Informational Session – Amendment to Wastewater Treatment Plant Facility Plan- Shane Griese Shane Griese, Utilities Manager, reported on additions to the Wastewater Treatment Facility Plan. Shane noted that once the engineers started work on the facility plan, they found that a large scope would benefit the project. Shane reported the changes to the Council. Discussion followed on projects to be done at the Wastewater Facilities. Council Member Murra arrived at 12:03 p.m. 5. Educational Session- Paint Striping Options for Downtown Vermillion - Jose Dominguez Jose Dominguez, City Engineer, reported on the striping of downtown Vermillion after the slurry seal is applied. Jose noted the parking before the streetscape construction, after construction, and two proposed plans for re-striping downtown. Discussion followed on the downtown striping project. 6. Briefing on the July 18, 2022 City Council Regular Meeting 1 Council reviewed items on the agenda with City staff. No action was taken. 7. Visitors to be Heard Joe Kyte of the Clay Rural and Vermillion Fire/EMS Department invited everyone to come to the 50th celebration for the unit. Joe noted that the event is happening July 30th from 2:00 p.m. to 5:00 p.m. 6. Public Hearings A. Special permit to exceed permissible sound levels by no more that 50% for Ribs Rods & Rock’n Roll, Inc on or about September 9 and 10, 2022 from 5:00 p.m. to midnight on W. Main Street between High and Prospect Streets Katie Redden, Finance Officer, reported that Ribs, Rods & Rock ‘n Roll has applied for a special permit to exceed allowable noise levels for several bands and a street dance on Friday, September 9th and Saturday September 10th beginning at 5:00 p.m. and lasting until midnight. The request, diagram and notice of hearing are attached. Main Street to Kidder Street, Kidder Street from Austin Street to Court Street, Court Street from W. Main Street to half a block south, the public parking lot on the SW Corner of Market Street and Kidder Street, private parking lot at Market and Kidder and Prospect from W. Main Street to National Street and to include any other streets closed for the Ribs Rods Rock N Roll events Katie Redden, Finance Officer, reported that an application has been received for a special daily malt beverage and wine license from Ribs, Rods & Rock’n Roll for their events on September 9 & 10, 2022 on Main Street between Washington and Church Street, Ratingen Platz, Market Street from Main to Bloomingdale Street, Austin Street from Main to Kidder, Kidder Street from Austin to alley between Court and Market Streets, public parking lot at Market and Kidder, private parking lot at Market and Kidder, Prospect from Main Street to half block north, and to include any other streets closed for the events. Katie stated that the request from Ribs, Rods, & Rock’n Roll, notice of hearing and Police Chief’s report are included in the packet. Katie noted that sales will remain in the same location as previous years on Main Street by Market Street. Katie stated that City ordinance allows the City Council to set conditions and restrictions, as it may deem appropriate, in issuing a special license. Katie stated that these conditions were to require a Release and Indemnification releasing the City from liability for the event which is included with the street closing request, a Certificate of Insurance naming the City as an additional insured has been received, require clear signage at each egress from the area where alcohol is allowed, reimburse the City for overtime wages of the Police Department up to a maximum of $750, provide security personnel, require a cleanup plan and provide restroom facilities. Katie reviewed the conditions included in the Police Chief’s memo for reimbursement of overtime to locations allowed and signage. Katie recommended approval of the license contingent upon compliance with the Police Chief’s recommendations and any other the City Council may want to include. 235-22 Council Member Murra moved approval of the Special daily malt beverage and wine license for Ribs, Rods & Rock’n Roll on or about September 9 and 10, 2022 on W. Council President Holland declared the motion adopted. 7. Old Business A. Second reading of Ordinance 1467 to amend Title III, Administration; Chapter 34, Taxation; Section 34.04, Amending Use of Revenue to provide for additional use of second penny revenue. John Prescott, City Manager, reported on proposed Ordinance No. 1467 to amend second penny uses. John stated that the City of Vermillion adopted Ordinance No. 1117 in 2003 which provided for the use of second penny funds. The ordinance followed State direction at that time which limited the use of the funding to capital items. John noted that over time the State removed the requirement, but the City ordinance remained in place. The City’s second penny funds have only been used for capital purchases. John stated that the main three sources of revenue for the City’s General Fund are property taxes, the first penny of sales tax, and a transfer from the Light and Power fund. John noted that the wage, insurance, and benefit costs for approximately two-thirds of City employees and all operational costs of traditional municipal, non-utility departments are two examples of large expenditures that annually limit the ability of the General Fund to meet organizational needs. The current definition of a capital item in the existing second penny ordinance has required that some items come out of the General Fund vs. Second Penny Fund. John noted that, at the June 20th noon meeting, a draft ordinance to modify the use of second penny funds was presented for discussion and review. John stated that the proposed ordinance modifies the existing language for second penny uses to allow the initial purchase of vehicles and clarifies that all street rehabilitation, construction, and reconstruction of streets is allowed. The ordinance also allows items from the most recently adopted capital improvement plan (CIP) to be eligible second penny uses. For an item to be included on the CIP, a separate process to develop and approve the items is completed. John stated while listing on the CIP may be a broad category, there is a high level of review with the CIP as the process includes a presentation to the City Council and approval of the document by the governing body. John noted that the final change is to amend the financial definition of a capital item. The amount is currently $500. The proposed ordinance would raise the amount to $5,000. The City’s auditing firm supports this change. 236-22 Council President Holland read the title to the above-named Ordinance, and Council Member Hellwege moved adoption of the following resolution: 5 BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1467 entitled Amending Title III, Administration; Chapter 34, Taxation; Section 34.04, Amending Use of Revenue to provide for additional use of second penny revenue was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 5th day of July, 2022 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 18th day of July, 2022 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE 1467 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES, TITLE III, ADMINISTRATION; CHAPTER 34, TAXATION; SECTION 34.04, AMENDING USE OF REVENUE BE IT ORDAINED, by the Governing Body of the City of Vermillion, South Dakota that the Code of Ordinances Section 34.04, Use of Revenue, be amended as follows: Any revenue received in excess of the amount received if the rate of tax is 1% may be used only for capital improvement (definition of “capital” to include the accounting definition of capital item currently being an item over $5,000), land acquisition, the funding of public ambulances and medical emergency response vehicles, nonprofit hospitals with 50 or fewer licensed beds, and other public care facilities or nonprofit health care facilities with 50 or fewer licensed beds, the transfer to the special 911 fund authorized by SDCL § 34-45-12, the purchasing of firefighting vehicles and equipment, vehicles, items on the most recently adopted capital improvement plan, debt retirement, major building repair projects (roof repair and the like), capital project planning, feasibility studies and the minor rehabilitation, major rehabilitation, construction, or reconstruction of streets. New Business A. Resolution Removing Parking on South Plum Street Along the West Side of the Street from the Intersection with East Main Street to a Point 375-feet South of East Main Street Jose Dominguez, City Engineer, reported on removing parking on South Plum Street. Jose noted that the City received a request from Sanford Vermillion to remove the street parking along South Plum from East Main to approximately 375-south on the west side of South Plum St. Between the diagonal and parallel parking spots, their request would remove approximately 18 street parking spaces. Jose stated that the diagonal street parking being considered tonight was constructed by the hospital in 1992 as part of a hospital construction project that created all of the additional street parking (the diagonal parking), a new hospital entrance, and the senior housing by Jane and South Plum St. The Council approved the change in parking at a meeting in January 1992. Jose noted that the hospital’s request is due to safety concerns. After the construction of the new hospital in 2015, the hospital built two concrete panels connecting the back of curb to the sidewalk on the east side of South Plum. Jose noted that additionally the sidewalk from the street to the hospital entrance was also constructed. Staff assumes that the construction of these non-ADA sidewalks was to give an additional route to patients and to act as another location for drop-offs. However, the non-ADA items have become a route for pedestrians crossing South Plum from the parking lot on the west side to the hospital’s entrance on the east side. Currently, the pedestrians walk between parked vehicles while making the crossing. The parked vehicles block the pedestrians from view. The location of the crossing and the reduced visibility make this crossing dangerous. Jose stated that the hospital does have options, however, most of the options require that the eastside sidewalks be improved to meet ADA criteria. The requirements from ADA would force the hospital to reconstruct a large portion of the drop-off loop and to reconstruct most of the sidewalks by the entrance. 7 Jose noted that the option being considered takes into account that the area is currently being used by pedestrians and removes the visibility issue between pedestrians and vehicles. This is done by removing the diagonal and parallel parking on the west side of South Plum (this greatly improves visibility) and by constructing a new concrete area where the diagonal parking used to be (this shortens the crossing distance and “funnels” pedestrians to a safer location). This option does not require that the hospital complete any costly ADA improvements on the east side of the street. Jose stated that Administration recommends the adoption of the resolution removing the parking on South Plum Street along the west side of the street from the intersection with East Main Street to a point 375-feet south of East Main Street. 237-22 After reading the same once, Council Member Letellier moved adoption of the following: RESOLUTION REMOVING STREET PARKING ON SOUTH PLUM STREET ON THE WEST SIDE FROM EAST MAIN STREET TO A POINT 375-FEET SOUTH WHEREAS, pursuant to City of Vermillion Code of Ordinances, section 70.071, the City Council may establish, and cause to be designated and marked, streets, and parts thereof, where vehicles may be parked for limited periods of time only or similarly may establish no-parking areas; and WHEREAS, the City is responsible for safety, security, and general welfare of drivers along City streets and of pedestrians crossing streets; and WHEREAS, Sanford Vermillion is requesting that parking be removed along the west side of South Plum Street from East Main Street to a point 375- feet south to improve the safety of pedestrians crossing South Plum Street; and WHEREAS, Sanford Vermillion will be removing the diagonal street parking and replacing this space with colored concrete in order to improve visibility of pedestrians, reduce the crossing length for pedestrians, and to direct pedestrian to a safer crossing location. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota that 15 street parking spaces will be removed and replaced with a concrete area to improve pedestrian crossings along 8 the west side of South Plum Street from East Main Street to a point 375- feet south of East Main Street. Main from Prospect to Center Street during varying days and times noted in request for Ribs Rods Rock N Roll Event Stone Conley, Assistant to the City Manager, stated that Ribs, Rods, & Rock ‘n Roll organization is requesting a street closing to host their State BBQ Championship, music festival, corn hole tournament and car show on September 9 and 10, 2022. Stone reported that the request is broken down into three sections as follows: Section one: Main Street from High Street to Prospect Street, Prospect Street from W. Main Street to the alleyway ½ a block north, Market Street from W. Main to Bloomingdale Street, Kidder Street from Austin Street to the alleyway ½ a block East of Market Street, Austin Street from Kidder Street to W. Main Street, Ratingen Platz, the Public Parking Lot on the SW corner of Kidder Street and Market Street starting Friday, September 9, 2022 at 6:00 a.m. until Sunday, September 11, 2022 at 12:00 p.m. (noon). Main Street from the Vermillion High School parking lot to High Street, High Street from Main to West National Street for routing and/or staging of the Dakota Days parade on Saturday, October 22, 2022 from 7:30 a.m. until 12:00 p.m. Stone Conley, Assistant to the City Manager, reported that a street closing request was received from the Dakota Days Board to close Main Street from the Vermillion High School parking lot to High Street on Saturday, October 22, 2022 from 7:30 a.m. for the duration of the Dakota Days parade estimated to end at noon. Stone stated that the Police, Fire and EMS were notified with the request. Stone noted that the application indicates that the Board will clean up after the parade. 241-22 Council Member Murra moved approval of the Street Closure Request for E. Main Street from the Vermillion High School parking lot to High Street, High Street from Main to West National Street for routing and/or staging of the Dakota Days parade on Saturday, October 22, 2022 from 7:30 a.m. until 12:00 p.m. Council Member Hellwege seconded the motion. Amending the Vermillion Area Chamber and Development Company’s Street Closure Request for the Thursdays on the Platz events during July and August 2022 to add Thursday, September 1, 2022 from 4:00 p.m. to 8:00 p.m. Stone Conley, Assistant to the City Manager, reported that, at the June 6, 2022 meeting, the City Council approved the Vermillion Area Chamber and Development Company’s (VCDC) amended street closure request for their Thursdays on the Platz events taking place in July and August 2022 on the following Thursdays: July 7, July 14, July 21, July 28, August 4, August 11, August 18, August 25. Stone noted that on July 8, 2022, Staff received a request to add an additional Thursday date at the end of the series as the July 7, 2022 event was cancelled due to weather. Stone stated that the VCDC has requested the closure of W. Main Street from the east line of the intersection with Prospect Street west through Ratingen Platz, Prospect Street north from W. Main Street to the CorTrust Bank driveway, and 11 Market Street as it abuts Ratingen Platz on September 1, 2022 from 4:00 p.m. to 8:00 p.m. Stone stated that the street closure request application and diagram are attached. The Street, Police, and Fire-EMS departments have been notified of the amended street closure request. They did not have any concerns. Cleanup will be handled by VCDC staff. 242-22 Council Member Price moved approval of Amending the Vermillion Area Chamber and Development Company’s Street Closure Request for the Thursdays on the Platz events during July and August 2022 to add Thursday, September 1, 2022 from 4:00 p.m. to 8:00 p.m. Council Member Hellwege seconded the motion. Motion carried 7 to 0. Council President Holland declared the motion adopted. 9. Bid Openings - none 10. City Manager's Report A. John reported that the City will be fogging for mosquitoes this Wednesday, July 20th and Thursday, July 21st. If a property owner does not want to have the fogging equipment on as they pass their property, please contact the Parks and Recreation at ParksandRec@cityofvermillion.com. The address will remain on the Do Not Fog list for the remainder of the 2022 season. B. John reported that the Landfill and Recycling Center are open the 2 and 4th Saturdays of the month. The Landfill will be open 8:00 a.m. to noon and the Recycling Center from 9:00 a.m. to noon this Saturday, July 23rd. C. John stated that there is a one-year term open on the Housing Authority Board due to a resignation. This seat is reserved for a program participant. Expression of Interest forms are due by noon on Thursday, July 28th with the appointment at the August 1st meeting. D. John noted that Thursdays on the Platz began this month and continue every Thursday during the months of July and August. Main Street, Prospect Street, and Market Street near Ratingen Platz will be closed from 4:00 p.m. to 8:00 p.m. on these Thursdays for setup and the actual event. E.
