New Business; item a Council Agenda Memo From: Mike Carlson, Finance Officer Meeting: November 10, 2020 Special Meeting Subject: Canvass of November 10, 2020 Home Rule Charter Election Results Presenter: Mike Carlson Background: State law requires the canvass of the election results by the governing body within seven days of the election. 9-13-24. Return and canvass of votes. The election returns shall be reported as soon as possible to the finance officer, and within seven days of the election, the governing body shall canvass the election returns, declare the result, and enter the result on its journal. Discussion: The Administrative Rules list the duties of the board of canvassers as follows: 5:02:17:12. Duties of official board of canvassers for local jurisdiction. The duties of the official board of canvassers for a local jurisdiction are as follows: (1) Open the returns from each precinct which are found in each poll book; (2) Satisfy itself that the returns are genuine and not forged; (3) Tabulate the returns from the precincts and the certification of provisional ballot count; (4) Declare the result; and (5) Make an abstract of the results of the votes cast for each of the candidates and each of the issues. The abstract must be signed and certified by the canvassers under the seal of the business manager or finance officer of the local jurisdiction. It should be noted that the poll books have been opened by the County Commission when canvassing and then resealed for the city canvass. There should be two poll books for each ward, one for the absentee ballots and the other from the polling place for in-person voting. A worksheet is attached that provides the total ballots by ward from the absentee and polling place recap sheets compared to the tabulation machine totals. The Detail Results by Precinct for each city ward are attached. The ward is listed in the upper left, and the City Home Rule is Question 1, the last item on the second page. Each document lists the total Yes and No votes along with over votes and under votes. The County Auditor noted that when the County canvassed the results, it was determined that there was one more ballot counted in the Southeast Ward. The poll book for the Southeast Ward polling place voting showed 428, and the absentee poll book had 1,118 for a total of 1,546. However, the tabulation machine total was 1,547. This was noted when the ballots were counted, but  4. New Business; item a the math on the Recap Sheet totaled 429. The ballots were counted twice with the same total. Two provisional ballots filed at the election with one in the northeast ward and the other in a rural ward. A voter is given the option of filing a provisional ballot if they cannot be found as being a registered voter. On the provisional ballot envelope, the voter explains where and when they registered; on the day after the election, the county auditor reviews to determine if the voter registration was omitted in error. If it is determined there was an error and the vote should have been counted, a provisional ballot counting board meets an hour before the County Canvass Board and provides a Certification of Provisional Ballot count that is then combined with the results from the wards. I have completed an abstract of the results from the unofficial election results sheets and included the provisional ballot board certification, which will need to be signed unless there are any changes found. The totals agree with the official canvass as included on the county official canvass. Also included is the Clay County Detail Results for information that show the total on the second page Question 1 before the provisional ballot was included. I will make copies of the documents emailed and have them available at the meeting so you do not need to print copies. Financial Consideration: None.
