Minutes of October 6, 2025, Special Session and October 6, 2025, Regular Session. 716-25 Council Member Holland moved approval of the October 6, 2025, special session and October 6, 2025, regular session minutes. Council Member Murra seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. 4. Adoption of Agenda 717-25 Council Member Price moved approval of the agenda. Council Member Leber seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. 5. Visitors to be Heard 6. Public Hearings A. Special Daily Malt Beverage and Wine License for the Clay County Agricultural Fair Association at 515 High Street on or about November 22, 2025, at the Clay County Fairgrounds 4-H Center. Nick Doty, Deputy Finance Officer, reported a Special Daily Malt Beverage and Wine License for the Clay Couty Agricultural Fair Association at 515 High Street on or about November 22, 2025, at the Clay County Fairgrounds 4-H Center. Nick stated the Police Chief’s memo was attached to the 1 packet which outlined safety measures to be taken by the Fair Association. 718-25 Council Member Holland moved approval of the Special Daily Malt Beverage and Wine License for the Clay County Agricultural Fair Association at 515 High Street on or about November 22, 2025, at the Clay County Fairgrounds 4-H Center with the recommendation from the Police Chief’s safety measures. Council Member Price seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. B. Request for a variance to decrease the required setback when abutting a residential district from 20 feet to 0 feet to either construct a new building with commercial units on the ground level and residential uses above, or to modify the existing building to provide the same at 16 High Street. (Legal description of Lots 11, 12, 15, 16 & 17, Block 36; Exc. S 82’ of Lots 15, 16 & 17, Block 36; Snyders Addition, City of Vermillion, Clay County, South Dakota). Jose Dominguez, City Engineer, reported the City received a petition requesting that the setback required when a business district abuts a residential district be reduced from 20 feet to 0 feet for the construction of a mixed used building that may use the foundation of the existing building. Jose noted the variance would facilitate the use of the property as a mixed used building with commercial units on the main floor and residential units above the main floor. A mixed-use building is a permitted use in the CB Central Business zoning district. Jose noted the request was made by the owner, Mart Brothers Construction, Inc. Jose stated the City Council, acting as the Board of Adjustment (Board), hears and decides on any zoning ordinance variance requests. Section 155.100 of the Zoning Ordinance sets what items may be varied and the process that needs to be followed. Jose noted setbacks are an item that can be varied by the Board. The applicant is seeking this variance to decrease the setback when abutting a residential district from 20 feet to 0 feet. Jim Peterson, VCDC CEO, stated they reached out to the property owner to the north and they could not be reached, and XIX Brewery is in favor of this. Nick Mart, Mart Brothers Construction, stated it’s not cost effective to start completely new. Remodeling might be a good option, but razing the building and revising the existing foundations would provide a more aesthetic and cost-effective end product. Nick stated it will be the exact same footprint as today. First reading of Ordinance 1547 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.037 GB General Business District, Subsection (B) Conditional Uses, amending the Applicable Standards for the Veterinarian, Small Animal Use. Jose Dominguez, City Engineer, reported on the first reading of Ordinance 1547 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.037 GB General Business District, Subsection (B) Conditional Uses, amending the Applicable Standards for the Veterinarian, Small Animal Use. Jose stated at the October 6, 2025, City Council meeting, the Council considered a request for an appeal regarding the placement of a small animal veterinarian use. Jose noted the appeal was requested since Staff denied the application because the use would be closer than 150 feet from a residential building located in a residential district. Jose stated after consideration, and denial of the appeal, the City Council requested that the ordinance be amended as quickly as possible so that small animal veterinarian uses are allowed as a conditional use within the GB General Business district. Jose noted the current ordinance places small animal veterinarians as a conditional use. This requires the use to be reviewed and approved by the City’s Planning and Zoning Commission, but prior to being considered the use must meet certain applicable standards. One of these standards is the fact that the use cannot be located within 150 feet of a residential building within a residential district. Jose reported the proposal would remove the distance requirement and not allow the kenneling of dogs outside of the building. This will remove the distance requirement and any future appeals due to proximity to residential use. Jose stated that the Planning and Zoning voted unanimously to pass this ordinance. 3 Jim Peterson, VCDC CEO, thanked the Council for having the meeting to reconsider the ordinance and expediting the process. Council Member Jennewein stated that the no outdoor kenneling for all small animal clinics is a little too far the other way. Jennewein stated that other areas in town could add a vet and have outdoor kenneling. Jennewein stated she has concerns about this long term but currently it’s fine to get this vet in town. Discussion followed. 720-25 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Price moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No 1547 entitled An Ordinance Adopting Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.037 GB General Business District, Subsection (B) Conditional Uses, amending the Applicable Standards for the Veterinarian, Small Animal Use of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 20th day of October, 2025 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 7 members voted in favor of and 0 members voted in opposition to the motion. RESOLUTION AUTHORIZING THE TRANSFER OF EQUIPMENT TO PENNINGTON COUNTY WHEREAS, SDCL 6-5-5 and SDCL 9-12-5 authorize the governing body of a municipality to transfer personal property to any other political subdivision of the State; and WHEREAS, the City of Vermillion Emergency Communications Department has declared surplus a 2013 console in working condition; and WHEREAS, Pennington County has expressed interest in the console that has been declared surplus; and WHEREAS, Pennington County is in need of an additional console; and WHEREAS, it would be beneficial for the City of Vermillion Emergency Communications Department to transfer the 2013 console to Pennington County. Second reading of Ordinance 1545 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District (property located at 1200 W. Main Street). Jose Dominguez, City Engineer, reported on the second reading of Ordinance 1545 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District. Jose stated the owners of the land, Heines, have requested that the City rezone their property from the NRC Natural Resource Conservation District to the R-1 Residential District. Jose stated the area is roughly 4.86 acres in size and is addressed as 1200 W. Main Street with the existing uses surrounding the property are commercial to the north and east and residential to the west and south. Jose stated the zoning to the north is GB General Business, to the east it is GB General Business and LI Light Industrial, and to the west it is R-1 Residential. Jose noted the property to the south is outside of City limits and is in the Joint Jurisdiction zoning area and is within the A-1 Agricultural zoning district. Jose reported that when property is annexed into the City it is automatically placed in the most restrictive zoning district which is the most restrictive district. Jose noted the owners of lots 2 through 4 rezoned their parcels in January 2012 from the NRC Natural Resource Conservation district to the R-1 Residential district. The owner of lot 1 rezoned his property from the NRC Natural Resource Conservation District to the GB General Business district in December 2021. The owner of lot 5 never requested their parcel to be rezoned. Jose noted the City provided the Heines with information to contact the owners of 18 properties that cover 801,455 square feet. Jose stated for the meeting to occur, the Heines had to collect signatures from the owners of at least 360,655 square feet, or 45% of the aggregate area. The Heines collected signatures from owners of six properties who owned 618,508 square feet. Jose stated Heines’ desire for rezoning their property is to allow for the construction of an addition to the existing house which the current zoning does not allow for residential uses. Jose noted the existing residence can remain in the district, but no additions can be completed. For the Heines to be able to construct the desired addition, the property needs to be rezoned to the R-1 Residential district. Jose noted rezoning this property will not be construed as offensive to the neighbors. Similarly zoned property exists to the west and the 9 property to the east and north is in a different zoning district that allows for what may be considered offensive uses by residential construction. Jose reported this item was considered by the City’s Planning and Zoning Commission at their September 22nd meeting with four members of the public present at the meeting, the owners and VCDC staff. Jose noted the VCDC spoke in favor of the rezone and that it would not be harmful to the neighboring properties. City Staff answered questions from the Commission regarding the possibility of developing part of the lot south of the bluff. After discussion, the Commission voted 6-0 to recommend the City Council adopt the rezone as proposed. 722-25 Second reading of title to Ordinance No. 1545, entitled An Ordinance Amending Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District for the City of Vermillion, South Dakota. Mayor Cole read the title to the above-named Ordinance, and Council Member Holland moved adoption of the following: BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1545 entitled Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 6th day of October, 2025 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 20th day of October, 2025 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. First reading of Ordinance 1543 to amend Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events. Katie Redden, Finance Officer, reported on the first reading of Ordinance 1543 to amend Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events. Katie stated in 2010 state statue was amended to allow for “any licensee licensed pursuant to 35-4” to be issued a special daily on-sale malt beverage or special on-sale wine license. The statute was also amended to allow for special on-sale liquor licenses. The City Council in 2010 did not opt to change the ordinance to allow these two items. At the August 4, 2025 noon meeting, a presentation was given on current state laws for special daily licenses vs the City’s current ordinance. Katie noted currently only civic, charitable, educational, veterans, or fraternal organizations are allowed to hold either a malt beverage or wine special license. Katie stated that on October 7, 2025, a roundtable was held with current alcohol license holders and City Staff. At that meeting license holders 11 agreed that only current license holders would be allowed to get a special daily liquor license if they applied. Katie noted the ordinance change brought forward today would allow for current license holders in the City of Vermillion to hold special daily malt beverage, wine, and liquor licenses for special events. The motion was seconded by Council Member Price. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 7 members voted in favor of and 0 members voted in opposition to the motion. Mayor Cole declared the motion adopted. C. Resolution amending the fee for the on-sale full-service restaurant license. Katie Redden, Finance Officer, reported on the on-sale full-service restaurant license fee being lowered to $70,000. Katie noted that at the September 15th council meeting this topic was to be brought to a roundtable discussion. Katie noted on October 7, 2025, the Vermillion Area Chamber and Development Company hosted a roundtable event with City officials and bar owners. Katie noted discussions happened and the current liquor license holders stated they purchased their licenses for far more than $70,000 therefore allowing restaurant licenses to be purchased at that amount would de-value their licenses. Consensus of the bar owners was not to decrease this cost. Council Member Thaler asked if restaurants are not coming to town due to the license being too expensive. 12 Jim Peterson, VCDC CEO, stated that he has not seen this. Council Member Price stated that during the meeting restaurant owners stated lowering the cost would not make or break them getting a license. Mayor Cole declared the item dies due to lack of motion. 9. New Business A. First reading of Ordinance 1546 to amend Title VII, Chapter 70, Section 70.198, to amend the address of the Vermillion Police Department. John Prescott, City Manager, reported on the first reading of Ordinance 1546 to amend Title VII, Chapter 70, Section 70.198, to amend the address of the Vermillion Police Department. John stated there is one mention of the Vermillion Police Department’s address in the Code of Ordinances. Council Member Jennewein seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. C. Carr Street Construction (Duke to Bower) Change Order No. 1. Jose Dominguez, City Engineer, reported on Change Order No. 1 for the Carr Street Construction project. Jose stated North Carr Street was an existing north-to-south undeveloped right-of-way that commences at West Duke Street and ends at Bower Street. Prior to this year, this portion of North Carr Street was undeveloped and lacked any street improvements. However adjacent property has been developed since 2015. Jose noted on June 17, 2024, the City Council adopted a resolution of necessity for the construction of this portion of North Carr Street. The City Council awarded a contract to Steve Harris Construction on February 18, 2025, to construct this section of Carr Street. Jose stated the construction of Carr Street between Duke Street and Bower Street has been mostly constructed, but the items that remain to be completed are grading of the boulevard and seeding. Jose noted that during construction several items had to be addressed in a timely fashion to allow the project to progress which consisted of changes to the extension of the watermain, adjustment of the vertical control prior to construction, modification of the grading at the Polaris driveway, adjustment of the quantities, and poor soils encountered at the site. The changes required that the contract be adjusted by a total of $129,847.56. 726-25 Council Member Leber moved approval of the Carr Street Construction (Duke to Bower) Change Order No. 1 of $129,847.56. Council Member Holland seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. D. Resolution amending landfill disposal rates. John Prescott, City Manager, reported on a resolution to amend landfill disposal rates. John stated the City of Vermillion entered into a Joint Powers agreement with the City of Yankton, Clay County, and Yankton County in 1994 to provide for solid waste services. John noted the agreement didn’t create a new entity but provides for the transfer station in Yankton to be operated by the City of Yankton and the operations at the landfill and recycling center to be conducted by the City of Vermillion. John stated the Joint Powers Board was created to facilitate communications between the members, coordinate the operations, and provide recommendations to the member governing bodies. 14 John reported the Joint Powers Board at their September 18, 2025, meeting recommended the adjustment of the landfill and transfer station rates effective January 1, 2026. Other rate changes such as for asbestos, contaminated soil, etc. will be brought forward later this year. John noted the upcoming development and closure of additional landfill cells, the recent purchase of a new dozer, and the purchase of a loader in 2026 are substantial costs in the Joint Powers budget. Replacement of the dozer was completed through a grant and a loan which added to the annual debt service. Costs to operating the recycling center that are not covered by the sale of recyclables are also covered by landfill tipping fees. The curbside recycling collection program is not part of the Joint Powers budget. 727-25 After reading the same once, Council Member Jennewein moved adoption of the following: RESOLUTION REVISING DISPOSAL RATES AT THE MUNICIPAL LANDFILL WHEREAS, at the September 18, 2025 Joint Powers Advisory Board meeting in Yankton, the Board voted to recommend that both the cities of Vermillion and Yankton increase the tipping fees at each municipality’s respective solid waste facility; and WHEREAS, with recent landfill cell construction and closure, increased debt service, future capital purchases, and construction projects, the cost to operate per ton has increased; and WHEREAS, the Joint Powers member cities desire to provide solid waste services on a self-sustaining user fee basis; and WHEREAS, Section 52.07 of the 2008 Revised Ordinance of the City of Vermillion allows the City Council to establish and charge fees and service charges for the commercial and non-commercial deposits of receivable solid waste at the landfill. Mayor Cole declared that the Resolution was adopted. 10. Bid Openings A. Water Treatment Plant improvement. Shane Griese, Utilities Manager, reported on the bid for the Water Treatment Plant improvements. Shane noted the Water Treatment Plant (WTP) was put into service in 1972. Large-scale improvements were made in 2006. In 2022 a Facility Plan was performed on the WTP. The Facility Plan focused on aging infrastructure within the treatment plant; it also included replacement of nearly 1 mile of aging water mains. The plan allowed for the project to be placed on the State Water Plan which gave the City the ability to request funding through the State of South Dakota. Shane stated the Facility Plan was presented to the public at the December 19, 2022, City Council meeting, and a funding application was submitted 16 in the beginning of 2023. In March of 2023 the City was awarded a $7,000,000 SRF loan to fund the project. In August of 2023 the City Council awarded the engineering contract to Banner Associates in the amount of $673,500.00. Shane noted that contract was broken into two separate task orders. Task #2 covered the engineering for the WTP ($480,500) and Task #3 ($193,000) covered the water distribution improvements. Task #3 Water distribution improvements were completed in 2024 by Hulstein in the amount of $1,286,601.25. Shane stated the project design on the Water Treatment improvements was completed by Banner in the summer of 2025 and plans were reviewed by the state of South Dakota Department of Agriculture and Natural Resources. The project’s advertisement for bids was published on August 29th and September 5th as required by state statute. Shane noted the Water Treatment Plant project bid documents were broken into two parts, a Base bid and a Bid Alternate. The Base bid included improvements to the filters, piping, valving and SCADA systems while the Bid Alternate was for pipe and valve improvements in the high service room. Shane reported that on September 30, 2025, at 2:00 p.m. four bids were collected and opened for the WTP improvement project. The low bid was received from RP Constructors LLC from North Sioux City, SD. RP submitted a Base bid in the amount of $6,103,940.00 and a Bid Alternate in the amount of $293,922.00. Banner Associates has reviewed the bids and submitted a letter of recommendation which has been attached for review. 728-25 Council Member Murra moved approval of the bid from RP Constructors LLC from North Sioux City with a base bid in the amount of $6,103,940.00 and reject Bid Alternate in the amount of $293,922.00. John reported on two meetings or events before the next City Council meeting on Monday, November 3, 2025:  Tree Board meets on Wednesday, October 22 at 9:30 a.m. in the Powell Conference room.  Special City Council meeting to consider the second reading of Ordinance 1547 on Monday, October 27 at 12:00 p.m. at the Powell Conference room at City Hall. 17 B. John stated the VCDC’s Downtown Trick-or-Treat event is Friday, October 31. Church Street from East Main Street to Kidder Street will be closed from 3:30 p.m. to 6:30 p.m. for the event. C. John reported on two raffle notifications:  The Clay County Agricultural Fair Association is selling raffle tickets at a price to be determined but will not exceed $10. The sale date is November 22, 2025. It is a 50/50 drawing with the proceeds to go for facility improvements at the fairgrounds.  The USD OT Chapter of Pi Theta Epsilon is selling raffle tickets at 1 for $3 or 2 for $5 from October 13 through November 9, 2025. The prizes are 5 baskets that vary in value from $10 to $25. They hope to raise $1,000 which will be donated toward St. Catherine Challenge which funds research in interventions with occupational therapy.
