Unapproved Minutes Council Special Session November 15, 2021 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, November 15, 2021 at 12:00 noon in the Jack Powell Conference Room – City Hall. 1. Roll Call Present: Hellwege, Holland, Humphrey, Jennewein, Letellier, Price, Ward, Willson, Mayor Collier-Wise 2. Adoption of Agenda 374-21 Council Member Price moved approval of the agenda. Council Member Holland seconded the motion. Motion carried 9 to 0. Mayor Collier-Wise declared the motion adopted. 3. Visitors to be Heard - None 4. Informational Session – American Rescue Plan Fund proposal— John Prescott John Prescott, City Manager, reported on the American Rescue Plan (ARP)and the funding we received in 2021. John stated that the City received $976,930 in the first tranche from the State for the ARP. John noted that the City Council already allocated $50,000 for the Vaccinate Vermillion Sweepstakes. John stated that there are four categories that the City could utilize this money, in which, infrastructure improvements is being utilized by a large portion of cities in our area. Shane Griese, Utilities Manager, reported on a few projects associated with the Water and Wastewater Departments that the ARP could help fund. Shane stated that these projects have been on the CIP to be completed in five to ten years. Shane noted that, since these projects have been in the works, the groundwork is already laid out. Discussion followed on the projects the City could use the ARP on. 5. Informational Session – Review Medical Cannabis Ordinance background check requirements – John Prescott John Prescott, City Manager, reported on the City and State laws for Medical Cannabis background check requirements. John noted that currently 1 Ordinance No. 1435 has language that states, “Disqualifying felony offense. A crime that was classified as a felony in the jurisdiction where the person was convicted.” John noted that the State codified law states that a disqualifying felony offence is, “A violent crime that was classified as a felony.” Discussion followed on the differences between State and City laws. 6. Briefing on the November 15, 2021 City Council Regular Meeting Council reviewed items on the agenda with City staff. No action was taken. 7. Transgender Day of Remembrance Proclamation Council Member Jennewein read the proclamation for “Transgender Day of Remembrance” recognizing November 20, 2021 as Transgender Day of Remembrance in Vermillion as a memorial to all transgender lives lost in the past year due to anti-transgender violence. B. Small Business Saturday Proclamation Council Member Holland read the proclamation for “Small Business Saturday” recognizing Saturday, November 27, 2021 as Small Business Saturday in Vermillion and encouraged residents to support small business and merchants throughout the year. 6. Public Hearings A. Annual Liquor and Wine License renewals Katie Redden, Finance Officer, reported that this was the time set for the public hearing for the annual liquor and wine license renewals. Katie stated that the notice of hearing and the Police Chief’s report are included in the packet. Katie stated that, from the police report, there were two license holders that had failed a compliance check and, as required by ordinance, a management plan from Leo’s Bar and Grill LLC for Leo’s Lounge and Old Lumber Company, Inc for the Old Lumber Company Bar and Grill is included in the packet. Katie noted that, for City Council actions, the Council may first want to consider the renewal of the retail 3 on-sale liquor license with Sunday sales for the Old Lumber Company, Inc for the Old Lumber Company Bar and Grill at 11 & 15 Court Street. Katie stated that in May 2018 Old Lumber Company, Inc was granted a site transfer of the liquor license to expand into 11 Court Street and at that time the site transfer was approved contingent upon final inspection by the building official. Katie reported that the site expansion has not been completed so the recommendation will continue for the approval of the retail on sales liquor license for the Old Lumber Company, Inc at 11 & 15 Court Street with the expansion into 11 Court Street contingent upon the final inspection of the building official. Katie noted that the second action would be to consider the renewal of the balance of the on-sale retail liquor licenses with Sunday sales, retain on-off sale wine licenses and municipal package off sale license. Katie noted that, if not approved, the reason for the denial must be stated. 378-21 Council Member Holland moved approval of the reissuance of the retail on sale liquor license with Sunday sales for Old Lumber Company, Inc. for Old Lumber Company Bar & Grill at 11 & 15 Court St with the expansion into 11 Court Street contingent upon occupancy permit issued by the building official. First reading of Ordinance 1447 amending Title XV; Chapter 155; Section 155.026 rezoning the NW ¼ SW ¼ 13-92-52 Exc. Holiday Village Addition, Miscellaneous, City of Vermillion, Clay County, South Dakota from the NRC – Natural Resource Conservation District to the R-2 Residential Medium Density District (To facilitate placement of new school in Barstow Park) Jose Dominguez, City Engineer, reported on the First Reading of Ordinance No. 1447 to Amend Title XV; Chapter 155. Jose stated that City Staff is asking to rezone the area that includes Barstow Park and the Vermillion Middle School from the NRC Nature Resource Conservation to the R-2 Residential district. Jose noted that the City contacted the Vermillion School District (School District) and received a letter of support from the School District for the proposed rezone. Jose stated that this rezone was initiated by the City, therefore, there are no requirements to collect signatures from the neighboring properties, pay the rezoning fee, or for the property being rezoned to be posted, however, the City did post the property since it is one large tract of land. Jose noted that the City’s Planning and Zoning Commission considered this item at their November 8th meeting where they voted unanimously to recommend that the City Council adopt the proposed rezone. Jose stated that the property being considered has been zoned NRC since the adoption of the 2008 zoning ordinance, but prior to that, the area had been zoned residential. Jose noted that the area being considered for a rezone (Barstow Park) is the only School District property not within a residential district which means that the Vermillion Middle School, which is in Barstow Park, is also zoned NRC. Jose noted that the NRC district, although it allows for parks, does not allow schools. Jose stated that rezoning Barstow Park to a residential zoning district would put this property in a similar situation as the rest of the School District’s properties making the existing Middle School a conforming use, it would allow the School District to construct a future school on their property (Barstow Park). 380-21 Mayor Collier-Wise read the title to the above mentioned Ordinance and Council Member Ward moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1447 entitled an Ordinance amending Title XV; Chapter 155; Section 155.026 rezoning the NW ¼ SW ¼ 13-92-52 Exc. First reading of Ordinance 1445 amending Title XV; Chapter 155; Section 155.058 Definitions to remove and replace the term “Public Service Facility” with a new definition (new definition would allow for a law enforcement facility that has incarcerated individuals) Jose Dominguez, City Engineer, reported on the First Reading of Ordinance No. 1445 amending Title XV; Chapter 155. Jose noted that the City’s most recent zoning ordinance was adopted by the City Council in December 2019, which completely replaced the 2008 zoning ordinance with an updated version. Jose noted that, with the ongoing discussions regarding the possible construction of a new jail and law enforcement center, Staff reviewed the zoning ordinance to ensure that the use would be allowed in the City. Jose stated that the City’s Planning and Zoning Commission considered this item at their November 8th meeting where the Commission amended the original proposal to separate the use of a Law Enforcement Facility with the Ability to House Incarcerated Persons from the Public Service Facility use. Jose noted that the Commission proposed to amend the permitted and conditional uses within certain zoning districts to include the new use of “Law Enforcement Facility with the Ability to House Incarcerated Persons.” Jose stated that the Commission voted unanimously to recommend that the City Council adopt the amended proposed zoning ordinance amendment. Jose stated that the term “jail” is not individually listed in the zoning ordinance, however, Staff believes that the use of a “jail” could be included within the “Public Service Facility” use. Jose noted that a “Public Service Facility” includes government facilities that provide an essential public purpose or service (i.e. police station, judicial court, fire station, ambulance service, and transit or transportation transfer station), however, the definition currently excludes “facilities for incarcerated persons.” Jose stated that Staff is proposing to amend the current definition of “Public Service Facility” to include law enforcement facilities that may, or may not, house incarcerated persons. The definition would require that a jail be constructed in conjunction with a law enforcement facility and not as a standalone use. Jose noted that currently the “Public Service Facility” use is allowed as a permitted use within the Central Business and General Business zoning districts and as a conditional use within the R-1, R-T, 6 R-2, and R-3 Residential zoning districts. Jose stated that the changes proposed by the Commission would maintain the “Public Service Facility” uses as originally intended and within the original zoning districts. First reading of Ordinance 1446 amending Title XV; Chapter 155; Section 155.039 to allow for a “Public Service Facility” as a Conditional Use in GI – General Industrial District zoning Jose Dominguez, City Engineer, reported on the first reading of Ordinance No. 1446 amending Title XV; Chapter 155. Jose noted that the City’s Planning and Zoning Commission considered this item at their November 8th meeting where they proposed to separate the use of a Law Enforcement Facility with the ability to house incarcerated persons from the Public Service Facility use which also affects this agenda item. Jose noted that the Commission voted unanimously to recommend that the City Council adopt the amendments to the GI General Industrial district. Jose stated that a “Public Service Facility” use is currently allowed as a permitted use within the Central Business and General Business zoning districts and as a conditional use within the R-1, R-T, R-2, and R-3 Residential zoning districts. Jose stated that the Commission’s proposal would have created a new use, “Law Enforcement Facility with the Ability to House Incarcerated Persons,” that would be allowed as a permitted use within the Central Business and General Business zoning districts and as a conditional use 7 within the R-T, R-2, and R-3 Residential zoning districts. This amendment would have originally added use of “Public Service Facility” as a conditional use in the GI General Industrial district. Jose noted that including this use as a conditional use would allow the City to consider the placement of a new facility in relation to the surrounding uses and allow the public to voice any concerns. First reading of Ordinance 1448 – 2021 Supplemental Appropriations Ordinance Katie Redden, Finance Officer, reported that the supplemental appropriations ordinance is needed to adjust the budget for items that have changed since the revised budget was adopted in September 2021. Katie stated that the agenda memo included an explanation of the individual line-item changes noting that the general fund is projecting an increase in the general fund reserve by $15,494 for 2021. Mayor Collier-Wise declared the motion adopted. B. Resolution to authorize and approve customary purchase agreement terms and conditions, closing, and payment for property to build new Tom Street lift station (portion of 1505 W Cherry) Shane Griese, Utility Manager, reported that the project to replace the Tom Street lift station in northwest Vermillion has been anticipated for a few years. Shane stated that, in 2014, an assessment was performed to determine the capacity and life expectancy of the current sanitary sewer lift station. Shane stated that the assessment determined that the best course of action was full replacement. Shane noted that, in 2020, a Facility Plan was completed, which is required by the State for all projects that will be requesting funding. Shane noted that funding requests are planned for 2022, with design and construction taking place in 2022-2023. Shane stated that, in December of 2020, the City Council approved a resolution authorizing the purchase of property to house the new lift station, but before the sale was finalized the property changed owners. Shane stated that negotiations began with the new ownership in July of 2021 and continued throughout the summer. Shane noted that the current owners of the property have agreed to sell the land in question for a price of $25,000. 384-21 After reading the same once, Council Member Willson moved adoption of the following: RESOLUTION TO AUTHORIZE ACCEPTANCE OF SALE OFFER PRICE AND APPROVE CUSTOMARY PURCHASE OPTION AGREEMENT TERMS AND CONDITIONS, CLOSING, AND PAYMENT FOR PURCHASE OF PROPERTY FOR TOM STREET LIFT STATION WHEREAS, the City of Vermillion has determined the need to replace the Tom Street wastewater lift station; and 9 WHEREAS, the current lift station is located in the street and right-of- way, and the replacement without land acquisition will require additional costs for street removal and replacement; and WHEREAS, the Utilities Manager had inquired of Westgate MHP Vermillion LLC about acquiring a portion of their property to allow the lift station to be relocated out of the street; and WHEREAS, Westgate MHP Vermillion LLC has agreed to sell a portion of their property, the South 20 feet of the East 112 feet of Lot 1, Anderson Addition, Vermillion, Clay County, South Dakota, to the City in the amount of $25,000.00; and WHEREAS, the Utilities Manager has determined there will be a project savings by relocating the lift station onto this property that will also provide for ease of maintenance on the lift station and ease of replacement years into the future. NOW, THEREFORE, BE IT RESOLVED, that the Vermillion City Council accepts the purchase price with Westgate MHP Vermillion LLC for the property described above and authorizes the Mayor and/or City Manager to execute a purchase option agreement upon customary terms and conditions and close said property acquisition; and BE IT FURTHER RESOLVED, that the Vermillion City Council herein authorizes payment to the seller for the purchase option and purchase price with adjustments thereto for customary closing costs, including but not limited to: taxes proration, title insurance cost, closing cost and recording fee allocations; and BE IT FURTHER RESOLVED, that the Mayor and/or City Manager are authorized and directed to take any and all action, and to execute and deliver any and all documents, including but not limited to conveyance documents, agreements, assignments, leases, closing statements, resolutions and other needed documents, and to do all things necessary or appropriate in their discretion to consummate and close the transaction described in the purchase option agreement and amendments thereto according to their terms. Final Plat of Lots 1 through 4, Harvest Edge Addition, SE ¼ of the SE ¼ of Section 17, T92N, R51W of the 5th P.M., Clay County, South Dakota (property located ¼ mile east of city limits) Jose Dominguez, City Engineer, reported that, on September 2021, Brandt Land Surveying submitted a final plat on behalf of NDH Enterprises, LLC, owners of the property. Jose noted that the area to be platted is roughly 9.00-acres in size and will be divided into four residential lots. Jose stated that the area is approximately ¼ of a mile east of the east city limits and the proposed tract is approximately ¼ of a mile from city limits. Jose reported that the land being platted is within the Joint Jurisdictional Zoning Area. Jose noted that final plats within this area are required by State statute and City ordinance to be presented to the County’s Planning Commission for their recommendation to the City Council. The City Council may then either approve or reject the plat. At this point, the preliminary plat requirement was waived because the land will only be used to develop four residential lots fronting existing right-of- ways with constructed roads. Jose stated that the proposed plat meets all of the requirements set within the zoning ordinance for the Joint Jurisdictional Zoning Area. Jose noted that this plat was presented to the County’s Planning Commission at their September 27, 2021 meeting where they recommended approval of the final plat. 385-21 Council Member Ward moved approval of Final Plat of Lots 1 through 4, Harvest Edge Addition, SE ¼ of the SE ¼ of Section 17, T92N, R51W of the 5th P.M., Clay County, South Dakota (property located ¼ mile east of city limits). Resolution of Necessity and Notice of Hearing for December 20, 2021 for installation of sanitary sewer along East Main Street east of Cypress Drive Shane Griese, Utility Manager, reported that staff received a request for sanitary sewer along East Main Street east of Cypress Drive to the east city limits. Shane noted that, at that time, petition documents and an estimate were drawn up and distributed to the requesting party. Shane stated that, to necessitate the sewer improvements, staff has typically looked for a petition to be signed by at least 55% of the owners owning assessable frontage. Shane noted that, on November 5, 2021, City Staff 11 received the petition with signatures of property owners owning 50% of the assessable frontage. Of that 50%, only 20% is within city limits. Shane stated that the special assessment process provides that the governing body: (1) set a public hearing and (2) notify the property owners of the hearing by both sending notification and publishing the notice of the hearing. Shane stated that the notice calls for the public hearing to be held on December 20, 2021. Shane noted that the affected property owners will be sent a letter notifying them of the hearing. Resolution to adjust Conditional Use Permit, Variance Application, and Mobile Home inspection fees Stone Conley, Assistant to the City Manager, reported Chapter 151, Section 151.07 and Chapter 155, Sections 155.095 (C) and 155.099 (B) provide that the City Council may, by resolution, designate fees for mobile home inspections, conditional use permits (CUP), and variance applications. Stone noted that on Monday, June 7, 2021 during the noon meeting, the City Council discussed changes to the current mobile home inspection fee rate. Stone noted that this type of mobile home inspection is only done when a structure is moved to a new property or mobile home park and the inspection ensures all connections, straps, and infrastructure is in place to support the mobile home properly. Stone noted that the fee has not been changed since 1994. Stone noted that in comparison with other Cities, Vermillion’s current fee rates for CUPs and variances are the second lowest, neither having a fee change since 2011. Stone noted that mobile home inspections and requests for conditional use permits or variances can be time consuming, and fees accrue for publications, postage costs from sending written notification to property owners of proposed variance and conditional use permit hearings or mobile home inspections. Stone noted that staff recommends increasing mobile home inspections to $20, Conditional Use Permits to $150, and Variances to $150. 387-21 After reading the same once, Council Member Hellwege moved adoption of the following: RESOLUTION TO ADJUST FEES FOR CONDITIONAL USE PERMITS, ZONING VARIANCES, AND MOBILE HOME INSPECTIONS WHEREAS, Title XV, Chapters 151 and 155, Sections 151.07, 155.095 (C), and 155.099 (B) of the 2008 Revised Ordinances of the City of Vermillion permit the City Council to designate mobile home inspection fees, the 14 application fee for conditional use permits, and the application fee for a zoning variance, in combination with any other matters pertaining to Chapters 151 and 155; and WHEREAS, mobile home inspection fees have not changed since 1994, and conditional use permit and variance application fees have not changed since 2011. Resolution to adjust Building Permit and Rental Registration fee 15 Kalin Knief, Building Official, reported that building permit fees and rental registration fees have not been changed since 2008 and 2011. Kalin noted that the City has adopted the 2018 IBC & IRC and these two national codes along with City Code allows for the City to implement fees for building permits, rental registrations, and other services provided by Code Enforcement and its officials. Kalin noted that staff proposes a change in both the Building Permit fees, Rental Registration fees, and updated fees for other inspections or violations with regard to buildings. Kalin noted that, after reviewing the information about various fees from compared first class cities in South Dakota, alongside receiving input from the City Council, staff prepared a resolution adjusting the base fee from $25 to $30 and an additional 50 cent increase for each multiplier. Kalin noted a change in rental housing registration fees was also discussed. Kalin stated that, while the number changes frequently as properties are added to and removed from the rental registration list, City staff inspect over 900 structures. Kalin stated that the proposal is to raise the per structure fee from $25.00 to $30.00 with the unit charge of $15.00 per unit to remain the same. Council Member Ward asked how staff would notify the public of the change in building permits and rental registrations. Resolution to adjust nuisance tagging fees 17 Kalin Knief, Building Official, reported that the administrative process for the abatement of nuisances can be time consuming and costly. Kalin noted that the City incurs cost in reviewing properties for complaints, documenting the complaint, and revisiting the site after notification has been provided to the property owner. Kalin stated that, in some instances, multiple visits to a site are necessary to address a nuisance. Kalin stated that the City also incurs postage costs from sending written notification to affected property owners and nuisance abatement require securing contractors to do the work, assigning the work to the contractors, processing the documentation for payment to the contractor, and billing the property owner for the completed work. Kalin noted that, after reviewing the information about nuisance abatement fees from comparable first class cities in South Dakota and receiving input from the City Council, staff prepared a resolution adjusting the fees as fifteen dollars ($15.00) for the first offense with the fee increasing an additional twenty-five dollars ($25.00) for each subsequent offense, per lot, occurring within a given calendar year. 389-21 After reading the same once, Council Member Ward moved adoption of the following: RESOLUTION AMENDING ADMINISTRATIVE FEE FOR CITY ABATEMENT OF NUISANCES FEES WHEREAS, Title IX, Chapter 90, Section 90.51 and Chapter 96, Section 96.12 of the 2008 Revised Ordinances of the City of Vermillion allow the City Council to establish and set by resolution the fee for the abatement of nuisances by the City; and WHEREAS, the Code Enforcement Department is responsible for responding to nuisance complaints and verify, notify, and abate if violation has not been addressed; and WHEREAS, the Code Enforcement Department addresses numerous nuisance complaints each year. The Code Enforcement Department also addresses many properties that have repeated nuisance violations to resolve each calendar year. Resolution to purchase a stump cutter for the Street Department Jose Dominguez, City Engineer, reported that City crews cut down around 20 to 50 trees per year. The number of trees vary depending on weather events that may occur during the year, diseases, or dying due to age. Jose noted that, after City staff fell the trees, the City hires a contractor to grind the remaining stumps below the ground. Contractors are typically local (i.e. Yankton or Elk Point) and usually charge between $4,000 to $6,000 to grind the stumps. Jose noted that recently the City has been having issues hiring a contractor to do the work due to some of the local contractors no longer in business or that they can get a more lucrative contract in other locations. Jose noted that having our own stump grinder allows the City to control when the work occurs rather than waiting to be placed on the contractor’s schedule. Jose reported that staff proposes utilizing a Sourcewell bid awarded to the Vermeer Company for the purchase of a 2022 Vermeer SC70TX Stump Cutter.
