Unapproved Minutes City Council Regular Session December 1, 2025 Monday 6:00 p.m. The regular session of the City Council, City of Vermillion, South Dakota was called to order on Monday, December 1, 2025, at 6:00 p.m. by Mayor Cole. 1. Roll Call Present: Thaler, Leber, Price, Holland, Jennewein, Cheeseman, Murra, Mayor Cole Absent: Hellwege 2. Pledge of Allegiance 3. Minutes A. Minutes of November 17, 2025, Special Session and November 17, 2025, Regular Session 750-25 Council Member Holland moved approval of the November 17, 2025, special session and November 17, 2025, regular session minutes. Council Member Murra seconded the motion. Motion carried 8 to 0. Mayor Cole declared the motion adopted. 4. Adoption of Agenda 751-25 Council Member Murra moved approval of the agenda. Council Member Price seconded the motion. Motion carried 8 to 0. Mayor Cole declared the motion adopted. 5. Visitors to be Heard 6. Public Hearings A. First reading of Ordinance 1549 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 1, Block 1, Pollman Addition, City of Vermillion, Clay County, South Dakota, from the NRC Natural Resource Conservation District to the GB General Business District. (Property located at the northeast corner of Princeton Street and South Dakota Highway 50.) Jose Dominguez, City Engineer, reported that Mr. Christian Cabrera, representative of the owner, has requested that the City rezone the property located on the northeast corner of Princeton Street and SD Hwy. 50 from the NRC Natural Conservation District to the GB General Business District. Jose noted the area is roughly 3.00 acres in size and the property is bounded by farm ground to the north, east, and west. South of the property, and across SD Hwy. 50, are commercial uses. The property to the north and east is within City limits and is in the NRC Natural Conservation District. The area to the south is also within City limits and is within the GB General Business District. However, the land to the west is in the Joint Jurisdiction Zoning Area and it is within the A-1 Agricultural Zoning District. Jose stated this lot was annexed in May 2025 as part of the larger annexation of Marv Tract 1. When property is annexed into the City it is automatically placed in the most restrictive zoning district. Because the owner is requesting to rezone the land within 1-year of the annexation, the owner is not required to collect signatures from nearby property owners. However, the City still must advertise the meeting to rezone the property and place notices on the property. Both have been done. Jose reported that the owners’ desire for rezoning their property is to allow for the future construction of a convenience store, fuel pumps, and car wash. For the owner to be able to accomplish this, rezoning is the first step. If the rezoning is successful, the owners will later approach the City’s Planning and Zoning Commission with a Conditional Use Permit to discuss the gas station use. Jose noted rezoning this property will not be construed as offensive to the neighbors. Currently the property to the west, north, and east is undeveloped farm fields, while to the south, and across the highway, is commercially developed property. Council Member Thaler asked if there were going to be more entrances onto the property or how traffic would be handled. Jose stated that currently there have been discussions, but the DOT stated no more entrances from SD Highway 50 will be added and there is no need for a stop light. Council Member Murra asked if there was any conversation about how busy this intersection is. Mayor Cole stated that this is about the zoning and not traffic. Council Jennewein stated that the conversation about how busy the intersection will be is relevant to zoning therefore has there been a conversation about this? Jose stated that Staff has talked about SD Highway 50 multiple times with the DOT this year. Council Member Cheeseman asked if there were talks about other businesses or things going in there. Jose stated that currently there has not been. Jose Lira, 324 Purdue, stated that it is very dangerous on the street going north, so there needs to be something there for safety. 752-25 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Murra moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1549 entitled An Ordinance amending Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 1, Block 1, Pollman Addition, City of Vermillion, Clay County, South Dakota, from the NRC Natural Resource Conservation District to the GB General Business District of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 1st day of December, 2025 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Council Member Holland. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 8 members voted in favor of and 0 members voted in opposition to the motion. Resolution authorizing the Mayor to sign Amendment No. 1 to Firm Electric Service Contract with Western Area Power Administration (WAPA). RESOLUTION APPROVING AMENDMENT No. 1 TO CONTRACT 15-UGPR-1017 WHEREAS, the City of Vermillion has entered into an agreement to obtain an allocation of federal hydroelectricity from the United States Department of Energy, Western Area Power Administration, Pick-Sloan Missouri Basin Program, Eastern Division (“Western”) pursuant to a contract for electric service to the City of Vermillion through December 31, 2050; and WHEREAS, both Western and City of Vermillion wish to revise the existing electric service agreement and associated exhibits which provide for power supply through December 31, 2050; and WHEREAS, both Western and the City of Vermillion desire to amend the current agreement to revise Section 18, General Power Contract Provisions (GPCP); and WHEREAS, the City of Vermillion staff has reviewed the amendment and has recommended to the City Council the approval of the amendment; and NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota, that: 1. RESOLUTION AUTHORIZING THE PURCHASE OF A STREET DEPARTMENT TANDEM DUMP TRUCK CHASSIS WHEREAS, SDCL 5-18A-37 authorizes a governmental entity to participate in cooperative purchasing agreements and conduct purchasing transactions under a joint agreement in this or any other state; and WHEREAS, the City of Vermillion has reviewed and determined that the bid awarded by Sourcewell to Freightliner for a 2027 Freightliner 108SD Plus chassis for a price of $119,549.00 offers an advantageous price to the City for said item; and WHEREAS, the City has contacted I-State Truck Center, from Sioux Falls, South Dakota and they have agreed to allow the City to purchase a 2027 Freightliner 108SD Plus chassis for the awarded price and terms as they have contracted with Sourcewell. Request from USD to temporarily remove parking on the east side of North Dakota Street from Parking Lot 36 to South Dakota Highway 50 and the west side of North Dakota Street from Alumni Street to South Dakota Highway 50 on January 4 and 5, 2026 from midnight to midnight, for setup, and midnight to 9:00 p.m. on January 8, 2026 for tear down of the 2026 Farm Show. Alex Ruth, Assistant to the City Manager, reported that the University of South Dakota Athletics Department has requested that no parking be allowed on the east side of North Dakota Street Parking Lot 36 to SD Hwy. 50 and the west side of North Dakota Street from Alumni Street to SD Hwy. 50 for the 2026 Farm Show. Alex stated that this request allows members of the event to utilize the area as a loading/unloading location on Sunday, January 4, Monday, January 5, from midnight to midnight and Thursday, January 8, 2026 from midnight until 9:00 p.m. Alex noted that USD’s Athletic Department indicated this closure should only affect USD Athletics, the USD Foundation, Holiday Inn Express, and The Heights. All affected entities will be made aware of the parking removal. The Vermillion Police, Fire/EMS and Street Departments have no concerns at this time, but USD will be responsible for snow removal on those days from the barricades to the curb. USD staff will post the no-parking notifications as they have previously. Classes are not in session at USD during the time of this request. Council Member Leber asked how many accidents have occurred at this location. Alex noted that they did not give her that information. Council Member Thaler asked if this is going to cause an issue with overflow parking with the hotel. John Prescott stated that he contacted the company running the event and they did not request the change, but the times work for them. 753-25 Council Member Cheeseman moved approval of the request to temporarily remove parking on the east side of North Dakota Street, Parking Lot 36 to SD Hwy. 50 and the west side of North Dakota Street from Alumni Street to SD Hwy. 50 on January 4, 5, from midnight to midnight and 8, 2025 from midnight to 9:00 p.m. for the Dakota Farm Show. Council Member Jennewein seconded the motion. Motion carried 8 to 0. Mayor Cole declared the motion adopted. B. Resolution amending The Bluffs Golf Course fees. Jim Goblirsch, Parks & Recreation Director, reported on raising the Bluffs Golf Course fees. Jim discussed that at the November 19, 2025, Golf Advisory Board meeting the fees were discussed and they support the fee increases. Jim noted Staff is proposing to increase prices for all season golf passes, junior season range passes, private cart storage and season cart passes, league memberships, green fees, driving range balls, and punch cards. The City is not proposing any change to cart rental prices, as they were increased in 2024. 754-25 After reading the same once, Council Member Leber moved adoption of the following: RESOLUTION AMENDING GOLF COURSE FEE RATES WHEREAS, the City Council establishes rates and fees for City services; and WHEREAS, the need for some fees changes over time due to industry practices and increased cost of providing service. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota, at a regular meeting thereof in the Council Chambers of City Hall at 6:00 p.m. on the 1st day of December 2025 that the following fee rates be amended as follows: Golf Course: Green Fees: 9-Hole Monday-Friday $25.00; 18-Hole Monday-Friday $35.00; 9-Hole Saturday, Sunday & Holidays $30.00; 18-Hole Saturday, Sunday & Holidays $45.00. Season Pass: 2-Person Family $829.00 annually, plus one child $899.00 annually, 2+ $969.00 annually; Adult $659.00 annually; college (full- time) or under 25 $359.00 annually; Junior $169.00 annually. Mayor Cole declared that the Resolution was adopted. C. Resolution amending Prentis Plunge fees. Jim Goblirsch, Parks & Recreation Director, reported on increases to the Prentis Plunge fees. Jim noted the last increase in pool pass fees occurred in 2022. Jim noted Vermillion offers one season pool pass that is open to all ages, aside from children aged 0-6 who receive free admission while with a paid adult. Reduced season pool pass rates are also offered at 20%, 40%, or 75% off for individuals meeting certain income requirements. Jim stated Staff proposed the 2026 Prentis Plunge Season Pass fees (all passes include lap swimming and water walking): Ages 0-6: Free with paid adult, limit two under 7 with paid adult Daily Admission Fee: $6.00 all ages - 7 years old or older Season Pass: $65.00 all ages – 7 years old or older 755-25 After reading the same once, Council Member Holland moved adoption of the following: RESOLUTION TO ADJUST FEE RATES FOR PRENTIS PLUNGE SWIMMING POOL WHEREAS, the City Council establishes rates and fees for City services; and WHEREAS, the City Council has previously changed the original swimming pool fee rates; and WHEREAS, the cost of maintenance, operations, and supplies has increased, while the fee rates have not changed since 2022. Mayor Cole declared that the Resolution was adopted. D. First Reading of Ordinance 1548 – 2025 Supplemental Budget Appropriations Ordinance. Katie Redden, Finance Officer, reported that the Supplemental Appropriations Ordinance is needed to adjust the budget for items that have changed since the revised budget was adopted in September 2025. Katie stated that the agenda memo included an explanation of the individual line-item changes noting that the general fund is projecting to decrease the general fund reserve by $45,366 for 2025. Discussion followed. 756-25 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Holland moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1548 entitled An Ordinance Adopting 2025 Budget supplemental appropriations ordinance of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 1st day of December, 2025 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Council Member Price. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 8 members voted in favor of and 0 members voted in opposition to the motion. John reported on two meetings or events before the next City Council meeting on Monday, December 15, 2025:  Human Relations Commission meets on Friday, December 5 at 5:30 p.m. in the Mamura Conference room at City Hall.  Historic Preservation Commission meets on Wednesday, December 10 at 9:00 a.m. in the Powell Conference Room at City Hall. B. John stated that the annual Parade of Lights is this Thursday, December 4. 2025 from 6:00 to 7:00 p.m. on West Main Street from Court Street to the alley abutting the west side of CorTrust Bank, 1/2 block of Prospect Street, 1/2 block of Market Street will be closed from 4:00 p.m. to 7:00 p.m. for the event. The Library is hosting their Open House following the event from 7:00 to 8:00 p.m. C. John reminded residents that sidewalks are to be cleared 24 hours after the end of a snow event. Snow should be stored on your property – not across the street on a neighbor’s yard without permission or piled up in the street in front of neighbor’s property. If moved across the street, windrows of snow should not be left in the street.
