Roll Call Present: Hellwege, Holland, Jennewein, Letellier, Murra, Price, Mayor Cole Absent: Humphrey, Ward 2. Adoption of Agenda 287-23 Council Member Price moved approval of the agenda. Council Member Holland seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. 3. Visitors to be Heard - None 4. Mobile Home Park Regulations - Building Official Kalin Bird Kalin Bird, Building Official, reported on Mobile Home Park Regulations. Kalin went over the current code for mobile homes which are regulated by HUD and City ordinance. Kalin stated that an annual review is to be done to make sure everything in the park is up to code. Kalin noted that in August he has started inspecting the mobile homes and he plans on having all parks done by December 1st. Discussion followed on mobile home inspections. 5. Briefing on the August 21, 2023 City Council Regular Meeting Council reviewed items on the agenda with City staff. No action was taken. 6. Visitors to be Heard Council Member Holland stated that an outstanding member of Vermillion, Don Forseth, had passed away. Holland stated that Don was a great asset to the community and will be missed. 6. Public Hearings A. Retail (on-off sale) Malt Beverage & SD Farm Wine License and Retail (on-off sale) Wine and Cider License for XIX Brewing Company, LLC located at 113 W. Main Street Austin Flowers, Deputy Finance Officer, reported on an application that was received for a retail on-off sale Malt Beverage & SD Farm Wine License and a retail on-off sale Wine and Cider License from XIX Brewing Company, LLC located at 113 W. Main Street. Austin stated the Retail (on- off sale) Malt Beverage & SD Farm Wine License is for the licensing period from issuance to expiration on June 30, 2024, and the Retail (on- off sale) Wine and Cider License is for the licensing period from issuance to expiration on December 31, 2023. Austin stated the City Council has the ability to issue a license on two criteria: suitable applicant and suitable location. Austin noted, as to the suitable applicant, the owners, Edwin Gerrish and Katey Ulrich, have submitted information to the South Dakota DCI and FBI for background checks. The background checks through the DCI did not show any disqualifying events. The FBI background checks have not yet been received by the Police Chief. Austin noted the Police Chief states that a check of the Vermillion police records did not show any disqualifying contacts for the owners. Austin stated with respect to the location criteria, this location is in the downtown business district. 292-23 Council Member Price moved approval of the Retail (on-off sale) Malt Beverage & SD Farm Wine License and Retail (on-off sale) Wine and Cider License for XIX Brewing Company, LLC located at 113 W. Main Street contingent on the FBI background checks coming back. Council Member Hellwege seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 3 B. Special permit to exceed permissible sound levels by no more than 50% for the USD Department of Music on or about Sunday, October 15, 2023, from 2:00 p.m. to 5:00 p.m. for a music festival on the south side of Prentis Park. Austin Flowers, Deputy Finance Officer, reported that the USD Music Department has applied for a special permit to exceed allowable noise levels for a music concert on or about Sunday, October 15, 2023 in the south side of Prentis Park from 2:00 p.m. to 5:00 p.m. Austin stated that a copy of the application, map of the area, and notice of hearing are attached. Austin noted that the USD Music Department is sponsoring the free concert in the park. Austin stated that the concert includes performances by both USD and Vermillion High School. 293-23 Council Member Price moved approval of the special permit to exceed permissible sound levels by no more than 50% for the USD Department of Music on or about Sunday, October 15, 2023, from 2:00 p.m. to 5:00 p.m. for a music festival on the south side of Prentis Park. First Reading of Ordinance 1487 – Amending the City of Vermillion Code of Ordinance Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Tract 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the GB-General Business District. Jose Dominguez, City Engineer, reported on the first reading of Ordinance 1487 – Amending the City of Vermillion Code of Ordinance Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Tract 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the GB-General Business District. Jose stated the City, owner of the land, is requesting to rezone Tract 1, Jack Powell Addition, from the NRC Natural Resource Conservation District to the GB-General Business District. Tract 1 consists of 7 acres and is bounded on the east by Stanford Street (SD Hwy. 19) and the remaining sides by Tract 2 of Jack Powell Addition. Jose stated a resolution annexing this tract of land was approved by the City Council on July 17th. When land is annexed into the city limits, it automatically enters the City as NRC Natural Resource Conservation District. This is the strictest zoning district within the City. After annexation, the owner of the land has one year to rezone the land without a petition or posting signs for the meeting. Jose noted the City has 4 published a notice in The Plain Talk advertising tonight’s meeting and on the City’s website along with posting notices on the land being rezoned notifying the public of tonight’s meeting, although not required. Jose noted the City’s Planning and Zoning Commission (Commission) considered this item at their August 14th meeting. After reviewing the ordinance, the Commission voted 9 to 0 in favor of the City Council adopting the proposed ordinance as amended. The amendments pertained to the inclusion of the word “Resource” in a couple of places in the ordinance presented by Staff. During the meeting, the Commission discussed the possible future uses of the Jack Powell Addition. Jose stated the surrounding area to the one being considered are zoned GI-General Industrial (east) and NRC Natural Resource Conservation districts (west, north, and south). Jose noted the City will be asking for the area north of Tract 1 to be rezoned to GB-General Business District and the area west and south to be rezoned to the R-3 Residential District. Jose stated Zoning Tract 1 into the GB-General Business District will allow for the proposed Law Enforcement Center to be constructed. The Law Enforcement Center would be considered a permitted use in the proposed district. 294-23 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Murra moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1487 entitled An Ordinance Amending the City of Vermillion Code of Ordinance Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Tract 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the GB-General Business District of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 21st day of August, 2023 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 9 members voted in favor of and 0 members voted in opposition to the motion. Mayor Cole declared the motion adopted. 7. Old Business 5 8. New Business A. Request from Alpha Phi for the closing of N. Pine Street from E. Cedar Street to E. National Street on Monday, September 4, 2023 from 8:00 a.m. to 5:00 p.m. for a sorority bid day event. John Prescott, City Manager, reported that the Alpha Phi Sorority has requested the closure of N. Pine Street from E. Cedar Street to E. National Street for Alpha Phi’s Sorority Recruitment Bid Day event. John noted that the street closure is requested for Monday, September 4, 2023 from 8:00 a.m. to 5:00 p.m. John noted that the completed street closure request application and diagram are attached. John stated that the Street, Police, Fire, and EMS Departments have been notified of the street closure request and did not have any concerns. John noted that cleanup will be handled by the Alpha Phi organization after the event concludes and the street will be cleared immediately. John stated that, according to the application, Alpha Phi’s organizer of this street closure will meet with neighbors to notify them of the street closing. John stated that the street closure request covers the same location as Alpha Phi’s previous street closure requests starting in 2017, which has never had issues. 295-23 Council Member Ward moved approval to close N. Pine Street from E. Cedar Street to E. National Street for Alpha Phi’s Sorority Recruitment Bid Day on Monday, September 4, 2023 from 10:00 a.m. to 4:00 p.m. Council Member Price seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. B. Resolution authorizing the purchase of landfill bale bags. Jose Dominguez, City Engineer, reported on a resolution to purchase landfill bale bags. Jose noted the landfill baler compresses the solid waste into bales and slides them into polypropylene bags before the baled waste is transported to the landfill cell. Bale bags are used daily. These bags can contain up to a 2,800-pound bale. Jose stated the City would like to utilize a bid awarded by the City of Pierre (Pierre) on January 31, 2023. The contract was awarded by Pierre to Accent Wire-Tie for a price of $4.27 per bag. Jose noted if the City were to use the same bid, and placed the order as soon as possible, it is anticipated the order will be received approximately the second week 6 of December 2023. Jose noted staff has verified with Accent Wire-Tie that they are willing to honor the bid price offered to Pierre earlier in the year. The City has used Accent Wire-Tie in the past and has not experienced issues with deliveries or quality. Jose noted State Statute 5-18-18 allows the City to purchase from the lowest responsible bidder from a contract that was competitively solicited and awarded within the previous 12 months with the concurrence of said bidder. 296-23 After reading the same once, Council Member Price moved adoption of the following: RESOLUTION AUTHORIZING PURCHASE OF SOLID WASTE BALE BAGS WHEREAS, SDCL 5-18A-22(3) authorizes a governmental entity to purchase necessary supplies from the lowest responsible bidder from a contract that was competitively solicited and awarded within the previous twelve months with the concurrence of said bidder; and WHEREAS, the City of Pierre, South Dakota on January 31, 2023, awarded Accent Wire-Tie of Texas a bid in the amount of $4.27 per bag delivered; and WHEREAS, the City has contacted Accent Wire-Tie and they have agreed to honor their January 2023 bid price and allow the City to purchase up to 17,500 solid waste bale bags in a semi-load for the awarded prices and terms. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, that the City Finance Officer or City Manager is hereby authorized to purchase up to 17,500 solid waste bale bags in a semi-load from Accent Wire-Tie of Texas at the awarded price of $4.27 per delivered bag and under the same terms as when the City of Pierre, South Dakota awarded a bid to this company on January 31, 2023. First Reading of Ordinance No. 1490 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code; Chapter 70, General Traffic and Parking Regulations amending Section 70.02, Definitions and Section 70.053, Driving Over Sidewalk. John Prescott, City Manager, reported on the first reading of Ordinance No. 1490 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code; Chapter 70, General Traffic and Parking Regulations amending Section 70.02, Definitions and Section 70.053, Driving Over Sidewalk. John noted the City was approached by a business wanting to rent electric scooters for use in the community. This agenda has several potential ordinance amendments to provide for this business model and will modify the definitions and address the use of the sidewalk. John stated a definition of a dockless vehicle is proposed. A dockless vehicle would be a motorized vehicle for commercial purposes such as an electric bicycle or motorized foot scooter. A motorized foot scooter is also defined. John noted a motorized foot scooter becomes a dockless vehicle when it is used for commercial purposes or rented. The definition of an Operating Authority is also proposed. An Operating Authority is the entity that would own the dockless vehicles and operate the business which offers the dockless vehicles for use. A separate ordinance addresses the requirements of an Operating Authority. John stated this ordinance amendment also addresses the Code language for driving over the sidewalk. The current language is dated and addresses the speed at which a vehicle crosses the sidewalk and how to cross a sidewalk in the downtown area. The proposed language will specify that only bicycles, wheelchairs, electric personal assistive devices, and motorized foot scooters can use the sidewalk. This is in addition to pedestrians. The reason for motorized foot scooters to be included in this sentence involves children currently riding them within the City, and not wanting children on the roadways. First Reading of Ordinance No. 1491 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code; Chapter 70, General Traffic and Parking Regulations adding Sections 70.220 and 70.221. John Prescott, City Manager, reported on the first reading of Ordinance No. 1491 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code; Chapter 70, General Traffic and Parking Regulations adding Sections 70.220 and 70.221. John stated City staff are aware of personally owned motorized foot scooters currently within the city limits of Vermillion. Ordinance No. 1491 acknowledges those that currently use these scooters as a mode of transportation. Vermillion Police Department and City staff have not had issues with personally owned scooters. This ordinance allows personally owned motorized foot scooters on the roads within the City, requiring them to follow the rules of the road, and establishing guidelines on where they can and cannot park. City staff believe that self-governance for this personal type of transportation will be the most effective at this point in time. State statute allows municipalities to adopt ordinance permitting the use of motorized foot scooters “on any street, bike path, or multi-use path within its platted boundaries.” 298-23 Mayor Cole read the title to the above mentioned Ordinance and Council Member Letellier moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1491 entitled An Ordinance Amending City of Vermillion Code of Ordinances, Title VII, Traffic Code; Chapter 70, General Traffic and Parking Regulations adding Sections 70.220 and 70.221 of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on 9 this 21st day of August, 2023 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. First Reading of Ordinance No. 1492 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code, Chapter 70, General Traffic and Parking Regulations adding Sections 70.230 – 70.241. John Prescott, City Manager, reported on the first reading of Ordinance No. 1492 amending City of Vermillion Code of Ordinances, Title VII, Traffic Code, Chapter 70, General Traffic and Parking Regulations adding Sections 70.230 – 70.241. John noted this ordinance would set guidelines for businesses looking to rent dockless vehicles. The Operating Authority License grants the business the opportunity to operate within Vermillion city limits. John stated this will require an application to include proper documentation, insurance, and a fee set by resolution based on the number of dockless vehicles. The lifespan of an Operating Authority License will be from January 1st – December 31st of each year, while also requiring documented changes of the application prior to and during the lifespan of the license. An example of a change would be if an Operating Authority were to increase the number of dockless vehicles they rent out. There are permitted and unpermitted riding and parking areas throughout the City, outlined in the ordinance. Dockless vehicles would only be permitted on streets with a speed limit no greater than 30 miles per hour. Mayor Cole declared the motion adopted. 9. Bid Openings - None 10. City Manager's Report A. John reminded the public that the final Thursdays on the Platz will take place this Thursday, August 24, 2023. Portions of W. Main Street and Market Street will be closed for the event. B. John stated there is an opening on the Planning & Zoning Commission for a term expiring in June 2025. Expression of Interest forms are due by Monday, August 28th at noon. It is anticipated that the City Council will make an appointment at the September 5th meeting. C. John noted there are two terms expiring on the City’s Historic Preservation Commission. The terms are for three years. At least four of the seven members of the Commission need to reside in a historic district or own a property on the historic register. With the current makeup of the Commission, at least one of the appointees will need to either live in a historic district or own a property on the historic register. Expression of Interest forms are due by Monday, August 28th at noon. It is anticipated that the City Council will make an appointment at the September 5th meeting. D. John noted a Plat that administrative approved that was approved since the last meeting. Lots 1 & 2, Block 1 Barari Addition was replated as Lot 1A, Block 1 Barari Addition. E. John noted City offices will be closed on Monday, September 4th for the Labor Day holiday. F. John stated the next regular City Council meeting is on Tuesday, September 5, 2023. G. John reported on a raffle notification: The St. Agnes Knights of Columbus are selling NFL Monday Night Football books. The cost of a book is $20. One $50 winner each week per 100 books sold. The winner is determined by the last digit in the score of each team playing that Monday night.
