so there is less confusion. Farrel stated that this would require an ordinance change and that, as with window permits, maybe a fixed fee could be set for siding and roofs. 1 Discussion followed with Susan answering questions of the City Council on the Historic Preservation Commission and Farrel answered questions on the building code. The consensus of the City Council was to have staff bring forward a change to the ordinance to require permits for siding and roofs along with establishing a fee for each permit and/or combined permits. 4. Informational Session – Change Network project – Integrating the Arts – Susan Heggestad Susan Heggestad, President of the Vermillion Area Arts Council, as well as member of other boards throughout the years, stated that as part of a Bush Foundation Change Network for professional development she has selected integrating the arts as her community project. Susan stated that the project will be discussion based involving many organizations and individuals in the community. Susan stated that the Change Network grant is to empower people to bring about change to elevate the organizations in the community. Susan lead the City Council in discussion of arts in the community. Susan stated that she will be conducting other discussion groups with individuals and organizations to gather information for her report and thanked the City Council for their participation. 5. Briefing on the December 2, 2019 City Council Regular Meeting Council reviewed items on the agenda with City staff. No action was taken. 6. First Reading of Ordinance 1395 establishing Business Improvement District #2 to complete streetscape improvements in the downtown business as defined by Resolution James Purdy, Assistant City Manager, reported that the City Council and the Business Improvement District (BID) #2 Board of Directors have been discussing an infrastructure project commonly referenced as the Downtown 3 Streetscape Project for the last couple of years. James noted that the eligible streetscape improvement expenses may include: removal and reconstruction of sidewalks, removal and reconstruction of street pavement as needed, removal and reconstruction of curb and gutter, construction of landscaping features, signage, street lighting, landscaping, storm sewer improvements, and necessary staffing for the consultant to execute these efforts. James reported that the City does not anticipate losing any public parking spaces to this project and may see a net gain. James stated that a goal for the project design will be to avoid any complete street closures during construction and the consultant will be expected to find creative ways to limit the affect the construction has on business operations. James noted that the construction project’s limits are both sides of Main Street from the west side of Ratingen Platz to the east side of the intersection with Dakota Street, both sides of Market Street from West Main to Kidder Street, both sides of Court Street from West Main to Kidder Street, the east side of Elm Street from East Main Street to the first east-west alley north of East Main Street, both sides of Center Street from Main Street to the first east-west alley north of Main Street, and the east side of Prospect Street from West Main Street to the first east-west alley north of West Main Street. James reported that the BID #2 Board is made up of four downtown business owners and one downtown resident. James stated that a resolution establishing the boundaries of BID #2 was passed on April 16, 2018. James noted that the BID #2 Board has had several meetings over the last year to develop a plan and a proposed funding mechanism. James noted that the Bid #2 Board has had two public input meetings and multiple discussions with downtown property owners and the Board believes that the project has the necessary public support to move forward. James reported that the BID #2 Board presented a plan that the City Council accepted at the October 7, 2019 City Council meeting and a Resolution of Intent to set a public hearing for this evening was passed on October 21, 2019. James reported that a notice of public hearing for the creation of the proposed Business Improvement District was mailed to each property owner of taxable property in the district at least 30 days prior to tonight’s public hearing and that copies of the letters for Area A and Area B have been included in your packet. James noted that the BID Board proposes the estimated cost breakdown of $2,450,000 (based on a 2016 conceptual plan) for the public improvements within the proposed district. James stated that the cost would be split between the City and the owners of taxable property within the Business Improvement District at a ratio of 82% paid by the City, and 18% paid by the owners of taxable property. James stated that the property owner’s portion of the project cost would be paid in the form of a special assessment that will be based on actual project costs minus any grants and donations, and implemented in accordance with state statute. James noted that the special assessment would be 18% of the total cost of the project divided amongst property owners in two different areas (with two different rates) within the BID. 4 James stated that the special assessment shall be payable in ten equal annual installments. James reviewed the estimated funding for the project noting the actual amount of the special assessment will be calculated after the project is completed. James recommended approval of the first reading of Ordinance No. 1395 Establishing Business Improvement District #2 unless additional information is presented during the public hearing. Mark Siecke, owner of 3 W Main, stated that he does not see the benefit of the project as a property owner. Mr. Siecke asked how grant funds would be allocated or could the Board apply it all to the City. James Purdy explained that the grant funds received would be used to reduce the total project cost which is then allocated to the City and the special assessments to the property owners. Paul Hasse, resident of Vermillion, stated that not all the sidewalks need to be replaced asking the City Council if they have inspected all the sidewalks proposed to replaced. Mr. Hasse projected that construction will shut down areas of the downtown for a week or two also noting that there will be dust and dirt from construction. Mr. Hasse stated that the trees will reduce the visibility at intersections. Mr. Hasse noted the need for downtown parking and taking the parking away from in front of the theater in the past was a bad idea. Mr. Hasse suggested that parking spaces be made wider to accommodate full size vehicles. Mr. Hasse stated that semi-truck traffic will be hindered by the bump outs at the intersections. Mr. Hasse noted the need for better lighting in the downtown area suggesting LED lighting. Mr. Hasse noted that removing the sidewalks could damage the older building. Mr. Hasse stated that it is a wild expensive project that is not needed. Dick Sunde, property owner at 14,16 & 18 East Main, noted that he has five tenants and asked how long access to his business will be restricted. Jose Dominguez, City Engineer, stated that, it is anticipated that the construction contract will require the contractor to work with the property owners to minimize the impact on each property. Mr. Sunde asked about removing the bump out by the pocket park and theater. John Prescott, City Manager, reported that, following the July public meeting, the Bid #2 Board recommended the removal of the bump out in this area. City Council discussion followed on the project including the assessment to properties in Area A and B and questioned how many basements extend under the sidewalk. Jose Dominguez, City Engineer, stated that as part of the project design he would anticipate inspections will be made of each property to determine in advance of bidding the number as well as anticipating the estimated cost to repair these basements. President Collier-Wise thanked the BID #2 Board members for their work to date on this project. Discussion followed. 5 339-19 President Collier-Wise read the title to the above mentioned Ordinance and Alderman Willson moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1395 entitled An Ordinance Adding Chapter 122, which Establishes a Business Improvement District No. 2 within the Municipal Limits of the City of Vermillion for the Improvement of Public Facilities and Activities in the Central Business District of the City of Vermillion, South Dakota has been read and the Ordinance has been considered for the first time in its present form and content at this meeting being a regularly called meeting of the Governing Body of the City on this 2nd day of December, 2019 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Alderman Hellwege. After discussion, the question of adoption of the Resolution was put to a vote of the Governing Body and 7 members voted in favor of and 0 members voted in opposition to the motion. President Collier-Wise declared the motion adopted. 7. Old Business A. Second reading of Ordinance 1408 to rezone Lots 1 and 2 in Block 2, Arroba Addition to the City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the R-2 Residential District (property on the north side of E. Main approximately 550 feet east of Cypress Drive) Jose Dominguez, City Engineer, reported that a petition to rezone this area from the owner’s representative, Mr. Michael Barkl, was received on October 10th. Jose reported that the property is located on East Main east of Cypress Drive. Jose noted that the request is to rezone the property from NRC Natural Resource Conservation District to R-2 Residential District. Jose reported that the applicant has circulated the petition and acquired the necessary signatures, which is enclosed with this memo. Jose reported that the Planning and Zoning Commission considered the request at their November 12th meeting and recommended that the Council approve the rezone request. Jose reported that the City Council approved first reading at the November 18th meeting. Discussion followed. 340-19 Second reading of title to Ordinance No. 1408, entitled an Ordinance Rezoning Lots 1 and 2 in Block 2, Arroba Addition to the City of Vermillion, South Dakota. 6 President Collier-Wise read the title to the above named Ordinance, and Alderman Willson moved adoption of the following: BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1408 entitled an Ordinance Rezoning Lots 1 and 2 in Block 2, Arroba Addition to the City of Vermillion was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 18th day of November, 2019 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 2nd day of December, 2019 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE 1408 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES TITLE XV LAND USAGE; CHAPTER 155, ZONING REGULATIONS; SECTION 155.026 ENTITLED ADOPTION OF OFFICIAL ZONING MAP, REZONING LOTS 1 AND 2, IN BLOCK 2, AROBBA ADDITION, CITY OF VERMILLION, CLAY COUNTY, SOUTH DAKOTA FROM THE NRC NATURAL RESOURCE CONSERVATION DISTRICT TO THE R-2 RESIDENTIAL DISTRICT. President Collier-Wise declared that the Ordinance has been adopted and directed publication thereof as required by law. B. Second reading of Ordinance 1409 adopting Comprehensive Zoning regulations and deleting the existing Zoning Ordinance adopted on July 7, 2008 with the adoption of Ordinance 1189, and as amended Jose Dominguez, City Engineer, reported as background that the City has had two zoning ordinances with the first being adopted in 1966. Jose reported that in 2008 the City adopted a new zoning ordinance which completely rewrote zoning requirements within the City. Jose stated that this new ordinance still divided the City into districts; however, each district has permitted uses and conditional uses. Jose noted that this, along with different uses being permitted within each zoning district, were the largest changes between the two ordinances. Jose stated that, due to the existing zoning ordinance being 11 years old, Staff proposed to the Planning Commission to update the comprehensive zoning ordinance and over the last year the Planning Commission undertook a review of the ordinance in order to determine if changes need to be made. Jose noted that the depth and scope of that review was determined by the Planning Commission. Jose reported that the Planning Commission has held fourteen meetings, all open to the public, to discuss the proposed changes to various sections of the zoning ordinance. Jose noted that the proposed changes deal mainly with updates that the Planning Commission and Staff feel are needed to remove possible conflicts from the ordinance that may arise from differing interpretations. Jose noted that some of the changes ensure that adjustments to the districts and definitions section are also reflected in these sections. Jose reviewed the major changes proposed for the zoning ordinance. Jose noted that these items have also been presented to the City Council during two educational meetings. Jose noted that staff would recommend creating a new residential district exclusively for single-family attached dwellings. Jose reported that the proposed ordinance, with the changes to the R-1 Residential District and the new residential district, were presented to the Planning Commission at their November 12th meeting with the Planning Commission recommending that the City Council adopt the new ordinance. Jose reported that the City Council approved first reading at the November 18th meeting. Request to close Kidder Street from Court Street to the alley between Court Street and Market Street on Sunday, February 15, 2020 from 11:00 a.m. to 7:00 p.m. for the Special Olympics Polar Plunge James Purdy, Assistant to the City Manager, reported that the Law Enforcement Torch Run and Special Olympics of South Dakota are requesting the closing of Kidder Street from Court Street west to the alley between Court and Market Street on Saturday, February 15, 2020 from 11:00 a.m. to 7:00 p.m. for the Polar Plunge. James reported that a map of the proposed street closing is attached. James noted that the location on Kidder Street is the same as in 2019 but the time requested is an hour longer to allow for cleanup. Jon Cole, representing the Law Enforcement Torch Run and Special Olympics of South Dakota, thanked the City Council for their past support and requested approval of the street closing for the Polar Plunge event. Mr. Cole reviewed the funds raised in the past noting that with the Special 9 Olympics in Vermillion most of the funds raised will stay in the community. 342-19 Alderman Sorensen moved approval of the street closing requested by the Law Enforcement Torch Run and Special Olympics of South Dakota for Kidder Street from Court Street west to the alley between Court and Market Street on Saturday, February 15, 2020 from 11:00 a.m. to 7:00 p.m. for the Polar Plunge. Alderman Price seconded the motion. Motion carried 7 to 0. President Collier-Wise declared the motion adopted. B. Resolution Fixing a Time and Place for a Hearing and Notice of Hearing on the Special Assessment Roll for Construction of Concrete Surfacing Along Elm Street from Alumni Street to 246-feet South of Alumni Street Jose Dominguez, City Engineer, reported that on October 1, 2018 the City Council approved a Resolution Adopting the Resolution of Necessity for Construction of Concrete Surfacing along Elm Street from Alumni Street to 246-feet south of Alumni Street. Jose noted that this resolution involved the construction of a section of Elm Street. Jose reported that the work has been completed on the improvements. Jose stated that the special assessments were calculated and filed with the Finance Officer on November 26, 2019. Jose stated that, per State statute, the City is required to hold a public hearing to allow the affected property owners to review and discuss any concerns regarding the assessed value. Jose stated that the property owners to be assessed will also be notified of the hearing by mail and the notice of public hearing will also be published in the Vermillion Plain Talk. Jose recommended approval of the resolution setting a public hearing for January 20, 2020. 343-19 After reading the same once, Alderman Willson moved adoption of the following: RESOLUTION FIXING THE TIME AND PLACE FOR A HEARING AND NOTICE OF HEARING ON THE SPECIAL ASSESSMENT ROLL FOR CONSTRUCTION OF CONCRETE SURFACING AND OTHER IMPROVEMENTS ALONG ELM STREET FROM ALUMNI STREET TO 246 FEET SOUTH OF ALUMNI STREET IN THE CITY OF VERMILLION, SD WHEREAS, a special assessment roll was filed in the office of the City Finance Officer of the City of Vermillion, Clay County, South Dakota, on the 26th day of November, 2019, for the construction of a concrete street 10 in front or abutting lots in the City of Vermillion, Clay County, South Dakota, said special assessment being against the property abutting upon said improvement; and WHEREAS, said assessment roll, now on file in the office of the City Finance Officer of the City of Vermillion, South Dakota, is open for public inspection and is referred to for further particulars; and WHEREAS, said assessment roll shows as follows: 1. Jose stated that this resolution involved the sidewalks in the northwest quadrant of the community (everything north of Main Street and west of North Dakota Street). Jose reported that the work has been completed on the improvements. Jose stated that the special assessments were calculated and filed with the Finance Officer on November 26, 2019. Jose stated that, per State statute, the City is required to hold a public hearing to allow the affected property owners to review and discuss any concerns regarding the assessed value. Jose stated that the property owners to be assessed will also be notified of the hearing by mail and the notice of public hearing will also be published in the Vermillion Plain Talk. Resolution Authorizing the Purchase of a Utility Tractor for the Bluffs Golf Course 15 Jose Dominguez, City Engineer, reported that, during the budget sessions in August, the City Council reviewed the 2020 equipment replacement schedule. Jose noted that the 2020 equipment replacement schedule included the replacement of a 1999 Bluffs’ Golf Course John Deere 4600 tractor. Jose reported that Administration would like to take advantage of an attractive quote from C&B Operations from Yankton for a 2020 John Deere 4066R Compact Utility Tractor for $38,824.00 and a trade in price of $7,045 for the City 1999 tractor that lowered the net cost for the 2020 tractor to $31,779.00. Jose noted that staff obtained another quote for a similarly equipped tractor with the exception of built in radio speakers for $36,190 but the trade in offered was only $4,473 for a net of $31,717. Jose noted that taking into account that any warranty work would have to be done by the dealership where the tractor was purchased, made the Yankton quote more attractive. Jose noted that the 2020 Equipment Replacement Fund includes a budget of $34,000 for the purchase of the tractor. Jose recommended approval of the resolution to purchase a 2020 John Deere 4066R Compact Utility Tractor from C&B Operations, LLC, from Yankton, SD, for $38,824 with the trade in the 1999 John Deere 4600 for $7,045.00 for a net price of $31,779. 345-19 After reading the same once, Alderman Sorensen moved adoption of the following: RESOLUTION AUTHORIZING THE PURCHASE OF A UTILITY TRACTOR FOR THE BLUFFS GOLF COURSE WHEREAS, SDCL 5-18A-22(19) authorizes a governmental entity to purchase equipment that cost less than $50,000 without going out to bids; and WHEREAS, knowing this the City asked for quotes from two utility tractor distributors in order to ensure that the City receives the most advantageous price; and WHEREAS, the City of Vermillion has reviewed and determined that the quote received from C&B Operations, LLC of Yankton, South Dakota, for a John Deere 4066R Compact Utility Tractor for the total of $38,824 offers an advantageous price to the City; and WHEREAS, the proposal offered by C&B Operations, LLC also includes a trade-in value for the City’s 1999 John Deere 4600 of $7,045. Administrative Services Agreement with Western Area Power Administration and Missouri River Energy Services John Prescott, City Manager, stated that the City receives a fixed allocation of electrical power from Western Area Power Administration (WAPA) and the needs beyond the WAPA allotment are met by our supplemental electrical power supplier Missouri River Energy Services (MRES). John stated that the City has an existing administrative services agreement with WAPA and MRES. The WAPA agreement expires December 31, 2020 and the MRES agreement expires December 31, 2050. John noted that WAPA has been updating their soon-to-expire administrative services agreements held by MRES customers over the last several months. John stated that the proposed agreement is almost exactly the same as the current administrative services agreement with WAPA. John stated that the language does clarify that MRES will administer payment of the WAPA bill on behalf of the City, and handle bill crediting and net billing. John noted that this has been the current practice for many years. John stated that the proposed agreement also clarifies that MRES will provide scheduling services for the City which has also been the current practice in our relationship with MRES. John stated that the City Attorney has reviewed and approved the proposed agreement. John recommended approval of the agreement. First reading of Ordinance 1410 – 2019 Supplemental Appropriations ordinance Mike Carlson, Finance Officer, reported that the supplemental appropriations ordinance is needed to adjust the budget for items that have changed since the revised budget was adopted in September 2019. Mike noted that the agenda memo included an explanation of the individual line item changes noting that the general fund reserve is proposed to be reduced by $50,222 for the changes.
