Gayle Bickle, 121 Elm Street, stated they tore down the building next to her house. Gayle noted that they posted signs stating there was asbestos in the house. She noted that there was a cloud over her house from them tearing the house down next to her. She said she would come back with handouts and to abate residential properties not just commercial properties. B. Proclamation recognizing Senator Tim Johnson’s service. Mayor Cole read the following proclamation: WHEREAS, Tim Johnson grew up in Vermillion and graduated from Vermillion High School where he held a record for the number of touchdowns scored in a single season; and WHEREAS, Tim Johnson earned a bachelor's degree in Political Science, a Master of Public Administration, and a law degree all from the University of South Dakota; and WHEREAS, Tim Johnson practiced law in Vermillion and served in the Clay County States Attorney's office; and WHEREAS, Tim Johnson represented Vermillion in the South Dakota House from 1979-1982; and WHEREAS, Tim Johnson represented Vermillion in the South Dakota Senate from 1983-1987; and WHEREAS, Tim Johnson was elected as South Dakota's sole United States House Representative for five terms serving from 1987-1997; and WHEREAS, Tim Johnson was elected to serve three terms as a United States Senator for South Dakota from 1997-2015; and WHEREAS, Tim Johnson gathered the votes needed to provide earmarks to help with the construction of the University of South Dakota's current medical school building, Vermillion hike/bike paths, and many infrastructure projects around the State; and WHEREAS, Tim Johnson was a respected member of Congress who was recognized as a hard-working, centrist leader who continually demonstrated the ability to work with members of both political parties for the betterment of South Dakota and the nation; and 3 WHEREAS, the passing of Tim Johnson on October 8, 2024 was a reminder to reflect on Tim Johnson's humble but long-lasting and dedicated service to Vermillion, Clay County, and South Dakota. Public Hearings A. Request for a variance to decrease the front yard setback from 30 feet to 0 feet for the construction of off-street parking at Hillside Community Church, 1800 Constance Drive. (Legal description of Lots 1, 2, 3, 4, 5, and 5A, Block 5A, Westgate Addition, City of Vermillion, Clay County, South Dakota). Jose Dominguez, City Engineer, reported on a request for a front yard setback variance from 30 feet to 0 feet. Jose noted the variance would facilitate the use of the property as a church by allowing the owner to increase the area that can be used for off-street parking. Jose noted that Hillside Community Church made the request, and churches are a permitted use in the R-1 Residential zoning district. Jose stated the City Council, acting as the Board of Adjustment, hears and decides on any zoning ordinance variance requests. Section 155.100 of the Zoning Ordinance sets what items may be varied and the process that needs to be followed. Setbacks are an item that can be varied by the Board. The applicant is seeking this variance to increase the number 5 of off-street parking spaces within its property and to reduce the use of the street for parking by members of the church. Prior to deciding if a variance is to be granted, the Board needs to consider any public comment and review the following factors: Unnecessary hardship where an owner cannot reasonably use their property, convenience, loss of profit, financial limitations, or self-imposed hardships shall not be considered, literal interpretation would deprive applicant rights commonly enjoyed by others, Variance requested is the minimum variance needed to alleviate hardship, granting variance will comply with the general purpose and intent of this chapter, and will not be offensive to adjacent areas or to the public, other nonconforming uses, or structures, cannot be considered as grounds for the issuance of variance, exceptional and extraordinary circumstances apply to the property that do not apply to other properties in the same zone or vicinity, and the Board of Adjustment may attach conditions to a variance to preserve the intent of the zoning regulations and to protect the public interest. Discussion followed on minimum parking requirements and setbacks. 368-24 Council Member Price moved approval of the variance to decrease the front yard setback from 30 feet to 0 feet for the construction of off- street parking at Hillside Community Church, 1800 Constance Drive. (Legal description of Lots 1, 2, 3, 4, 5, and 5A, Block 5A, Westgate Addition, City of Vermillion, Clay County, South Dakota) with a contingency this area is just for a parking lot. Council Member Holland seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 7. Old Business - None 8. New Business A. Request to close Church Street from East Main Street to Kidder Street from 3:30 p.m. to 6:30 p.m. on Friday, October 25, 2024 for the VCDC’s Downtown Trick or Treat event. John Prescott, City Manager, reported a request to close Church Street from East Main Street to Kidder Street. John noted the Vermillion Area Chamber and Development Company (VCDC) is hosting their Downtown Trick or Treat event on Friday, October 25, 2024 from 4:00 p.m. to 6:00 p.m. John stated to enhance the safety of local pedestrian traffic and visitors during the event, the VCDC has requested this temporary street closure of Church Street from East Main Street to Kidder Street from 3:30 p.m. to 6:30 p.m. on Friday, October 25. John noted Church Street is where many of the businesses and organizations will set up. This location provides an abundance of public parking opportunities in the 6 downtown area. Last year, Court Street was also included in the request, but the businesses participating asked that it not be included this year to allow one centralized area for all participants and attendees. John stated this event is open to the public. The applicant states VCDC staff will be responsible for all trash cleanup following the event. John noted Vermillion Fire/EMS, Police, and Street Departments have been notified of the event and currently have no concerns. Council Member Murra moved approval of the request to close Church Street from East Main Street to Kidder Street from 3:30 p.m. to 6:30 p.m. on Friday, October 25, 2024 for the VCDC’s Downtown Trick or Treat event. Council Member Jennewein seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. B. Final Plat of Lots 16 through 26 in Block 4, Jack Powell Addition, City of Vermillion, Clay County, South Dakota. Jose Dominguez, City Engineer, reported that the City of Vermillion has submitted a final plat as the owner of the land. The area to be final platted is roughly 2.3 acres in size. The land will be bordered on the west by open land owned by the City, on the north and east by residential lots within the Jack Powell Addition, and on the south by Baylor Street. The final plat proposes to subdivide the area into 5 single-family detached lots and 6 single-family attached lots. In addition, the plat will also dedicate a small portion of James Street and the north 10 feet of Baylor Street. The area is currently zoned within the R-3 Residential district. Jose noted the preliminary plat for the Jack Powell Addition was approved by the Commission at the March 25, 2024 meeting. The City Council approved the final plat for the other portions of the development on April 1, 2024. The plat being considered by the City Council does not deviate from the approved preliminary plat. Jose stated Staff reviewed the final plat and found that it complies with all code provisions. The applicant will also be dedicating all utility easements and rights-of-way for the necessary streets. Jose noted this item was considered by the Planning and Zoning Commission at their October 15th meeting. At that meeting the Commission had several questions regarding the location of the lots in relation to the ones already platted. After a brief discussion, the Commission recommended 8-0 that the City Council approve the plat as presented. 7 369-24 After reading the same once, Council Member Holland moved approval of the following plat: WHEREAS IT APPEARS that the owners thereof have caused a plat to be made of the following described real property: Lots 16 through 26 in Block 4, Jack Powell Addition City of Vermillion, Clay County, South Dakota for approval. BE IT RESOLVED that the attached and foregoing plat has been submitted to and a report and recommendations thereon made by the Vermillion Planning Commission to the City Council of Vermillion which has approved the same. BE IT ALSO RESOLVED that access shall be granted to the lot in accordance with the City of Vermillion street access and driveway approach policy, which requires an application permit. BE IT FURTHER RESOLVED that the attached and foregoing plat has been submitted to the Governing Body of the City of Vermillion which has examined the same, and it appears that the systems of streets and alleys set forth therein conforms to the system of streets and alleys of the existing plat of such city, and that all taxes and special assessments, if any, upon the tract or subdivision have been fully paid and that such plat and survey thereof have been executed according to law, and the same is hereby accordingly approved. The motion was seconded by Council Member Price. Discussion followed and the question of the adoption of the Resolution was presented for a vote of the Governing Body. 9 members voted in favor of and 0 members voted in opposition to the Resolution. Mayor Cole declared that the Resolution was adopted. C. Resolution to withdraw from participation in Vermillion River hike/bike path grant agreement. Jose Dominguez, City Engineer, reported on a resolution to withdraw from participation in the Vermillion River hike/bike path grant agreement. Jose noted the City has been working for a few years on reconstructing a portion of the bike path along the Vermillion River from 12th Street to West Street. The City has been trying to complete this project since the flooding events between 2009 and 2011 that damaged the, at the time, newly completed bike trail. Jose noted the project for the reconstruction was awarded late in 2023 with construction to start around July 2024. 8 Jose stated that prior to reconstruction commencing in 2024 the area along the Vermillion River experienced another flood event. Due to the flood, additional riverbank was lost in the vicinity where the trail would turn north towards Broadway Street. In addition to the loss of the bank, the area was also covered by debris consisting of sand and trees. Jose noted after the flood occurred the City assessed the damage and determined that it would be best to request from the DOT and FHWA that the City not be required to pay back the grant money used for the construction of the trails. Jose stated Staff felt that this option would remove the expense of reconstructing the trail in the future, performing costly maintenance after flood events, and of purchasing property to relocate the trail. After discussing with the DOT and FHWA, the DOT recommended that the City draft a resolution where the Council acknowledges the withdrawal of the project (PCN 05NK) and that all the costs to date be paid. Additionally, the City would not be responsible for the reconstruction of any of the trail or for returning the used funds to the DOT or to FHWA. However, the City would need to return any unexpended funds to the DOT. Jose reported the original grant received by the City in 2005 was for $750,000. This money was intended to be used by the City for the construction of bike trails in the community. The money has been used to construct trails along the river (e.g. from 12th Street to the west), along the Bypass (e.g. Carr Street to Stanford Street), and along Stanford Street (e.g. Bypass to West Cherry Street). Currently, there is approximately $80,000 left of the original grant. The DOT estimates that the City will need to repay no more than $6,575.84 to BX Construction and $3,883.95 to McLaury Engineering, for a total of $10,459.79. These costs are associated with the portion of the mobilization and bonding expenses incurred by the contractor and for consultant services. Although the DOT had a precise estimate, they asked the City to round up the amount to $12,000 in case additional costs have been incurred and are not accounted for yet. Council Member Holland asked if the current bike path would be taken out. Jose stated no, the current portions would stay there and they would close the bike path. Mayor Cole asked if the $80,000 of grant money could be used for clean- up of the bike path. Jose stated no, all funds would have to be used for construction of a bike path. 9 Mayor Cole stated the intent is to redesign the bike path at a later date. 370-24 After reading the same once, Council Member Holland moved adoption of the following: RESOLUTION TO WITHDRAW FROM PARTICIPATION IN THE CITY OF VERMILLION SHARED-USE PATH PROJECT (PCN 05NK) WHEREAS, the City of Vermillion received a $750,000 grant in 2005 from the Federal Highway Administration (FHWA) for the construction of shared-use paths in the City; and WHEREAS, the City of Vermillion, with the assistance and direction of the South Dakota Department of Transportation (SDDOT), has completed several shared-use path projects in the City, one of those being along the Vermillion River from 12th Street to West Street; and WHEREAS, between 2009 and 2011 the Vermillion River flooded areas adjacent to the already constructed trails and damaged them so that they were unsafe to use; and WHEREAS, since 2010 the City of Vermillion has been working with the SDDOT to relocate the damaged trail to a location away from the river and to avoid repaying the money used to the FHWA; and WHEREAS, the reconstruction of the shared-use path was going to occur in the summer of 2024; and WHEREAS, in June and July 2024 the Vermillion River flooded and eroded additional riverbank and deposited debris in other parts of the shared- use path; and WHEREAS, the City of Vermillion asked the SDDOT and FHWA to abandon the reconstruction project and to remove the City’s requirement to repay FHWA for any of the grant used; and WHEREAS, the SDDOT and FHWA have agreed to allow the City of Vermillion to repay expenses already incurred by the SDDOT, the contractor, and the consultant no more than $12,000, and to return any of the remaining grant funds originally given to the SDDOT. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota, that the City is withdrawing from participation in the construction of the Shared Use Path project (PCN 05NK), will repay the SDDOT, the contractor, and the consultant no more than $12,000, 10 and return any remaining monies associated with the original grant to the SDDOT. Mayor Cole declared the motion adopted. E. Resolution Amending the Fee for Special Daily On-Sale Malt Beverage and Wine Licenses. John Prescott, City Manager, reported on amending the fee for Special Daily On-Sale Malt Beverage and Wine Licenses. John presented rates that other municipalities charged and proposed a $20 advertising fee and $30 per day license fee. 371-24 After reading the same once, Council Member Hellwege moved adoption of the following: RESOLUTION REVISING THE FEE FOR SPECIAL DAILY ON-SALE MALT BEVERAGE AND WINE LICENSES WHEREAS, Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 of the 2008 Revised Ordinances of the City of Vermillion allows the City Council to change the fee for special 11 alcoholic beverage licenses issued in conjunction with special events; and WHEREAS, there is a need to review and adjust fees as expenses change over time; and WHEREAS, rates and fees are adjusted periodically to recover the increased costs. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota that effective January 1, 2025, rates be changed and established as follows: 112.18 (A) Special on-sale malt beverage and/or special on-sale wine license fee shall be thirty dollars ($30.00) per day plus a twenty-dollar ($20.00) advertising fee. 112.18 (B) Special off-sale package wine dealers license such license may only sell wine manufactured by a farm winery that is licensed pursuant to SDCL 35-12 fee shall be thirty dollars ($30.00) per day plus a twenty-dollar ($20.00) advertising fee. Mayor Cole declared that the Resolution was adopted. F. Consider Adoption of the Jack Powell Addition 2024 Concerted Community Development and Revitalization Plan (CCRP). John Prescott, City Manager, reported that a Concerted Community Development and Revitalization Plan (CCRP) is a strategic framework aimed at enhancing community well-being and neighborhood development. It 12 involves collaborative efforts among local government, community organizations, businesses, and residents to address social, economic, and environmental challenges. John stated several documents that provide input to identify the need for affordable housing within the Vermillion area are included in the document. Furthermore, the need for affordable housing was demonstrated at all ages, incomes, and phases of life. The documents cited within the CCRP include the City of Vermillion Housing Study, Sanford Vermillion’s Community Health Needs Assessment, City of Vermillion’s Community Development Block Grant application, SECOG’s Comprehensive Economic Development Strategy, and the City of Vermillion 2035 Comprehensive Plan. The CCRP highlights five goals and priorities within the 2035 Comprehensive Plan that the Jack Powell Addition provides for the community. John stated a proposed developer is applying for a tax-credit housing project through the South Dakota Housing Development Authority (SDHDA). Due to these 50 acres of the Jack Powell Addition not being within City limits during the last census, it is not considered a qualified census tract, and therefore the developer requested a CCRP to assist them in their application to the SDHDA. The application is directed toward assisted and independent senior living. Council Member Murra moved approval of Jack Powell Addition 2024 Concerted Community Development and Revitalization Plan (CCRP). Council Member Hellwege seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 9. Bid Openings - None 10. City Manager's Report A. John reported the City and County Planning & Zoning Commissions meet at 5:30 p.m. on Monday, October 28. The agenda item is considering rezoning a parcel south of West Main Street outside of City limits in the JJZA. B. John stated the City Council and County Commission are meeting at 6:00 p.m. on Tuesday, October 29 to consider the first reading of an ordinance to rezone property from A-1 to RR located in the JJZA on the west of Highway 19 approximately 1/2 mile north of City limits. C. John noted two three-year terms on the Business Improvement District #1 Board are available. Interested individuals are asked to complete an Expression of Interest form by 5:00 p.m. on October 24. Anticipate that the City Council will make appointments at the November 4 meeting. 13 D. John stated sealed bids to lease the 230+ acres of farmland located east of town will be opened at 11:00 a.m. on Friday, November 1, 2024. Anticipate that the City Council will make an award at the November 4, 2024 meeting. E. John noted the November 4th City Council meeting will include a public hearing to review the progress of the East Clark Street reconstruction project. This is one of the requirements of the CDBG program used to help fund the project. F. John reminded citizens that political signs are not be placed in the public right-of-way. Signs should be behind the sidewalk. G. John noted the Landfill moves to their winter schedule as of November 1st. There are no Saturday hours with the winter schedule. H. John stated a draft of the proposed historic district of the southern portion of the USD campus is available for review at City Hall. I. John reported one raffle notification. Vermillion After Prom is selling raffle tickets at $25 each, 3 for $50, or 7 for $100. Tickets will be sold until November 1, 2024. Proceeds from the raffle will be used to fund the After Prom event, prom decorations, and the 2026 senior class trip. The prize is valued at $800 and includes 6 tickets to the USD – NDSU football game on November 23, 2024, 6 combo meal concession vouchers, 6 Coyote landing passes, 1 tailgate spot, $50 Charlie’s store gift certificate, and a $50 Hy-Vee gift card. J. John gave an update that the Wastewater force main project temporary piping is gone, and all three forced mains are in place. John noted that removal of the bridge will happen soon. K. John noted that the Labor and Finance Committee is meeting after the Council meeting.
