Council Member Murra seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 4. Adoption of Agenda 726-25 Council Member Price moved approval of the agenda. Council Member Jennewein seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 5. Visitors to be Heard A. Small Business Saturday Declaration – Vermillion Area Chamber and Development Company. Katie Heine, VCDC, read the following proclamation: Declaring Saturday, November 29, 2025, as “Small Business Saturday” WHEREAS, small businesses are the backbone of the American economy — representing roughly 99.9% of all U.S. businesses, employing nearly half of the American workforce, and contributing roughly 43–44% of the nation’s GDP; and small firms sustain community character, create jobs, and foster innovation and opportunity across every region of the country. WHEREAS, the State of South Dakota’s small business community has been a powerful engine for job growth and local opportunity; small businesses in South Dakota accounted for many the state’s net new jobs in the most recent SBA analysis, contributing materially to the state’s economic resilience and growth. WHEREAS, Clay County is home to hundreds of employers that provide local jobs, services, and payroll that support families and the County’s quality of life — with Census QuickFacts reporting approximately 298 employer establishments and several thousand local employees contributing to the County’s economy. WHEREAS, Vermillion is a vibrant college town of more than 12,000 residents with hundreds of local businesses — including retail, restaurants, professional services, and small manufacturers — that support the University of South Dakota, visitors, and surrounding rural communities and provide essential goods, services, and employment to the region. WHEREAS, “Small Business Saturday” is an opportunity to celebrate and support the locally owned, independently operated businesses that invest in our neighborhoods, create jobs, and strengthen our sense of community; and WHEREAS, residents and visitors are encouraged to shop local, dine local, and use local services on Small Business Saturday to sustain the distinctive businesses that make Vermillion and Clay County unique. NOW, THEREFORE, I, Katherine Heine, Manager of the Vermillion Area Chamber of Commerce, do hereby proclaim Saturday, November 29, 2025 as SMALL BUSINESS SATURDAY in the City of Vermillion and throughout Clay County, South Dakota, and urge all citizens to recognize the contributions of our small business owners and to support them through patronage, advocacy, and partnership. B. Veterans Day Proclamation – Human Relations Commission. No one was present to read the proclamation. The City Council noted the proclamation could be read if someone showed up by the end of the meeting to do so. 6. Public Hearings A. Annual liquor and wine license renewals. Katie Redden, Finance Officer, reported that this was the time set for the public hearing for the annual liquor and wine license renewals. Katie stated that the notice of hearing and the Police Chief’s report are included in the packet. Katie noted that the Council is to consider the renewal of the on-sale retail liquor licenses with Sunday sales, retail on-off-sale wine licenses and municipal package off-sale license. RESOLUTION AUTHORIZING THE PURCHASE OF TWO POLICE FORD ALL-WHEEL DRIVE INTERCEPTOR VEHICLES WHEREAS, SDCL 5-18C-8 authorizes a governmental entity to purchase any piece of equipment, without advertising for bids, from a willing vendor, any supplies contained in the state contract list at a price at or below that shown in the state contract; and WHEREAS, the City of Vermillion approached the local dealer, Vermillion Ford, to see if they could match the price found in the state contract for two Ford All-Wheel Drive Interceptor Rated Police vehicles; and WHEREAS, after the prices from the local dealer were compared with the State contract prices it was found that the local dealer’s prices were less than, or identical to, the State’s contract prices. Second reading of Ordinance 1543 to amend Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events. Katie Redden, Finance Officer, reported on the second reading of Ordinance 1543 to amend Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events. Katie stated in 2010 state statue was amended to allow for “any licensee licensed pursuant to 35-4” to be issued a special daily on-sale malt beverage or special on-sale wine license. The statute was also amended to allow for special on-sale liquor licenses. The City Council in 2010 did not opt to change the ordinance to allow these two items. At the August 4, 2025, noon meeting, a presentation was given on current state laws for special daily licenses vs. the City’s current ordinance. Katie noted currently only civic, charitable, educational, veterans, or fraternal organizations are allowed to hold either a malt beverage or wine special license. Katie stated that on October 7, 2025, a roundtable was held with current alcohol license holders and City Staff. At that meeting license holders agreed that only current license holders would be allowed to get a special daily liquor license if they applied. Katie noted the ordinance change brought forward today would allow for current license holders in the City of Vermillion to hold special daily malt beverage, wine, and liquor licenses for special events. This would allow current business owners to use their licenses at an off-premise location for a special event. 729-25 Second reading of title to Ordinance No. 1543, entitled An Ordinance Amending Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events for the City of Vermillion, South Dakota. Mayor Cole read the title to the above-named Ordinance, and Council Member Leber moved adoption of the following: BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1543 entitled Amending Title XI, Business Regulations; Chapter 112, Alcoholic Beverages; Section 112.18 modifying eligible applicants for Special Alcoholic Beverage Licenses issued in conjunction with Special Events was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 20th day of October, 2025 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 3rd day of November, 2025 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows:  ORDINANCE 1543 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES TITLE XI, BUSINESS REGULATIONS; CHAPTER 112, ALCOHOLIC BEVERAGES; SECTION 112.18, SPECIAL ALCOHOLIC BEVERAGE LICENSES ISSUED IN CONJUNCTION WITH SPECIAL EVENTS TO MODIFY ELIGIBLE APPLICANTS. BE IT ORDAINED, by the Governing Body of the City of Vermillion, South Dakota, and it is hereby ordained by authority of the same, that Section 112.18 be amended to clarify special event as set forth below: § 112.18 SPECIAL ALCOHOLIC BEVERAGE LICENSES ISSUED IN CONJUNCTION WITH SPECIAL EVENTS. (A) The City Council may grant, after public hearing, a special on-sale malt beverage, and/or a special on-sale wine license to a civic, charitable, educational, veterans, or fraternal organization in conjunction with a special event. (B) The City Council may grant, after public hearing, a special off-sale package wine dealers license to a civic, charitable, educational, veterans, fraternal organization, or any licensee licensed pursuant to SDCL35-4-111 or subdivision 35-4-2(4), (6), or (16) in conjunction with a special event. A special off-sale package wine dealers licensee may only sell wine manufactured by a farm winery that is licensed pursuant to SDCL 35-12. (C) The City Council may grant, after public hearing, a special on-sale malt beverage, and/or a special on-sale wine license, and/or on-sale liquor license to any licensee licensed pursuant to SDCL35-4-111 or subdivision 35-4-2(4), (6), or (16) in conjunction with a special event. (D) Any license issued pursuant to this section shall be issued to the person and the location specified on the application. Any license issued pursuant to this section may be issued for a period of time established by the municipality. However, no period of time may exceed fifteen (15) consecutive days. The granting of the special license shall be subject to such conditions and restrictions as the City Council may deem appropriate and consistent with state law. Second reading of Ordinance 1546 to amend Title VII, Chapter 70, Section 70.198, to amend the address of the Vermillion Police Department. John Prescott, City Manager, reported on the second reading of Ordinance 1546 to amend Title VII, Chapter 70, Section 70.198, to amend the address of the Vermillion Police Department. John stated there is one mention of the Vermillion Police Department’s address in the Code of Ordinances. Since the Vermillion Police Department moved to a new location at the recently completed Clay County Law Enforcement Center, the code needs to be updated. 730-25 Second reading of title to Ordinance No. 1546, entitled An Ordinance Amending Title VII, Chapter 70, Section 70.198, to amend the address of the Vermillion Police Department for the City of Vermillion, South Dakota. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE 1546 AN ORDINANCE AMENDING CITY OF VERMILLION CODE OF ORDINANCES TITLE VII, TRAFFIC CODE; CHAPTER 70, GENERAL TRAFFIC AND PARKING REGULATIONS; SECTION 70.198, ENFORCEMENT AMENDING THE ADDRESS OF THE VERMILLION POLICE DEPARTMENT. BE IT ORDAINED, by the Governing Body of the City of Vermillion, South Dakota that the City of Vermillion Code of Ordinances Title VII, Chapter 70, Section 70.198, Amending the Address of the Vermillion Police Department, be amended as follows: § 70.198 ENFORCEMENT. (A) Generally. It shall be the duty of any law enforcement officer authorized by law to enforce the provisions of this subchapter and to keep account of all violations of this subchapter. (B) Specifically. (1) When any vehicle is illegally parked, it shall have attached thereto a notice stating that it has been parked in violation of this chapter, and directing the owner or operator to enclose an amount set by resolution in the envelope upon which notice shall be written and deposit the same in overtime courtesy boxes located within the parking meter zone. (2) If the amount is not deposited in the courtesy box or taken to the Vermillion Police Department at 1250 Stanford Street within 48 hours after the notice is placed upon the vehicle, the penalty to be enclosed or deposited or delivered to the Police Department shall be an amount set by resolution. (Property located at the NW intersection of SD Highway 50 and SD Highway 19.) Shane Griese, Utilities Manager, reported on an agreement with Clay-Union Electric to transfer electric service territory for Munger Tract 4, in the SW 1/4 of the SE 1/4 of the Section 11, Township 92 North, Range 52 West of the 5th P.M., Clay County, South Dakota. (Property located at the NW intersection of SD Highway 50 and SD Highway 19.) Shane stated at the August 4, 2025, meeting, the City Council approved annexation of the property currently known as Munger Tract 4, into City limits. Shane noted state law gives municipalities the right to provide utility services to annexed properties within a year of the annexation. At the same August meeting, the City Council approved a Notice of Intent (NOI) to Purchase Service Territory, which was sent to Clay-Union Electric on August 5, 2025. Shane stated Clay-Union Electric acknowledged receipt of the NOI on October 21, 2025, and has confirmed there are no existing services on the property. Shane noted they have existing power lines and materials on the north end of the property, however, this infrastructure does not need to be abandoned or relocated. Shane stated a transfer agreement was drafted by the City and the language in that agreement was approved by Clay-Union Electric staff. There is no infrastructure that will be transferred, and there is no cost to reintegrate Clay-Union Electric’s system. A transfer date of December 1, 2025, has been agreed to the respective staff of each party. Shane stated the City will be responsible for paying annual lost revenue fees in the amount of 25% of all sales for a period of seven years for all existing services and any new service that is served within the annexed property during an 11-year period. All the lost revenue charges are based on the City’s electric rate at the time of transfer. Shane reported once approved the agreement will be delivered to Clay- Union Electric for approval by their board. Once all parties have approved the agreement, the transfer agreement will be filed with South Dakota Public Utilities Commission. Shane noted that the Clay-Union Electric general manager had sent an email on Friday that he was unable to make the meeting but was in agreement with signing the document. 731-25 Council Member Murra moved approval of the agreement with Clay-Union Electric to transfer electric service territory for Munger Tract 4, in the SW 1/4 of the SE 1/4 of the Section 11, Township 92 North, Range 52 West of the 5th P.M., Clay County, South Dakota. Resolution amending curbside recycling fees. John Prescott, City Manager, reported on a resolution to amend curbside recycling fees. John stated that the City Council adopted Ordinance 1184 implementing curbside recycling for qualifying residential properties and the mandatory fee in April 2008. John noted the ordinance was referred to a vote and upheld by voters with the November 2008 election. John reported in 2008 that the mandatory fee for curbside residential recycling collection was established at $3.30 per month plus sales tax. The fee was adjusted in January 2016 to $3.50 per month plus sales tax, in January 2018 to $3.70 per month plus sales tax and in January 2022 to $3.90 per month plus sales tax. The City has also established a fee for collection of recyclable materials not mandated by the ordinance at a flat fee that shall cover the collection costs. The current rate is set at $12.50 per month plus sales tax. John noted a 10-cent increase per qualifying residence per month and a 50-cent increase for collection of recyclable materials from locations not mandated by the ordinance is estimated to generate an additional $3,400 per year for the curbside recycling fund. John stated the adjusted fee will be effective for utility billing after January 1, 2026. The first time a resident would pay the increased amount would be for the bill sent out in late January that is due no later than February 10, 2026. 732-25 After reading the same once, Council Member Hellwege moved adoption of the following:  RESOLUTION REVISING CURBSIDE RECYCLING COLLECTION RATES WHEREAS, Ordinance 1184 establishing mandatory curbside recycling for qualifying residences was adopted by the Vermillion City Council in April 2008 and upheld via a municipal election in November 2008; and WHEREAS, Section 52 of the Vermillion City Code of Ordinances provides the policies and procedures for curbside recycling collection; and WHEREAS, the City Council desires to provide curbside recycling on a self-sustaining user fee basis; and WHEREAS, Section 52.32 of the 2008 Revised Ordinance of the City of Vermillion allows the City Council to establish the monthly mandatory fee for residential curbside collection via resolution. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota, at a regular meeting thereof, in the Council Chambers of said City, at 6:00 p.m., on the 3rd day of November, 2025, to amend the mandatory curbside recycling fee for utility billing after January 1, 2026 to be $4.00 per month plus sales tax for residential service and $13.00 per month plus sales tax for commercial service. BE IT FURTHER RESOLVED, that the City Manager of the City of Vermillion, South Dakota is authorized to establish rates for collection of recyclable materials from locations not mandated by the ordinance at a flat fee that shall cover the collection costs. City can procure bids based on the requirements set forth in 5-18A; or 2. City can purchase from an already awarded contract that was awarded within 12-months as long as the awarded bidding process in 5-18A was followed (5-18A-22(3)); or 3. City can purchase from a purchasing agency (5-18A-37); or 4. City can purchase from a local vendor as long as the purchased item is at, or below, the price on the State contract list (5-18C-8); or 5. City can purchase any equipment that costs less than $50,000 without going to bid (5-18A-22(19)). Jose noted typically, the City avoids procuring bids because this requires considerable Staff time and additional resources to develop the specifications, advertise the bid documents, and evaluate the bids. Rather, the City tries to purchase directly from a local vendor, from an already awarded contract, from the State list, or from a purchasing agency. Jose noted Staff contacted local dealers (Vermillion Ford and Jerry’s Chevrolet/GMC) for prices on vehicles. The prices listed on the following table include all the prices provided by the different sources. Jim Goblirsch, Parks and Rec Director, reported on an agreement with AMS Building Systems to re-do the Lions Park restroom facility. Jim noted over the past two years there have been acts of vandalism on the interior floor of the restroom building in both the restroom and shower areas. Even though these areas were professionally repaired Staff believe there may have been water damage to the sub floor that was not found. Jim discussed that this past summer City Staff discovered numerous weak spots throughout the facility floor. Staff monitored the facility floors throughout the summer and in late June floor breakages were found in two areas. AMS was contacted to investigate the floor damage; they found that the floor had unrepairable water damage compromising the strength of the entire facility floor. Jim noted Staff recommend this restroom facility should not be reopened to the public until the damage is repaired. AMS was the only local contractor that offered to look at and repair the issue. 736-25 Council Member Cheeseman moved approval of the agreement with AMS Building Systems, LLC for repairs to the floor at the Lions Park restroom facility.
