Unapproved Minutes Council Special Session July 19, 2021 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, July 19, 2021 at 12:00 noon at the John “Jack” Powell Conference Room. 1. Roll Call Present: Hellwege, Holland, Humphrey, Jennewein, Letellier, Price, Ward, Willson, Mayor Collier-Wise 2. Adoption of Agenda 231-21 Council Member Price moved approval of the agenda. Council Member Holland seconded the motion. Motion carried 9 to 0. Mayor Collier-Wise declared the motion adopted. 3. Visitors to be Heard 4. Educational Session- State of Emergency Nuisance Ordinance- Cohl Turnquist, Administrative Intern Cohl Turnquist, Administrative Intern, presented a State of Emergency Nuisance Ordinance to the Council. Cohl stated that this ordinance would establish procedures and support if a state of emergency was declared. Cohl noted that the City Attorney advised them to create this ordinance in case a state of emergency were to arise again in the future. Discussion followed. 5. Educational Session- DEED Internship Report- Kacy Tubbs, DEED Intern Kacy Tubbs, DEED Intern, reported on her DEED internship and her findings. Kacy noted that she started this internship with three goals: studying stainability for solar array at the city landfill, cybersecurity of the solar array, and public outreach. Kacy stated that she attended a conference in Orlando, FL to present her findings and networked with other interns to help with her project. Kacy reported that the landfill’s baler building roof would be the most efficient place to place the solar panels with the batteries inside the building. Kacy noted that for the cybersecurity there are many things that the city could do in house and would not need additional cost for that. Kacy reported that for her public outreach there will be an electric vehicle ride and drive at the 1 Thursdays on the Platz along with promotional information to use 100% green resources with our Bright Energy Solutions Program. 6. Briefing on the City Council Regular Meeting Council reviewed items on the agenda with City staff. No action was taken. 7. Executive Session per SDCL 1-25-2(3) 232-21 Council Member Price Moved to go into Executive Session at 12:50 p.m. Council Member Ward seconded the motion. Motion carried 9 to 0. Mayor Collier-Wise declared the motion adopted. First Reading of Ordinance 1438 Rezone Lot 3, AMS Industrial Park Addition, City of Vermillion, Clay County, South Dakota, from NRC-Natural Resource Conservation District to the HI-Heavy Industrial District Stone Conley, City Management Assistant, reported that the City received a petition to rezone Lot 3, AMS Industrial Park Addition from Mr. Nick Slattery on behalf of AMS Building Systems (AMS), on June 29th. Stone stated that AMS is requesting that the property be rezoned from NRC Natural Resource Conservation District to HI Heavy Industrial. Stone noted that the district property is located north of 317th Street (part of Heikes Tract 4, 17-92-52). Stone stated that this property was annexed into the City on June 7, 2021 and when a property is annexed it is automatically placed in the NRC Natural Resource Conservation District. 235-21 Mayor Collier-Wise read the title to the above mentioned Ordinance and Council Member Willson moved adoption of the following Resolution: 3 BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1438 entitled An Ordinance Adopting Rezone Lot 3, AMS Industrial Park Addition, City of Vermillion, Clay County, South Dakota, from NRC-Natural Resource Conservation District to the HI-Heavy Industrial District of the City of Vermillion, South Dakota has been read and the Ordinance has been considered for the first time in its present form and content at this meeting being a regularly called meeting of the Governing Body of the City on this 19th day of July, 2021 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Council Member Ward. After discussion, the question of adoption of the Resolution was put to a vote of the Governing Body and 9 members voted in favor of and 0 members voted in opposition to the motion. Mayor Collier-Wise declared the motion adopted. 7. Old Business 8. New Business A. Review of covenants for Bliss Pointe phase 2 addition (Lot 6,7,8,9,10) John Prescott, City Manager, reported on the covenants for Bliss Pointe Phase 2. John stated that the Vermillion Area Chamber & Development Company (VCDC) has been working to develop Phase 2 of the Bliss Pointe addition. John noted that the City Council has established a TIF district (TIF #7), approved the TIF plan, approved Ordinance No. 1430, which provides for narrower lots in the center block, and approved the final plat of the lot. John stated that, when the TIF #7 grant agreement was approved, the document included the following language to discuss the importance of establishing a buffer for Lots 15-19, Block 3 and Lots 19- 21, Block 5 of Bliss Pointe Addition. John reported that the covenant had addressed this issue with the addition of two trees to be placed in the back yards for those stated lots. Nate Welch, VCDC CEO, stated that the trees were added to the covenant to keep costs down for more affordability. Discussion followed. 236-21 After amendment, Council Member Hellwege moved approval of the covenants for Bliss Pointe Phase 2 addition (Lot 6,7,8,9,10). Council Member Letellier seconded the motion. A roll call vote of the Governing Body was as follows: Hellwege-Y, Holland-Y, Humphrey-N, Jennewein-Y, Price- Y, Sorensen-Y, Ward-N, Willson–N, Mayor Collier-Wise-Y. Mayor Collier- Wise declared the motion adopted. B. The Dakota Days Committee has submitted a request to close East Main Street from the Vermillion High School parking lot to High Street, High 4 Street from Main to West National Street for routing and/or staging of the Dakota Days parade on Saturday, October 2, 2021. Stone Conley, City Management Assistant, reported that the Dakota Days Committee has submitted a request to close streets on October 2, 2021 from 4:00 a.m. until 12:30 p.m. for routing and/or staging of the Dakota Days parade. Stone stated that the parade will begin at 9:00 a.m. at the intersection of Anderson and East Main Street. Stone noted that the applicant knows the importance of cleaning up after the parade. Stone reported that the application indicates volunteers will pick up after the parade. 237-21 Council Member Price moved approval of the request to close East Main Street from the Vermillion High School parking lot to High Street, High Street from Main to West National Street for routing and/or staging of the Dakota Days parade on Saturday, October 2, 2021. Request to close Kidder Street from Market Street to Court Street for the Dakota Days Street Dance on Thursday, September 30, 2021 from 6:00 p.m. to Midnight (12:00 a.m.) Stone Conley, City Management Assistant, reported that the Dakota Days Committee has submitted a request to close Kidder Street from Market Street to Court Street on Thursday September 30, 2021 from 6:00 p.m. to Midnight (12:00 a.m.) for the D-Days street dance. Stone stated that the purpose of the proposed street closure is to provide pedestrians safe accessibility and navigation during the event. Stone noted that the street closure application and diagram have been provided. Stone reported that the committee may request electrical use needs with the possibility of reserving a generator for staging and the DJ. Stone noted that security will be provided by the Dakota Days Committee and a no parking posting will occur one hour before the event begins. Stone noted that the Police, Fire-EMS, Street Department and Vermillion Light & Power Department will also be notified of the event. 238-21 Council Member Hellwege moved approval of the request to close Kidder Street from Market Street to Court Street for the Dakota Days Street Dance on Thursday, September 30, 2021 from 6:00 p.m. to Midnight (12:00 a.m.). Resolution authorizing the purchase of a Solid Waste Department Loader for the Landfill 5 Cohl Turnquist, Administrative Intern, reported on a Resolution Authorizing the Purchase of a Solid Waste Department Loader for the Landfill. Cohl stated that Sourcewell, formerly the National Joint Powers Alliance (NJPA), has a bid with the heavy equipment manufacturer Caterpillar Company for a 2021 914 Cat loader for $146,766.31. Cohl noted that Caterpillar Company’s distributor for South Dakota is Butler Machinery of Sioux Falls, SD. who has agreed to sell a Cat 914 loader to the City at the Sourcewell awarded bid amount. Cohl stated that Butler has offered $27,000 for the City’s existing 2012 914G Cat loader which brings Butler’s bid to $119,766.31. After reading the same once, Council Member Hellwege moved adoption of the following: RESOLUTION AUTHORIZING THE PURCHASE OF A SOLID WASTE DEPARTMENT LOADER WHEREAS, SDCL 5-18A-37 authorizes a governmental entity to enter into agreements with purchasing agents in any other state for purchases under a joint agreement or contract at the accepted bid price and the concurrence of said bidder; and WHEREAS, the City of Vermillion has reviewed and determined that the bid awarded by Sourcewell (formerly known as the National Joint Powers Alliance) for a 2021 914 Cat loader from Caterpillar in the amount of $146,766.31 offers an advantageous price to the City for said item; and WHEREAS, the proposal offered by Caterpillar also includes a trade-in value of $27,000 for the City’s 2012 Caterpillar 914G loader. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, that the City Manager or the City’s Finance Officer is hereby authorized to purchase a new 2021 Cat 914 loader from Butler Machinery of Sioux Falls, South Dakota for a net price of $119,766.31 after trade- in of the 2012 Caterpillar 914G loader. Change Order No. 2 for Highway 50 Drainage Improvements John Prescott, City Manager, reported on Change Order No. 2 for the Highway 50 drainage improvements. John noted that on March 1, 2021 the City Council awarded a $3,077,119.99 contract to Midland Contracting, Inc. of Huron to construct a storm sewer along the south ditch of South Dakota Highway 50 from Dakota Street to Over Drive. John stated that Change Order No. 1 (CO1) was approved by the City Council at the July 6, 2021 meeting for $6,064.34 which increased the contract with Midland Contracting, Inc. to $3,083,184.33. John reported that Change Order No. 2 (CO2) is mainly concerned with the construction of a temporary access for Over Drive, importing suitable backfill material for the installation of the 60-inch pipe, and for the construction of a manhole at the intersection of Princeton Street and SD Hwy. 50. John stated that the project is funded through a combination of DOT, CDGB Grant of $750,000, and stormwater funds of $900,000. Discussion followed. 240-21 Council Member Ward moved approval of the Change Order No. 2 for Highway 50 Drainage Improvements. Council Member Humphrey seconded the motion. Motion carried 9 to 0. Planning and Zoning Commission member appointment Kelsey Collier-Wise, Mayor, reported on the appointment of a member to the Planning and Zoning Commission. Kelsey noted that the Commission is comprised of nine citizens. Kelsey stated that the Board terms are typically for five (5) years and expire in June, however, the current opening is for the remainder of a five year (5) term that expires in June 2022. The opening was advertised on the City’s website, at City Council meetings, and through social media. Kelsey reported that the Council has chosen Greg Merrigan to fill the open position on the Planning and Zoning Commission. 241-21 Council Member Price moved approval of the appointment of Greg Merrigan to the Planning and Zoning Commission. John Prescott reported that one term on the BID#1 Board, which is the Business Improvement District for the hotel/motel lodging fee, is available. John stated that, per the originating ordinance, this seat is for an individual who owns or manages a lodging facility. B) John reported that Thursdays on the Platz are underway. Reminder that the west City Hall parking lot and Center Street between Main Street and National Street will be closed on Thursdays from 4:00 p.m. to 8:00 p.m. for these events. John noted that on July 29, 2021 the Vermillion Light and Power will be sponsoring Thursday on the Platz with the chance to test drive electric vehicles. C) John reported that the City’s Historic Preservation Commission is hosting a presentation by Bob Yapp entitled “Preservation Doesn’t Cost – It Pays”. John noted that the event will be on Wednesday, July 28th at 7:00 p.m. at the Coyote Twin. D) John reported that the Contractor has finished most of the work on the arches at the NW and SE corners of Prentis Park. John stated that they worked with the Historical Preservation Commission on putting the repair project together and used as much of the existing brick as we could. E) John reported that a large tournament at Prentis Field will take place on July 24th and 25th. John noted that it is the State VFW Tournament that will host 8 teams. John stated that last weekend was the State 14U Tournament.
