Unapproved Minutes Council Special Session January 16, 2024 Tuesday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Tuesday, January 16, 2024 at 12:00 noon at the John “Jack” Powell Conference Room. 1. Roll Call Present: Humphrey, Jennewein, Murra, Price, Ward, Mayor Cole Absent: Hellwege, Holland, Letellier 2. Adoption of Agenda 20-24 Council Member Price moved approval of the agenda. Council Member Ward seconded the motion. Motion carried 6 to 0. Mayor Cole declared the motion adopted. 3. Visitors to be Heard - None 4. DOT financing options for E. Clark Street reconstruction - City Engineer Jose Dominguez Jose Dominguez, City Engineering, presented the Council with three options for funding through the Department of Transportation for road infrastructure improvements on E. Clark Street. Jose noted that every year the state gives the City STIP funds, which are state and federal funds, and these funds are only to be used on road infrastructure. The State could give out loans in accordance with these funds. Jose went over the SIB loans, STBGP Advance, and the State Highway Fund loan. Jose stated that the State Highway Fund loan is used in emergency situations and would not be a viable option for this project. Jose explained that the SIB loans are typically a 7-year loan at 1.5% interest and have no maximum loan amount. Jose noted that the State would contract this project with the City’s consultants and all designs must follow DOT standards. Jose noted that the STBGP Advance would be an advance of the City’s STIP funds for a loan of three years at 1.5% income with a maximum loan of two times the federal STIP allotment. Discussion followed on the loan options. 1 5. Off-premises Signs – John Prescott City Manager John Prescott, City Manager, reviewed the off-premises sign ordinance language. John explained the updated definitions, the sign table, and questions that the staff has for Council. John went over the maximum areas for different lot frontages and explained that the current sign ordinance allows for 160 square feet for freestanding signs. Discussion followed on size of signs and location from residential areas. 6. Briefing on the January 16, 2024 City Council Regular Meeting Council reviewed items on the agenda with City staff. International Holocaust Remembrance Day proclamation – Vermillion Human Relations Commission Becky Rider with the Human Relations Commission read the following proclamation: Proclamation for International Holocaust Remembrance Day Issued by the Vermillion Human Relations Commission WHEREAS, the Vermillion Human Relations Commission is unwavering in its dedication to creating a welcoming community for all citizens and fostering understanding WHEREAS, on Saturday, January 27, 2024, we observe International Holocaust Remembrance Day, a day of reflection and commemoration for the millions of lives lost during one of humanity's darkest chapters; and WHEREAS, the Holocaust serves as an enduring reminder of the dire consequences of unchecked hatred, discrimination, and the violation of fundamental human rights; and 3 WHEREAS, the Vermillion Human Relations Commission recognizes its responsibility to educate, memorialize, and reflect upon the lessons of the Holocaust to prevent the recurrence of such horrors in the future; and NOW, THEREFORE, we, the Vermillion Human Relations Commission, stand in solidarity with the international community on this day. B. Council Member Price stated that there was terrible cold and a snowstorm. Price thanked to City staff for keeping the roads clear and the lights on. Price thanked Pete and his staff for going out in the bitter cold. Price noted that storms like this are scary and having staff that are willing to keep the City running is appreciated. C. Council Member Humphrey thanked the citizens for going out of the way to help each other. 6. Public Hearings A. Special daily wine license for the South Dakota Shakespeare Festival “Wine with Will” event on or about Saturday, March 2, 2024 from 6:00 p.m. to 9:00 p.m. at the Main Street Inn. Austin Flowers, Deputy Finance Officer, reported on a special daily wine license application received from the South Dakota Shakespeare Festival. Austin noted that the event “Wine with Will” is a fundraising event to be held on March 2, 2024 from 6:00 p.m. to 9:00 p.m. Austin stated that the notice of hearing and the Police Chief’s report were included in the packet. Austin noted that the routine Police Department records check of the parties involved with the special daily license revealed no alcohol related violations or felony convictions in reference to this application. Council Member Holland abstained from voting due to being the applicant. 24-24 Council Member Ward moved approval of the special daily wine license for the South Dakota Shakespeare Festival “Wine with Will” event on or about 4 Saturday, March 2, 2024 from 6:00 p.m. to 9:00 p.m. at the Main Street Inn. First reading of Ordinance 1507 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 Rezoning Tract 2, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the R-3 Residential District. Jose Dominguez, City Engineer, reported on the first reading of Ordinance 1507 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 Rezoning Tract 2, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation District to the R-3 Residential District. The City, owner of the land, is requesting to rezone Tract 2, Jack Powell Addition, from the NRC Natural Resource Conservation District to the R-3 Residential District. Tract 2 consists of 36 acres and is bounded on the east by Stanford Street (SD Hwy. 19) and Tract 1 (LEC), to the north by SD Hwy. 50, to the south by Baylor Street and to the west by a residential area. Jose stated this property was annexed into the City in July 2023. All property when annexed into city limits is placed into NRC zoning. Tract 1 was rezoned in August 2023 from the NRC Natural Resource Conservation district to the GB-General Business district. Jose noted the City has published a notice in the Plain Talk advertising tonight’s meeting and on the City’s website and, although not required, the City also posted notices on the land being rezoned notifying the public of tonight’s meeting. Jose stated the City’s Planning and Zoning Commission (Commission) considered this item at their January 8th meeting. After reviewing the ordinance, the Commission voted 6 to 0 in favor of the City Council adopting the proposed ordinance. During the meeting, the Commission discussed the possible future uses of the Jack Powell Addition and how the development of Jack Powell Addition may affect traffic on SD Hwy. 19 or SD Hwy. 50. Jose mentioned that it should be noted that the Commission also discussed the possibility of postponing the item due to weather conditions. However, the Commission decided to proceed with the meeting as scheduled because the public would have additional opportunities to voice their concerns (e.g. this meeting or the 2nd reading), because no person, or group, had expressed concerns about the rezoning, and because the proposed project was well known within the community. 5 Jose reported the surrounding area to the one being considered is zoned GI-General Industrial (east), GB-General Business (east), R-4 Residential (south), and R-1 Residential (south and west). The area north of the tract is zoned A-1: Agricultural in the Joint Jurisdiction Zoning Area. In the future, staff will be asking for a portion of Tract 2 to be rezoned from the R-3 Residential district into the GB-General Business district. This portion will be on the corner of the property at the intersection between SD Hwy. 19 and SD Hwy. 50. Jose noted zoning Tract 2 into the R-3 Residential district will allow for most of the land to be used for residential purposes. If rezoned, the possible uses would range from housing (multi-family, townhomes, and detached housing) to assisted living centers and congregate care facilities. The motion was seconded by Council Member Holland. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 8 members voted in favor of and 0 members voted in opposition to the motion. Second reading of Ordinance 1504 Amending Title V, Public Works; Chapter 53, Water, Sewers, and Sewage Disposal - Water; Service Pipes; Section 53.055 Installation. Shane Griese, Utilities Manager, reported on the second reading of Ordinance 1504 Amending Title V, Public Works; Chapter 53, Water, Sewers, and Sewage Disposal - Water; Service Pipes; Section 53.055 Installation. Shane noted the City of Vermillion Water Department installs water service pipes 2 inches and smaller from the water main to the property 6 line on both new construction projects as well as upgrades. The City updated the City specifications to allow for the installation of additional pipe materials in 2020, however, the City Code section has not been updated. City Code section 53.055 only allows copper tubing to be installed. Shane stated the proposed amendment will allow for additional pipe materials to be installed for water service lines. All proposed materials are approved for water service lines through the American Water Works Association (AWWA). 26-24 Second reading of title to Ordinance No. 1504, entitled An Ordinance Amending Title V, Public Works; Chapter 53, Water, Sewers, and Sewage Disposal - Water; Service Pipes; Section 53.055 Installation for the City of Vermillion, South Dakota. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE 1504 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES TITLE V, PUBLIC WORKS; CHAPTER 53, WATER, SEWERS, AND SEWAGE DISPOSAL; SECTION 53.055, INSTALLATION TO ALLOW FOR CROSS-LINKED POLYETHYLENE PRESSURE PIPE BE IT ORDAINED, by the Governing Body of the City of Vermillion, South Dakota that the City of Vermillion Code of Ordinances Title V, Section 53.055, Installation, be amended as follows: § 53.055 INSTALLATION. (A) Installation by the city. The City shall install all service pipes from the water mains to inside the curb lines in streets, alleys, and avenues in the City, which the pipes shall be best quality drawn copper 7 tubing, full inside with standard brass or copper fittings, or an AWWAC904 certified “Cross-linked Polyethylene (PEX) pressure pipe”. Copper pipe shall be subjected to a test pressure of not less than 500 pounds per square inch and shall weigh, per lineal foot as follows: 1 inch, 83/100 (0.83) pound; 1 and 1/4 (1.25) inches, 1 and 4/100 (1.04) pounds; 1 and 1/2 (1.5) inches, 1 and 36/100 (1.36) pounds; 2 inches, 2 and 6/100 (2.06) pounds. Cross-linked Polyethylene pipe shall be rated for 200 PSI @ 73.4˚F and have a co-extruded UV shield made from UV- resistant high–density polyethylene, color blue. Pipe shall be manufactured for use with AWWA C800 fittings, when using stainless steel inserts. (B) City to lay pipe under paving. Whenever a resolution shall have been adopted by the Council, declaring the necessity of paving any street, alley, or avenue, it shall be the duty of the City Engineer to report to the Council all iron pipe connections in the street, alley, or avenue, at the next meeting thereafter, and thereupon the City shall immediately cause to be constructed, built and laid, new pipe as above described in the place of the iron pipe from the water mains to the lot line and shall charge connection fees. Shane Griese, Utilities Manager, reported on the second reading of Ordinance 1505 Amending Title V, Public Works; Chapter 53, Water, Sewers, and Sewage Disposal – Water Rates and Charges; Section 53.077 Turn-On 8 Charges. Shane noted the City of Vermillion Finance Department collects fees for the disconnection/reconnection of water services. In the past this process involved the physical removal of water meters and the language in code 53.077 reflects that. Shane stated with the completion of Automated Meter Infrastructure (AMI), it is not always required to remove water meters in the event a property owner requests a service to be disconnected. Certain situations allow staff to turn off the water service without the need to remove the meter. The AMI system can monitor the meters when service has been discontinued. Shane noted the proposed amendment updates the language to allow the Finance Department to charge for all changes in services regardless of whether or not the meter is removed. 27-24 Second reading of title to Ordinance No. 1505, entitled An Ordinance Amending Title V, Public Works; Chapter 53, Water, Sewers, and Sewage Disposal – Water Rates and Charges; Section 53.077 Turn-On Charges for the City of Vermillion, South Dakota. Second reading of Ordinance 1506 Amending Title IX, General Regulations; Chapter 96, Streets and Sidewalks - General Provisions; Section 96.12 Snow and Ice. Shane Griese, Utilities Manager, reported on the second reading of Ordinance 1506 Amending Title IX, General Regulations; Chapter 96, Streets and Sidewalks - General Provisions; Section 96.12 Snow and Ice. Shane noted that Chapter 96.12 requires property owners, tenants, or the person in charge of a building to remove snow and ice from sidewalks. This ordinance does not currently require those same individuals to remove snow from around fire hydrants. Shane noted in heavy snow events, Water Department staff does not have the ability to remove snow from all hydrants in a timely manner, potentially causing safety concerns. While many citizens already remove snow from hydrants that abut their properties, we have had some hydrants buried in snow in the past. In some instances, snow removal services have dumped the driveway snow over the fire hydrant. Shane stated the burial of fire hydrants has resulted in damage to the hydrants and creates a serious issue in the case of a fire. 10 Shane noted the proposed amendment updates the language to include fire hydrants in the ordinance. This would require people in charge to remove a three-foot radius of snow from all fire hydrants abutting the property in addition to the sidewalks. Discussion followed on responsibility of the homeowners verse City. 28-24 Second reading of title to Ordinance No. 1506, entitled An Ordinance Amending Title IX, General Regulations; Chapter 96, Streets and Sidewalks - General Provisions; Section 96.12 Snow and Ice for the City of Vermillion, South Dakota. (A) Removal of snow and ice; duty of person in charge. Every person in control of any building or lot of land within the city fronting or abutting on a paved sidewalk, whether as the owner, tenant, occupant, lessee, or otherwise, shall remove and clear away, or cause to be removed and cleared away, snow and ice from the sidewalk in front of or abutting on the building or lot of land within 24 hours after any fall of snow or freezing rain. A three-foot radius shall be cleared around fire hydrants. 11 When freezing rain has resulted in ice upon the sidewalk making it impossible to remove, the person in charge shall sprinkle or spread some suitable material upon the sidewalk to prevent the sidewalk from being slippery and dangerous to pedestrian travel. (B) City may remove and assess costs to person in charge. If the person in control of any building or lot of land fails or refuses to remove the snow or ice from the sidewalks, or around fire hydrants, within the time limit provided, the City may have the snow or ice removal done by other means and charge the cost against the property owner as provided by law. (C) Failure to remove, liability of owner. Any owner of the real property who shall fail to remove the snow or ice from the sidewalks, or around fire hydrants, in front of or along the property if they reside thereon, or if they do not reside thereon, to move the same forthwith, shall be held liable to the municipality for any damage caused by the failure or neglect. Request to close Kidder Street from Court Street to the alleyway one-half block west on Saturday, February 17, 2024 from 8:00 a.m. to 4:00 p.m. for Special Olympics SD Polar Plunge fundraiser. Jack Baustian, Assistant to the City Manager, reported on an application to close Kidder Street from Court Street to the alleyway one-half block west. Jack noted that the South Dakota Law Enforcement Torch Run, in conjunction with Special Olympics South Dakota, are hosting their annual 12 Polar Plunge event to raise funds for Special Olympics South Dakota. Per the application, this is the largest fundraising event for Special Olympics South Dakota, which uses the funding to provide year-round training and services to thousands of athletes with intellectual disabilities across the State. Jack noted the request for the closure of Kidder Street provides ample space for setup of the event along with participants, hosts, and attendees to support the event. The applicant stated that Old Lumber Company will be the only business directly impacted by the closure. As they are also a sponsor of the event, they have been properly notified of the requested closure. Jack noted the Police, Fire, and EMS Departments have all been notified of the closure requests and have found no safety concerns. Volunteers will assist with the setup and teardown upon conclusion of the Polar Plunge and the applicant has discussed contingencies with the Street Superintendent in the event of a snowstorm. 29-24 Council Member Murra moved approval of the request to close Kidder Street from Court Street to the alleyway one-half block west on Saturday, February 17, 2024, from 8:00 a.m. to 4:00 p.m. for Special Olympics South Dakota Polar Plunge fundraiser. Council Member Humphrey seconded the motion. Motion carried 8 to 0. Mayor Cole declared the motion adopted. B. Resolution authorizing the lease of 44 golf carts for The Bluffs Golf Course. Jose Dominguez, City Engineer, reported on a resolution to lease 44 golf carts for The Bluffs Golf Course. Jose noted during the August 2023 budget meetings, the City Council reviewed the proposal from The Bluffs Golf Course to lease 44 golf carts for the course. Currently the City leases 40 golf carts and one beverage cart. Jose noted the current golf cart lease will expire in March 2024. In December 2023, the City Council authorized the purchase of a beverage cart funded by the Dakota Tour account. Jose noted State statute allows municipalities to enter into lease agreements for equipment. The statute requires that the term of the lease does not exceed 10 years for equipment and that if the lease is for more than one year 60% of the City Council members must vote in favor. In our case, six members would need to vote in favor of the lease agreement to enter into the lease. Jose stated in this instance, staff proposes to enter into a lease with Yamaha Golf & Utility from Burnsville, MN. The lease would be for 44 13 carts and for 44 GPS systems and screens. This lease would be done through a Yamaha BuyBoard contract. BuyBoard allows the City to benefit from the low prices offered to BuyBoard members. The City would lease 44 2024 Yamaha EFI QT gas golf carts each equipped with a YamaTrack GPS system and screen. The City would lease the items for five years, but only make 30 monthly payments (only pay for the six months out of the year that the carts are in use). The monthly payments for all of the carts are $9,046.48 and $3,263.74 for the GPS system and screens. The total annual lease amount for the carts and screens is $73,861.22. 30-24 After reading the same once, Council Member Ward moved adoption of the following: RESOLUTION AUTHORIZING THE LEASE OF 44 GOLF CARTS FOR THE BLUFFS GOLF COURSE WHEREAS, SDCL 9-21-18.1 authorizes a municipality to enter into lease agreements for equipment as long as the lease agreement for the equipment does not exceed 10 years; and WHEREAS, the City of Vermillion has reviewed and determined that the bid awarded by National Purchasing Cooperative, d/b/a BuyBoard to Yamaha for 44 Yamaha EFI QT golf carts each equipped with a YamaTrack GPS system and screen for a lease price of $12,310.22 per month; and WHEREAS, the City has contacted Yamaha Golf and Utility, of Burnsville, Minnesota and they have agreed to allow the City to lease the 44 Yamaha EFI QT golf carts each equipped with a YamaTrack GPS system and screen for the awarded price and terms as they have contracted with BuyBoard. Mayor Cole declared that the Resolution was adopted. C. Approval to submit an application to the SDDOT for a Surface Transportation Block Grant Program (STBGP) Advance. Jose Dominguez, City Engineer, reported on an application to the SDDOT for a STBGP Advance. Jose noted the City has identified the need to reconstruct East Clark Street from North Dakota Street to North Plum Street. The original plan was to complete the construction in two phases. The first phase would be from N. University Street to N. Plum Street to be completed in 2024 and the second phase from N. Dakota Street to N. University Street to be completed in 2027. To try and complete the entire project at one time, the City applied for a $2 million Community Development Block Grant (CDBG) award in September 2023 to provide the funding needed. Jose stated in December 2023, the City received notice of a $500,000 CDBG award for the E. Clark Street project. This amount is much less than the $2,000,000 hoped for and will require the City to use more STP funds than originally expected. Jose noted recently the City learned of a SDDOT program that offers the ability to borrow money against the City’s STP allotment given by the State. The money borrowed would have to be used for the reconstruction of transportation infrastructure. Jose stated the SDDOT offers a couple of transportation loan programs. The programs are a State Infrastructure Bank/Federal loan (SIB loan) and a Surface Transportation Block Grant Program advance (STBGP advance). Both programs utilize the City’s STP federal allotment received every year as payment after interest is calculated. Jose noted that the SIB loan requires the SDDOT to manage the program from the selection of the design consultant, the design criteria to follow, bidding, to the 15 construction administration; while the STBGP advance allows the City to control all of those items. Another major difference between the two is that the SIB loan utilizes a 7-year amortization schedule while the STBGP advance uses a 3-year amortization schedule. Jose stated staff is proposing that the City apply for a STBGP advance to try and make up the difference that the CDBG grant did not cover. In conversations with the SDDOT the City would be able to request that the amortization schedule be extended to four years. Additionally, the City would also be able to use other funds to pay for the loan rather than just the City’s STP allotment. The estimated project cost are as follows: Design consultant $95,000 Construction $2,655,000 TOTAL $2,750,000 Jose noted the City would be requesting $1,500,000 to cover the portion that was not covered by the CDBG grant.
