CITY OF VERONA MINUTES BOARD OF REVIEW September 30, 2013 Verona City Hall 1. The meeting was called to order by Chair, Jon Hochkammer at 6:01p.m. 2. Roll Call: Mike Bare, Elizabeth Doyle, Jon Hochkammer, Kami Lynch, Heather Reekie, Brad Stiner, and Dale Yurs. Members absent and excused include Luke Diaz, Scott Manley & Mac McGilvray. Also in attendance: Bob Courter, Assessor; Paul Musser, Assessor; and Bill Burns, City Administrator. 3. Approval of Minutes: Motion by Yurs, seconded by Stiner to approve the minutes of the July 30, 2012 and May 13, 2013 Board of Review minutes. Motion carried 7/0. 4. Affidavit of Board of Review Member Training. Members Elizabeth Doyle, Jon Hochkammer, Kami Lynch, Heather Reekie, and Dale Yurs have taken the required Board of Review Training. 5. Swearing in of Assessor. Bob Courter and Paul Musser were sworn in for all matters on hearing for the evening. 6. Consideration of Objection to 2013 Real Estate Property Tax Assessment for Rick Schoenemann, for the following properties: 241‐247 Meadowside Drive, 251‐257 Meadowside Drive, 261‐267 Meadowside Drive, 271‐277 Meadowside Drive; Parcel No. 0608‐242‐4927‐7, 0608‐242‐4975‐6, 0608‐242‐5026‐2, 0608‐242‐5077‐1. Mr. Schoenemann was in attendance to present his objection to the Board of Review. He provided testimony on all properties at one time as the properties are all very similar commercial properties. Reasons cited for the requested reduction in the assessed value included; the properties have older appliances and carpeting and the roof is due for replacement. City Assessor, Paul Musser explained that he had adjusted the value twice to account for these items. In the matter of 241‐247 Meadowside Drive, Parcel No. 0608‐242‐4927‐7; Motion by Hochkammer, seconded by Lynch to affirm the Assessor’s 2013 value: Land: $109,100.00 Improvements: $281,500.00 Total: $390,600.00. A roll call vote was taken. Those voting ‘aye’ were Bare, Doyle, Hochkammer, Lynch, Reekie, Stiner and Yurs. There were no members voting ‘no’. Motion carried 7/0. In the matter of 251‐257 Meadowside Drive, Parcel No. 0608‐242‐4975‐6; Motion by Yurs, seconded by Reekie to affirm the Assessor’s 2013 value: Land: $113,400.00 Improvements: $277,200.00 Total: $390,600.00. A roll call vote was taken. Those voting ‘aye’ were Bare, Doyle Hochkammer, Lynch, Reekie, Stiner and Yurs. There were no members voting ‘no’. Motion carried 7/0. In the matter of 261‐267 Meadowside Drive, Parcel No. 0608‐242‐5026‐2; Motion by Reekie, seconded by Yurs to affirm the Assessor’s 2013 value: Land: $117,300.00 Improvements: $273,300.00 Total: $390,600.00. A roll call vote was taken with the following members voting ‘aye’: Bare, Doyle, Hochkammer, 2013-09-30 1 Lynch, Reekie, Stiner, and Yurs. There were no members voting ‘no’. Motion carried 7/0. In the matter of 271‐277 Meadowside Drive, Parcel No. 0608‐242‐5077‐1; Motion by Hochkammer, seconded by Yurs to affirm the Assessor’s 2013 value of: Land: $116,800.00 Improvements: $273,800.00 Total: $390,600.00. A roll call vote was taken with the following members voting ‘aye’: Bare, Doyle, Hochkammer, Lynch, Stiner, and Yurs. There were no members voting ‘no’. Motion carried 7/0. 7. Consideration of Objection to 2013 Real Estate Property Tax Assessment for Chad Zeznanski, Agent for Convenience Store Investments. 400 E Verona Ave, Parcel No. 0608‐154‐2361‐7 and 2145 County Hwy PB, Parcel No. 0608‐261‐8680‐2 The applicant withdrew the objection prior to the hearing. Notice of the 2013 Board of Review For the City of Verona NOTICE IS HEREBY GIVEN that the Board of Review for the City of Verona of Dane County, Wisconsin shall meet on the 30th day of September 2013 from 6:00 p.m. to 8:00 p.m. at Verona City Hall Council Chambers, 111 Lincoln Street, Verona, WI 53593. Please be advised of the following requirements to appear before the Board of Review and procedural requirements if appearing before the Board: No person shall be allowed to appear before the Board of Review, to testify to the Board by telephone or to contest the amount of any assessment of real or personal property if the person has refused a reasonable written request by certified mail of the Assessor to view such property. After the first meeting of the Board of Review and before the Board’s final adjournment, no person who is scheduled to appear before the Board of Review may contact, or provide information to a member of the Board about the person’s objection except at a session of the Board. No person may appear before the Board of Review, testify to the Board by telephone or contest the amount of the assessment unless, at least 48 hours before the first meeting of the Board or at least 48 hours before the objection is heard if the objection is allowed because the person has been granted a waiver of the 48- hour notice of an intent to file a written objection by appearing before the Board during the first two hours of the meeting and showing good cause for failure to meet the 48-hour notice requirement and files a written objection, that the person provides to the clerk of the Board of Review notice as to whether the person will ask for removal of any Board members and, if so, which member will be removed and the person’s reasonable estimate of the length of time that the hearing will take. When appearing before the Board of Review, the person shall specify, in writing, the person’s estimate of the value of the land and of the improvements that are the subject of a person’s objection and specify the information that the person used to arrive at that estimate. No person may appear before the Board of Review, testify to the Board or by telephone or object to a valuation, if that valuation was made by the Assessor or the Objector using the income method of valuation; unless the person supplies the Assessor all requested information about income and expenses, as specified in the Assessor’s manual under Sec. 73.03(2a) of Wis. Statutes. The City of Verona ordinance no. 99-604 protects the confidentiality of information about income and expenses provided to the Assessor. The information that is provided under this paragraph, unless a court determined that it is inaccurate, is not subject to the right of inspection and copying under Sec. 19.35(1) of Wis. Statutes. The Board shall hear upon oath, by telephone, all ill or disabled persons who present to the Board a letter from a physician, surgeon, or osteopath that confirms their illness or disability.
